1 Benadir Regional Administration Somalia Urban Investment Project (SUIPP) Terms of Reference 1. Project Background The Somali Urban Investment Planning Project (SUIPP) will support feasibility, assessment and preliminary design studies for urban investment activities, which could be funded from a Multi Partner Fund (MPF), in the municipalities of Mogadishu, Hargeisa and Garowe. The SUIPP comprises a project to prepare a project. The main project to be prepared by SUIPP -, called the Somali Urban Development Project (SUDP), has an estimated budget envelope of US$86.11m intended for support by the MPF. Pursuant to relevant Bank Operating Procedures, which specifically allow for such situations, and given that the project has an environmental safeguard categorization of B, the activities to be supported under the SUDP will include both detailed project design and implementation. The activities to be undertaken under the SUDP constitute the rehabilitation and upgrading of primary and secondary/community roads, a potential combination of the upgrading of intra-city roads and/or bridge-building in Garowe, the enhancement of solid and liquid waste management and water supply in Hargeisa, the extension and institutionalization of the Local Development Fund, and institutional strengthening activities focused on the three municipalities and the Hargeisa Water Agency. These activities have been identified through a process of technical work and dialogue the Bank Task Team has undertaken during a number of visits to the three cities and are described in the Project Information Document for the SUDP and in the Aides Memoire produced after each visit. A detailed description of the SUDP is attached the PIM as Annex 1. Preliminary preparation, which includes feasibility studies and preliminary design for the main infrastructure activities under the SUDP, as well as a number of potential urban infrastructure investments on the Somali territories, and a range of institutional assessments, will be undertaken under the SUIPP also to be supported by the MPF. Some of the output of the technical work undertaken under the SUIPP will provide the basis for the preparation of the SUDP, while the scope of TA should also be applicable to urban development projects in a variety of different funding contexts. It should be noted that final design work itself e.g. detailed engineering design, social and environmental impact assessments, exploratory drilling and preparation of bidding documents will not be undertaken as part of the SUIPP. They will be undertaken as part of the SUDP or other projects under different financing arrangements and funding to cover these costs will be included in the project documentation and proposals relating to that operation. Overall, the SUIPP will support two basic types of activity: a. Feasibility and preliminary design studies for the physical investments that will be supported by the SUDP and other urban development projects, and institutional assessments of the agencies that will execute these investments to provide an informational and analytic base for the preparation of institutional strengthening activities that will be supported by the SUDP. In order to facilitate the quick execution of these activities in the fragile and conflict affected environment of the Somali territories, they will be executed by the Bank pursuant to OP 10 (para 12); b. Provision of technical assistance to enhance the capacity of the Somali executing agencies to prepare and implement urban development projects, such as the SUDP, effectively and efficiently and to mitigate fiduciary and safeguards risk. These activities will be client executed.

2 The SUIPP activities briefly described in b above will implemented by three different agencies, namely the Mogadishu Benadir Regional Administration (BRA), the Garowe Municipality (GM) and the Hargeisa Municipality (HM). In order to establish sufficient capacity to prepare and then implement the SUDP, technical assistance for the BRA will need to be recruited under SUIPP comprising a full-time project coordinator, full-time procurement specialist, full-time financial management specialist, a full-time social and environmental specialist, and a full-time monitoring and evaluation specialist, full time communication & Conflict resolution specialist, project engineer and Admin & finance officer. Operating and minor equipment costs related to the recruitment and employment of these positions will also be incurred. In addition, some training and capacity building for these individuals and other staff associated with preparation and execution of the SUIPP and SUDP will be required. SUIPP Project Coordinator The SUIPP Project Coordinator PC will have overall responsibility for the management of SUIPP and the SUIPP team. The PC will also be the primary interlocutor for the Project with the Minister of Finance and with the World Bank. The PC will also ensure the Project is implemented in compliance will all fiduciary and safeguards requirements, reviewing and approving all reporting on the project within the Ministry and with the World Bank. The PC shall also ensure active engagement with other ministries, regional and administrative districts in the implementation of the Project in order to ensure its smooth implementation. The PC will undertake the role and responsibilities as set out above and in the Scope of Work section of these TORs. Scope of Work The SUIPP Project Coordinator has the following overall responsibilities: 1. Preparing monthly and quarterly work plans for the PIU, in line with its functions (project preparation, tendering, award, implementation and supervision) 2. Ensuring that the PIU carries out its functions on schedule, and to an acceptable standard 3. Leading BRA-PIU project identification consultations at all districts of Banadir Region. 4. Maintain excellent communications with the World Bank. 5. Overseeing the BRA-PIU procurement process 6. Participating in BRA-PIU monitoring visits. 7. Ensure that Environmental and Social Safeguard guidelines and policies are adhered to. 8. Ensuring that the BRA-PIU prepares monthly and quarterly progress reports for consideration by the World Bank 9. Managing SUIPP personnel in line with SUIPP Project Implementation Manual policies and guidelines (including anti-corruption guidelines and Code of Conduct). 10. Ensuring safety and security of SUIPP PIU resources. I. Period of Performance The SUIPP Project is expected to begin 01 /06/2016 and close 30 June PC contract will be for approximately 9 months on a full time basis. Follow on implementation of SUDP is planned and the PC contract is eligible for possible extension. II. Qualifications 1. Relevant university degree, preferably Master s degree in social sciences or international development. 2. Minimum of 7 years of relevant working experience in project development and management in Somalia

3 3. Demonstrate experience in managing teams 4. Strong working knowledge of procurement processes 5. Strong understanding of best-practice approaches to monitoring 6. Strong communication and representation skills. 7. A drive for results in a relatively high-volume, quick-paced programme environment, creativity and analytical capability required to respond to evolving programme demands and current events. 8. Strong inter-personal skills and ability to work within and build a team environment, ability to provide both detailed and strategic analysis, excellent communication and negotiation skills, ability to work effectively and harmoniously within a diverse work environment. 9. Ability to adapt and cope with change. 10. Excellent computer skills. 11. Written and spoken fluency in Somali and English required. 12. Understand well in local dynamics

4 2. Objective of the Assignment SUIPP PIU-BRA Financial Management Specialist The objective of the assignment is for the SUIPP-BRA Financial Specialist (FS) to perform all necessary financial management (FM) activities under SUIPP for the period of the assignment. The FS will work in close coordination with the FGS External Assistance Fiduciary Section (EAFS) within the Ministry of Finance, Office of the Accountant General. The FS will manage the financial management activities of the project in strict compliance with: (i) EAFS Manual (ii) the requirements of the Agreement between the World Bank and the Government; (iii) Project Appraisal Document (PAD) iv) the Project Implementation Manual (PIM) for this project which is based on appropriate financial management best practice and international accounting standards. Scope of work: 1) Maintain all accounting records in line with approved accounting standards and in line with the World Bank s and Government s regulations; 2) Render periodic reports, (i.e. monthly/quarterly/annually) in the formats approved by the World Bank and FGS and in line with the project documents and financing agreement; 3) Ensure that disbursements are made in accordance with approved annual budgets and work plans together with the Project management; 4) Ensure that all payments are done in accordance with good accounting practices and in line with the project objectives and financing agreement; 5) Where applicable, ensure that the required the World Bank No Objection letters relating to an expenditure have been rendered by the Bank before effecting payment; 6) Ensure prompt release of funds once approved to beneficiaries; 7) Ensure that required accounting and submissions of returns by beneficiaries who receive advances are fully supported, complete, accurate and timely; 8) Maintain relevant books and records for the Project that reflects the components and activities; 9) Ensure that the filing system of the accounting records are satisfactory at all times and they are easily retrievable for reviews and audit purposes; 10) Ensure that all accounting records are updated promptly; 11) Prepare monthly bank reconciliations for the project bank accounts, including designated and project accounts; 12) Ensure financial reports are prepared in accordance with agreed formats and in line with the financing agreement; 13) Prepare Unaudited Quarterly Financial Reports (IFRs) and Annual Financial Statements for all Project Funds are prepared and analysed according to the categories and project components as appropriate, and provide timely reporting of any material variances; 14) Together with the SUIPP Coordinator, maintain, develop and update the financial procedures manual on a regular basis; 15) Liaise with the internal/external auditors to get project financial statements audited and follow up any audit queries/management letters; 16) Follow up on No Objection from the Bank s Procurement Specialist where not available and ensure they are properly filed as part of the accounting records; 17) Ensure that no project category/component is overspent without proper authorization from the World Bank;

5 18) Working with other project staff, prepare annual work plans and budgets. In addition review all aspects of the Project work plans and budgets based on the results of operations and changing economic conditions and recommend corrective measures to the management; 19) Initiate corrective measures to address internal financial shortcomings and irregularities as the need arises; 20) Establish and enhance as appropriate, systems of internal control (goods, works, services, fixed assets, civil works); 21) Prepare, monitor and interpret cash flow forecasts in consultation with the Head of the PIU; 22) Analyse changes in the forecast and advise the project management accordingly; 23) Ensure compliance with operating procedures of Government and the World Bank, e.g. Procurement, Disbursements, Designated Accounts, SOEs, IFRs, Special Commitments etc.; 24) Monitor, in conjunction with the Procurement Specialist financial management aspects of consulting services and other procurement contracts; 25) Brief the SUIPP Coordinator on capacity development progress being achieved; 26) In conjunction with the SUIPP Coordinator, the SUIPP Procurement Specialist monitor performance against agreed Financial Performance Indicators; 27) Prepare quarterly and final reports at the end of the contract period outlining achievements, challenges and recommendations pertaining to the financial management function; 28) Keep abreast of changes in financial regulations and legislations and ensure the accounting staff is updated on new developments. 29) Identify key emerging gaps and fiduciary risks that inform the need to revise the EAFS manual and PIM. 30) Reports and other documents shall be submitted in English. 3. Period of Performance The SUIPP Project is expected to begin 1 st June 2016 and close 30 June The FS contract will be for approximately 9 months. Follow on implementation of SUDP is planned and the FS contract is eligible for possible extension. 4. Qualifications Master s Degree in accounting, finance or business administration (accounting); Professional qualification in financial management, registered by and attained final qualification of any financial management related recognized professional body e.g. CIPFA IPFM, ACCA, CPA etc.; At least 7 years of experience in audit or financial management; Preferably at least 2 years of post-qualification experience in financial management directly relevant to public sector and/or international development organization ; Experience of project financial management in a developing country; experience in a fragile state is preferable; Understand well in local dynamics Excellent written and oral communication skills in English, to deliver technical financial documents, and reports; candidates familiar with Somali language will have an added advantage; Excellent computer skills in Microsoft Office tools (Word, Excel, and PowerPoint) and Internet use, including database use is required

6 SUIPP PIU-BRA Procurement Specialist Scope of Work The SUIPP Procurement Specialist (PS) will be responsible for providing proper guidance to the PCU on procurement process and shall be responsible for preparing, implementing and monitoring the Project procurement plans. The PS will report to the Project Coordinator. Responsibilities of the PS include: Creating and ensuring the SUIPP (and later the SUDP) Procurement plan aligns with the Annual Work Plan; Creating a detailed personnel work plan to assure the timely processing of all planned procurement in consultation with the Project Coordinator. Prepare, or ensure the proper and timely preparation of, advertisements, bid documents, requests for proposals, bid and proposal evaluation reports, minutes of bid openings and minutes of negotiations and requests for NOLs from the Bank as needed to maintain the procurement schedule. Collaborate with the Engineers on management of sub-project implementation contracts; Ensuring that all SUIPP/SUDP procurement is done in accordance with World Bank and applicable FGS guidelines and regulations; Contribute as needed to the Quarterly reports and other reporting as requested by the Project Coordinator; Participate in and advise the Bid and Tenders Evaluation Committee(s) on the responsiveness of bids and proposals, particularly in technical matters; Reports and other documents shall be submitted in English and in Somali when required; Procurement Specialist shall undertake additional duties as reasonable directed by the Project Coordinator for the better implementation of the Project. 7 SUIPP PIU-BRA Project Engineer The PIU Engineer will be responsible for overseeing the preparation of the consultant teams preparing the subprojects and will oversee preparation of bidding documents and will be involved in the assessment of bids and consultant processes for work related to sub-projects. The Engineer will also be responsible for assessing quality and progress of sub-projects, and will coordinate with the Monitoring Agent as well as the Monitoring and Evaluation Officer and the Procurement Officer. The PIU Engineer will undertake the role and responsibilities as set out in the Scope of Work section of these TORs. I. Scope of Work The PIU Engineer is responsible for: 1. Working closely with sub-contractors that will undertake the feasibility study of rehabilitation of primary roads in Mogadishu. 2. Working closely with sub-contractors that will undertake the feasibility study of secondary/tertiary roads in all 17 districts in Mogadishu 3. Consult and inform local communities on implementation of infrastructures and facilities. 4. Working closely with subcontractors to develop preliminary design of primary roads of Mogadishu. 5. Assisting the Procurement Officer in preparation of Bid document; 6. Advising the Project Coordinator progress on all implementation sub-contracts; 7. Identify and manage risks so that maximum benefit to clients and stakeholders is achieved 8. Ensuring full engagement with all stakeholders of the project ; 9. Participate in and advise the Bid and Tenders Evaluation Committee(s) on the responsiveness of bids and proposals, particularly in technical matters; 10. Support and advise the Project Coordinator as appropriate for the smooth implementation and administration of the Project including appropriate input to the Quarterly Report; 11. Reports and other documents shall be submitted in English and in Somali when required; 12. Project Engineer shall undertake additional duties as reasonable directed by the Deputy Coordinator for the better implementation of the Project. II. Capacity Building The PIU Engineer will serve as mentor to other Engineers in Mogadishu municipality for supervising, performance and increasing the depth of knowledge in all areas of project management and project design for follow-on SUDP project. The Project Engineer will also serve as a resource to Mogadishu Municipality by assisting them to understand World Bank and FGS procedures for project execution. III. Period of Performance The PIU-SUIPP Project is expected to begin 1 June 2016 and close 31 June The project Engineer s contract will be for approximately 10 months. Follow on projects are planned and the Project Engineer s contract is eligible for possible extension. The PIU office will be established with in the BRA however occasion site visits will be undertaken by the Engineer as needed to adequately assist the sub-contractors to perform properly on their duty. IV. Qualifications 1. Post- Graduate Degree in civil engineering. 2. Minimum of 7 years experience with urban and community infrastructure construction and rehabilitation. Experience executing externally financed projects is desirable. 3. Experience of working project related road building /rehabilitation

8 4. Demonstrate ability to work within diverse and demanding environments while maintaining excellent communication and negotiating skills. 5. Demonstrated experience leading teams and successful ability to work within a team environment. 6. Evidence of analytical capacity and competence in providing detailed strategies for the successful delivery small infrastructure work in challenging situations. 7. Show evidence of report writing skills and technical design 8. Knowledge of local dynamics is an advantage 9. Written and spoken fluency in Somali and English. 10. Experience with World Bank Standard Bidding Documents is highly desirable.

9 SUIPP PIU-BRA Communication Specialist The PIU Communication Specialist will undertake the role and responsibilities as set out in the Scope of Work section of these TORs. 2. Scope of Work The Communications & Conflict resolution Specialist will be responsible for raising awareness of the program and the program activities. The CS & CR will work close with the communications team in FGS to ensure communications of the program is consistent with overall government communications. The CO will also oversee the management and production of the PIU-SUIPP website and other communications media related to the Project. Responsibilities of the C&CRS include: 1. Raising awareness of the PIU s activities to the local population. This will also involve liaising with the communication teams of FGS to ensure the messaging surrounding the PIU is coherent and effective. 2. Raising the public profile of the BRA-SUIPP using proactive media outreach, and a range of public relations activities; 3. Participate in the design, maintenance and dissemination of a Complaints Handling System in cooperation with the Project Coordinator. 4. Coordinating and managing all PIU communications; 5. Contributing to media strategy development and engagement in cooperation with the Benadir Regional Administration ( BRA); 6. Coordinating and supervising press conferences, media briefings and interview in cooperation with the BRA; 7. Drafting statements and other materials to ensure that PIU- SUIPP values are conveyed to the public consistently and coherently; 8. Writing and editing press releases and briefing papers; 9. Establishing and managing the PIU website. This role includes contributing to the content of the BRA SUIPP website by providing text, photographs, and other appropriate audio-visual material; 10. Assisting the BRA in the publication of PIU related information on the official website; 11. Maintain a log of all communications; 12. Write monthly and quarterly success stories and/or feature articles that clearly illustrate programmatic impact, 13. Conduct interviews with partners and beneficiaries, direct and produce multimedia content and take quality photographs; 14. Produce and update a variety of communication products, including posters, slideshows and brochures for the PIU- SUIPP programs and BRA; 15. Facilitating Community consultation of Secondary Road feasibility study throughout 17 districts of Mogadishu 16. Develop Conflict resolution framework 17. Develop information material to the community on potential benefit on secondary roads 18. Reports and other documents shall be submitted in English and in Somali when required; 3. Period of Performance The SUIPP Project is expected to begin 1 June 2016 and close 31 June The C&CR s contract will be for approximately 9 months. Follow on projects are planned and the C&CRS s contract is eligible for possible extension.

10 4. Qualifications 1. Master s Degree in communications or international development & conflict resolution 2. Minimum of 5 years of relevant working experience in developing and implementing strategic communications strategic communications strategies. 3. Demonstrated experience in managing communication activities. 4. Strong inter-personal skills and ability to work within and build a team environment, excellent communication and negotiation skills, ability to work effectively and harmoniously within a diverse work environment. 5. Ability to adapt and cope with changes and work related pressure. 6. Excellent computer skills, including website content management. 7. Written and spoken fluency in Somali and English required 8. Understand well in local dynamics

11 SUIPP PIU-BRA Environmental & Social Specialist As part of the SUDP preparation, the safeguard specialist will provide assistance and support so that the various safeguard instruments generated by the Project meet all applicable requirements of the Bank s and FGS safeguard policies. 2. Scope of Work a. Assist the PIU as needed with the safeguard aspects of the preparation of SUDP activities in Mogadishu and prepare the initial screening checklist for safeguard policies; b. Advise BRA on World Bank safeguard policy requirements, preliminary EA category and which safeguard policies are likely to be triggered by a specific subproject; c. Advise BRA on the appropriate type and scope (extent) of safeguard instruments to be prepared for a particular sub-project. Examples of the different types of safeguard instruments include Environmental Impact Assessment, Environmental Management Plan, Environmental (and Social) Management Framework, Social Impact Assessment, Indigenous Peoples Plan, Indigenous Peoples (Planning) Framework, Resettlement Action Plan and Resettlement Policy Framework; d. Provide advice, guidance, example documents and inputs for draft TOR and for the preparation of the required safeguard instrument(s), such as EIA, RAP, or other; e. Facilitate the timely review of, and comment on, all draft environmental and social reports prepared by external consultants as needed upon request from IAs; f. Manage the safeguard review and assessment work plan of the SUDP preparation/management team to ensure timely review, approval and implementation of sub-projects. Summaries of the safeguards reviews and findings will be provided to the Project Coordinator; g. Assist the Project Coordinator to expedite and monitor the compliance of Safeguards requirements of both Federal Government of Somalia and WB during the SUDP preparation and implementation h. Undertake site inspections and local travel as required by BRA in Mogadishu. 3. Period of Performance The SUIPP Project is expected to begin 01 June 2016 and close 30 June The SS contract will be for approximately 4.5 months on a part-time basis. Follow on implementation of SUDP is planned and the SUIPP contract is eligible for possible extension. 4. Qualifications a. Advanced degree preferably in Environment, Social Science, Engineering, or related field, b. 7 years experience in national and international project development and implementation. Experience in Somalia is required together with dealing with Safeguard aspects in significant project development work on municipal services, transport and investment in infrastructure services, c. Proven ability to advise and support project safeguard assessment and preparation, contractual and financial elements of development project delivery, and experience of all stages of investment program identification, specific technical sector program design and documentation, and implementation experience, d. Ability to develop and maintain effective interaction with high level government officials, project management offices and implementing agency officers, and international and national consultants.

12 e. Good knowledge and working experience of the full range of World Bank Group's operational products and Safeguards procedures, FGS legal and safeguards systems, and Operational Procedures; f. Excellent interpersonal, writing, and communication skills, ability to work in English and Somali is essential. g. Knowledge of local dynamics is an advantage

13 SUIPP PIU-BRA Monitoring & Evaluation Specialist The MEO will be responsible for overall Monitoring and Evaluation of the Project. This will include monitoring the physical and financial progress of the Project. In addition, the MEO shall be responsible for managing the Project s overall Monitoring and Evaluation Framework to ensure that the Project is on track to meeting its development objectives, its expected outputs and outcomes and it intended beneficiaries. The MEO will work in close consultation and coordination with the Engineer, the Financial Officer, Project Officers and the Bank s Independent Monitoring Agent. Results based M&E will follow a methodology for measuring and monitoring results, as well as for review. The baseline for measuring results under the SFF-LD will be validated within six months of appraisal; responsibility will rest with the PCU complemented by close Bank support. A results framework and monitoring matrix to track inputs, outputs, and outcomes has been developed for the project with intermediate and key performance indicators (See PAD, Annex 1). Project implementation progress will be monitored continuously, and outputs and outcomes will be reviewed during project supervision to evaluate progress using data compiled by the PCU. M&E will measure individual project performance according to results framework targets and provide quarterly activity reports, targeting both the management of contractors as well as external stakeholders. A baseline, annual beneficiary surveys to measure who and to what extent people benefit from the infrastructure and services as well as how it affects their lives in both social and economic terms, an end-line survey, an end term review and final implementation completion report will be completed. In view of the BRA-SUIPP s nature and the strategic importance of scaling up its activities to other areas in Somalia, the M&E system would target the identification of lessons to be applied to the design of follow up projects. The Bank team will provide technical support to the PCU as needed to carry-out its duties and responsibilities towards this project. 2. Scope of Work The MEO shall be responsible to: Validate the baseline measurements of the M&E matrix included in the Project Appraisal Document and agreed between the Government and the World Bank. Provide technical inputs on monitoring and evaluation parameters to improve planning, programming and implementation of project. Liaise closely with the Bank s M&E counterpart. Contribute to the Quarterly report regarding M&E. Ensure that the Annual Work Plan reflects the goals of the Results Monitoring Matrix as agreed between BRA and the World Bank. Develop in-depth knowledge of monitoring and evaluation system of capacity development operations to guide performance tracking activities of staff with M&E responsibilities in project beneficiary Regional Administrations and key stakeholders Assist in defining monitoring and evaluation requirements at the different levels of project implementation Conduct analysis of monitoring data, documents findings from monitoring and evaluation activities and submits monitoring reports to the PIU Coordinator. Work closely with the World Bank, Monitoring Agent, SUIPP Specialists and project/subproject stakeholders to ensure that data collected for purposes of performance evaluation is credible and of high quality. Produce reports in English and /or Somali as required.

14 3. Period of Performance The SUIPP Project is expected to begin 01 June 2016 and close 30 June The PC contract will be for approximately 4.5 months on a part-time basis. Follow on implementation of SUDP is planned and the PC contract is eligible for possible extension. 4. Qualifications The Project MEO should have demonstrable experience in activities as follows: Masters Degree or equivalent experience in Project management, International Relations, or community Development. A minimum of 5 year professional experience in M&E related function. Strong analytical skills. Monitoring and evaluation of plans and programs Strong orientation and knowledge in establishing baseline measurements for results monitoring. Good report writing and presentation skills. Ability to communicate effectively. Ability to see and manage risks and consequences. Functions effectively in a team of professionals Experience in working in development projects within the Civil Service, and good knowledge of Public Sector issues. Project management experience. Experience working in a fragile environment will be an advantage. 15 SUIPP Admin & Finance Officer Administrative & Finance Officer s responsibility includes providing support to ensure efficient operation of the office. You will support managers and employees through a variety of tasks related to organization and communications. The admin job scope includes communicating & ensuring that all administrative assistant duties are completed accurately and delivered with high quality and in a timely manner. Provide a complete finance service to the whole of the Project, addressing all issues of a finance nature and providing all relevant information to meet external demands. Principal Duties/Tasks and responsibilities Work closely with the Finance department to ensure smooth operation of all finance matters Support the Finance Manager by inputting into ledgers from source documents Input accounting data into the accounting system with speed and accuracy Assist in the production of financial statements and applications, preparation of spreadsheets, reports and correspondence as required Provide financial support to team members Any other duties that may be deemed appropriate to this role Monitor compliance to applicable codes, practices, performance standards and specifications Interact daily with the clients to interpret their needs and requirements and represent them in the field Perform overall quality control of the work (budget, schedule, plans, and personnel s performance) and report regularly on project status Assign responsibilities and mentor project team Cooperate and communicate effectively with project manager and other project participants to provide assistance and technical support Review engineering deliverables and initiate appropriate corrective actions 3.
