TERMS OF REFERENCE Assessing and Strengthening Legal Awareness Raising Initiatives with Youth Bhutan National Legal Institute (BNLI) 1

Application Deadline: 26 th August 2015 Expected duration: 14 working days over a period of 4 weeks, including a mission to Bhutan (September 2015) 1. BACKGROUND Currently the Bhutan National Legal Institution (BNLI) is engaged in a number of Legal Education Dissemination initiatives throughout Bhutan. These programs are considered one of the main mandates of the BNLI under the Judicial Service Act of 2007. This not only includes judicial training for judicial personnel but includes the further responsibility of assisting in the creating of legal awareness on the rule of law and access to justice. Through BNLI s network of law clubs in schools across Bhutan, legal awareness activities in schools are implemented. BNLI has also engaged media through television and radio programmes in order to reach a broader impact for legal awareness raising. Within this context, UNDP Bhutan has together with partners from the legal sector in Bhutan developed a project strategy document on Access to Justice (2014-2018) focusing on ways and means to potentially strengthen these initiatives within thematically identified priority areas. This includes continuing to support BNLI s initiative to support law clubs in high schools, through supporting high-quality teaching materials (including videos) for use by clubs, training teachers to support peer mediation in schools, run moot courts and mock trials, and supporting closer coordination with district judges e.g. school study visits to observe trials etc. 2. OBJECTIVES AND SCOPE OF WORK The objective of the assignment is to increase the effectiveness of BNLI s legal awareness raising activities through: assessment of current practices and programmes and review of existing training materials and methods; increasing capacity of educators in best practices; and providing recommendations for future programming in terms of approaches, methods and overall strategy. The assessment should be undertaken in a collaborative and participatory manner, together with BNLI staff and, within the constraints of time, inputs from participants to the legal education work. The aim is to provide concrete and practical recommendations for future programming and the measurement of results. 2

This is to be are to be achieved through three main deliverables: 2.1. Assessment of BNLI s Current Programming and Practice for Legal Education with Youth a. Based on materials shared by BNLI and observation of training sessions and education materials as appropriate, develop a mapping of BNLI s legal education programming with youth, including evidence gathered on results and impact b. Review of the methodologies and approaches used in the context of appropriate methodologies for the Bhutanese context, as well as best practices internationally c. Review of the monitoring and evaluation framework for the education work 2.2. Workshop on legal education programming with BNLI trainers and staff a. Deliver a two-day workshop with BNLI legal education programming and staff, in part with a view to contributing to the results of the assessment overall b. The workshop will provide participants with information regarding best practices and innovation in legal awareness programming from the Asia-Pacific region, including measurement of results c. The workshop will help BNLI facilitate a review of their own legal education programming, in order to prioritize and develop a strategic plan for the upcoming period d. The workshop will include a component on legal awareness raising programmes with urban youth 2.3 Assessment Report and Recommendations for Future Programming The final deliverable is a report, which will have three main components: a. Outcomes of the assessment of BNLI s current programming on legal awareness raising with youth b. Review of legal awareness programming strategy at BNLI, developed in collaboration with BNLI c. Recommendations for future programming on legal awareness raising, including capacity development needs within BNLI, recommended approaches and methodologies to be adopted, partnership approaches with agencies in Bhutan, as well as proposals for legal awareness raising programmes with urban youth in Bhutan. 3

3. OUTPUTS AND SCHEDULE The precise dates of the assignment will be agreed with the consultant prior to signature of the agreement. A 10 day mission to Bhutan is expected to take place during September 2015, depending on consultations with the BNLI and the expert. A break up of the proposed days is provided in the table below. REMUNERATION AND EXPENSES 4

The UNDP office of Bhutan shall pay the consultancy fee to the consultant as agreed between both the parties by contract agreement. All travel and local expenses shall also be included in the contract agreement. Initial payment of 30% will be made upon the submission and approval by UNDP Bhutan and BNLI of Bhutan of the workshop plan, questions for needs assessment and background materials for the workshops. The remainder will be paid upon the delivery of the training and completion of all previously outlined activities, including the approval of the final report. 5. INSTITUTIONAL ARRANGEMENTS The Expert shall work in close consultation with BNLI and UNDP Bhutan and other relevant key agencies. The Expert shall be reporting to UNDP Bhutan and BNLI. The Expert will be expected to submit reports as required and agreed in the work plan and time schedule. 6. QUALIFICATIONS AND EXPERIENCE a) Master s Degree in law, education or a related social science discipline; b) A minimum of 10 years direct relevant experience in the area of legal education programming, preferably with youth; c) Experience in implementing participatory assessment methodologies; d) Experience in leading training workshops on legal education; e) A good understanding of review and evaluation methodologies would be an asset; f) Good understanding of legal education and legal empowerment programming in the Asia-Pacific Region is required, experience in South Asia an asset; g) Experience of leading programming reviews and assessments; and h) Fluent English and demonstrated excellent report drafting skills utilizing MS office software. 9. CRITERIA FOR THE SELECTION OF BEST OFFER The criteria which shall serve as basis for evaluating offers will be: Combined Scoring method where the qualifications and methodology will be weighted a max. of 70%, and combined with the price offer which will be weighted a max of 30% Criteria Weight Max.
