3 RULES and FUNCTIONS of PANSA PANSA as a service provider in the Polish Airspace, declares its willingness to participate in the collective work, leading to the enactment of legal and organizational solutions (including safety and operational issues) within the scope of integration of UAS as a rightful user of the Polish Airspace. PANSA considers the Polish Airspace (FIR Warsaw) as a common good, ensuring all airspace users the fulfillment of wide spectrum of their needs. 4 UAS the need for regulation Unmanned Aerial Systems (UAS) currently attract increasing attention both of military and civil users. Access to the common airspace becomes the core issue of their application. In recent years many different international institutions and agencies, member of European Union, ICAO and EUROCONTROL e.t.c., have taken active efforts to establish legal regulations within the scope of UAS flights in common airspace (out of segregated elements of airspace)

6 LEGAL STATUS of UAS INTEGRATION TO POLISH AIRSPACE CHICAGO CONVENTION Article 8 Unmanned Aerial Vehicle No aircraft capable of being flown without a pilot shall be flown over the territory of a contracting State without special authorisation by the State and in accordance with the terms of such authorisation. Each contracting State undertakes to ensure that the flight of such aircraft without a pilot in regions open to civil aircraft shall be so controlled as to obviate danger to civil aircraft UASs are aircraft
7 LEGAL STATUS of UAS INTEGRATION TO POLISH AIRSPACE PRIMARY ASSUMPTION UAS operations have to meet at least the same level of safety and operational standards as manned aircraft All undertaken actions of aviation authorities, international organisations, committees and dedicated groups in area of UAS integration should bring the outcome describing: Standards and Recommended Practices (SARPs), followed by Air Traffic Management Procedures (ATM), and consultative materials as a base for UAS operations, which allows them to operate safely, co-ordinately and constantly in common airspace.
8 CURRENT IMPLEMENTATIONS ICAO Circular 328 Legislation that gives the FAA a deadline for authorizing the flying of Unmanned Aerial Vehicles (UAVs). The legislation requires the FAA to produce a comprehensive plan within nine months for integrating the unmanned planes into manned airspace. By May 2013, the next class of drones, those weighing less than 55 pounds, can fly the nation s skies, according to provisions of the FAA bill passed by Congress and signed by President Barack Obama. The deadline for full integration of drones into U.S. airspace is Sept. 30, FAA Releases Lists of Drone Certificates - List of All Certificates of Authorizations (COAs) Issued to Public Entities. - List of All Special Airworthiness Certificates issued to Private Entities.
9 THE LEGAL STATUS of UAS INTEGRATION TO THE POLISH AIRSPACE national approach At present, Polish legal regulations concerning the use of UAS can be found in art. 126 and 149 of the AVIATION LAW Act. The latest amendment to art.126 defines the access of UAS to the Polish Airspace. Article No Unmanned Aerial Vehicles (UAV) are allowed to operate within Polish Airspace. 2. Unmanned Aerial Vehicle have to be equipped with systems and devices enabling flight, navigation and communication identical as in manned aircraft performing a VFR or IFR flight within a defined class of the airspace. Derogations applicable to manned aircraft shall equally apply to Unmanned Aerial Vehicles (UAV).

Operations of Unmanned Aerial Vehicles equipped in accordance with Paragraph No. 2 can be performed following the filed flight plan in the manner and according to the terms stipulated in Paragraph No. 5, subject to the provisions of Art. No Flights of unmanned aerial vehicles without the equipment specified in Paragraph No. 2 can be performed within zones excluded from generally accessible airspace, with the consideration of regulations issued based on Article No. 121, Paragraph No. 5.
11 THE LEGAL STATUS of UAS INTEGRATION TO THE POLISH AIRSPACE con. 5. Minister competent for transportation in consultation with the Minister of National Defence shall regulate detailed conditions of performing flights by unmanned aerial vehicles within Polish airspace, as well as cooperation procedures for the operators of these vehicles with air traffic control service providers, taking into account safety of the air traffic. Article No. 149 International flights can be performed by foreign UAV under permission of the President of Polish Civil Aviation Office in consultation with competent military authority.
12 THE LEGAL STATUS of UAS INTEGRATION TO THE POLISH AIRSPACE con. The Regulation as mentioned in para. 5 of art 126 has not yet been issued. Therefore, UAS operations may be performed only within segregated elements/structures of the airspace. Lack of the Regulation (para. 5 of art 126) makes PANSA ensure the safe usage of polish airspace by UAS by segregation of the airspace.
13 PANSA COOPERATION with MILITARY and CIVIL OPERATORS In order to assess the required safety level of implemented rules for designing segregated airspace elements for UAS operations, PANSA has developed an Air Traffic Safety Analysis document. This internal document was developed in cooperation with military experts, who operate and represent the approppriate experience in UAS activities. The Analysis constitutes a base for designing and allocating segregated zones dedicated for the Polish Armed Forces and defines the safety principles for military UAS operations within the Polish Airspace (at that time: Orbiter and Aerostar). 16 CONCLUSION REQUIRED SOLUTIONS common classification of UAS; flights certification (airworthiness); management of permanent airworthiness; frequency aspects (harmonization of radio frequency spectrum); common ATM and ASM procedures for UAS and GAT; communication; UAS pilot-operator certification; UAS aviation terminology; UAS technical aspects (engine, airframe, R/NAV equipment, remote control systems, sense and avoid systems, secure control links etc.). The development of adequate standards, procedures and technologies is essential and has to take into account the evolving technical and regulatory environment generated by UAS and ATM systems in Poland and EUROPE
