Trent, president/chairman Victor Drury Kathleen Duncan Nicole Forbes Cynthia Lulham Patrick Martin Timothy Price Theodora Samiotis ATTENDU qu'un avis de motion se rapportant a la presentation du present reglement a ete donne au cours de la seance ordinaire du conseil de la ville de Westmount, dciment convoquee et tenue le 5 mars 2012; ATTENDU QUE le conseil municipal de la ville de Westmount a adopte par vole de resolution un premier projet de reglement intitule «R glement VISANT A MODIFIER DE NOUVEAU LE REGLEMENT 1303 CONCERNANT LE ZONAGE - ZONE C5-24-11 (RESTAURANT)» lors d'une seance ordinaire dudit conseil municipal dument convoquee et tenue 5 mars 2012; et WHEREAS Notice of Motion of the presentation of this By-law has been given at the regular sitting of the Municipal Council of the City of Westmount, duly called and held on March 5, 2012; WHEREAS a first draft by-law entitled "By-law TO FURTHER AMEND ZONING BY-LAW 1303 - ZONE C5-24-11 (RESTAURANT) ", was adopted by resolution of the Municipal Council of Westmount, at the regular sitting of the said Municipal Council, duly called and held on March 5, 2012; and Page 1
T WESTMOUNT ATTENDU QUE ledit conseil municipal a dument convoque et tenu, le 28 mars 2012 une assemblee de consultation publique portant sur ledit projet de reglement; ATTENDU QUE ledit conseil municipal a adopte par vole de resolution un second projet de reglement intitule «Reglement visant A MODIFIER DE NOUVEAU LE R GLEMENT 1303 CONCERNANT LE ZONAGE - ZONE C5-24-11 (RESTAURANT)» lors d'une seance ordinaire dudit conseil municipal dument convoquee et tenue le 2avril 2012; Le reglement n 1303, adopte le 3 juillet 2001, puis modifie par les reglements n 1309, RCA02 23003, RCA02 23004, RCA04 23018, RCA04 23019, RCA05 23035, RCA05 23036, RCA05 23037, RCA05 23041, 1331, 1331-1, 1353, 1369, 1384, 1392, 1394, 1398, 1406, 1406-1, 1406-2, 1406-3 et 1413 est de nouveau modifie comme suit: II est ordonne et statue par le reglement 1427, intitule «Reglement visant A modifier de NOUVEAU LE REGLEMENT 1303 CONCERNANT LE ZONAGE - ZONE C5-24-11 (RESTAURANT)», comme suit: WHEREAS a public consultation meeting on the said draft By-law was duly called and held by the said Municipal Council on March 28, 2012; WHEREAS a second draft by-law entitled "By law TO FURTHER AMEND ZONING BY-LAW 1303 - ZONE 05-24-11 (RESTAURANT)", was adopted by resolution of the Municipal Council of Westmount, at the regular sitting of the said Municipal Council, duly called and held on April 2, 2012; By-law No. 1303, adopted July 3, 2001, as amended by by-law Nos. 1309, RCA02 23003, RCA02 23004, RCA04 23018, RCA04 23019, RCA05 23035, RCA05 23036, RCA05 23037, RCA05 23041, 1331, 1331-1, 1353, 1369, 1384, 1392, 1394, 1398 1406, 1406-1, 1406-2, 1406-3 and 1413, is hereby further amended as follows: It is ordained and enacted by By-law 1427, entitled "By-law to further amend Zoning By-law 1303 - zone C5-24-11 (restaurant) ", as follows: ARTICLE 1 SECTION 1 La grille des usages et types de batiments permis pour la zone C5-24-11 est modifiee afin d'autoriser I'usage restaurant. The Table of permitted building types and uses for zone C5-24-11 is modified to authorize the use restaurant. Page 2
WESTMOUNT ARTICLE 2 SECTION 2 L'annexe «A» du reglement 1303 est modifiee par le remplacement de la grille des usages et types de batlments permis qui porte sur la zone C5-24-11 par la grille donnee a l'annexe 1. Schedule "A" of By-law 1303 is modified by replacing the Table of permitted building types and uses concerning zone 05-24-11 by the table given in schedule 1. ARTICLE 3 ENTREE EN VIGUEUR SECTION 3 COMING INTO FORCE Le present reglement entre en vigueur conformement a la loi. This By-law comes into force according to law. DISPOSITIONS AFPLICABLES/APPLICABLE PROVISIONS (1) L'unite de logement minimum d'une maison d'appartements doit comporter une salie de bains, une chambre ^ coucher et une pi^ce comportant I'espace n^cessaire ^ une cuisine, un coin repas et un s^jour. Les autres appartements doivent comporter au moins une (1) pi^ce habitable additionnelle. (1) The minimum dwelling unit in an apartment building shall contain a bathroom, a bedroom, and a room containing a kitchen area, a dining area and a living area. Other apartments shall contain, at least one (1) additional habitable room. (2) Le rez-de-chaussee de tout batiment 6rige, construit ou bati apr^s le 5 novembre 1981 ne doit etre occupe par un etablissement autre qu'une banque, le bureau d'une agence immobiliere, le bureau d'une agence de voyage, un magasin de detail ou une boutique de service; et pourvu, en outre, qu'aucune banque, aucun bureau d'agence immobiliere, aucun bureau d'agence de voyage ou aucune boutique de service ne pr^sente une facade de plus de 35,00 pieds (10,70 metres) au niveau de la rue. (2) No occupancy shall be established at street level in any building erected, constructed or built after the 5th day of November 1981, other than a bank, a real estate office, a travel agency office, a retail store or a service shop; and further provided that no bank, real estate office, travel agency office or service shop at street level shall have a frontage exceeding 35.00 feet (10.70 meters).
