FOX SPORTS and Bridgestone Ultimate Driver Experience Game of Chance Competition CONDITIONS OF ENTRY 1. Competition and Promoter 1.1 By entering the FOX SPORTS and Bridgestone Ultimate Driver Experience Game of Chance Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of these Conditions of Entry. 1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN 16 065 445 418 of 4 Broadcast Way, Artarmon NSW 2064 (Promoter). 2. Who may enter 2.1 Subject to paragraph 2.3, entry into the Competition is open to all permanent residents of Australia aged 18 years or over at the date of entry into the Competition. 2.2 Each eligible entrant may only submit one entry in the Competition. 2.3 The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter, Bridgestone Australia Ltd (Bridgestone), Granted Worldwide Pty Ltd (Granted Worldwide) and each of their related corporations and associated agencies are not eligible to enter the Competition. 3. Competition Period 3.1 The Competition commences at 12:00pm Australian Eastern Daylight Time (AEDT) on 10 October 2014 and closes at 10:00am AEDT on 15 December 2014 (Competition Period). 3.2 Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win. 4. How to enter Eligible entrants must, during the Competition Period: (a) (b) (c) go to the FOX SPORTS website (www.foxsports.com.au/win) and follow the link to the Competition; correctly answer the entry question, Which tyre is Bridgestone s ultimate performance tyre? ; and enter the details requested.
5. Draw, prize and notification 5.1 The Competition is a game of chance. All valid entries received during the Competition Period will be entered into a random computerised random draw. 5.2 The random computerised draw will be conducted by Mike Da Silva & Associates (Aust) Pty Ltd (MDSA) on behalf of the Promoter at Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089 at 12:00pm AEDT on 16 December 2014. The prize winner will be notified in writing within 2 business days of the draw. The prize winner s name will also be published in the Public Notices section of The Australian newspaper on 19 December 2014. 5.3 The entrant with the first valid entry drawn will win an Ultimate Driver Experience in Germany in 2015 comprising: Frankfurt (a) (b) (c) (d) (e) return economy airfares for the prize winner and one travel companion from the Australian capital city nearest to the prize winner s place of residence to Frankfurt, Germany, including all associated flight taxes, valued at a maximum of A$7,110; airport/hotel transfers in Frankfurt, valued at a maximum of A$600; 3 nights twin share accommodation in a 4 star hotel in Frankfurt, valued at a maximum of A$2,100; two 2-day tickets to the 2015 Frankfurt Motor Show, valued at a maximum of A$300; two first class train tickets from Frankfurt to Stuttgart, valued at a maximum of A$900; Stuttgart (f) (g) (h) (i) 4 nights twin share accommodation in 4 star hotel in Stuttgart, valued at a maximum of A$2,210; two tickets for a private guided tour of the Porsche Museum and Factory in Stuttgart, valued at a maximum of A$1,660; two tickets for a guided tour of the Mercedes-Benz Museum in Stuttgart, valued at a maximum of A$260; two return first class train tickets from Stuttgart to Frankfurt, valued at a maximum of A$870; Adenau (j) (k) return train station/hotel transfers, valued at a maximum of A$3,320 3 nights twin share accommodation at the Landhaus Sonnenhof Hotel in Adenau, valued at a maximum of A$1,420;
(l) (m) a co-pilot passenger experience in an Aston Martin driven by an experienced Nurburgring Racing Driver for the prize winner and their companion on the Nürburgring Nordschleife (one lap), valued at a maximum of A$2,180; a Backstage Tour of Nürburgring and admission to the Nürburgring Ring Werk Museum for the prize winner and their companion, valued at a maximum of A$210; General (n) (o) A$5,000 for spending money; travel insurance with Aussietravelcover Pty Ltd for persons up to and including 50 years of age at the date of departure from Australia under paragraph 5.3(a) above, valued at a maximum of A$750. Without limiting paragraph 5.12 below, If the prize winner or their companion is aged 51 years or older at the date of departure, then the prize winner and/or their companion will be responsible for any additional travel insurance premiums and/or expenses payable as a result of being 51 years of age or older at the date of departure. 5.4 The total prize value is A$28,890 (including GST). 5.5 The prize winner s companion must be aged 18 years or over. 5.6 The prize winner and their companion must depart Australia between 10 September 2015 and 24 September 2015. The Promoter will determine the travel dates in consultation with the prize winner and Granted Worldwide. Travel dates must be determined at least 90 days before the requested departure date unless stated otherwise. 5.7 The prize winner acknowledges that, as at the commencement of the Competition Period, the admission dates for the prize in paragraphs 5.3 (d), (g), (h), (l) and (m) have not been determined by Granted Worldwide. 5.8 The prize set out in paragraph 5.2(n) above will be provided to the prize winner via electronic funds transfer. The Promoter will request the prize winner s bank account details once the prize winner has accepted the prize and will provide those bank account details to Granted Worldwide for the purpose of conducting the electronic funds transfer. The Promoter accepts no liability for prizes lost in transit if the prize winner supplies incorrect bank account details. 5.9 The prize winner acknowledges that the prize may be subject to additional terms and conditions imposed by third party prize suppliers including but not limited to, Bridgestone, Granted Worldwide and any venue operators. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. The Promoter does not accept responsibility and is not liable for any additional conditions imposed on the taking of the prize by Bridgestone, Granted Worldwide, a venue operator or any other third party prize supplier or the breach of those conditions by any person.
Without limiting the foregoing, additional terms and conditions including but not limited to following apply in respect of the prize in paragraph 5(l) above: (a) the passenger must be maximum weight of 90kg and must be a maximum height of 190cm; and (b) without limiting paragraph 8.1 below, the prize winner and their companion acknowledge that their participation in the prize will involve physical activity and exertion and may result in injury. The prize winner and their companion participates in the prize at their own risk and will be required to sign a release and indemnity form prior to participating in the prize. The prize winner and their companion must comply with all directions of the prize organiser and venue operators in connection with the participation in the prize. 5.10 The Promoter accepts no responsibility for any variation in the value of a prize. The prize is not transferable or exchangeable. The prize is not redeemable for cash and must be taken as offered. In the event that any element of the prize is not available, the Promoter reserves the rights to substitute a prize of equal or greater value, subject to written directions from State regulatory bodies. 5.11 The prize winner is responsible for all expenses not specified in these Conditions of Entry, including but not limited to, any spending money not stated above, meals, any insurance not stated above (including medical, travel and health), transport to and from the prize winner s nearest capital city, any transfers not stated above (including but not limited to, transfers to activities while in Stuttgart and Adenau), items of a personal nature (including but not limited to in-room charges, tips, telephone and laundry) and all other ancillary costs. 5.12 If for any reason the prize winner does not take an element of the prize during the stated period and on the conditions stipulated by the Promoter or any third party prize suppliers, that element of the prize will be forfeited. Cash will not be awarded in lieu of that element of the prize. 5.13 The prize winner and their companion are responsible for travel documentation (including passports and visas) and compliance with any health or other government requirements. The prize winner and their companion must possess a valid passport with a minimum of six months validity from the date of scheduled return to Australia under paragraph 5.3(a) above. 5.14 Prize travel is subject to fare rules and other conditions of carriage. Tickets will not be exchanged for another destination. The prize winner and their travel companion cannot upgrade any prize travel or prize accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any prize flights or with any prize accommodation. The prize winner and their travel companion must travel together on the same flights on all sectors and stay together at the nominated hotels. Prize travel must be taken in order to coincide with the prize in paragraph 5.3 above. Prize travel may not be changed by the prize winner or travel companion under any circumstances. If the prize winner cannot travel in accordance with these Conditions of Entry and on the flights nominated by the Promoter, the prize will be forfeited.
Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice. 6. Unclaimed prizes 6.1 If the prize is unclaimed by 12:00pm AEDT on 16 March 2015, a random computerised second chance draw will be conducted for the unclaimed prize by MDSA on behalf of the Promoter at Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089 at 12:00pm AEST on 7 April 2015, subject to written directions from State regulatory bodies. 6.2 The winner of the second chance draw, if any, will be notified by telephone and in writing within 2 business days of the draw. The prize winner s name will be published in the Public Notices section of The Australian newspaper on 10 April 2015. 7. Information for prize winner All entrants agree to provide the Promoter or the Promoter s authorised agent with identification and/or proof of age if selected as a prize winner. In accepting a prize, the prize winner agrees to the limitation of liability set out below. The form of identification and/or proof of age are at the discretion of the Promoter. 8. Limitation of liability 8.1 Except for any liability that cannot by law be excluded (including as set out under paragraph 8.2), the Promoter, its related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant (including the prize winner and their companion) in connection with the Competition or a prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death. 8.2 Nothing in these Conditions of Entry limits, excludes or modifies, or purports to limit, exclude or modify, the statutory implied guarantees/warranties as provided under the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth), including the statutory consumer guarantees under the Australian Consumer Law, or similar laws in the States and Territories of Australia. 9. Privacy By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant s personal information to assist in conducting the Competition and communicating with the entrant in regard to special offers from the Promoter and its related entities. Entrants in the Competition acknowledge that the Promoter may share an entrant s personal information with the Promoter s Australian and foreign related entities which may contact the entrant with marketing messages and special offers. Without limiting the foregoing, the Promoter may disclose the prize winner s personal information to third parties for the purpose of fulfilling the
prize. If an entrant elects to receive information from other third parties, the Promoter may also disclose the entrant s personal information for that purpose. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth). Entrants may find out more information about how the Promoter collects, uses and discloses personal information by reading the Promoter s Privacy Policy, which is available at http://www.foxsports.com.au/about-us/privacy. Entrants may access the personal information the Promoter holds about them by writing to the Promoter at the address set out below. If the Promoter limits or denies an entrant access to their personal information in certain circumstances, the Promoter will tell the entrant why access was limited or denied. The entrant can contact the Promoter by writing to the Promoter at 4 Broadcast Way, Artarmon NSW 2064. 10. General 10.1 By entering the Competition, the prize winner agrees that: (a) if requested by the Promoter, the prize winner will: i. provide comments about the Competition and/or a photograph or audio-visual clip of themselves; and ii. participate in a promotional shoot in connection with the Competition; (b) (c) (d) (e) the Promoter may use the prize winner s name, image, comments, photographs or clips (Materials) for publicity and promotional purposes in any form of media, without reference or compensation to the winner or any other person; the Promoter may use, reproduce, edit and communicate to the public the Materials at any time in any form of media; the Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same; and the prize winner unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of their moral rights in the Materials and waives all moral rights in the Materials that arise outside Australia. 10.2 In the event that there is a dispute concerning the conduct of this Competition, the Promoter s decision is final and binding and no correspondence will be entered into. 10.3 The prize remains the property of the Promoter until it is delivered to the selected prize winner or unclaimed prize winner as the case may be. 10.4 If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any causes beyond the Promoter s control which corrupt or affect the fairness or integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Competition, subject to written directions from State regulatory bodies.
10.5 The Promoter reserves the right to disqualify any entrant who conspires with others to gain an unfair advantage or who is otherwise involved in manipulating, interfering or tampering with the entry process or any other element of the Competition. The use of any automated entry software or any mechanical, electronic or other means which allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 10.6 No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. or due to periods of unavailability of the entry mechanism during the Competition Period. 10.7 The prize winner is advised that tax implications may arise from the prize and should seek independent financial and taxation advice prior to acceptance of the prize. The prize winner is responsible for all taxes (excluding airfare and airport taxes in the prize as set out in paragraph 5.3(a) above and GST) which may be payable as a consequence of receiving a prize. 10.8 It is the entrant s responsibility to inform the Promoter of any change to the entrant s contact details, including their email address or telephone number. 10.9 This Competition is authorised under NSW Permit No. LTPS/14/07830, ACT Permit No. TP14/03457, VIC Permit No. 14/5320 & SA Licence No. T14/1841.
