4 1 INTRODUCTION AND INTERPRETATION 1.1 Introduction These Course Regulations apply to all students enrolled in the Bachelor of Laws/Bachelor of Human Resource Management Award and the Award at The University of Notre Dame Australia. These Regulations should be read in conjunction with the University s General Regulations and the School of Law and the School of Business Regulations. 1.2 Interpretation The terms included in these Regulations have the meanings as defined in the University s General Regulations and the School of Law and the School of Business Regulations. 1.3 Amendments made to Course Regulations Unless otherwise specified, when amendments are made to the structure, content or academic requirements of these Awards, the amendments will automatically apply in accordance with General Regulation Section Applicability to Campuses of the University These Awards are available on the Fremantle and Sydney Campuses. 1.5 The Australian Qualifications Framework (AQF) The Bachelor of Laws Award is a Level 7 AQF qualification. The Bachelor of Human Resource Management Award is a Level 7 AQF qualification. The Bachelor of Laws (Honours) Award is a Level 8 AQF qualification. 5 2 ENTRY CRITERIA 2.1 General Criteria The standard entry requirements for admission into these Awards are detailed in the University s General Regulations and the School of Law and School of Business Regulations. 2.2 Additional Entry Requirements / Pre-Requisites There are no additional entry requirements or pre-requisites for these Awards. 2.3 External Accreditation Requirements External accreditation requirements are applicable to the Bachelor of Laws component of these Awards. The accreditation requirements are according to the Uniform Admission Rules administered by the Legal Practice Board in the relevant jurisdiction, that is, Western Australia and New South Wales. 6 3 AWARD REQUIREMENTS 3.1 Structure (i) For the Bachelor of Laws/Bachelor of Human Resource Management Award Structure, refer to Appendix A. (ii) For the Award Structure, refer to Appendix B. (iii) For the Human Resource Management component of these Awards, refer to Appendix C. Unless a student receives the prior approval of the Dean (or delegate) to alter the order of study, students are required to enrol in and pass all of the units in each academic year of study as detailed in the relevant course structure before they will be permitted to enrol in units outlined in the subsequent academic year of study Compulsory s (i) Compulsory units for these Awards are listed in the course structure in Appendices A - C. (i) For the Award students must enrol in LW441 Advanced Research Project in Semester 1 and Semester 2 of their final full year of academic study. (ii) Students are required to complete no less than 400 credit points of compulsory Human Resource Management units comprising: credit points from the Business Foundation Program: BS100 BS103 BS106 BS110 BS122 BS160 BS390 Economics Quantitative Methods for Business Business Information Technology Accounting (Fremantle) OR BS111 Accounting for Business (Sydney) Principles of Marketing Principles of Management Business Internship 2. 2 credit points from the following Business Human Resource Management units: BS266 BS273 BS314 BS368 BS370 BS374 BS375 CN329 PS264 Employment Relations Principles of Human Resource Management Human Resource Development Change Management Human Resource Policy Strategic Workforce Issues Organisational Development Mediation and Dispute Resolution Psychology of Work Elective s There are Elective unit(s) within these Awards. (i) Students enrolled in the Bachelor of Laws/Bachelor of Human Resource Management Award are required to complete six (6) Law elective units in addition to the compulsory Law units. Elective units may be selected from an approved list of unit offerings published by the School of Law on an annual basis. Bachelor of Laws/Bachelor of Human Resource Management PAGE 6
7 (ii) Students enrolled in the Award are required to complete four (4) Law elective units in addition to the compulsory Law units. Elective units may be selected from an approved list of unit offerings published by the School of Law on an annual basis. There are no Elective units permitted within the Bachelor of Human Resource Management component of the Award Majors and Double Majors There are no Majors or Double Majors available in these Awards Minors There are no Minors available in these Awards Specialisations There are no Specialisations permitted in these Awards Special Interest s There are no Special Interest s in these Awards. 3.2 Special Award Requirements There are no special award requirements in these Awards. 3.3 Practicum or Internship requirements Students are required to complete BS390 Business Internship within the Bachelor of Human Resource Management component of these Awards. 3.4 Approved unit substitutions Law unit substitutions, where permitted, must be approved by the Dean of Law. Human Resource Management unit substitutions, where permitted, must be approved by the Dean of Business. 3.5 Alternative Pathways An Alternative pathway is not available for these Awards. 3.6 Volume of Learning Standard Duration (i) The Volume of Learning for the Bachelor of Laws/Bachelor of Human Resource Management Award and the Award is approximately 6.2 years of equivalent full time study. (ii) A student is able to enrol in these Awards on a part-time basis Accelerated Duration An accelerated mode is available for these Awards as outlined in the Appendices of these Regulations Maximum Duration The maximum period of time within which a student is permitted to complete these Awards is detailed in the University s General Regulations. 8 3.7 Graduation Where a student has satisfied all the requirements of these Awards as detailed in these Course Regulations and the General Regulations, the University may grant the student graduation status. 3.8 Exit Awards An Exit Award pathway is not available for these Awards. 3.9 Honours The Bachelor of Human Resource Management component of the Double Degree Award is not offered with Honours The Bachelor of Laws component of the Double Degree Award is offered with Honours. These regulations should be read in conjunction with the Policy: The Award of a degree with Honours Honours in the Law Component of these Awards General Definitions "Eligible Student" is a student who has satisfied the criteria for being invited into the Honours program set out in Regulation (iv). "Graduating Class" means the body of students who, as at 1 November, are enrolled in one or more of the units listed below for the following academic year: (a) LW462 Alternative Dispute Resolution; and (b) LW464 Civil Procedure B or LW464.1 Civil Procedure B. "Honours Cohort" means Eligible Students who are participating in the Honours program. "Honours Committee" means the Dean, the Honours Co-ordinator(s) and the Assistant Dean(s). "Eligible s" are all Law units, with the exception of: (a) LW104 Ethics and the Law; (b) grades for units assessed on a Non-Graded Pass (Pass/Fail) basis; (c) units that are studied on a cross-institutional basis; and (d) general credit advanced standing. "Honours Calculation Average" means, for a given student, the sum of the Honours for each of that student's Eligible s divided by the number of Eligible s. When calculating the sum of the Honours and the number of Eligible s LW441 Advanced Research Project will be counted as four (4) Eligible s. "Honours " means, for an Eligible, the points set out in the following scale: (a) a grade of HD is worth 6 Honours ; (b) a grade of D is worth 4 Honours ; (c) a grade of C is worth 2 Honours ; (d) a grade of P is worth 0 Honours ; (e) a grade of F is worth -2 Honours ; and (f) a grade of FN and WF is worth -2 Honours Honours Calculation Average The Honours Calculation Average for a given student in the Graduating Class is to be determined as follows: Step 1 - Calculate the Honours for each of the Eligible s for which that student has been awarded a grade. 9 Step 2 - Calculate the Honours Calculation Average for that student Admission to the Honours Program in Law (i) Admission to the Law Honours program is by invitation only (in accordance with School procedures) and is subject to approval by the Dean in consultation with the Honours Committee. (ii) A student who is enrolled in the Award part-time may enrol in the Honours program with the Dean s approval. (iii) The Law Honours program cannot be completed part-time Selection Criteria (i) The Honours Co-ordinator, in consultation with the Dean, will determine at the end of each academic year, the eligibility of the members of the Graduating Class to participate in the Honours program for the following academic year. (ii) Subject to Regulation (v), the academic performance of a student will be the sole basis for determining whether a student is eligible to participate in the Honours program, and that academic performance will be judged according to the Honours principles detailed in this Regulation. (iii) The eligibility of a student for participation in the Honours program will not be considered unless and until they have completed or are enrolled in both LW462 Alternative Dispute Resolution and LW464 Civil Procedure B. (iv) To be eligible to participate in the Honours program a student must: (a) have obtained a minimum Honours Calculation Average of 3 over the course of their Bachelor of Laws/Bachelor of Human Resource Management Award; and (b) using the Honours Calculation Average, fall within the top 20% of the Graduating Class. (v) The Dean, in consultation with the Honours Committee, will invite those students who are eligible to participate in the Honours program to apply to enter the program. In deciding whether an eligible student can participate in the Honours program, the Dean may, in consultation with the Honours Committee, take into account matters such as academic performance and School of Law resources. No student will be deemed to be enrolled in the Honours program until the Dean (and/or his or her delegate) has formally accepted that student's application in writing. (vi) The Dean s decision on eligibility for entry into the Honours program is final Deferral of Participation in the Honours Program (i) An Eligible Student who has been invited to enter the Honours program may apply to the Dean in writing to defer their participation in the Honours program. (ii) In considering whether to grant the deferral, the Dean must consult with the Honours Committee and may take into account the academic performance of the student, the grounds for the deferral and any other matters that the Dean considers relevant. (iii) The Dean will advise the Eligible Student in writing as to whether their application to defer their participation in the Honours program has been successful. (iv) The Dean's decision as to whether or not to grant the deferral is final. (v) If the Dean approves the deferral then: (a) to determine whether the student falls within the top 20% of the graduating class,the student is deemed to be a part of the Graduating Class which they were a part of when they were invited into the Honours program; and Bachelor of Laws/Bachelor of Human Resource Management PAGE 9
10 (b) to determine the final grade and mark for their performance in LW441 in accordance with Regulation (v), the student is deemed to be a part of the Honours Cohort for the year in which they complete LW Eligibility for Award of Honours (i) If an Eligible Student is accepted into the Honours program, the student must successfully complete the unit of LW441 Advanced Research Project which is a substitute for and the equivalent of two Law electives. In completing this unit the student is required to undertake legal research upon a topic approved by the Dean (or delegate) and to present the results of that research in a word research paper ( the thesis ). (ii) A principal supervisor must be appointed to oversee the research undertaken in fulfilling the requirements of LW441. A co-supervisor may also be appointed. (iii) There will be a minimum of two readers of the thesis, one of whom must produce a formal examination report to the Dean (or delegate). The other reader must be the principal supervisor or co-supervisor of the paper and must confer with the examiner on the production of the final report. (iv) Neither the principal supervisor nor any co-supervisor may be appointed as the examiner of the thesis. (v) The student will be awarded a final grade and mark for their performance in LW441. (vi) To be eligible for the award of Honours, at the completion of the final year of their Bachelor of Laws/Bachelor of Human Resource Management Award, a student must have maintained an Honours Calculation Average of at least 3 throughout this Award. A student who has not maintained an Honours Calculation Average of 3 may nonetheless graduate with a Bachelor of Laws/Bachelor of Human Resource Management Award provided they have satisfied the academic requirements of the Award. (vii) The Class of Honours for each student will be determined by the Board of Examiners upon recommendation by the Honours Co-ordinator. The Honours Co-ordinator s recommendation will be made after consultation with the Dean (and/or his or her delegate) and the Honours Committee, and will be based on a comparative analysis of the Honours Calculation Average and theses of the students participating in the Honours program Examination of Honours Research Component Examination of the Honours research component is detailed in the LW441 Advanced Research Project Thesis Marking Guide/Examiners Report Awarding Honours Honours within the Bachelor of Laws component of these Awards is in accordance Regulation (vii) with the General Regulations as graded Honours.
