1 Orders of Commissioners Court Bexar County, Texas TUESDAY, NOVEMBER 06, 2007 Court met at 11:00 a.m. A Regular Meeting was held by the Honorable Commissioners Court, in and for said State and County, met at the Courthouse, of thereof, in Bexar County on Tuesday,. Present at roll call: Nelson W. Wolff, County Judge; Sergio "Chico" Rodriguez, County Commissioner Precinct No. 1; Paul Elizondo, County Commissioner Precinct No. 2; Lyle Larson, County Commissioner Precinct No. 3; Tommy Adkisson, County Commissioner Precinct No. 4; Tommy J. Tompkins, County Auditor; Gerard Rickhoff, County Clerk (Rep. by Leonor Salazar); Susan Reed, District Attorney (Rep. by Ed Schweninger); Keith L. When the following proceedings were had to-wit: Father Tony Posada from Mission San Jose gave the invocation at today's meeting. County Commissioner Sergio "Chico" Rodriguez led the Pledge of Allegiance. A letter of condolence is to be sent to the family of Fred F. Farias expressing to them the sympathy of the court on the loss of their loved one. Mr. Farias was a proud veteran of the United States Air Force. He was a founding partner in San Antonio Coors Distributors, the Coors beer distributor in San Antonio, Texas. He was also a founding partner of L&F Distributors, an Anheuser-Busch beer distributor in South Texas. He is survived by his wife, Mamie A. Farias; sons, Dr. Fred Farias III, George L. Farias, and Matthew A. Farias, and numerous nieces and nephews. A letter of condolence is to be sent to the family of Fred L. Rodriguez expressing to them the sympathy of the court on the loss of their loved one. Mr. Rodriguez was a graduate from Brackenridge High School, Class of He was an All-Star Athlete, participating in football and Track/Field. After he graduated he began working at San Antonio Water Systems as a sewer maintenance worker. After working for SAWS for 30 years, he retired in March 2003 from his position as Director of Dos Rios Recycling Treatment Plant. He is survived by his wife, Blanca E. Rodriguez; children, Lisa G. Rodriguez, Tammy G. Rodriguez, and Fred G. Rodriguez, Jr.; one grandson and numerous nieces and nephews. A letter of condolence is to be sent to the family of Eulogio Lloyd Garza, Jr. expressing to them the sympathy of the court on the loss of their loved one. He graduated in 1964 from San Antonio High with a scholarship to Southern Baptist Convention, and in 1967 graduated from Baylor University with a B.S. in Economics. He worked as a manager in retail lumber business before returning to Baylor to pursue his law degree, which he received in Mr. Garza had a private law practice in Waco and Killeen from 1972 until 1979 when he joined the Killeen Police Department as the Legal Advisor. From 1981 to 1987 he was the City Attorney for the City of Killeen and from 1987 to 1997 he was the City Attorney for the City of San Antonio. In 1997 he opened his practice in Austin and San Antonio before returning to Killeen in 1999 to serve as Assistant

2 Attorney until his retirement in He is survived by his wife, Judy Garza, children Tracy L. Schwend and Derek B. Roberts and 2 grandchildren. A letter of condolence is to be sent to the family of Marianna Chandler Jones expressing to them the sympathy of the court on the loss of their loved one. She was a devoted wife, mother, educator and influential community leader who actively furthered the causes of women in education as well as preservation of San Antonio s unique cultural heritage. With a BS in Library Science from N. Texas State Teachers College, and an MS in Library Science from Our Lady of the Lake University in San Antonio, she had a long and influential career as a librarian at South San Antonio H.S. and Randolph Field ISD. In addition to traveling the world upon retirement, she continuously served multiple offices in such public-spirited local, national and international organizations as: The Women s Club of San Antonio, Delta Kappa Gamma Society, National Library Assn., Texas State Teachers Assn., Super Adults of Laurel Heights Methodist Church, Society for the Preservation of Old Ft. Sam Houston, San Antonio Historic Design and Review Committee, and President of the San Antonio Conservation Society. She is survived by her son, Richard Chandler Jones; daughter, Nora Ellen Boling and 4 grandchildren. A letter of condolence is to be sent to the family of Genevieve Zaiontz Bongiovi expressing to them the sympathy of the court on the loss of their loved one. She is survived by her husband, John and her daughter Lucy Clothier, 3 grandsons and numerous nieces and nephews. A letter of condolence is to be sent to the family of Joe Lee Stubblefield expressing to them the sympathy of the court on the loss of their loved one. He graduated from Sunset High School in 1962 and went to college at the University of Texas in Austin, where he graduated in 1968 with a bachelor of architecture. He continued his studies at UT and in 1972 earned a master of science in community and urban planning. He established his architectural practice in 1974 in San Antonio, where he worked briefly as an intern for O Neil Ford, San Antonio s legendary architect, during the halcyon days of Ford Powell and Carson when the firm was working on such signature projects as Trinity University and the Strand in Galveston. After he s internship was complete, the partners in the firm, recognizing Joe s sunny nature and love of a good joke, sent him off into his own practice by throwing banana cream pies at him, something sweet that he always remembered about his treasured internship. He is survived by his two children, Samuel Culberson Stubblefield and Kathanne Rochelle Stubblefield. A letter of condolence is to be sent to the family of Hannelore Ordway expressing to them the sympathy of the court on the loss of their loved one. She was born in Karlsruhe, Germany and moved to the United States in 1962 and became a citizen of the United States of America in She managed several restaurants in the San Antonio area; maintained the books for her husband s Law Practice and worked as a sales person in the Clothes Hanger located at the S.A. Airport for 17 years. She is survived by her husband, Sidney Ordway; sons, Roland and Terry Ordway and daughter, Andrea Rand and 6 grandchildren. A letter of condolence is to be sent to the family of Gloria Villa Cadena expressing to them the sympathy of the court on the loss of their loved one. She was a recognized scholar in Texas history throughout the state and Mexico and a primary source for professional historians, who relied on her comprehensive knowledge of Texas history and meticulous research for their own work. As the historian Oakah Jones, Jr. explained to his university history class, the first thing he learned when he came to San Antonio was that all roads (to Texas history) led to Gloria Cadena s house. With Angel Sepulveda Brown, she complied and published the San Antonio Parish of Laredo: Abstracts of Marriage, Book I: in 1987 and San Augustine Parish of Laredo: Abstracts of Marriage, Book II, in She founded Los Bejarenos Genealogical Society, an organization dedicated to promoting Hispanic history through genealogical research and educational programs. An active member of El Patronatos, she was a tireless sponsor of it s scholarship fund and programs. She was a member of the Texas Historical Commission and the Bexar County Historical Commission. She is survived by her children, Mary Elizabeth Galvan, Robert A. Galvan, Jr., Carmen Martin, Catherine A. Meaney, Rebecca Galvan, Laura J. Galvan, David Galvan, Tracy L. Colborn and Sara Katz; 34 grandchildren and 4 great-grandchildren. A letter of condolence is to be sent to the family of Aziz Shihab expressing to them the sympathy of the court on the loss of their loved one. He was a reporter and editor for several newspapers, including the San Antonio 2

3 Express; lecture on Middle East affairs; and author of two memoirs. He is survived by his wife, Miriam Allwardt Shihab; son, Adlai Shihab; daughter, Naomi Shihab Nye and 3 grandchildren. Jones Genevieve Zaiontz Bongiovi Joe Lee Stubblefield Hannelore Ordway Gloria Villa Cadena Aziz Shihab Item 3 a-e Commissioners Court Ceremonial items The Court recognized Bexar County Sheriff Rolando Tafolla and the Bexar County Sheriff s Office Cycling Team for the Team s participation in the Valero MS 150 Ride for the fight against Multiple Sclerosis over the past four years. Sheriff Rolando Tafolla introduced his new appointments: Ruben Garcia, Chief Deputy Manuel Longoria, Deputy Chief, Criminal Investigations Dale Bennett, Deputy Chief, Criminal Warrants Brian Menges, Director, Jail Administrator Morris Munoz, Jail Population Monitor The Court presented a Proclamation recognizing and proclaiming Veterans Day November 11, 2007 as A Day to Honor, Remember, and Give Thanks to all Veterans and Their Families. The Court presented a Proclamation declaring December 5, 2007 as Small, Minority, and Women-owned Business Enterprise Day in Bexar County which celebrates the many valuable contributions of minority business to our economy. County Judge Nelson W. Wolff left the meeting at this time. County Commissioner Paul Elizondo is presiding officer. The Court presented an Hidalgo to Amelia Mellie Cardona-Flores, Chief Bailiff for 25 years of service with Bexar County. Item 4a 3

4 Planning and Resource Management A Presentation regarding the 2007 United Way Community Street Fair and the Bexar County Employee Health Fair on Monday, November 19, 2007 from 10:00 a.m. to 2:00 p.m. in the Central Jury Room and Justice Center parking lot. (Record) There being no objections agenda item 57 will be heard at this time. Item 57 District Clerk s Office The Court hereby ordered and approved a motion approving a request from the District Clerk s Office to hire two Central Magistrate Criminal Court Clerks, Non Exempt-04 (Salary Range $24,852-$34,800) at the salaries listed as follows: Rose Mary Romero $33,219 and Peter Slusarski $33,106, effective November 1, (Record) A motion was presented by County Commissioner Sergio Chico Rodriguez, duly seconded by County Commissioner Lyle Larson, which motion was voted on as follows: Commissioners Rodriguez, Elizondo, Larson, and Item 6 Commissioners Court The Court hereby ordered and approved a motion approving the Consent Agenda (items 10-56) with the exception of agenda item 31, which will be heard separately and agenda item 46 which will be pulled at this time. Item 10 Commissioners Court The Court hereby ordered and approved a motion approving a request by County Judge Nelson W. Wolff to reappoint Christina Rodriguez to the Alamo Regional Mobility Authority for a term to begin upon appointment and expire February 1, (Record) Item 11 4

5 Commissioners Court The Court hereby ordered and approved a motion approving a request by Commissioner Lyle Larson, Precinct 3 to re-appoint Robert Engberg to the Bexar County Hospital District Board of Mangers for a term to begin upon appointment and expire August 31, (Record) Item 12 Fire Marshal s Office The Court hereby ordered and approved a motion approving a grant application to be submitted to the Texas Association of Regional Councils, 2007 Citizen Corps Program through the Alamo Area Council of Governments for a project entitled, Alamo Area Regional Citizen Corps in an amount not to exceed $58,798, with no County cash match, for the grant term of November 2007 through February 2009; and acceptance of funds, if awarded. (Record) Item 13 Fire Marshal s Office The Court hereby ordered and approved a motion approving a request to refund $3, to Mr. Mike Vogt, a contractor who obtained a building permit that was not required by law. The project is a residential structure, which does not require a building permit. (Record) Item 14 Juvenile Department The Court hereby ordered and approved a motion approving three contracts with Family Services Association of San Antonio, Inc., Center for Family Relations, Inc., and Family Violence Prevention Services, Inc., for professional services to be rendered to the Bexar County Safe Havens Collaborative project during the period of November 1, 2007 through October 31, 2009, and funded by a grant awarded to Bexar County by the Office on Violence Against Women of the U.S. Department of Justice in the amount of $247,225. No County cash match is required. (Record) 5

6 Item 15 District Attorney s Office The Court hereby ordered and approved a motion approving a request from the Criminal District Attorney s Office and Family Justice Center to receive, with appreciation, a modification and extension of a grant award from the Bexar County Family Justice Center Foundation in the amount of $140,000; and acceptance of funds, designated for rental, telephone, and cell phone expense for the Bexar County Family Justice Center for the period of August 1, 2007 to November 30, No County cash match is required. (Record) Item 16 Criminal District Courts The Court hereby ordered and approved a motion approving a request from the Criminal District Court Judges to rehire Edward F Shaughnessy, a Bexar County retiree, as a part-time Bexar County Magistrate (T-99), at a rate of $43 per hour, effective November 1, (Record) Item 17 Justice of the Peace, Precinct 2 The Court hereby ordered and approved a motion approving a request from the Justice of the Peace, Precinct 2 Office to rehire Teresa C. Sanchez, a Bexar County retiree, as an Assistant Court Clerk (NE, Grade-01) at a monthly salary range of $1, to$1,846.00, effective November 7, (Record) Item 18 6

8 Item 22 County Auditor The Court hereby ordered and approved a motion approving the Tax Assessor-Collector s Report of Taxes Collected in September 2007 and approving an Order transferring tax collections for the month of September 2007 from Unallocated Receipts. (Record) Item 23 Elections Office The Court hereby ordered and approved a motion approving a request to submit a budget for the Elections Department as required by the Texas Election Code, Chapter 19, Financing Voter Registration Fund, Sections , , and (Record) Item 24 Purchasing Department The Court hereby ordered and approved a motion awarding a delivery order on a requirements contract basis to Instant Data Technologies, dba Indatatech, Incorporated for the purchase of Fixed Asset Inventory and Management Services as requested by the Bexar County Purchasing Department for an eleven-month period, beginning upon award and ending September 30, 2008 for an estimated amount of $35,000; and authorizing the Purchasing Agent to execute and file appropriate award documents for record. (Record) Item 26 Purchasing Department The Court hereby ordered and approved a motion awarding a contract to the lowest and best bid submitted by ABM Janitorial Services to provide custodial services in various County owned and leased facilities in the amount of $445,600 for the period December 1, 2007 through September 30, 2008 as requested by the Bexar County Infrastructure Services Department; and authorizing the Purchasing Agent to execute and file appropriate award documents for record. (Record) Item 27 Purchasing Department The Court hereby ordered and approved a motion awarding the renewal of a requirements contract with The Levy Company, L.P. to provide for the maintenance of traffic signals and school zone flashers for a one-year period under the same pricing, terms and conditions at the request of the Bexar County Infrastructure Services Department for an estimated annual amount of $39,500; and authorizing the Purchasing Agent to execute contract modifications and file appropriate award documents for record. 10 The Court hereby ordered and approved a motion awarding the renewal of a service contract with Tootsie s Fine Foods, dba Weary Traveler, Incorporated to provide cafeteria concession services at the Bexar County Justice Center as requested by the Bexar County Cafeteria Committee for a one year period, beginning December 1, 2007 and ending November 30, 2008, under the same pricing, terms and conditions with an estimated annual revenue of approximately $28,000; and authorizing the Purchasing Agent to execute contract modification and file appropriate award documents for record. (Record) Item 29 Purchasing Department The Court hereby ordered and approved a motion authorizing the Purchasing Agent to advertise an Invitation for Bids for the purchase of construction services for the Jungman Road High Water Detection System at Medina River as requested by the Bexar County Infrastructure Services Department. (Record) Item 30 Purchasing Department The Court hereby ordered and approved a motion authorizing the Purchasing Agent to advertise a Request for Proposals for Arbitrage Services as requested by the Bexar County Auditor s Office. (Record) Item 32 Community Investment The Court hereby ordered and approved a motion approving execution of the Management Agreement between Bexar County and Christian Senior Services for payment of meals for nutritionally at-risk seniors through their Meals on Wheels program for a one-year period beginning October 1, 2007 and ending September 30, 2008, in the amount of $29, from Community Development Block Grant (CDBG) Program Funds. (Record) Item 53 Infrastructure Services The Court hereby ordered and approved a motion approving the First Amendment to the contract with Carter and Burgess for producing 35 percent Design-Build Bridging documents for the Justice Center Expansion Project, in the 15

16 amount of $1,395,895, which includes $10,000 reimbursable expense funding. (Record) Item 54 Infrastructure Services The Court hereby ordered and approved a motion authorizing the County Judge to execute agreements (at no cost to the Bexar County) related to the March 12, 2007 contract with Carter Burgess, Inc. for County consent to a possible change of ownership of the firm of over 10 percent as required by Article XXVI, Section of the contract. (Record) Item 55 Planning & Resource Management The Court hereby ordered and approved a motion approving the First Amendment to an Interlocal Agreement between Bexar County and VIA Metropolitan Transit Authority for bus services provided to County employees and Bexar County residents summoned to jury duty by the County. Modifications to the existing agreement have been determined based on cost analysis, data used by VIA and Bexar County.
