1 GENERAL INFORMATION Since its creation in 2011, fotofever has welcomed over 250 galleries. Praised for its human scale, welcoming atmosphere and commitment to emerging talents in photography: fotofever is the major event to discover the players of tomorrow s artistic scene! The fifth edition of fotofever will take place at Carrousel du Louvre from 11 to 13 November, The opening will take place, Thursday 10, To celebrate its fifth anniversary, fotofever will launch some new initiatives: A newly designed floor plan, improving visibility and access to all booths Focus, a category supporting emerging French and international galleries Solo, showcasing five solo shows selected by fotofever s artistic director and presented in a dedicated area at the fair entrance Access to an extended and reinforced international VIP network Collaboration with corporate partners sharing our passion for art and eager to promote it All applications for fotofever must be filled out online at Application deadline: May 5, 2016 A 300 (incl. tax) non-refundable application fee is due for each applicant. It must be paid online. 3 SOLO To encourage solo presentations fotofever offers a 10% discount* to any galleries choosing to present a solo show. In addition, five solo projects will be selected by fotofever s artistic director and exhibited in a dedicated area right at the fair entrance. FOCUS T INFO Focus embodies fotofever s commitment to the most promising new galleries representing photography. Five galleries are to be selected by fotofever s artistic director based on the quality of their exhibition program and the project submitted specifically to 2016 edition of fotofever, and located in a dedicated area within the fair. These galleries will benefit from a 20% discount* on the total invoice. 4 SELECTION SELECTION PROCESS AND ATTRIBUTIONS Only the galleries selected by the artistic direction can take part in fotofever 2016 (artists and agents will not be considered) Only artists selected by the artistic direction can be exhibited at fotofever 2016 Only artworks produced in a maximum of 30 editions (all formats) can be exhibited If your application is validated by the artistic direction, you will be notified of your booth attribution and its location. Every effort will be made to satisfy your initial request. However, owing to availability and technical constraints, inability to satisfy a special request of stand surface area and/or stand location for whatever reason, does not grant you the right to cancel your participation nor obtain any price reduction or compensation of any kind. 6 REGULATION, TERMS AND CONDITIONS CY ART FOTOFEVER 5, rue de Charonne Paris ARTICLE 1 APPLICATION OF THIS REGULATION Applying constitutes a final and binding agreement to pay the full amount of the exhibition space and associated costs. The exhibitor agrees to fully and unconditionally comply with the clauses of the regulations. The organiser reserves the right to rule on any cases not covered by these rules and to add new provisions whenever it deems this necessary for the smooth operation of the show. The voidance, for any reason whatsoever, of all or part of one of the provisions of these rules shall not affect in any manner the other provisions thereof. ARTICLE 2 EVENT AND ORGANIZER fotofever paris 11 > 13 nov 2016 I Carrousel du Louvre with an opening November 10, Artistic and commercial international photography exhibition. The terms of organization for fotofever (opening date, duration, location, opening hours, visitors fees ) are determined by the organizer and can be changed at his convenience. ARTICLE 3 TERMS OF PAYMENT Any missing or incomplete payments of one of the terms at the stated dates gives full right, starting from the day after the date marked on the bill, to the application of a fee equaling twice the current rate for the allotted sums. If the exhibitor cancels his participation or declares rescission or cancellation of the agreement after having been admitted, he bears the cancellation fees as follows: 35% if the cancellation happens by june 27th, % if the cancellation happens by july 25th, % if the cancellation happens by august 14th, % if the cancellation happens after september 1st, 2016 ARTICLE 4 PHOTOGRAPHY AND IMAGES The fair management is entitled to authorize staff to make video recordings and photographs of fair booths and exhibits and to use the resulting material for its advertising purposes (catalogue, poster, internet, social media, press release, advertising). The exhibitor waives all objections arising from his rights of ownership and rights of use at all time, without restriction. Other people require specific written permission from the fair management for recordings of any kind. ARTICLE 5 SET UP AND DISMANTLING The exhibitor will receive in advance the exhibitor manual stating the instructions to be followed. Any stand remaining vacant before the beginning of the event and for which the exhibitor did not mention a late arrival will be used by the organizer at the exhibitor s expenses or will be allocated to someone else in order to fit harmoniously in the fair. If the exhibitor dismantles his stand before the end of the exhibition, the organizer is entitled to charge a contractual fine of 900. ARTICLE 6 EXHIBITORS 5 exhibitor badges are distributed by the organizer during the set-up. exhibitors with pending payment by November, 2016 will not be allowed to access the fair. Wearing the badge is mandatory to enter and circulate in the venues of the event. each stand must be occupied at all times during opening hours, during the duration of the fair. The exhibitors are forbidden to sell, sub-rent or share their stand with someone else, against payment or for free. Any advertising outside of the rented space is forbidden. The cleaning of the common area and of the corridors is provided by the organizer. The exhibitor is responsible for the cleaning and tidying of his stand every day. Animals are not admitted to the exhibition. The only exceptions are guide dogs for disabled persons and for the blind and service dogs. The fair organizer cannot be held liable, in no circumstances, for damage caused by the exhibitor s delay in submitting order forms or failure to submit those forms (incorrect entry in the exhibitors catalogue, incomplete furniture during the set up ). ARTICLE 7 INSURANCE AND LIABILITIES The fair management subscribes to an organizer s insurance which does not cover the works of art and objects by the exhibitor during the fair. The exhibitors must make sure that they are fully covered by insurance on his booth and elsewhere within the fair and at all time on all risks on their property, exhibits or articles, public/civil liability and comprehensive protection against any loss and damage caused by any circumstances whatsoever. The exhibitor shall provide proof to the organizer that the exhibitor has the adequate insurances. FOTOFEVER ART FAIR I paris@fotofeverartfair.com I

7 ARTICLE 8 DATA PROTECTION Data specified by the exhibitor will be recorded and saved in the database of CY ART. CY ART will use the data, including company details, for the purpose of organizing the events. CY ART will share the personal details with third parties if necessary and only to the extent of fulfilling the agreement between the exhibitor and CY ART. The mailing address, address and company details will serve the purpose of keeping the exhibitor informed about forthcoming events by CY ART. It is possible to withdraw consent to the promotional use of the data at any time. ARTICLE 9 FORCE MAJEURE In case of force majeure or in case that, for any unpredictable reason, the event could not take place, the application forms will be cancelled and the available funds, after payment of all due expenses, will be distributed between the exhibitors to a prorata of the sums paid by each of them. Exhibitors commit to follow and to apply the terms and conditions of the event as internal regulation. ARTICLE 10 CLAIMS In case of a disagreement regarding the interpretation or the application of the terms and conditions, the organizer and the exhibitors will look, before engaging in any legal procedure, for an amicable settlement and will exchange all the information needed at this purpose. If an amicable settlement is not reached within 15 days, the only competent authority will be the tribunal de commerce de Paris.
