2 Divided into two separately bookable seminars, the Annual Alternative Dispute Resolution (ADR) Conference explores challenges faced by lawyers who change hats; ADR in the mining, sugar and insurance industries; mediation in public sectors including tax and defence; family law; arbitration and ethical issues in ADR. Program Tuesday 17 July am 8.55am Registration MORNING SEMINAR 8.55am 9.00am Welcome remarks 9.00am 9.30am Opening address Speaker: The Honourable Attorney General Jarrod Bleijie 9.30am 10.15am Challenges for lawyers who change hats In the context of lawyers who change hats to mediate or negotiate, there are skills and qualities beyond legal training that need to be acquired. The speaker will explore essential mediation and negotiation skills that usurp adversarial traits of lawyers who are used to fighting their client s case; effective communication as opposed to legal opinion; and the generation of options and solutions as opposed to adhering to rigid legal principles. How are disputes managed in the mining sector? What is the process involved for the engagement of mediators in the mining and primary industries? Covering these questions, this session focuses on mediation processes and practices. A lawyer with mediation experience in dealing with public sector related disputes will join the panel to discuss their experience and offer tips. The session will be followed by a panel discussion. Speaker: Robert Wensley QC, Barrister, Queensland Bar Chair: Khory McCormick, Partner, Minter Ellison and Chair, Queensland Law Society Alternative Dispute Resolution Section 2.45pm 3.15pm Afternoon tea 3.15pm 4.15pm Ethical issues and ADR As ethical framework for the legal profession continues to evolve, a range of ethical issues such as confidentiality, conflict of interests and disclosure arising in ADR practice requires a closer look. Against the background of the current National Mediator Accreditation System s approach to standards and ethical issues, this session focuses on ethical dilemmas arising in the context of mediation practice. 4 4.15pm 5.00pm The role ADR plays in native title; an Indigenous service provider perspective 3 June 2012 marks the twentieth anniversary of the historic High Court judgment in Mabo (no. 2.). This presentation examines the importance of ADR in an evolving jurisprudence involving multi-party proceedings attempting to reconcile diverse, longstanding interests. The paper will provide a brief overview of the complex legal, social and historical issues associated with the resolution of native title matters; the various institutions that have a statutory ADR role to perform; and the unique challenges that beset inter and intra-indigenous dispute resolution. Located in the heart of the business district close to hotels and transport. Registration Registration is on Level 2 and all sessions will be held in the Auditorium.
