2 TECHNICAL BID General Terms & Conditions (Summary) NATIONAL INSTITUTE OF SCIENCE COMMUNICATION AND INFORMATION RESOURCES (NISCAIR) GENERAL TERMS AND CONDITIONS (GTC) 1 Sealed tenders in two bid system (Technical & Financial) are hereby invited from the contractors of appropriate class of C.P.W.D., railways, MES, P&T, state PWD, semi Govt. organizations and/or from those who have worked for CSIR or its laboratories/institutes and having successfully carried out preferably three similar works (AMC of the said work in Government or Semi.-Government, etc.), for the work of: Regular Post construction anti termite treatment, general pest and rodent control measures in NISCAIR at two locations i.e. (1) at Dr. K.S. Krishnan Marg, Pusa and (2) at 14 Satsang Vihar Marg, New Delhi. 1.1 Before participate, bidders must ensure the following Technical Criteria: i) Firm should be of registered under appropriate class of CPWD, Railway, MES, Post & Telegraph Department, and / or those who have worked out for CSIR or its laboratories / Institutes and semi government organization / PSU s ii) iii) iv) Firm must have Valid sales tax / Tin no. & PAN no. in the name of firm. The bidder must have successfully carried out at least three similar works amounting to not less than 40% or two similar works amounting to not less than 50% or one similar work amounting to not less than 80% of the Estimated cost in the last five years Firms must be registered with IPCA 1.2 The technical bid shall consist of EMD and all documents establishing the eligibility criteria as stated above. The financial bid is to be submitted in a separate cover and it shall consist of this entire document with BOQ. 1.3 The bidders are required to attach proof of fulfilling the above conditions and performance certificate for the work from their concerned department in the technical bid while submitting the tender documents otherwise their bids may be rejected out rightly. 2 Time period of the contract: 2 years (24 months) and the date of commencement shall be reckoned from the tenth day of issue of award letter. 3 Bids must be received by NISCAIR as per schedule time and date specified on the cover page. In the event of the specified date for the submission of bids being declared a holiday for NISCAIR, the bids will be received up to the appointed time on the next working day. 2

3 4 Bidders may inspect the site in complete before quoting the rates, as the bidders will be responsible for pest free service for this AMC in the respective building(s). Please contact the contact person (mentioned on the first page), for any clarification. 5 Sales tax or any other tax or duties on material and on services in respect of this contract will be payable by the Contractor and nothing extra will be paid by NISCAIR for increase in such taxes or duties even if imposed or levied either before or after the tenders are opened or during the currency of contract, over and above the tendered cost. 6 Full Earnest money is liable to be forfeited, if the contractor selected for the work fails to start the work within 10 days from the date of issue of work award letter. 7 Tenders, which do not fulfil all or any of the conditions or are incomplete in any respect, are liable to summary rejection. 8 The Earnest Money, to be paid by demand draft or pay order of a schedule bank and drawn in favour of Director, NISCAIR, New Delhi, should accompany the tender in separate envelope along with technical bid part. Tenders received without earnest money will be invalid. 9 Director NISCAIR does not bind himself to accept the lowest or any tender and reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rates quoted. 10 Canvassing/Recommendation in connection with the tenders is prohibited and the tenders submitted by the contractor who resort to canvassing are liable for rejection. 11 The tenderers shall not be permitted to tender for works in concerned unit(s) of CSIR wherein a relative is posted in the grade between Controller of Administration and Junior Engineer, (both inclusive). He shall also intimate the names of persons who are working with him in any capacity or subsequently employed by him and whose relatives are as mentioned above. 12 Tender submitted shall remain valid for 90 days from the date of opening for the purpose of acceptance and award of work, validity beyond 90 days from the date of opening shall be by mutual consent. 13 The tenderer shall quote rates both in figures and words. He shall also workout the amount for each item of work and shall write in both figures and words. If any difference is found between the rates quoted by the tenderer in words and in figures or in the amount worked out by him, the following procedure shall be followed When there is a difference between the rates in figures and in words, the rates, which correspond to the amounts worked out by the tenderer, shall be taken as correct When the tenderer has not worked out the amount of an item, or it does not correspond with the rate written either in figures or in words, the rate quoted by the tenderer in words shall be taken as correct. 3

4 13.3 When the rate quoted by the tenderer in figures and in words tallies but the amount is not worked out correctly the rate quoted by the tenderer shall be taken as correct and not the amount. 14 Before tendering, the tenderer shall inspect the site to fully acquaint himself about the condition in regard to accessibility of site, nature and extent of ground, working condition of site and locality including stacking of materials, installations of tools and plants (T&P) etc., conditions affecting accommodations and movement of labour etc., required for the satisfactory execution of the work contract. No claim whatsoever on such account shall be entertained by the Director NISCAIR in any circumstances. 15 Except writing rates and amount, the tenderer should not write any conditions or make any changes, additions, alterations and modifications in the printed form of tenders. Tenderers who are desirous to offer rebate, the same should be brought out separately in the covering letter and submitted along with the tender except wherever needed after referring the details of the tender and if asked for. 16 Payment: Payment under the contract will be made on quarterly basis i.e. on satisfactory completion of two treatments at every 45 days interval. Taxes, as applicable, will be deducted at source. The work shall be carried out as per listed general scope of work, detailed scope of supplies & services, special condition and additional terms & condition as listed in Annexure A. 17 Payment after satisfactory completion of work shall be made through ECS mode only. Contractor is required to furnish the relevant details of bank account for getting the payment through Electronic Clearance System (ECS) The contractor is required to either provide Photostat copy of cancelled cheque or to take attestation from concerned bank, as a documentary support. i) Bank account no. Branch name & complete address of the bank ii) 11 digit IFSC (Indian Financial System Code) of the bank. iii) 9 digit MICR (Magnetic INK Characters Recognition) Code of the bank iv) PAN No. & TAN No. in name of the firm. v) Phone no. / mobile no./ address. 18 Security deposit & performance security: A 10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum already deposited as earnest money, will amount to Security Deposit of 5% of the tendered value of the work. In addition, the contractor shall be required to deposit an amount equal to 5% of the tendered value of the contract as Performance Security (as per Annexure-I) within the period prescribed for commencement of work in the letter of award issued to him, failing which the earnest money shall stand forfeited. The Performance Guarantee shall be valid from the date of commencement of work till the date of satisfactory completion of work. The SD shall be released within one month of satisfactory completion of AMC The performance security shall be in one of the following forms: A Bank guarantee from a scheduled bank in the format provided in the tender document as Annexure- II), or A Bankers Cheque or Demand Draft 4

5 19 The contractors, to whom the work is awarded will have to execute an indemnity bond in favour of the Director, NISCAIR, indemnifying the authorities staff and individuals of NISCAIR against theft, loss of material, damages of any kind, including fire caused by any mishandling/mistakes, mis-operating, or improper maintenance, to the site, installations, buildings and appurtenances and that all such damages will be made good by him/his firm/his partners at his/their own risk and cost. Any cement or other material required for making good the damages will be brought by the contractor at his own cost and risk. 20 All procedures either technical or security measures as followed in NISCAIR for all contractors will be followed in the case of this contract also. 21 Corrupt or Fraudulent Practices: Bidders & Suppliers shall observe the highest standard of ethics during the procurement and execution of the contract. The purchaser will reject a proposal for award if it determines that the bidder recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question. The purchaser will declare a firm ineligible, either indefinitely or for a stated period of time, to be awarded a contract if it at any time determines that the firm has engaged in corrupt or fraudulent practices in competing for this bid, or in executing the contract. 22 Unsuccessful Bidder s EMD will be discharged/returned as promptly as possible as but not later than 30 days after the expiry of the period of bid validity prescribed by the purchaser. 23 Director NISCAIR reserves the right to accept or reject any tender in full or in part without assigning any reason. 24 One-month notice will be given by either party for termination of the contract during the tenure of contract for breach of clause or otherwise. 6 Annexure A (A) GENERAL SCOPE OF WORK The work consists of Regular post construction anti-termite treatment, general pest and rodent control measures in NISCAIR at two locations i.e (1) at Dr. K.S. Krishnan Marg, Pusa and (2) at 14, Satsang Vihar Marg, S.V. Marg Campus. The general scope of work includes: (i) (a) To ensure that the rooms, halls, stores, library and entire premises of institute are completely free from any insect, termites, pests and rodents etc. to avoid any epidemic and damage to the holdings of NISCAIR. The store rooms and library holdings fumigation with moth repellents and insecticides against pest, termites and rodents. (A) Following is the overall scope of work for keeping the buildings termite & rodent free etc. by adopting scientific methods and using chemicals /pesticides/ insecticides / any other suitable methods by the pest control agency. 1. General i) Treatment for cockroaches, Mosquitoes& Flies etc. ii) iii) Anti Larva, treatment of drains and water bodies to control vector of Dengue, Malaria etc. Treatment for silver fish (for carpets, clothes & Books, etc.) 2. Rodent and other animal control such as Kabar bijju and bats i) Household rodent (e.g. mice) ii) Small animals like Kabbar bijju and Bats 3. Anti termite treatment i) Post Construction termite treatment ii) Field treatments 6

7 (B) The detailed Scope of Supplies and Services for keeping the building pest, termite & rodent free is as under:- (B-1) At NISCAIR, Dr. K.S.Krishnan Marg, Pusa, New Delhi :- Pest / Rodent Control Services as detailed below shall be provided at every 45 days interval i.e. twice in a quarter year in the entire complex including buildings with ground floor plus two floors at Pusa. Complete area of ground, 1 st and 2 nd floor of main building including ceiling, walls, corners of all halls, toilets and corridors etc., Complete area of Annexes building including ceiling, walls, corners of all halls, toilets, corridor of ground, first and second floor. Complete area of ceiling walls corners of book shop Shed, Publication Store, and Sports club and stores area. Complete area of sub-station including roof walls corners etc. Note:- Vendors are advised to visit the complex and assess the scope of work before participate. (a) Gen Pest Control i) Extermination of Cockroaches etc. by application of gel using Imidaclorpid as the base chemical and residual spray of DDVP.(App 2 tubes of Gel & 600 ml of DDVP per teartment) ii) Fogging operation by motorized machine shall be carried out in the exterior of complex for control of mosquitoes and flies. iii) Fumigation by dry powder (appx 3 box of 125 gms each per treatment) shall be done in the library of Niscair and in another similar area where books / files / records are kept. iv) Spray of ICON 10WP (Lambda Cyhalothrin 10 % wp, 200 gms per treatment) as the ingredient shall be carried out on the walls and water bodies etc for control of mosquitoes, flies and cockroaches v) Spray of Responsar or equivalent for extermination of Cock roaches, flies, Mosquitoes, Silver Fish etc inside the premises (appx 4.5 Ltr. per treatment) (b) Rodent Control i) Treatment to control Rodents & Mice by baiting method shall be provided in the entire complex using Bromodiolene (App 60 gm per treatment) ii) Baiting trays containing rodenticide shall be kept at rodent activity points iii) Glue Traps (Appx 11 No.) shall be placed at the rodent activity points for trapping of Rodents inside the premises. iv) Bait Station (Appx 11 No.) shall be installed at both places for trapping of rodents (c ) Antitermite (Spray Method) i) Regular spray Imidaclorpid for Anti Termite solution in water on walls and floors will be carried out once in every 45 days.(appx 300 ml for single application) 7

8 (B-2) At NISCAIR, 14, Satsang Vihar Marg, New Delhi :- Pest / Rodent Control Services as detailed below shall be provided at every 45 days interval in the entire complex including building having basement plus four floors at S V Marg. Complete area of basement to 3 rd floor including false ceiling, walls, corners of halls, rooms, toilets, corridor, stairs etc. Complete area of canteen, Substation including transformer room HT, LT room, AMF panel room, security gate and complete area of hostel and drivers quarters. Including the treatment inside the false ceiling wherever exists including the removal of wooden tiles from the position and re-fixing the same. Note:- Vendors are advised to visit the complex and assess the scope of work before participate. (a) Gen Pest Control i) Extermination of Cockroaches etc. by application of gel using Imidaclorpid as the base chemical and residual spray of DDVP.(App 4 tubes of Gel & 1400 ml of DDVP per treatment) ii) Fogging operation by motorized machine shall be carried out in the exterior of complex for control of mosquitoes and flies. iii) Fumigation by dry powder (appx 7 box 125 gms each per treatment) shall be done in the library of Niscair and in another similar area where books / files / records are kept.. iv) Spray of ICON 10WP (Lambda Cyhalothrin 10 % wp, 400gm per treatment) as the ingredient shall be carried out on the walls and water bodies etc for control of mosquitoes, flies and cockroaches. v) Spray of Responsar or equivalent for extermination of Cock roaches, flies, Mosquitoes, Silver Fish etc inside the premises (appx 4.5 Ltr. per treatment) (b) Rodent Control i) Treatment to control Rodents & Mice by baiting method shall be provided in the entire complex using Bromodiolene (App 140 gm per treatment) ii) Baiting trays containing rodenticide shall be kept at rodent activity points iii) Glue Traps (Appx 25 No.) shall be placed at the rodent activity points for trapping of Rodents inside the premises. iv) Bait Station (Appx. 25 No.) shall be installed at both places for trapping of rodents (c ) Anti termite (Spray Method) i) Regular spray Imidaclorpid for Anti Termite solution in water on walls and floors will be carried out once in every 45 days.(appx 700 ml for single application) 8

9 (C ) SPECIAL TERMS & CONDITION 1. No Pesticides are to be applied to the internal Cavities of any electrical apparatus including computer terminals, disk driven etc. without the written permission of authorized officer of the relevant department or Engineer-in-charge. 2. Excess residue is to be thoroughly removed by the pest controller before leaving the side. 3. No repeat application or any other alternative pesticide shall be used until the time span for full effect of the original pesticide has elapsed unless this is agreed between the officer in charge and user of the room in written. 4. Where an area cannot be adequately ventilated, following the application of pesticide, for security or any reasons, the pest controller will install and leave operating a portable mechanical ventilator unit, which will be provided & operated by the pest controller. 5. The ventilation unit will be allowed to operate until the officer-in-charge and the authorized officer of room/department whose spaced has been treated is satisfied, that fumes have been satisfactory evacuated. 6. The Pest controller before leaving the NISCAIR premises will report to officer-in-charge regarding the satisfactory completion of work carried out on the day/ evening/holidays or any convenient day based on actual requirement. 7. After the award of work, the contractor shall submit the duty chart for routine work in respect of all the premises which include the details/planning for scientific and sate pest control activity of each Building on Weekly basis etc. in addition to that the contractor have to attend (as and when required) the complains any received from occupants of building. 8. The contractor shall deploy adequate, educated and trained manpower to carry our day to day works and maintain a register for each building. 9. The firm will be responsible for the security/insurance of their staff working at site and NISCAIR will not be responsible in any manner in case of any accident / mis-happening 9

10 (D) Additional Terms & Conditions 1. The contractor shall not appoint any sub-contractor to carry out any obligation under the contract. 2. The duration of the contract shall be 24 month duration subject to quarterly appraisal and review by the Engineer in-charge. 3. NISCAIR will have the full right to direct the security personal to check, search or examine the contract employ, agent or representative of the contract while entering/leaving the premises if felt necessary, with the help of police. 4. Contractor will carry out the jobs as per the enclosed Annexure A and to their entire satisfaction of the Engineer in charge. In case the contractor fails to follow the direction of Engineer in-charge/officer in-charge he said contract can be terminated by giving one month notice. 5. Persons engaged for pest control service by the contractor should not cause any obstruction to the office work. He should be cordial, polite & well behaved. The contractor employee for pest control services shall enter the premises into proper uniform & identification card. 6. Suggested list of chemicals / Materials & monthly consumption is given in scope of supplies & services which shall be used for pest control services. However, any requirement for change in chemical/material should be done by the contactor in consultation with Engineer in charge or NISCAIR officials. 7. While using the chemical/insecticide, pesticide etc. the contractor must insure that the method of application and doses etc are as pr manufacturer s specification/ recommendation only. 8. Contractor must ensure while using chemical, insecticides, pesticides etc. in canteen kitchen etc. that the foods likely to absorb, odour and flavours, and all exposed food, utensil used.for eating, etc. are be adequately protected or removed. 9. All materials, tools, equipments etc. required for pest control services shall be arranged by the contractor in sufficient quantity at his own cost. 10. While using chemicals for pest control services necessary precaution any measure for providing masks, hand gloves etc. to the worker shall be arranged by the contractor. 10

14 (d) Add, However, release of security deposit would be only after written clearance of Labour Officer regarding no dues or claims is received Add sub para (d) as Employer shall have the discretion to permit the IEEMA (Indian Electrical & Electronics Manufactures Association) clause for escalation in case of specialized works e.g. electrical and maintenance installations etc. where the price variations is not similar to building works Modify as below: ARBITRATION (a) Except where provided in the contract, all questions and disputes relating to the interpretation of the specifications, designs, drawings and instructions herein before mentioned, and as to quality or workmanship or materials used on the work or s to any other question, claim, right, matter or thing whatsoever in any way arising out of or relating to the contract, designs, specifications, estimates, instructions, orders on these conditions or otherwise concerning the works, or the execution or failure to execute the same, whether arising during the progress of the work or after the completion or abandonment thereof, shall be referred to the sole arbitration of the person appointed by the Director- General, Council of Scientific & Industrial Research. The arbitrator shall be appointed within 30 days from the receipt of a request by any party. The arbitrator to whom the matter is originally referred, being on willing or unable to act for any reason the Director-General shall appoint another person to act as of Arbitrator in accordance with the terms of the contract, such person shall be entitled to proceed with the reference from the stage at which it was left by his predecessor. The arbitrator shall give a speaking award. The award of the arbitrator shall be final and binding on the parties. The cost of the arbitrator shall be borne equally by both the parties. (b) It is also a term of the contract that the party invoking arbitration shall specify the dispute or disputes to be referred to arbitration under this clause together with the amount or amounts claimed in respect of each such dispute. (c) It is also a term of the contract that if the contractor does not make any deemed for arbitration in respect of any claim in writing within 90 days or receiving the intimation from the Employer that the final bill is ready for payment, the 14

15 claim of the contractor will be deemed to have been waived and absolutely barred and the Employer shall be discharged and released of all liabilities under the contract in respect of these claims. (d) Subject as aforesaid the provisions of the arbitration and conciliation act, 1996, or any statutory modification or reenactment thereof and the rules made there under and the time being in force shall apply to the arbitration reference under this clause Add para Add para 31 Add para 30 to as under: DISMANTLED MATERIAL The contractor shall treat all material obtained during dismantling of a structure services sub systems/installations, excavation of the site for a work etc., a employers property and such material shall be disposed of the best advantage the Employer according to instructions issued in writing by the Engineer. Add para 31 as: PERFORMANCE GUARANTEES Performance Guarantee may be taken from the contractor before the award of work, by the officer authorized to award the contract, if and where considered necessary, to ensure that a part or whole of the contract is completed by the contractor. (b) For sanitary and water supply works one qualified diploma holder with experience of not less than 5 years, out of which one year should be in sanitary and water supply works when the tendered cost of work is more than Rs. 50,000/- (c) For electrical works. i) One qualified Graduate Engineer possessing Degree in Electrical from recognized university with an experience of not less than 3 years or a diploma holder in electrical engineering with an experience of not less than 7 years when the tendered cost of the work is not less than Rs. 1.5 lakhs. ii) One Graduate Electrical Engineer with two years experience or Diploma Holder in Electrical Engineering with experience of not less than 3 years, when the tendered cost of the work is more than Rs. 75,000/- but less than Rs. 1.5 lakhs. iii) One diploma holder in Electrical Engineering with experience of not less than 3 years when tendered cost of work is more than Rs. 37,000/- but less than Rs 75,000/- iv) One licensed supervisor with experience of not less than 3 years when the tendered cost of work is more than Rs 7,500/- and less than Rs. 37,000/- (d) In case the contractor fails to employ the technical staff as aforesaid, he shall be liable to pay reasonable amount not exceeding the amount shown below for each month of default. These recoveries are subject to modifications from the time by CSIR based on CPWD. i) In case when a Graduate Engineer is to be employed Rs. 3,000/-. ii) In case when a qualified Diploma holder is required to be employed Rs. 1,500/- iii) In case when a technical supervisor is required to be employed Rs. 750/ Clause 28 para (ii) The cost of work on which escalation will be payable shall be reckoned as 85% of the cost of the work as per the bills, running or final, and from this amount the value of material supplied by the Employer any items at prevailing market rates. 16
