1 Minutes of the Meeting of the LICENSING ENFORCEMENT SUB-COMMITTEE Held: TUESDAY, 9 JUNE 2015 at 9:30 am P R E S E N T: Councillor Thomas (Chair) Councillor Byrne Councillor Shelton * * * * * * * * 122. DECLARATIONS OF INTEREST Members were asked to declare any interests they might have in the business to be discussed. No such declarations were made PRIVATE SESSION Paragraph 1 that the press and public be excluded during consideration of the following report in accordance with the provisions of Section 100A(4) of the Local Government Act 1972, as amended, because it involves the likely disclosure of 'exempt' information, as defined in the Paragraphs detailed below of Part 1 of Schedule 12A of the Act, and taking all the circumstances into account, it is considered that the public interest in maintaining the information as exempt outweighs the public interest in disclosing the information. MINUTES OF PREVIOUS MEETING AGREED:- that the minutes of the Licensing Enforcement Sub-Committee meeting held on 29 April 2015be confirmed as a correct record APPLICATION FOR THE RENEWAL OF A HACKNEY CARRIAGE AND The applicant was present at the meeting accompanied by his solicitor and an interpreter. The Licensing Team Manager and Solicitor to the Sub-Committee were also present. convictions referred to in the report. It was noted that the references to Question 3 in paragraph 5 of the report should read Question 2. There were no questions on the report from those present. The applicant s solicitor set out the reasons why despite his convictions he ought to be considered an exception to the Council s guidelines on convictions, and answered questions from Members. The applicant also responded to questions from Members. Some of the responses were made by the applicant and some through the interpreter. The applicant and his solicitor were then given the opportunity to sum up and make any final comments. The Sub-Committee received legal advice from the Solicitor to the Sub- Committee in the presence of the applicant and his solicitor and interpreter.
3 In reaching their decision, Members felt they should deliberate in private on the applicant, his solicitor and the interpreter, then withdrew from the meeting. The Licensing Team Manager and the applicant, his solicitor and the interpreter, then returned to the meeting. Carriage and Private Hire be granted. submission on behalf of the applicant they were not entirely convinced by the account given but had decided to give the applicant the benefit of the doubt and grant the renewal of the licence. However, the applicant was also advised that should he appear before the sub-committee in the future any submissions would not be viewed as sympathetically APPLICATION FOR THE RENEWAL OF A HACKNEY CARRIAGE AND The applicant was present at the meeting. The Licensing Team Manager and Solicitor to the Sub-Committee were also present. convictions referred to in the report. There were no questions on the report from anyone present. The applicant set out the reasons why despite his convictions he ought to be considered an exception to the Council s guidelines on convictions, and answered questions from Members. The applicant was then given the opportunity to sum up and make any final comments.
4 The Sub-Committee received legal advice from the Solicitor to the Sub- Committee in the presence of the applicant. In reaching their decision, Members felt they should deliberate in private on the applicant then withdrew from the meeting. The Licensing Team Manager and the applicant then returned to the meeting. Carriage and Private Hire be granted. applicant s submission they were satisfied with the account and had decided to grant the renewal of the licence. The applicant was also advised that should something similar happen again he should obey the court order promptly as any driving offence would impact upon his hackney carriage and private hire driver s licence APPLICATION FOR THE RENEWAL OF A HACKNEY CARRIAGE AND The applicant was present at the meeting. The Licensing Team Manager and Solicitor to the Sub-Committee were also present. convictions referred to in the report. There were no questions on the report from anyone present. The applicant set out the reasons why despite his conviction he ought to be considered an exception to the Council s guidelines on convictions, and answered questions from Members. The applicant was then given the opportunity to sum up and make any final
