1 Swisse Scratch & Win Promotion Terms & Conditions 1. Information on how to enter and prizes information form part of these conditions of entry (Conditions of Entry). By participating in this promotion, entrants agree to be bound by these cconditions of Entry. Entries must comply with these conditions to be valid. A participant is responsible for ensuring his or her familiarity with the Conditions of Entry at the time of participation. The Promoter s decision not to enforce a speciic restriction (whether communicated to a participant or not) does not constitute a waiver of that restriction or of the Conditions of Entry generally. 2. Entry is only open to residents of New South Wales who are 18 years of age and over. Employees, management, directors, contractors and their immediate families (including spouse, de-facto spouse, parent, guardian, child or sibling) of the Promoter, its related entities, agencies, firms, companies, and venues/participating outlets associated with this promotion, and persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter are ineligible to enter. The persons referred to herein include natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an eligible participant in its absolute discretion. 3. To enter participants must, during the Promotional Period: a) purchase any Swisse product* from Chemist Warehouse, My Chemist Discount Vitamin Warehouse, or online at and and receive a Swisse Scratch & Win Card ( Scratch Card ) one for each product purchased ("Eligible Purchase"); and, b) Scratch 4 of the 12 panels/symbols on the Scratch Card (only 4 panels must be scratched otherwise card is considered void); and c) if the 4 panels scratched reveal 4 of the same image/prize that card is a winning Scratch Card. The customer must complete their details on the reverse of the winning scratch card (eg. address, home address, phone number), then post the winning scratch card and the original proof of purchase ie. original till receipt to PO Box 422, Moorabin Vic 3189 if the 4 panels scratched do not reveal 4 of the same image/prize that Scratch Card is not a winning card. To enter the 2nd chance draw unsuccessful customers may go online at Swissescratchandwin.com.au and complete their details. * Excludes Swisse Recover and Low Carb Protein Bars. Entrants must retain a clear copy of their original receipt and of their winning/non-winning Scratch Card as proof of a valid purchase. Once a winning Scratch Card has been received by the Promoter and validated, the consumer will receive an with a unique code directing the consumer to go online to Swissescratchandwin.com.au to claim their prize.

2 Any consumer with a winning 2 for 1 Movie code will be required to pay the additional $19 plus $2 administration fee. Unrecognised unique codes submitted by participants are deemed invalid and will not be accepted. 4. The promotion commences at AEDT on 22/01/2014 and closes at AEDT on 28/02/2014 ( Promotional Period ). Scratch Cards will be available while stock lasts. No claims received after AEDT on 14/03/2014 will be accepted. 5. There will be 45,000 unique Scratch Cards available during the Promotion Period each card is a potential winning Scratch Card and there is a 1 in 495 chance of winning. Total maximum retail value of all prizes in this promotion is $863,100 RRP (inc. GST) as set out in clause There are a total of 45,000 prizes to be won during the Promotional Period set out in the table below. Unique code found on their Eligible Purchase; ii. Full name (First & Last Name); iii. Phone number; iv. address; and v. Credit card details where prompted. c) Upon validation of the code and credit card details, customers will be charged $21.00, comprising a $2.00 processing fee plus $19.00 for a single adult movie voucher and will be able to print off two (2) single adult movie vouchers entitling the customer to a general admission screening of a movie of their choice at their selected cinema including those designated as No Free Ticket sessions up to the value of $ Movie vouchers will also be ed to the address provided on the website. d) Each voucher is valid for one adult admission at either Village Cinemas, Greater Union, Birch Carroll & Coyle or Event Cinemas, and is to be surrendered by the voucher holder at the cinema box office for a ticket to the session of their choice.

3 e) Vouchers do not guarantee or reserve a seat. Seating is subject to availability. f) Vouchers are not valid for Gold Class, group bookings, movie marathons, special events or in conjunction with any other offer or promotion unless otherwise stated. A surcharge applies for VMAX and 3D/Real D films. g) 2 for 1 Movie Vouchers will have a minimum 12 month expiry from date of purchase. Expired vouchers will not be extended or replaced. h) It is the responsibility of the claimant to use voucher before the displayed expiry date on the voucher. Expired vouchers will not be extended or replaced. Vouchers are not refundable and cannot be exchanged for cash. Vouchers cannot be sold or advertised without prior written consent of cinemas. Locations at which the voucher may be used are subject to change. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher. i) If the participant cannot print off their vouchers they can call for assistance. j) The movie voucher is not to be used/redeemed in conjunction with any other offer, including reduced priced movie tickets or other free ticket offers. $100 eftpos Gift Card $100 eftpos Card prize consists of an eftpos Card to the value of $100 (RRP, inc. GST). eftpos Gift Card Prize conditions It is a condition of accepting an eftpos Card that the winner must comply with all the conditions of use of the eftpos Card supplier, Edge Loyalty Systems Pty Ltd ABN (the "Supplier ) namely: a) eftpos Card will be redeemable at retailers in Australia with "eftpos" facilities who accept the card and when the eftpos has enough unused value to make the purchase. Recipients may use the eftpos Card to purchase goods or services during the validity period of the eftpos Card. See eftpos Card for expiry date. b) The eftpos Card must be activated within 3 months of the date detailed on the winner's letter, which will be delivered with the eftpos Card, by following the steps provided in the winner's letter. Available funds on the eftpos Card must be used within 12 months of activation. eftpos Card will be loaded with funds hrs after activation and cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new card, or be replaced after expiry, and are not legal tender, account, credit or debit cards or securities. c) The Promoter and Supplier are not liable for the availability, quality or fitness for purpose of any goods or services purchased with the eftpos

4 Card. Any dispute about goods or services purchased with the eftpos Card must be resolved with the supplier of those goods or services. Except for rights, which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by the law, the Supplier s liability is limited to replacing a faulty eftpos Card. d) The Supplier may cancel any eftpos Card or the gift card scheme, for any reason at any time without notice. If so the Supplier may either provide a refund or a replacement eftpos Card of equivalent value unless the Supplier reasonably suspects fraud in relation to an eftpos Card. The eftpos Card remains the Supplier s property. e) Should the eftpos Card not arrive via mail or a recipient suspects an unauthorised transaction, please contact the Supplier by telephone on , or online at 9. If any prize becomes unavailable for reasons beyond the Promoter s control, the Promoter may substitute a prize of equal or greater value, subject to approval by the applicable state authorities. 10. Prizes are not transferable and are not redeemable for cash. The judges decision is final and binding - no correspondence will be entered into. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion. 13. All valid claims for prizes will be met notwithstanding that the advertised prize pool has been exceeded. Printing errors or other quality control matters will not be used as the sole basis for refusing to award a prize. All instant prizes must be redeemed during the Promotional Period. 14. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. In the event that the participant cannot provide suitable validation or verification, the participant will forfeit any prize and no substitute will be offered. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage, is likely to jeopardise the fair or proper conduct of the promotion, or who is otherwise involved in any way in manipulating, interfering or tampering with this promotion. Any attempt to deliberately

5 undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. 15. The Promoter and the Promoter s related entities (and it s employees, agents, directors and contractors) shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including any indirect, or consequential loss), incurred, suffered or sustained by any winner arising out of, or in connection with the winner accepting and/or using a prize, whether in tort, contract, or otherwise.. All costs associated or arising in connection with the prize are the sole responsibility of the prize winner. 16. Before the prize is awarded, the winner and any other person(s) sharing the prize with the winner, may be required to sign an agreement to release the Promoter from, and indemnify the Promoter against, any loss (including any indirect, or consequential loss), damage or injury arising out of, or in connection with the use or participation in the prize. 17. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter. 18. Entries remain the property of the Promoter.
