STATEMENT: "This meeting is being held in compliance with the Open Public Meetings Act. It was published in the Tri-Town News, Asbury Park Press, Trenton Times and posted on the bulletin board. THOSE OFFICIALS PRESENT WERE: COMMITTEEMAN TROTTA COMMITTEEMAN MARINARI MAYOR LEUTWYLER DEPUTY MAYOR SORCHIK COMMITTEEMAN WYSONG ATTORNEY FORAN ADMINISTRATOR DANCER CLERK HENDRICKSON Mayor Leutwyler reviewed the agenda. There are three draft resolutions, the first one that clarifies Resolution No which appoints members to the Environmental Commission, the next one authorizes submittal of the NJ DEP Natural & Historic Resources Recreation Trails Program Grant and a resolution opposing Senate Bill 2511 amendments to the Open Public Meeting Act. There are three ordinances for introduction. Ordinance No rescinds Chapter 47A of the General Ordinances entitled Professional Service Entity and establishes a new Chapter 47A, which establishes that a business entity which makes Political Contributions to Municipal Candidates and Municipal and County Political Parties in excess of certain thresholds shall be limited in its ability to receive public contracts from Plumsted Township (Contractor Pay-To-Play Reform Ordinances). Administrator Dancer said he spoke to Tina Vignali of the DCA regarding this ordinance. Since Plumsted is a Transitional Aid municipality, it was suggested that the Ordinance be introduced by title so the State knows we are moving forward. It gives a window of time prior to the deadline of the advertisement for the public hearing. It also gives the Township an opportunity to speak with the Director of DCA and possibly tweak the ordinance so it does not create a hardship for someone who is not contributing to Township Committee Candidates. Ordinance No , amends and supplements Chapter 15, Section 5 of the General Ordinances entitled Zoning - General Regulations Solar Systems. Committeeman Trotta said he and Committeeman Marinari attend the Environmental Commission meetings. Miguel Garces is a member of the Environmental Commission and is also on the Land Use Board, other Environmental Commission members do not see ordinances such as this one. He felt this ordinance was very much involved with the environment and going forward he would like the Environmental Commission to review ordinances like these before they are introduced. Ordinance, No , creates and establishes a new Chapter 30 (57AA), entitled Massage Establishments. Attorney Foran stated that this updates the current ordinance where the business establishment is now licensed and the therapist is licensed through the State. Committeeman Trotta said his concern with this ordinance was with 30 (57AA)-7b regarding the Township Committee, in its discretion, may issue a license to any person convicted of any of the crimes. He had a problem with the offense of sexual misconduct with children. He felt that section should come out. Administrator Dancer said in Adult Entertainment, Chapter 1, there is a section that deals just with adult entertainment establishments. This is a massage establishment. Section 5 thru 8 also dealt with massage parlors and that section has been replaced with the new section on massage establishments so the Township knows that the individual has to be licensed by the State of New Jersey and the establishment has to be licensed by the Township Committee. The Adult Entertainment business is not being repealed. Deputy Mayor Sorchik questioned the background checks and wanted to make sure that police background checks are done on the applicant. It was decided to reference background checks in accordance with Chapter 14A that applicants are subject to criminal history record checks, including fingerprinting. Committeeman Trotta mentioned that the State allows municipalities to impose an occupancy tax on hotels, motels, bed and breakfasts and looking at transitional aid again, he felt this could be a way to show the State that the Township is looking into every avenue to receive more revenue. He asked if an ordinance like this could be introduced by title and then work on the details, and the second reading and public hearing at the next Township Committee Meeting as the peak season is coming up. The municipality can impose a fee of up to 3%. He stated this amount is paid by the people who come to the bed and breakfast. He saw model ordinances from Howell and Freehold. Administrator Dancer thought this was a good idea and it would allow time from the time of introduction prior to seconding reading and public hearing. It would

2 an opportunity for the Mayor and Committeeman Trotta to meet with the Bed and Breakfast and is a good signal to show the State that the Township is trying to work with the business and enhance revenues. There is a public hearing and second reading on Ordinance No , which establishes salaries for various Plumsted Township officials. Mayor Leutwyler asked if there was any questions on the resolutions. There was none. Committeeman Trotta said he would be abstaining on the bill list as he did not have time to review it due to his car accident. He noted that the bill list was late this month because it had to wait until the rollover from 2012 to He said he would like to see that in future years that rolling over from year to the next should not take a month, it should take two weeks. Committeeman Wysong mentioned that other States allow municipalities to put a tax on gasoline and wondered if New Jersey allows this. Administrator Dancer and Attorney Foran said they were not aware of any but could check into it. RESOLUTION NO , A RESOLUTION OF THE TOWNSHIP OF PLUMSTED, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE CONVENING OF AN EXECUTIVE SESSION IN ACCORDANCE WITH THE OPEN PUBLIC MEETINGS ACT WAS ADOPTED. ROLL CALL VOTE: ALL AYES. Mayor Leutwyler called the regular session of the Township Committee meeting to order with the flag salute. Leutwyler introduced the professionals at the dais; he informed the public the workshop had been completed as well as the Executive Session. PRESENTATIONS: Mayor Leutwyler said there are two new appointments to Senior Outreach Services. Since Patricia Gale and Judy Bryant were not in attendance to receive their Certificates of Appointment, President George Lee accepted them on their behalf. Mr. Lee stated that in addition to providing rides for seniors for medical appointments, the SOS also has social days and events. He said they are always looking for volunteers and invited anyone interested to come to their meeting, which is on the first Wednesday of every month. You don t have to be a senior to volunteer. Committeeman Trotta asked Art Teacher Ms. Ruggerio to come forward to help present Certificates of Appreciation for the Playground Committee T-Shirt Design Competition. These students participated in the competition to design a t-shirt for the Playground Committee. A new playground is being planned at the Recreation Field and this was a unique way of fundraising. The following children were presented Certificates of Appreciation for participation in this competition. Rebekah Schroeder, Julia Rice, Naomi Daniels, Eleni Toto, Tiffany Bautista, Gabrielle Hartman, Luke Peslak, Francesco LaTorre, Jaden Carroll, Noelle Baniowski and Dakota Hutchins. The Committee thanked the children for submitting their t- shirt designs and Mayor Leutwyler said it was a difficult decision to pick a winner. Noelle Baniowski was selected as the winner of the T-Shirt Design Competition. Mayor Leutwyler said the next presentation is for the 2012 Pinelands League 9U Fall Ball Champions. He asked Head Coach Chris Scozzari, and Assistant Coaches Bill Loesch and Mike Dolan to come forward to assist in handing out Certificates of Recognition to the following players: Ryan Britton, Ryan Conway, Michael Dolan, Tim Eichert, Nicholas Loesch, Jack Marchese, Tim Peters, Garrett Schaible, Anthony Scozzari, Jake Siegel, Aiden Smith and Robert Stroehlein. President of the League Sam LeNoble congratulated the team and on behalf of New Egypt Baseball Board for 2012/2013, he presented them with a plaque commemorating their achievement on the day of the victory. The Committee congratulated the team on their victory. Mayor Leutwyler asked Linda Leutwyler, Chairman of the Municipal Drug and Alcohol Alliance, to come forward and accept a Proclamation for Children of Alcoholics Week. Mayor Leutwyler explained that the Alliance does outstanding work in Plumsted. They have an information table at New Egypt Day and the Fall Festival and do a lot of work behind the scenes. They fund programs at the schools for education on drug and alcohol awareness, family dinner night, which promotes right choices. Deputy Mayor Sorchik read and presented the proclamation to Mrs. Leutwyler. Mrs. Leutwyler thanked the Committee for their support throughout the years. ROLL CALL VOTE: ALL AYES. Mayor Leutwyler said Ordinance No creates and establishes a new chapter entitled Massage Establishments. This ordinance is being introduced as amended. Since background checks are required by the State for Licensed Massage Therapists, background checks will now be required for the Therapeutic Massage Establishment. ON MOTION OF COMMITTEEMAN MARINARI, SECONDED BY COMMITTEEMAN WYSONG, ORDINANCE NO , AN ORDINANCE OF THE TOWNSHIP OF PLUMSTED COUNTY OF OCEAN, STATE OF NEW JERSEY CREATING AND ESTABLISHING NEW CHAPTER 30A (57AA), OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF PLUMSTED ENTITLED MASSAGE ESTABLISHMENTS WAS INTRODUCED. ROLL CALL VOTE: ALL AYES. Mayor Leutwyler said the following ordinance creating and establishing a new Chapter 21AA entitled Hotel and Motel Tax is being introduced by title. This ordinance would impose a tax to be charged in accordance with N.J.S.A. 54:32B-1 et. seq. on hotels, motels, bed & breakfasts or inns. 3

4 ON MOTION OF COMMITTEEMAN WYSONG, SECONDED BY COMMITTEEMAN TROTTA CREATING AND ESTABLISHING NEW CHAPTER 21AA OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF PLUMSTED ENTITLED HOTEL AND MOTEL TAX WAS INTRODUCED BY TITLE. The second reading and public hearing on the aforementioned ordinances is scheduled for the next regularly scheduled Township Committee Meeting which is March 6, RESOLUTIONS: THE FOLLOWING RESOLUTIONS ON A CONSENT AGENDA ARE CONSIDERED ROUTINE AND SHALL BE ENACTED BY ONE MOTION. Anna (inaudible), a crisis counselor from St. Barnabas Health was in attendance to give out information to the public regarding a program NJ Hope and Healing which is a grant-funded program sponsored through the Division of Mental Health and Addiction Services, Disaster and Terrorism Branch through a Federal Emergency Management grant, in partnership with Barnabas Health Institute for Prevention. This program is a way of helping people cope with the mental and emotional stress after Super Storm Sandy. Deputy Mayor Sorchik asked by calling the toll free number HELP (4357) what information would be available to a person. She said someone to listen to them anonymously and give resource numbers as to how and where to get help. The Committee thanked her for this information. Resident Kenneth Bauer was in attendance regarding an he sent to Mayor Leutwyler regarding his concerns to have a traffic light at the corner of Route 528 and Hawkin Road. He moved to Hornbeam Lane near the intersection about a year ago. He stated on January 12 th there was an accident with a NJ Transit Bus and an SUV and this was the fifth accident he witnessed in one year. He reached out to the Freeholders and County Engineer, Frank Scarantino regarding having something done at that intersection. Mayor Leutwyler said that a request came into the Police Department from County Engineering requesting reports on the intersection for a traffic study. Mayor Leutwyler said he and Committeeman Wysong would be attending their annual meeting with the County and this would be addressed. Committeeman Wysong told Mr. Bauer to tell his neighbors and friends that this Committee fully supports this issue. Mayor Leutwyler asked for any old or new business from the Committee.
