1 THE REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF WINTHROP HARBOR WAS HELD ON SEPTEMBER 21, 2004 AT THE MUNICIPAL BUILDING, 830 SHERIDAN ROAD, WINTHROP HARBOR, ILLINOIS The meeting was called to order by Mayor Loy at 7:00 PM. Trustee Weiss led the group in prayer, which was followed by the Pledge of Allegiance. Upon roll call the following Officials were present: Mayor Robert D. Loy Trustee Ronald P. Colangelo Trustee Joe Leech, Jr. Trustee Virginia Lopez Trustee Richard Robards Trustee Eugene Gene Swindle Trustee Hartmut Fritz Weiss Attorney Robert Long Village Clerk Jana Lee APPROVAL OF MINUTES None reported OLD BUSINESS None reported MAYOR S REPORT None reported CLERK S CORRESPONDENCE None reported. NEW BUSINESS Docket 10-PZB-04 Kylar Development, property located at SE corner of Kenosha Rd. and 9 th Street, final approval of 4-lot subdivision. Trustee Weiss noted the Planning and Zoning Board recommended approval with the stipulation that they would add who would be responsible for the shared driveway.

2 Regular Board Meeting A motion was made by Trustee Weiss and seconded by Trustee Colangelo to approve Docket 10-PZB-04 with the stipulation that they would add who would be responsible for the shared driveway. Docket 20-PZB-03 LEH Limited Partnership Leo Harris Owner, property located at 615 Lewis Ave. and W. 9 th Street. Request for Annexation and Zoning Amendment for Harbor Meadow Subdivision. Trustee Weiss reported that the Planning and Zoning Board recommended approval. 2 - A motion was made by Trustee Weiss and seconded by Trustee Robards to approve the Annexation and Zoning Amendment for Harbor Meadow Subdivision. At this time Attorney George Theophilos took over as Village Attorney for the discussion on the Harbor Meadow Subdivision. Trustee Weiss noted that Mr. Don Thomas, Land Planner, who represents the Village, Mr. Frank Tschakert, Mr. Christensen, Attorney Heyl and Mr. Harris were present for the meeting. Trustee Swindle asked that this be put over to the committee meeting to discuss this further. Trustee Swindle stated that in his view, giving the developer a $ per acre rebate, would have an impact on Winthrop Harbor. It would also impact the Fire, Police and Public Works Department. Trustee Swindle stated that he wanted to see this project move forward, but wants to see everybody paid their fair share. Mayor Loy stated that it was the intent of the board, when it was discussed, that in order to get the commercial developed first, that the incentive be given to Mr. Harris. Trustee Swindle stated that he was out of town for that meeting, but would have voiced his concern at that time. Trustee Swindle went on to say that it s a good development, but cannot support it, due to the $ per acre refund.

3 Regular Board Meeting 3 Trustee Weiss explained that the meeting that Trustee Swindle missed, the Village Board agreed to give the incentive to Mr. Harris that if he could bring in the commercial development within 5 years, the Village would forgo the fee, but if he cannot bring in the commercial within the 5 years then the fee would be required. Attorney Heyl noted that Mr. Harris would have to start construction within 3 years. Trustee Swindle stated that he would not support this, due to the $ rebate. Trustee Colangelo stated if by giving Mr. Harris the $30,000 incentive to get the commercial development going, then he is all for the incentive. Trustee Colangelo noted the only problem that he had with the annexation agreement, was item #7, area 4. He stated that he is aware that the density has dropped; that it started with 130 town homes/condominiums and dropped to 80 town homes/condominiums. Trustee Colangelo asked what type of leverage does the Village have with the density in negotiations. The agreement states that if it were a proper design, then he would be allowed to do 80. Trustee Colangelo noted that he has stressed some type of age restriction from the beginning, because if it s not part of the equation, then the Village is going to be committed to these 80 units based on design. Attorney Theophilos noted that 80 units are subject to review and approval of the final plan, and that is the leverage that the Village has. Attorney Theophilos pointed to the PUD Ordinance, where it talks about the requirements for a final plan, it lays out what is included in the final plan such as covenants. Trustee Lopez stated that she was not in favor of an age restriction as there are many empty nesters and single people that would be interested in town homes/condominiums. Upon roll call Trustees Leech, Lopez, Robards and Weiss voted aye. Trustees Colangelo and Swindle voted nay. At this time Attorney George Theophilos stepped down and Attorney Long returned.

4 Regular Board Meeting A motion was made by Trustee Leech and seconded by Trustee Robards to approve Accounts Payable Warrant in the amount of $87, A motion was made by Trustee Leech and seconded by Trustee Weiss to approve the Treasurer s Report for August Request for Increase Comcast Renewal Negotiation Budget 5 - A motion was made by Trustee Leech and seconded by Trustee Swindle to deny the request for an increase to the Comcast Renewal Negotiation Budget. Trustee Leech noted that the agreement was not to exceed $10, ORDINANCE 2004-O-16; An Ordinance Adopting NIMS System in The Village of Winthrop Harbor. 6 - A motion was made by Trustee Swindle and seconded by Trustee Leech to approve Ordinance 2004-O-16. Fire Chief Stried updated the Village Board on the Fire Alarm Panel. He stated that the Fire Department would like to go with a wireless alarm system and move away from the older type fire alarm board that was installed several years ago by Fire & Security. He noted that there would be no cost to the Village and that subscribers could save up to $50.00 per month. He also noted that Fire & Security has agreed to walk away. He stated that the new system would be implemented on December 1, 2004.

5 Regular Board Meeting 5 Worker s Compensation Policy for Police & Fire Attorney Long reported that one of our Police Officers was injured in the line of duty and he is on Worker s Compensation. While a Police Officer is receiving Worker s Compensation, he would get 100% of his salary. He noted that a question came up as to the policy on payment of his medical insurance premium while he is on Worker s Compensation. Attorney Long noted that currently the Village does not have policy set in wage policy. Attorney Long stated that most Village s have a policy whereby they pickup health insurance for the injured officer and his family to the same extent that they would normally receive. Attorney Long noted that the Board could make motion to pay the officers medical insurance to the same extent that would normally be paid. 7 - A motion was made by Trustee Colangelo and seconded by Trustee Leech to pay for the medical insurance to the same extent that it would normally be paid. ORDINANCE 2004-O-17; First Reading - An Ordinance Amending Title VII, Chapter 78, Entitled Traffic Schedules, Schedule 1, Stop Intersections of the Winthrop Harbor Municipal Code. 8 - A motion was made by Trustee Colangelo and seconded by Trustee Weiss to Set Aside the Rules of the President and Board of Trustees and Waive the Second Reading of Ordinance 2004-O-17 and approve. Upon roll call Trustees Colangelo, Leech, Lopez, Swindle and Weiss voted aye. Trustee Robards voted nay. PUBLIC HEARINGS Mr. Milt Jensen of 612 Geddes Avenue had a question about the News Article in the Zion-Benton News, regarding Onyx and he also stated he felt that penalties for water/sewer bills should be a flat rate not a percentage. Mr. Dave Morris of 814 Washington Avenue stated that he did not see the annexation notice in the newspaper. It was noted by the board that it had been placed in the newspaper.

6 Regular Board Meeting 6 UNFINISHED BUSINESS Trustee Weiss reported that the cell tower will be installed soon and he thanked the committee that worked on the Harris property. Trustee Lopez received a letter from the Girl Scouts requesting to use the Schlader Building on October 3, 2004 from 1:00 pm 3:00 pm and to have the fees waived. She noted that this would be placed on the next agenda for approval. Trustee Lopez noted that the October 2, 2004 Malamute Dog Show will not take place this year. Trustee Lopez also mentioned that the Board should have received the Schlader Building Addition Information in the Committee Agenda Packet. Trustee Swindle announced that the Winthrop Harbor Fire Department Fire Prevention Week Open House and Fire Association Pig Roast Fund Raiser would be held on Sunday, October 10, 2004 from 11:00 am 3:00 pm at the Fire Station 9 th & Sheridan Road. Attorney Long thanked Attorney George Theophilos for his help on Leo Harris Harbor Meadow Subdivision.
