3 Company Profile DYNAMARINe is dedicated to provide high quality consultancy services to the maritime community. It has services associated with technical studies, statutory compliance issues, condition surveys and risk management and has the experience to undertake specialized and innovative projects, supported also with a strong in-house software developing team. The company is based in Greece and currently comprises of a staff of eight persons. Both directors, Alexandros Glykas and Stelios Perissakis, are Naval Architects and Marine Engineers. Alexandros holds a PhD in ship structures and Stelios holds a PhD in experimental marine hydrodynamics. Both have been engaged in the maritime industry and several research projects for more than 15 years. DYNAMARINe team has experience in Ship Management of General Cargoes and Tanker Vessels. It offers a wide range of services on a consultancy basis such as vessel inspections, valuations, physical auditing etc. A strong asset of the company is the development of customised software for various maritime organisations. 4 ONLINESTS.NET SERVICE OnlineSTS.net is a suite of services and tools, addressed to tanker operators and oil cargo traders, related with the Ship to Ship transfer operations. The concept of these services and tools is to help users to estimate the involved risk, to act with due diligence and to follow prudent policies and procedures. Tasks like the clearance of nominated vessels, vessels compatibility analysis, quality assurance of STS Service Providers, record keeping and assessment of records can be successfully performed within the available timeframe and with minimum administration burden. The proposed methodologies take into account the commercial aspects of STS as well as the contractual obligations of ship owners according to their charter parties Additionally, onlinests.net includes an information system (OSIS), which supports the recordkeeping and assessment of records in a way that for each company, the developed knowledge, related with the STS operations, become available in a friendly and easy access format to the personnel and remains as an asset of the organization. Changes in STS operations after IMO MEPC 186(59) The ratification of the IMO MEPC 186(59) initiated a substantial impact to the liability burden on behalf of Ship Owners. Although STS transfers have proven to be safe, tanker operators bare all liability associated with the technical and safety issues through their policies and procedures described in the STS Plan. The Manual on Oil Pollution and the latest OCIMF guidelines, published after the ratification of the regulation, describe a number of quality criteria for all involved parties, which should be assessed from tanker operators, who bear the final responsibility of Safety. In order for tanker operators to be statutory compliant as well as in line with their insurance policies and at the same time in line with charterers commercial interests, the following actions have to be adopted: 1. On Charterers clearance request for a nominated vessel, their respond has to be based on justified policies and recorded diligently actions Appointed STS Service provider and POAC, have to be assessed regarding their ability to offer services in the expected level of quality. According to paragraph of Manual on Oil Pollution section I, the ship owner has to agree on the nominated POAC, whose qualifications are clearly described. 3. On the basis of charter parties, STS Operations are conducted at Masters final discretion and final approval; however they have not the right to unreasonably withhold the operation. Thus master should be well informed, in order to evaluate all possible technical risks that may endanger the STS Operation. 1 It worth mentioning a court award on a related case (Falkonera 20/12/2012)
5 4. Records of STS Operations have to be retained for 3 years. Since the STS Plan is part of the ISM system, those records have to be assessed and evaluated. Keeping records without assessing them is not a prudent practice and against the continuously improvement concept of the TMSA. During TMSA audits, the presentation of prudent and diligently policies and procedures, also in STS operations, improves the reputation of the tanker operator and provide assurance also for the reputation of the charterer and Cargo owner. 6 Description of the onlinests.net and the Screening Service FACTS: Ship owners are requested to clear participating vessels for STS operations STS operations are conducted at Masters final approval STS operations ought to take place according to policies and procedures (STS Plan, MEPC 186(59), OCIMF) Person in Overall Advisory Control has to be qualified (Oil Pollution Manual) Masters and Ship-owners bear the liability to ensure safety Commercial interest and charter parties obligations shall be taken into account. CONCEPT: Due dilligence to the best possible extent BENEFITS FOR TANKER OPERATORS The benefits for tanker operators are the following: DUE DILIGENCE + FIRM STS POLICIES + CLEARANCE ACCELERATION + TECHNICAL SUPPORT TO THE MASTER ON EACH STS + MINIMIZATION OF WORKLOAD TO SHORE PERSONNEL + POSITIVE FEEDBACK IN TMSA AUDITS & SHIP VETTING + COMMERCIAL ADVANTAGE ONLINESTS.NET offers functional assessment tools of all STS elements and participating parties (ships, STS service providers, POACs, etc) that are nominated by charterers to ship owners. Thus
7 owners may exercise their due diligence to the best extend and conditionally or unconditionally accept the participating vessels for the STS Operations. Furthermore useful tools and consultancy services are offered towards the masters of the vessels and the shore operators throughout the STS Operation from the clearance process up to the final assessment and extract of KPI s. Basic principal of the service is our rapid response time since in most cases, ship owners are provided with limited time to revert with their clearance. PARTICIPATING VESSEL CLEARANCE Clients of onlinests.net have to provide us with all their fleet Q88 or VPQ in advance in order to register them in our system. This is the only information we require for your vessels. All STS Screening enquires are being ed to dedicated addresses monitored 24X7. For Participating Vessel clearance and risk assessment the following documents are usually requested: 1. Updated last version of Q88 or VPQ 2. Recent class status report 3. P&I Entry certificate 4. IOPP Form B or approved STS plan STEP 1. CONFIRMATION OF RECEIPT Within 5 minutes after your request we revert with our confirmation of receipt. This means that we have commenced the process of preparing the screening report. THE CLEARANCE REPORT Within 25 minutes after your request we revert with our clearance report on the basis of Managers Policies. We call this report, PART A 2 and refer to evaluation of Ship Owners Policies. After receipt of PART A, you may identify if the participating vessel meets your policies and proceed with your clearance decision to your charterers. RISK ASSESSMENT ON STS ELEMENTS After the vessels have been cleared from the operators and the STS operation has been agreed, part B is forwarded directly to the master or to the shore operator with more detailed comments and technical advice for the specific STS operation. Part B includes detailed technical information as well as statistics from the STS location, associated with past vessels performance, major and minor reported incidents etc. In this way, the Master, assesses the risk on the basis of actual statistical data from OSIS. ASSESSMENT OF THE STS OPERATION RECORD KEEPING After completion of the STS Operation we receive from your Master the assessment of the Participating Vessel and other associated STS elements. Currently the assessment file is in Excel 2 PART A Report Sample is attached as a separate file
8 format which is being ed to all your fleet that participates in the service. Key points of the assessments are the following: 1. The assessment is being completed with 5 minutes by the Master or Chief Officer 2. The assessments are logged into OSIS Database automatically. 3. The assessments belong to the Client 4. No assessments are being released to third parties. 5. The assessments are necessary as per statutory requirements as per paragraph A The assessments are being utilized for your TMSA/ STATISTICS/ KPI s Assessments are being reviewed with respect to consistency of data and thereafter they are logged into your account to which you have access 24/7. Automatically statistics are being generated which may be incorporated to your TMSA. Development of statistics is customized to your needs. 10 OSIS A basic means of this service as well as component of its exclusivity and impartiality is the fact that it is being supported by a worldwide unique assessment database (OSIS) which has been solely developed by DYNAMARINe with the support of its users. The extracted statistics and KPI s have proved very important for management companies TMSA and are also components for the procedure of the clearing process as being implemented. Data on OSIS belong to the assessors (Masters) and their Managers. They may utilize the data for their TMSA and furthermore, they may substantiate reliable risk assessments for future STS Operations. Consolidated data are open to the public.
12 THE SELF ASSESSMENT PROCESS IN STS OPERATIONS Although there is no explicit STS assessment within the TMSA procedures of OCIMF, STS Operations are now governed by statutory requirements under the new MARPOL Chapter 8 of ANNEX I. Resolution MEPC 186(59) and the Manual on oil Pollution, section I, prevention indicate procedures that have to be followed by Tanker Operators who are involved in STS operations. The quality of services offered by ships, crews and their managers depend a great deal on the level and competency of exercised due diligence prior, during and after each STS Operation. Preservation of high safety standards by Tanker Operators supports their reputation as well as the reputation of cargo owners and their charterers. Due Diligence in STS Operations is easy to be described, difficult to be recorded and challenging to provide proof that is being followed.
