1 THE STATE OF TEXAS COUNTY OF ORANGE BE IT REMEMBERED that a Special Court Session was held on Monday, May 2, 2011 at 2:00 P.M. in the Commissioners Courtroom of the Orange County Administration Building with the following in attendance: Carl K. Thibodeaux, County Judge David Dubose, Commissioner, Precinct No. 1 Owen Burton, Commissioner, Precinct No. 2 John Dubose, Commissioner, Precinct No. 3 Jody Crump, Commissioner, Precinct No. 4 The meeting was called to order at 2:08 P.M., Douglas Manning, Assistant County Attorney gave the invocation, Carl Thibodeaux led in the Pledge of Allegiance and the following business was transacted, towit: Agenda items are in the order they were taken in the meeting. APPROVE MINUTES Motion made by John Dubose, seconded by David Dubose approving the minutes of the Public Workshop and Special Court Session held April 25, 2011, as circulated. 1. PROCLA- Motion made by John Dubose, seconded by Owen Burton authorizing the Orange County MATION Commissioners Court to issue a proclamation declaring Thursday, May 5, 2011 as National Day of Prayer. 2. NO ACTION No action taken on discussion and possible action regarding a presentation by Tax Attorney, Steve Bird, on the Tax Trust Property located at 340 West Davis Loop, Vidor, Texas/Tax Account number

TREASURER S Motion made by John Dubose, seconded by David Dubose accepting the monthly reports from MONTHLY the County Treasurer for month ending March 31, 2011 into the minutes of the Court as REPORT follows: a. Approval of Interest Earned to date in the amount of $43, b. Approval of Investments in TexPool, Super Investments-General Fund, Treasurer Investments-General Fund, Certificates of Deposits and Government Agencies in the amount of $2,575, c. Treasurer s Report of revenues received and disbursed in accordance with the Local Government Code (a)(d) and affidavit of approval by Court. This report will be available on the county s web site for viewing. d. Pledged Security Collateral for a total of $32,890,496.74, summary as follows: Wells Fargo Bank $21,086, Capital One Bank $11,803, TREASURER S Motion made by John Dubose, seconded by Jody Crump accepting for filing in the minutes of QUARTERLY the Court the County Treasurer s Quarterly Investment Report as required by HB 2459, Public INVESTMENT Funds Investment Act. This report is for quarter ending March 31, 2011, and will be available REPORT for viewing on the county s web site. 5. BILLS PAID Motion made by David Dubose, seconded by Owen Burton authorizing payment of bills approved by the County Auditor as per attested listings: GENERAL FUND $173, ROAD & BRIDGE OTHERS TOTAL FOR PAYMENT $174,524.66

3 PORT Motion made by John Dubose, seconded by David Dubose entering into an Intergovernmental SECURITY Agreement between Jefferson County and Orange County for the distribution of 2010 Port GRANT Security Grant Funds and authorizing Judge Carl K. Thibodeaux to sign the agreement and Karen Jo Vance, County Clerk to attest to the same. Jefferson County acting as the Fiduciary Agent for the grant will draw down the $370, approved for Orange County. 6. ADOPT Motion made by Owen Burton, seconded by David Dubose adopting a Special Budget, in SPECIAL accordance with the provisions of Local Government Code between Orange and BUDGET Jefferson County concerning the 2010 Supplemental Port Security Grant Program to purchase a Patrol and Rescue Boat. 7. PROJECT Jeff Kelley, Director of Emergency Management updated the Court on the Adult Probation UPDATES location site and on the State s Audit Report for Hurricane Gustav. 8. NO ACTION No action taken on discussion and possible action regarding Burn Ban in Orange County, Texas TOBACCO Motion made by John Dubose, seconded by David Dubose authorizing Sheriff Keith Merritt COMPLIANCE to apply for the 2012 Tobacco Compliance Grant. This grant is 100% funded through the GRANT Texas Comptroller of Public Accounts. The available funds are determined by the number of tobacco retailers within our jurisdiction and will be announced if the county is awarded the grant. 11. NO ACTION No action taken on discussion and possible action authorizing County Judge Carl K. Thibodeaux to sign the Inter-Local Agreement with Jefferson County to execute the 2010 Port Security Grant.

AWARD Motion made John Dubose, seconded by Owen Burton awarding the Orange County DEPOSITORY Depository Contract in accordance with Chapter 116, Texas Local Government Code as CONTRACT follows: a. To award the Depository Contract for Principal Managing Bank in accordance with Local Government Code Section to Wells Fargo Bank. b. To award the Sub-Depository Contract as the Sub-Depository Bank for Vidor/Precinct Four to Orange Savings Bank. 13. DEPART- The Court heard and received the following departmental reports. A short written report to the MENTAL members of the Court, followed by no more than a five minute verbal report and questions and REPORTS answers to follow: 1 st Meeting of the Month of May, 2011 Road and Bridge Department Records Management Department MIS Department Mosquito Control Department 14. COMMENTS Carl Thibodeaux announced the he would try to set up a second workshop with the redistricting attorneys and spoke on a discussion with the Elections Administrator concerning consolidating some of the voting boxes. 15. CLOSED Closed meeting, held pursuant to Tex. Gov. Code , to deliberate the purchase, MEETING exchange, lease or value of real property. Deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third party. The Court recessed to go into a Closed Meeting and this meeting was recorded. 16. RETURN TO Return to open meeting. Take any action necessary based upon discussion in closed meeting. OPEN MEETING

5 ACTION TAKEN Motion made by John Dubose, seconded by Jody Crump that Orange County inform the company to make the Orange County Commissioners Court an offer on the price per rod, the first year lease of the property in Claiborne Park and the continual annual lease of the property in Claiborne Park. 17. ADJOURN Motion made by David Dubose, seconded by John Dubose to adjourn the Commissioners COURT Court meeting. Carl Thibodeaux adjourned Court. Carl K.
