(b) The term includes lanning, administering, and erfrming research fr cmmunit alchl and drug abuse services deliver sstems. The term als includes the fllwing: (1) Using the cre functins f alchl and drug abuse cunseling. () Prviding alchl and drug abuse cunseling t famil members t hel them gain an understanding f the nature f alchl and drug abuse. () Making referrals t ther qualified rfessinals when arriate. (c) The term des nt include the erfrmance f schthera r the rendering f diagnses (as defined in I (c)). Sec.. "Alchl and drug abuse cunseling services" means evaluating r treating either f the fllwing n a fee-fr-services, reaid, r ther cmensatr basis: (1) An individual with an alchl r drug abuse rblem. () "Intake" means the administrative and initial assessment rcedures invlved in a client's admissin t a treatment rgram. () "Orientatin" means rviding the fllwing infrmatin t a client: (A) The general nature and gals f the treatment rgram. (B) Rules gverning client cnduct and infractins that can lead t discilinar actin r discharge frm the treatment rgram. () In a nnresidential treatment rgram, the hurs during which services are available. (D) Treatment csts that the client must bear, if an. (E) The client's rights. () "Assessment" means the rcedure b which a cunselr r treatment rgram, during the develment f a treatment lan, identifies and evaluates a client's strengths, weaknesses, rblems, and needs. () "Treatment lanning" means the rcess b which a cunselr and a client: (A) identif and rank rblems needing reslutin; (B) establish and agree un immediate and lng term gals; and () decide un a treatment rcess and the resurces t be used. The term includes liaisn activities and cllateral cntacts. () "risis interventin" means services that resnd t the needs f a client wh is abusing alchl r drugs, r bth, when the client is under acute emtinal distress r hsical distress, r bth. () "lient educatin" means rviding infrmatin t individual clients and grus f clients cncerning: (A) the abuse f alchl r drugs, r bth; and (B) the services and resurces available t assist the clients. () "Referral" means: (A) identifing the needs f a client that cannt be met b a cunselr r an agenc; and (B) assisting the client in using the available surt sstems and cmmunit resurces. () "Rert and recrd keeing" means: (A) charting the results f a client's assessment and treatment lan; and (B) writing rerts, rgress ntes, discharge summaries, and ther client related data. (1) "nsultatin with ther rfessinals" means relating with in-huse staff r utside rfessinals t assure cmrehensive, qualit care fr a client. Sec.. "unselr" means a clinical alchl and drug abuse cunselr. Sec.. "Licensed clinical alchl and drug abuse cunselr" means an individual engaged in the unlimited ractice f alchl and drug abuse cunseling. Sec.. "Pschthera" means the assessing and treating f mental and emtinal disrders b an f the varius means f cmmunicatin between an alchl and drug abuse cunselr and a client. hater. Alchl and Drug Abuse unselr Bard Sec. 1. The alchl and drug abuse cunselr bard is established n Januar 1, 00. Sec.. (a) The bard cnsists f five () members ainted b the gvernr as fllws: (1) Tw () members wh are licensed clinical alchl and drug abuse cunselrs with at least five () ears exerience 001 IN 0 LS 0/DI +

15 as clinical alchl and drug abuse cunselrs. () Tw () members wh reresent the general ublic and wh have never been credentialed under this article. () One (1) hsician licensed under I -. wh has training in schiatric medicine. (b) Each member f the bard shall serve a term f three () ears and until the member's successr is ainted and qualified. (c) Nt mre than three () members f the bard ma be frm the same litical art. (d) The members f the bard must be residents f Indiana. (e) The gvernr ma remve a bard member at an time fr incmetenc, neglect f dut, r unrfessinal cnduct. (f) A vacanc in the membershi f the bard shall be filled b aintment b the gvernr fr the unexired term. Sec.. (a) The bard shall meet at least ne (1) time each calendar ear, un the call f the chairersn r the written request f a majrit f the members f the bard. (b) The chairersn shall establish the time and lace fr each meeting. (c) Three () members f the bard, tw () f whm must be licensed clinical alchl and drug abuse cunselrs, cnstitute a qurum. 16 (1) enfrce and administer this article; () adt rules under I -- that are reasnabl necessar r arriate fr the administratin and enfrcement f this article; () establish standards fr the cmetent ractice f alchl and drug abuse cunseling, including rivileges, enalties, and standards f cmetent ractice within the field f alchl and drug abuse cunseling fr individuals wh are licensed as clinical alchl and drug abuse cunselrs; () rescribe the requirements fr and the frm f licenses issued r renewed under this article; () issue, den, susend, and revke licenses in accrdance with this article and I -1-; () in accrdance with I -1-, investigate and rsecute cmlaints invlving licensed clinical alchl and drug abuse cunselrs r individuals the bard has reasn t believe shuld be licensed, including cmlaints cncerning the failure t cml with this article r rules adted under this article; () establish cntinuing educatin requirements fr licensed clinical alchl and drug abuse cunselrs; () establish standards fr the retentin f atient recrds and rerts b a cunselr; () arve cntinuing educatin rviders, rgrams, curses, fees, and rf f curse cmletin; () establish fees in accrdance with I -1-; () cnsider the qualificatin f individuals wh al fr a license r renewal f a license under this article; and (1) cnduct rceedings under I -1-. hater. Licensing Requirements Sec. 1. Excet as rvided in I -.-1-, an individual ma nt ractice alchl and drug abuse cunseling after June 0, 00, withut first btaining a license frm the bard. Sec.. Excet as rvided in sectin f this chater, t qualif fr a clinical alchl and drug abuse cunselr license, an individual: (1) must cmlete an alicatin fr licensure in accrdance with rules adted b the bard; () must a the fee established b the bard; () ma nt have been cnvicted f a crime that has a direct bearing n the individual's abilit t ractice cmetentl as determined b the bard; 001 IN 0 LS 0/DI +

17 () ma nt have had discilinar actin taken against the individual r the individual's license b the bard r b a licensing agenc f anther state r jurisdictin n grunds that the individual was unable t safel ractice alchl and drug abuse cunseling, if the grunds fr disciline are still valid as determined b the bard; and () must shw t the satisfactin f the bard that the individual has dne the fllwing: (A) Received at least a master's degree in alchl and drug abuse cunseling, marriage and famil thera, astral cunseling, scial wrk, alied human develment, schlg, r nursing frm: (i) an accredited institutin f higher learning with degree rgrams accetable t the bard; r (ii) an educatinal institutin nt lcated in the United States that has a rgram f stud that meets the standards f the bard. (B) mleted curse wrk during the individual's educatinal training at the master's level that includes instructin in at least the fllwing cntent areas: (i) Theretical fundatins f alchl and drug abuse cunseling. (ii) Majr mdels f alchl and drug abuse. (iii) Drug harmaclg. (iv) Individual develment. (v) Famil develment and famil relatinshis. (vi) linical rblems. (vii) llabratin with ther discilines. (viii) Sexualit. (ix) Gender and sexual rientatin. (x) Ethnicit, race, sciecnmic status, and culture issues. (xi) unseling techniques. (xii) Behaviral research. (xiii) Abnrmal schlg r schathlg. Disclsure Requirements Sec. 1. Befre rviding alchl and drug abuse cunseling services, a licensed clinical alchl and drug abuse cunselr must disclse t the individual t whm alchl and drug abuse cunseling services are rvided the cunselr's educatinal backgrund, including the fllwing infrmatin: (1) Whether the cunselr has a degree in cunseling r a related field. () The te f degree the cunselr has and the institutin f higher educatin that issued the degree. hater. Renewal f License Sec. 1. (a) A license issued b the bard is valid fr the remainder f the renewal erid in effect n the date the license was issued. (b) An individual ma renew a license b: (1) aing the renewal fee n r befre the license's exiratin date; and () cmleting the cntinuing educatin requirements established b the bard under I IN 0 LS 0/DI +

19 (c) If an individual fails t meet the requirements f subsectin (b), the individual's license becmes invalid. Sec.. (a) The bard ma reinstate an exired license nt later than three () ears after the license's exiratin date if the individual hlding the exired license: (1) as a enalt fee fr late renewal; () as the renewal fee under sectin 1(b) f this chater; and () cmletes the cntinuing educatin requirements established b the bard under I (b) If mre than three () ears have elased since the date n which an individual's license exired, the individual hlding the license ma renew the license b satisfing the requirements fr renewal established b the bard. hater.
