Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia Search for Australia s Smart School Savers Promotion (the Promotion ) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by any person is deemed as acceptance of these Conditions of Entry. 2. The Promoter is the Commonwealth Bank of Australia, ABN , of Level 13, Darling Park Tower 1, 201 Sussex Street Sydney NSW Telephone: (the Promoter ). 3. The Promotion commences on 7 October, 2014 at AEST and closes on 31 October, 2014 at AEST (the Promotion Period ). 4. Entry into the Promotion is only open to individuals who satisfy the following eligibility requirements ( Eligibility Requirements ): Individuals must be an Australian resident; Individuals must be aged between five and 12 years of age; Individuals must not be employees (or members of their immediate family) of the Promoter or the Promoter s related entities directly involved in the Promotion (as determined by the Promoter). Immediate family means any of the following: spouse, exspouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin; and Have not already entered the Promotion. 5. Entrants must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. 6. To enter, individuals must satisfy the Eligibility Requirements and, during the Promotion Period: Answer the question in 50 words or less; Tell us in 50 words or less what you are saving for, and how you plan to save your money to achieve it. Don t forget to include your top tips for saving! in the provided box within the Search for Australia s Smart School Savers competition landing page on the CommBank blog.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 8. Only one (1) entry is permitted per person. 9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 10. This Promotion is a game of skill and chance plays no part in determining the winners. Entries will be judged by a representative of the Promoter and will be judged based on originality and creativity of the answer provided to the promotional question. Winners will be notified by . The Promoter s decision is final and no correspondence will be entered into. 11. The Promoter will select one winning entry from each of the following regional areas: NSW & ACT QLD MELB SA WA & NT TAS Each of the six regional winners will receive two ipad devices one for the winner and one for their school. 12. The best overall entry from the regional winners, as determined by the Promoter, will receive $1,000 in addition to the regional prize above. 13. The entries will be judged by a representative of the Promoter at 201Sussex St NSW 2000 on Wednesday 5 November, Winners will be notified by or phone within three (3) days of the date of judging. 14. Winners may not choose their own prize. 15. Any ancillary costs associated with redeeming the prize are not included. Redemption of the prize is subject to any terms and conditions of the promoter.

3 16. Incomplete, ineligible or incomprehensible entries will be deemed invalid. 17. Total prize pool value is $6, The winners accept the prizes as they are and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from their prize winnings. Winner should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser. 19. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. 20. As a condition of entering this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). 21. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 22. In the event that for any reason whatsoever the winner does not take the prize at the time stipulated by the Promoter then that the prize will be forfeited by that winner. 23. If any winner fails to claim their prize by 28 November, 2014 the Promoter may select further winning entries on 1 December, 2014 subject to any written directions given under applicable trade promotion laws and regulations. 24. As a condition of accepting the prize, each winner must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form. 25. If for any reason this Promotion is not capable of running as planned (including, but not limited due to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the

4 administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify any entrant who tampers with the entry process. 26. The Promoter is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person s computer related to or resulting from participation in or downloading any materials in this Promotion. 27. Any cost associated with accessing the promotional website is the entrant s responsibility and is dependent on the Internet service provider used. 28. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ( Non- Excludable Guarantees ). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion. 29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by the winner or entrant; or (f) use/redemption of the prize. 30. All entries become the sole property of the Promoter. The Promoter collects entrant s information so that it may process their entry, administer this Promotion and contact the entrant regarding information on products or services that may be of benefit or interest to the entrant (for an indefinite period unless otherwise advised). ). These Conditions of Entry shall be governed by the laws of Australia and each entrant agrees to submit to the non-exclusive jurisdiction of Australia.
