1 Council Chambers PEMBROKE, Ontario September 2, 2008 The Regular Meeting of Council was held this evening with Mayor Jacyno presiding and all members of Council in attendance, with the exception of Councillor Callaghan. Also in attendance was L. Eckford, Treasurer/Deputy Clerk. MINUTES: On motion of Deputy Mayor Scott, seconded by Councillor Severin, the minutes of the Regular Meeting of Council of August 5, 2008 were approved as circulated. DISCLOSURE OF PECUNIARY INTEREST: PETITIONS: 1. Angie Driver and her daughters Ashlyn and Cailyn were present to present their petition requesting signage on Centre Street and bordering side streets. Ashlyn Driver explained that they are requesting a lower speed limit and children at play signs because their friend Logan was hit by a car at the end of the school year in June 2008 and she and her sister don t want to see it happen again to one of their friends. Mayor Jacyno thanked Ashlyn, Cailyn and Mrs. Driver for presenting their petition to Council and advised that the petition will be forwarded to the Operations Department for review and comment to be presented at the September 16, 2008 meeting. Ashlyn Driver thanked Mayor Jacyno for hearing their petition and noted that she and her sister had to leave to go home to get ready for school the next day. COMMITTEE REPORTS: 1A. Councillor Lafreniere reported that she had received some concerns regarding Centre Street as well and the roads leading from Mackay Street to Centre Street, due to the poor visibility at the top of the hill. She would like the Operations Department to review this item as well. 1B. Councillor Lowe reported that the special garbage pick up will be taking place soon. She noted that residents with Monday pick up will have their large items removed the week of September 7, 2008, residents

2 Council Meeting ~ 2 ~ September 2, 2008 with Tuesday pick up will have their large items removed the week of September 14, 2008, and residents with Wednesday pick up will have their large items removed the week of September 21, Councillor Lowe advised that an advertisement was placed in the Daily Observer on Saturday, August 30, 2008, outlining the acceptable items for pick up as well as the fines associated with scavenging the scrap metal items. This advertisement is also posted on the City s website. 1C. Councillor Severin reported that he represented Council at the 40 th Anniversary of the Pembroke & Area Airport Commission on August, 23, He advised that the weather was perfect for the event and that he had the opportunity to view the City from the comfort of one of the airplanes. 1D. Councillor Hackett questioned Councillor Lowe if members of the public could scavenge other items from the special garbage pick up other than the scrap metal items, so that less garbage is placed in the land fill. Councillor Lowe advised that members of the public can take items that are useful for them but that the scrap metal items and white goods such as fridges and stoves are off limits, as these items make money for the partners involved in the Ottawa Valley Waste Management Board. 1E. Councillor Hackett reported that he represented Council at a recent boxing match in Petawawa that was held to honour and support our troops and their family members. He noted that the City s Fire Department was represented in the match as well. Councillor Hackett advised that he presented some medals to the winners of the matches on behalf of the City. BY-LAWS: FIRST AND SECOND READINGS: The following by-law was now introduced and read a first and second time, Rule 71 being suspended for that purpose, on motion of the members named, viz: 2. By-law Number ; a by-law to amend By-law , as amended, being a by-law to appoint Municipal By-law Enforcement Officers for the City of Pembroke. (Councillor Hackett and Councillor Severin) THIRD READING: The following by-law was now read a third time, short and passed, Rule 71 being suspended for that purpose, on motion of the members named, viz:

(Councillor Hackett and Councillor Severin) SPECIAL ORDERS: 3. Mayor Jacyno declared the week of September 6 to 14, 2008 as Square and Round Dance Week in the City of Pembroke. MOTION TO HEAR: On motion of Councillor Lafreniere, seconded by Councillor White, the Mayor asked if anyone was present to speak to Council. There was no one present to address Council. ANSWERS TO QUESTIONS: 3A. Deputy Mayor Scott advised that he was in contact with Mr. Bob Schreader of the Renfrew County and District Health Unit, regarding the recent closure of Riverside Beach due to high levels of E-Coli bacteria. It was noted that the E-Coli was caused by the feces of Canada Geese in conjunction with the high level of water as well as the increased rain fall over the summer. Deputy Mayor Scott advised that the Town of Petawawa was having difficulty with the increase in the number of Canada Geese this year as well. Deputy Mayor Scott would like to know what the City can do to get rid of the Canada Geese and would like this issue addressed at a future meeting of the Operations Committee. Councillor White agreed that this issue could be looked at and noted that a local golf course culled Canada Geese a few years ago. Staff was directed to research this issue. MOTIONS: Resolution No Moved by Councillor Severin, seconded by Councillor Hackett; THAT the Corporation of the City of Pembroke grant 2 Service Battalion the authority to exercise the Freedom of the City of Pembroke on Thursday, October 9, 2008 in celebration of the Battalion s 40 th

Resolution No Moved by Councillor Lowe, seconded by Councillor O Neill; WHEREAS the five municipal partners, including the City of Pembroke, comprising the Ottawa Valley Waste Management Board have each been charged under the Ontario Health & Safety Act (File No ) for activities associated with Ottawa Valley Waste Recovery Centre; AND WHEREAS the Council for the Corporation of the City of Pembroke deems it expedient and cost effective to engage in conjunction with the other Ottawa Valley Waste Management Board member municipalities, the same legal Counsel to address the charges on behalf of all of the municipalities; NOW THEREFORE BE IT RESOLVED THAT the Council for the Corporation of the City of Pembroke hereby supports the recommendation of the Ottawa Valley Waste Management Board that the law firm of Aird and Berlis be appointed as lead Counsel for the City of Pembroke regarding legal matters associated with the above noted charges; AND FURTHER BE IT RESOLVED THAT the Council of the Corporation of the City of Pembroke hereby supports the recommendation of the Ottawa Valley Waste Management Board that the law firm of Roy C. Reiche, Barrister & Solicitor, be appointed to represent the City of Pembroke for the purpose of making routine local court appearances to deal with procedural matters regarding the above noted charges; AND FURTHER BE IT RESOLVED THAT the Manager of the Ottawa Valley Waste Recovery Centre be authorized to deal directly with the above noted law firms regarding legal defense strategies and related matters associated with the above noted charges keeping Council updated on a regular basis through communication with the City s appointed member to the Ottawa Valley Waste Management Board and the City s CAO, seeking direction as required.

Mayor Jacyno advised that the petition presented this evening has been referred to the Operations Department for review and comment.
