Travel Promotion: Fly for Free on Business Class Terms and Conditions 1. Promotion Period, Eligibility and Qualifying Spend 1.1 The promotion period ( Promotion Period ) is the period from 20 July 2015 to 27 September 2015, both dates inclusive. 1.2 The Fly For Free Promotion 2015 ( Promotion ) is open to all members of Credit s ( Credit s and each, a Credit ) issued by Australia and New Zealand Banking Group Limited, Singapore Branch ( Bank ). Unless the context otherwise requires, terms used in these terms and conditions but which are not defined in these terms and conditions shall have the same meanings as ascribed to such terms in the member s Agreement. 1.3 The following members are not eligible to participate in the Promotion: Corporate members; (b) members who are employees of the Bank; (c) members who are employees of the Bank s auditing firm, the Bank s advertising agencies or any other party directly related to the Promotion; and members whose Accounts have been suspended, cancelled or terminated before issuance of the Prize (as defined in 2.1 below). 1.4 To participate in the Promotion, eligible members will need to do the following during the Promotion Period: Send a one-time SMS to 77288 in the following format to register their Credit (s): Fly <space> 16-digit Credit number (b) Charge a minimum of S$50 Qualifying Spend (as defined in 1.6 below) on their registered Credit (s) during the Promotion Period. 1.5 By participating in the Promotion, the member consents to the public disclosure of his/her name and identification/passport number in relation to the Promotion. member further consents to a representative of the Bank contacting him/ her in respect of the Promotion notwithstanding his/her registration on the Do Not Call Registry. 1.6 In the event member wins a Prize (as defined in 2.1 below), he/ she consents to photographs for publicity or commercial purposes, to participating in the publicity activities of the Bank in relation to the Promotion and to the use of any data provided by such winning member for any future marketing effort by the Bank, without any payment or compensation therefore. 1.7 The qualifying card spend for this Promotion ( Qualifying Spend ) is local and foreign retail spend including online purchases, and for the avoidance of doubt, excludes card spend on the following: all brokeage/securities, ez-link transactions, transitlink transactions, and gambling transactions (including online transactions); and
(b) (c) cash advances, balance transfers, funds transfers, tax payment facility amount, instalment amounts from Instalment Payment Plan, FlexiPlan, FlexiLoan, Quick Cheque, Balance/Fund Transfer and any other fees howsoever called, including but not limited to, the tax payment facility processing fee, annual fees, cash advance fees, interest and late fees and/or any amount brought forward from the last statement provided always that the list of excluded card spend is subject to change by the Bank at its sole discretion without prior notice. 2. Draw Prizes and Mechanics 2.1 There will be a draw held for each of the 10 weeks (each, a Qualifying Week ) during the Promotion Period, and all 10 draws will be held on 21 October 2015 ( Draws, and each a Draw ). Each winner of the 10 draws will win one pair of business class return air tickets from Singapore to designated cities in Australia or New Zealand ( Prize ). City Country Eligible Travel Period Sydney Australia Melbourne Australia To fly before Christchurch New Zealand 29 Feb 2016 Auckland New Zealand 2.2 After registering their Credit (s), participating members will be allocated draw chances for each week they charge a minimum of S$50 Qualifying Spend to their registered Credit (s), as set out below: (b) (c) one (1) draw chance will be awarded for every S$50 of Qualifying Spend charged to the registered Credit (s) in Singapore dollars; if a currency other than Singapore dollars is charged to the registered Credit (s), the Qualifying Spend will be converted to Singapore dollars and five (5) draw chances will be awarded for every S$50 of Qualifying Spend charged to the registered Credit (s). The exchange rate shall be determined by the Bank in its absolute discretion; and draw chances awarded in each Qualifying Week will not be rolled over to the next Qualifying Week. A Principal member B who registered successfully with on 10 August 2015 will earn lucky draw chances for all eligible spend made from 10 August till 16 August 2015 for the 4 th Qualifying Week. The draw chances earned in the 4 th Qualifying Week will not be rolled over to the next Qualifying week. For clarity, the table below sets out the dates of the Qualifying Weeks and the date of the Draws. Each participating member can only win 1 Prize. 2.9 Results will be announced on the Bank s website, two (2) weeks after the Draw. At the end of the Promotion Period, a print advertisement will be published in TODAY newspaper by 4 November 2015 to showcase the results of Draws.
2.10 In the event that winner(s) is/are found to be not eligible for the Draws, their Prize will be forfeited. The Bank reserves the right to draw reserve winners to substitute the disqualified winner(s). 2.11 The validity and eligibility of all participating members Accounts shall be determined by the Bank in its sole and absolute discretion. The Bank reserves the right to adjust or disqualify any draw chances accumulated by any member. 2.12 The Bank s decision of the results of the Draws shall be final. 3. Prizes 3.1 The Bank will issue a prize redemption letter to each winner of the Draws. Air tickets will be issued by the Bank s selected airline, upon presentation of prize redemption letter. 3.2 Airport taxes, fuel surcharges and other miscellaneous charges in relation to the issuance of air tickets will be payable by each winning member via his/her Credit s. 3.3 Prizes are subject to their individual expiry dates and terms and conditions, which will be clearly indicated on the respective redemption letter. 3.4 Prizes are not exchangeable for cash or other items, and are neither transferable nor negotiable. 3.5 In the event that any of the Prizes remain unclaimed within the stipulated redemption period, the Bank reserves the right to donate such unclaimed Prize(s) to any charity organisation of its choice. 3.6 The Bank will not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the prizes. The Bank is not an agent of the merchant participating in the Draw. Any dispute between a member and any merchant in respect of any prizes shall be resolved directly between the member and the merchant. The Bank shall not be liable for any loss, cost or damages of any kind resulting from the use of the Prizes. 4. General 4.1 The Bank s decision on all matters relating to or in connection with the Promotion shall be final, conclusive and binding on all parties concerned and no correspondence will be entertained. 4.2 In the event of any inconsistency between these terms and conditions and any brochure, marketing or materials relating to this Promotion, these terms and conditions shall prevail. 4.3 The Bank reserves the right to cancel, terminate or suspend this Promotion at any time in its reasonable discretion. 4.4 In order to participate in the Promotion, the member s Account must be in good standing and conducted in a proper and satisfactory manner as determined by
the Bank in its sole discretion. In the event that the relevant account is delinquent, voluntarily or involuntarily closed or terminated or suspended for any reasons whatsoever before the Prize is issued, such Prize shall automatically be forfeited immediately and without further notice from the Bank. 4.5 In the event that the transaction(s) used to calculate Qualifying Spend for participation in the Promotion is reversed, refunded and/or cancelled after the member has been issued with a Prize, the Bank reserves the right to claw back the costs of such Prize from such member. 4.6 Notwithstanding anything in these terms and conditions, the Bank reserves the right at any time in its reasonable discretion to determine and/or amend, by addition to, subtraction from or variation of, these terms and conditions, including but not limited to the eligibility terms and criteria, the selection of winners, and the timing of any act to be done, and all participants in the Promotion shall be bound by these amendments with effect from such date as the Bank may determine. 4.7 These terms and conditions shall be governed by the laws of Singapore, and all eligible members who participate in the Promotion irrevocably submit to the non-exclusive jurisdiction of the Singapore Courts. A person who is not a party to these terms and conditions shall have no right under the Contract (rights of Third Parties) Act (Cap. 53B) of Singapore to enforce any of these terms and conditions. 4.8 All information is correct at the time of submission/posting.
