In some situations, poorly performed services may also give rise to a claim for breach of contract. If someone is injured by a defective product or suffers loss or damage to private property, they can sue for damages. Both the producers and distributors can also face prosecution if they offer unsafe products for sale to the public. Even if it has not caused any damage or injury, the producers can be prosecuted for placing unsafe products on the market. It takes specific training in this field for manufacturers to understand how to prepare themselves to face this contingency. 4 Mr. Terence Lee Partner, Carroll, Burdick & McDonough International Mr. Terence Lee is the Managing Partner of the Hong Kong Office specializing in product liability practice in Asia. Mr. Lee is an international trial lawyer who has successfully handled complex products, commercial, construction, land and trust litigation and arbitrations around Asia, including many in the challenging jurisdictions of Malaysia, Hong Kong, Singapore, PRC, Taiwan, Macau, Korea, Japan, India and Sri Lanka. He frequently travels around the globe advising the clients with their product issues, litigation disputes and regulatory concerns. He also gives presentations and trainings around the globe on various product liability issues. Prior to joining the firm, Mr. Lee advised listed companies in Malaysia and Hong Kong in their commercial deals, including mergers and acquisitions, multi-national contracts and joint venture agreement. He was also involved in many cross-border transactions and litigations in Thailand, Malaysia, Hong Kong, PRC and Vietnam. Mr. Mubashir Mansor Partner, SKRINE Mubashir Bin Mansor was called to the Malaysian Bar in June 1989 and has been in legal practice in Malaysia with Skrine ever since. He became a partner of Skrine in Mubashir has acted as counsel in a number of trials and hearings. A number of the matters in which he has been involved in have been reported in the Malaysian law journals. His legal career has centred around litigation work and his practice areas include insurance, arbitration, aviation, contract, tort (in particular libel, slander and malicious falsehood), banking, land law (in particular landlord and tenant) and corporate litigation. Associate Professor Naemah bt Amin International Islamic University Malaysia Prof. Naemah is an Associate Professor at Ahmad Ibrahim Kuliyyah of Laws, International Islamic University Malaysia. Her areas of research in consumer law includes product liability, product safety, consumer credit and redress mechanism. She is the author of «Product liability in Malaysia» which is published by Sweet & Maxwell Asia. She has also wrotes articles and gives presentations around the globe on various product liability issues. Mr. Ridzwan Kasim Senior Director of Policy and Standards From July 1981 May 2002 Mr. Ridzwan was a Chemist in the Department of Chemistry Malaysia, Petaling Jaya; doing analytical work and maintaining the quality system, in various Divisions. He joined Department of Standards Malaysia in mid May He was previously Director of Accreditation who is responsible for the implementation and development of accreditation schemes for conformity assessment and ensuring the quality system complies with the requirements of international standards and guidelines. Currently, he is a Senior Director of Policy and Standards, responsible for development and promotion of Malaysian Standards, and ensuring compliance to international requirements and practices. Mr. Mohd. Shah bin Hashim Executive Director, Legal and Secretarial, Nestle Malaysia Prior to joining Nestle Malysia, Mr Mohd Shah is a private pratitioner. He joined Nestle Malaysia as Legal Manager in September He has then been transferred to the Legal Department in NESTEC Ltd., Vevey, Switzerland in June 1997 assuming the position of Legal Counsel. Mr Mohd Shah s involvement in the industry began in 1998 as Chairman of Food Group of Federation of Malaysian Manufacturers. He plays active participation in all industry discussion with governmental authorities in all aspects of food and beverage industry.
