2 This is Agency Working Agency Workers at HCA The aim of this booklet is to provide information to you about your entitlements and information about HCA and our facilities. If you do not find the information you are looking for within this booklet, please contact your recruitment agency as they will be able to answer any further questions that you may have. What is an Agency Worker? An agency worker is someone who has a contract with an employment agency to perform work or services personally for an organisation. HCA engages agency workers throughout the business in various clinical and non-clinical roles. The purpose of the Agency Workers Regulations 2010 which came into force on the 1st October 2011 is to ensure the protection of agency workers by ensuring that agency workers receive the basic conditions of work they are entitled to.

4 This is TEMPORARY STAFFING SERVICES About Temporary Staffing Services The Temporary Staffing Services ( TSS ) department is based at the HCA Head Office at 242 Marylebone Road,. The TSS department manages all of the Bank Members and Bureau nurses for HCA International. On occasions when a temporary staffing requirement is not filled by a Bank Member or an employee, HCA International may engage recruitment agencies to provide an agency worker on short term assignments. The TSS department liaises with recruitment agencies to book all clinical agency workers for the HCA facilities. Whilst the TSS department arranges the booking of the agency workers, they are not responsible for managing you on a day to day basis and will not be able to assist you with queries regarding your placement at HCA or any pay issues. You should contact your recruitment agency directly regarding any information or assistance that you require. 2

9 HCA Laboratories Highly experienced in acute diagnostic pathology, the laboratories serve all of the HCA facilities in addition to many other clinics, health centres, pharmaceutical companies, general practitioners and a variety of commercial concerns. The laboratory is directed by the Chief Executive Officer and medically directed by a full-time Consultant Haematologist. 10 HCA NHS Ventures HCA NHS Ventures is responsible for developing private patient units by forming partnerships between NHS Trusts and HCA International. With the team headquarters based at Shropshire House on Tottenham Court Road,, the division is focused upon developing joint ventures around the UK and offers exciting opportunities to work in a private patient setting alongside the NHS. Harley Street at UCH is our partnership with UCLH, formed in Based on level 15 in the tower at UCLH, the 18 bed acute facility is a specialist cancer unit for complex and rare conditions. We offer medical and surgical care including day case chemotherapy and a comprehensive bone marrow and stem cell transplant service in conjunction with the Trust. The Young Persons Unit at UCH is the only private teenage cancer unit in Europe and further establishes our relationship with UCLH. The 6 bedded Unit will treat all kinds of cancers and will provide high quality care specifically for patients aged between 13 and 19. 11 This is ABOUT YOUR ASSIGNMENT Where should I go at the beginning of my assignment? Your recruitment agency will advise you of who you should ask for on your first day when you arrive at the reception desk and where you should go. If you are uncertain about where you should go or who to ask for on your first day, please contact your recruitment agency. What should I bring? Your recruitment agency should advise you what you will need to bring. You will normally be asked by your recruitment agency to provide some photo ID. For nursing staff it may be necessary for the recruitment agency to request evidence of your NMC registration. If you have any queries about what you need to bring with you, please contact your recruitment agency. How do I get paid? You will be paid through your recruitment agency. In order to ensure that you are paid correctly and on time, you will need to complete the timesheet that your agency supplies you with and have this signed off by the approving HCA manager. In order that you are paid on time please ensure you are aware of the agency deadlines and follow the required procedure. If you have any queries in regards to your pay you should speak directly with your recruitment agency. Who do I contact if I am running late or sick? If you are running late or are sick you need to ensure that you contact your recruitment agency as soon as possible. Due to the impact this may have on patient safety, where possible it is also a good idea to take note of the HCA department telephone number so you can also call them directly to advise them if you are running late or are not able to attend work. This is particularly important outside of your recruitment agency opening hours. What are the usual shift times? You will be informed of the start and finish time of your shift by your recruitment agency. Shift times may vary across the HCA hospitals and departments therefore please ensure you check your assignment with your recruitment agency. 9

12 Where can I take my meal breaks? Nearly all of our sites have a restaurant offering meals at low prices which you are entitled to access during your shift. If you are unsure where this is, please ask a member of staff in the department that you work in to show you. You will be advised as to when you will be able to take breaks when you attend the hospital, which will vary depending on your shift. It is your responsibility to make sure that you take adequate rest breaks. What should I wear? During your work at HCA you may be provided with a uniform. This uniform will be provided on your first shift, it remains the property of HCA and it should be returned to HCA at the end of your temporary assignment. Where a uniform is not provided, you should attend for work in smart business dress or as advised by the recruitment agency. Where can I store my belongings when I am working? You will be advised on your first day when you arrive, where you may store your personal belongings for the duration of your shift. Please be advised that HCA do not accept any responsibility for any loss, damage or theft to your personal belongings. Please do not bring any valuable possessions when you attend your shift. Health and Safety As with any assignment you should be aware of HCA policies regarding Health and Safety and Fire. If you have not been provided with this by your agency you can also ask a member of staff working in the area you are assigned to show you where to find this information. What should I do if I want to stop providing my services at HCA? Do I have to give notice? There is no commitment either from HCA or you to provide any services or to perform a particular shift. If either you or HCA want to cancel an assignment, there is no requirement to provide notice. If you wish to stop performing services for HCA then you need to inform your recruitment agency as soon as possible. I would like a permanent role with HCA, where do I apply? 13 What am I entitled to as an agency worker? You will be provided with access to the following collective facilities and amenities from the first day of your assignment: Access to a canteen or other similar facilities, childcare facilities and transport services (where these are available). If you remain in the same role within HCA (during one or more assignment) for a period of 12 continuous calendar weeks, you will gain the same basic conditions ( the Basic Conditions ) including the following which will be offered to you on the same terms and conditions as permanent employees who have been providing services for the same length of time and in the same role as you pursuant to the Agency Workers Regulations 2010: Pay Duration of working time Rest periods Holiday Rest breaks and restrictions on night work Redundancy pay Personal performance bonus (if applicable) I would like to request further information about my rights in relation to the Basic Conditions, how do I do this? Any request for further information about the Basic Conditions referred to above must be made in writing to your recruitment agency. Your recruitment agency will then have 28 calendar days from receipt of your request to respond. If 30 calendar days has passed since you have written to your recruitment agency and you have not received a response, you may make a written request to the Head of Temporary Staffing Services, HCA International Limited, 242 Marylebone Road,, NW1 6JL. Following receipt of your request, we will normally respond to your request for information within 28 days and in accordance with the Agency Workers Regulations How do I raise concerns about my rights of access to facilities and amenities and/or access to current vacancies? If you wish to raise concerns about your rights of access to facilities and amenities and/or access to current vacancies, you are entitled to make a written request for information about how you have been treated to the Head of Temporary Staffing at the same address. We will normally respond to any request received within 28 calendar days following receipt of your request. 11
