SOLAR ENERGY SYSTEMS ON NEW JERSEY LANDFILLS

Robert Confer, Bureau Chief Mary Anne Goldman, Spvg. Env. Engineer Bureau of Landfill & Hazardous Waste Permitting NJDEP Solid & Hazardous Waste Management Program Phone : 609-984-6985 www.state.nj.us/dep/dshw/rrtp/bud.htm

Approval Process Permit Readiness Checklist (Office of Permit Coordination and Environmental Review) (available to download at http://www.nj.gov/dep/opppc/permitcoor.htm) Pre-application Meeting (Determination of permits & other requirements) Landfill Disruption Approval (Must be obtained before initiation of site investigation) Site Investigation (To determine what specific closure requirements are needed prior to installation of solar energy system)

Approval Process Continued Site Remediation Program Process (Building on Landfills) (N.J.A.C. 7:26C & E) Landfill Closure Plan or Landfill Closure Plan Modification Construction (Closure activities, installation of solar panels, etc.) Post-Closure Submissions (As-built drawings, engineering certification, quarterly inspection & monitoring reports, etc.)

Landfill Closure N.J.A.C. 7:26-2A.9 Minimum capping requirements: Pre-1982 Landfills: Must be covered with at least 2 of clean soil. If site is lined, the landfill cap must have same permeability as the liner, per N.J.A.C. 7:26-2A.7(i). Add l requirements (i.e., leachate & gas mngt, run on/run off, etc.) on a case-bycase basis.

Minimum Capping Req ts continued NJAC 7:26-2A.7 Post 1982 Landfills: Final Cover - designed to minimize infiltration of liquids into the landfill throughout closure & post closure. Elements to be considered: Cover System Drainage (designed in conjunction with use of HELP Model to determine depth & type of layers, permeability of each layer, etc.)

Minimum Closure Req ts continued NJAC 7:26-2A.7 Slope Stability (stability analysis with F.S.>1.5 required) Materials: (Clay = 12 inches + 6 drainage layer + 12 compacted soil + 6 vegetative layer; geomembrane = 30 mils except HDPE = 60 mils + 12 drainage layer + 6 compacted soil + 6 ) Vegetative Layer: (Minimum 6 top soil; seeded, mulched, etc. in accordance with the Standards for Soil Erosion & Sediment Plan Control, N.J.A.C. 2:90

Closure & Post-Closure Plan Solid Waste Facility Permit Application Form Certified Soil Erosion & Sediment Control Plan Plans for Final Capping/Cover, Final Cover Vegetation & Final Cover Maintenance including a QA/QC Plan (N.J.A.C. 7:26-2A.7(i))

Closure & Post-Closure Plan continued Plans for Side Slopes & Maintenance of Side Slopes Plans for Stormwater Run-on/Run-off Controls & Maintenance of Controls (must be designed to protect the landfill from run-on/ run-off at a min. peak discharge of a 24-hour, 25-year storm, and in accordance the N.J.A.C. 7:26-2A.7(g)) Groundwater Monitoring Wells and Maintenance of Wells (in accordance with NJPDES regulations, N.J.A.C. 7:14A)

Closure & Post-Closure Plan continued Landfill Gas Venting & Evacuation System, Maintenance & Testing of Gas System (designed in accordance with N.J.A.C. 7:26-2A.7(f)) Leachate Collection & Control System and Operation & Maintenance of Leachate Collection & Control System (designed in accordance with N.J.A.C. 7:26-2A.7(d)) Facility Access Controls & Maintenance of Facility Access Controls (designed in accordance with N.J.A.C. 7:26-2A.8(b)25)

Closure & Post-Closure Plan continued Conformance of Site to the Surrounding Area (N.J.A.C. 7:26-2A.9(e)) Inspections (include items to be inspected, inspection form, and inspection schedule) Closure & Post-Closure Financial Plan sets forth the costs & expenses for implementation of the Landfill Closure & 30-year Post-Closure Period (N.J.A.C. 7:26-2A.9(f)) Plan Certification (N.J.A.C. 7:26-2A.9(d))

Closure Plan Modification Written description of proposed changes & supporting documentation Engineering plans signed & sealed by a N.J. P.E. Schedule for implementation

Permit Coordination One stop permitting process provides a single source of contact at DEP Determination of all required permits by full Departmental permitting team (Permit Identification Form) Early identification of any potential problems or issues (Readiness Checklist)

Considerations in the Design of Solar Energy Systems Settlement Effects of differential settlement on solar system; type and weight of foundation and solar energy system; weight of construction equipment; type, depth and age of waste, and; measures to minimize effects of settlement

Design Considerations Continued Side Slope Stability - cover system design; solar foundations; snow & ice loading Landfill Cover measures to prevent damage to cap during construction & methods of repair if needed; compliance with Landfill Disruption Approval, as per N.J.A.C. 7:26-2A.8(j)

Design Considerations Continued Stormwater/Run-off measures to minimize erosion & stormwater structures designed for expected higher flow Routine Cap Maintenance vegetation management; erosion inspections & cover maintenance; inspection & maintenance of gas & leachate collection systems; gas migration & surface monitoring, etc.

Other Permits/Approvals Land Use (Stream Encroachment, Wetlands, CAFRA, etc.) Air Pollution (venting of landfill gases equipment, as per N.J.A.C. 7:27-8.2(c)17) Well Drilling (needed for all wells within or outside of landfilled area) N J Pollutant Discharge Elimination System (NJPDES) (for surface & groundwater discharges)

Other Permits/Approvals continued New Jersey Highlands Council N J Pinelands Commission Green Acres Fish & Game

Stormwater Requirements Construction Activity Stormwater General Permit (5G3) (required when more than one (1) acre of land will be disturbed) Stormwater Run-off Quantity & Control Requirements* Minimum design & performance standards require compliance with one of the three standards listed below:

Stormwater Requirements continued 1.) Demonstrate through hydrologic & hydraulic analysis that post-construction runoff does not exceed preconstruction runoff for 2, 10 and 100-year storm events;

Stormwater Requirements continued 2.) Demonstrate through hydrologic & hydraulic analysis that postconstruction peak runoff does not exceed preconstruction peak runoff for 2, 10 and 100-year storm events & that any increased volume or change in timing will not result in increased flood damage at or downstream of the site;

Stormwater Requirements continued 3.) Design stormwater management measures so that the postconstruction peak runoff rates for the 2, 10 and 100-year storm events are 50, 75 and 80%, respectively, of the preconstruction peak runoff rates * New stormwater criteria are currently being developed. Until completed, approval of stormwater mngt systems will be done on a site-specific basis.

Stormwater Requirements continued Stormwater runoff must be calculated in accordance with the following methods: 1.) USDA Natural Resources Conservation Service (NRCS) methodology (description included in TR-55) 2.) Rational Method for peak flow & the Modified Rational Method for hydrograph computations (description included in Appendix A-9 of the Standards for Soil Erosion & Sediment Control in New Jersey )

Typical Solar Panel Installation

Issues to be Resolved 1.) Stormwater Management Criteria in some cases 2.) Groundwater Management & 3.) Methane Gas Control
