1 Town of Fairlee Selectboard Meeting Monday January 28, :00pm Present: Board Members: Mary Daly; Chair, Frank J. Barrett, Jr., David Colby Town Administrator: Laurent J. Veilleux Visitors: Melissa Gahagan, Georgette Ludwig, Noёl Walker, Cicely Richardson, Leon C. Marsh, Jr. Call to Order: 6:02 pm Chair; Mary Daly called the meeting to order. Minutes Review: 6:02 6:10 pm Minutes reviewed from January 7, 2013 and January 14, MOTION: Jay Barrett/David Colby (Moved/Seconded), to approve minutes from January 7, 2013 with changes and January 14, 2013 as presented. All members present: Mary Daly, Jay Barrett, David Colby voted unanimously in favor. MOTION PASSED. Town Administrator Report: 6:10 6:25 pm Administrative Activities: Sent Minutes for December 3, December 10, and December 17, 2012 to the Journal Opinion for publishing. Posted Minutes to Home Web Page and Cohase Chamber of Commerce through Dec 17 th. Prepared Bid Solicitation for the Town Hall water damage repair. Discussed the date the bid proposals should be submitted for review. Office Staff Report: Town Clerk and Treasurer will attend a Wellness Workshop in Montpelier Jan 31 st. Highway/Road Agent Report: Conducted winter plowing. Police Report: Requested contracts for the State Police and Orange County Sheriff s Dept based on split Police Budget Received the Sheriff s Dept contract proposal State Police indicated no contract proposal to be submitted due to amount in the budget ear marked Discussion to be held later in the meeting. Beach/Recreation Report: Community Calendars are now available at the Town Clerk s office. Price is $10.00 per copy. 1

2 Correspondence: Town of Lyme correspondence regarding the Wilder Dam presented to the Selectboard. Delinquent Tax report presented to the Selectboard. Miscellaneous: Received approval for the Town of Fairlee membership to the Central VT Solid Waste Management District. Membership approval by the Town voters added as an Article in the Town Meeting Warning. Public Discussion: 6:25 7:40 pm Town Hall Water Damage Scope of Work & Bid Solicitation A preliminary Appraisers Report from Colonial Adjustment, Inc. submitted for discussion and review. There was extensive conversation regarding the needs of the Town Hall building and considerations regarding the current materials and the possible affect repairs may have on the Historical Registry procedure currently in progress. Further discussion on the Town Hall and the water damage continued. There was extensive discussion regarding the scope of work necessary, timeline, and the bid solicitation procedure. Leet Ware: Asked if anyone had asked the adjuster whether or not, in his appraisal, he had considered any hazardous materials in the building which may need to be addressed. There was also discussion regarding the fire sprinkler system. Tim Danen: Asked the Selectboard to consider all information being provided. Jay Barrett: Said that Leet has shown interest in the project and working together with Tim Danen. Leet Ware: Stated that the Town needs to have a definite level of comfort in the contractor chosen to consider all needs of the building. Noёl Walker: Stated the Town Clerk s vault is a concern and needs to be taken into consideration. Jay Barrett: Mentioned the roof repairs that still needed to be taken care of and the structural support also necessary. Asked that while the ceilings were being opened up, if this would be the right time to do necessary repairs and save from having to open up the roof again in a few years. Jay also stated that a list needed to be created of the expenses that could be taken care of now. David Colby: Said that in the end, someone had to be hired to oversee the Town Hall project. Jay Barrett: Stated that whoever was decided on for doing the repairs, needed to have strong managerial skills. David Colby: Stated that until they get into the floors, it cannot be determined if damage extends to the electrical in the floors or walls. Jay Barrett: Felt that what was in the adjuster s report was a good start. 2

3 Georgette Ludwig: Asked Jay about the historical listing of the building and whether it would impact the status of the ongoing project. Jay Barrett: Told Georgette that it is being considered and wants to make sure that any repair work does not compromise the historical integrity of the building. MOTION: Jay Barrett/David Colby (Moved/Seconded), to adjourn further discussion regarding repairs until more research and the final Appraisal Report is available next week. Continuation of the discussion will also give Tim Danen and Leet Ware time to gather information regarding the materials and determine the best approach for the repair work. All members present: Mary Daly, Jay Barrett, David Colby voted unanimously in favor. MOTION PASSED. Articles for Town Meeting Warning Discussion and Approval: 7:40 7:50 pm Annual Town Meeting Warning presented for review. Revised the wording in Article 10. MOTION: Jay Barrett/David Colby (Moved/Seconded) to revise Article 10 in the Warning to read: Shall the voters of the Town of Fairlee appropriate a sum of money for improvements to the Town Hall which are not part of the insurance claim while the building is being repaired from the water damage? All board members present: Mary Daly, Jay Barrett, David Colby voted unanimously in favor. MOTION PASSED. Police Services Discussion: 7:50 8:15pm There was discussion regarding the decision made to split the Police Budget with $22,000 going to the Sheriff s Department contract and $6,000 going to a contract with the Vermont State Police. Laurent had spoken with Lieutenant Robinson regarding the Town s decision and he displayed disappointment with the decision and would not be submitting a contract proposal. Jay Barrett: Stated that the Town of Fairlee was very happy with the services from the State Police and hoped that they could come to an agreement and have both departments police the Town. Lee Marsh: Stated that there is a strong need to have a contract with both departments and that it was important to maintain a relationship with the State Police. Jay Barrett: Thanked Lee for his input and said that he felt Lee was correct. Jay also stated that he would like to see the Police budget more evenly distributed between the two departments. Lee Marsh: Hoped that the Board would consider working together with the State Police. Mary Daly: Stated that she will contact Lieutenant Robinson this week to see if there is anything that could be done to maintain a contract with the State Police. 3

4 MOTION: David Colby/Jay Barrett (Moved/Seconded) to open previous discussion voted upon at the January 14, 2013 Selectboard meeting for possible renegotiating the previous motion passed regarding the distributed contract amounts. All board members present: Mary Daly, Jay Barrett, David Colby voted unanimously in favor. MOTION PASSED. MOTION: Jay Barrett/David Colby (Moved/Seconded) to allow the Selectboard Chair to sign all Excess Weight Permits as presented. All members present: Mary Daly, Jay Barrett, David Colby voted unanimously in favor. MOTION PASSED. Town Officer Positions & Other Town Position Vacancies Discussion: 8:15 8:25 pm Discussed all Town Officer positions up for election and other positions that are vacant: Selectboard Member, for one year. Selectboard Member, for three years First Constable, for one year Collector of Delinquent Taxes, for one year Lister, for three years Auditor, for three years Budget Committee Member for one year Budget Committee Member, for three years Planning Commission Member, for two years Planning Commission Member, for four years Planning Commission Member, for four years Cemetery Commissioner, for five years Grand Juror, for one year Grand Juror, for one year Town Agent to Prosecute, for one year Library Trustee, for four years Library Trustee, for five years Recreation Council Member, for two years Recreation Council Member, for three years Recreation Council Member for four years Recreation Council Member for five years These positions will be posted for interested parties and are listed in the Annual Town Meeting Warning. Discussion: 8:25 8:39 pm Vermont Clerks and Treasurers Association Donation Georgette Ludwig: As a member of the Vermont Clerks and Treasurers Association, asked the Selectboard to consider a donation of $50.00 to be put towards the association s hired lobbyist who aids in the legislative decisions that help Vermont Town Clerks and Treasurers. 4

5 MOTION: Jay Barrett/David Colby (Moved/Seconded), to approve a donation to the Vermont Clerks and Treasurers Association in the amount of $50.00 to support the efforts of the hired lobbyist for the association. All members present: Mary Daly, Jay Barrett, David Colby voted unanimously in favor. MOTION PASSED. Town Hall Maintainance Mary Daly: Said that Roger Carpenter came over to the Town Hall and looked at the heat ducts. Mary asked Roger if he was interested in looking at the heating system. There was discussion regarding Dead River Co. and the maintenance they provide for the heating system. Tax Appeals Noёl Walker: Stated that due to the State of Vermont board appeal decisions, the Tax Rate could be affected by 1cent. MOTION: David Colby/Jay Barrett (Moved/Seconded) to approve a note which is to be added to the Town Summary Report explaining that the Tax Rate may increase due to the appealed appraisals. All members present: Mary Daly, Jay Barrett, David Colby voted unanimously in favor. MOTION PASSED. Jay Barrett: Stated that the Tri-Town Committee will be meeting on the 14 th of February, 2013 at the Emergency Services Building Training Room. Public Comment: None Adjourn Meeting: 8:39 pm Motion to adjourn. MOTION: David Colby/Jay Barrett (Moved/Seconded) to adjourn the meeting.
