1 Standard Bonus Bet and Account Top Up Terms and Conditions 1. General Entry 1.1 Information sent or communicated to you via any Luxbet webpage, , letter, SMS, phone call, advertisement or any other type of communication (the Notification) on how to enter a Luxbet bonus bet or bonus account top up (the Bonus) promotion (the Promotion) form part of these terms and conditions (the Terms and Conditions) and prevail to the extent of any inconsistency. 1.2 The promoter is Luxbet Pty Limited, Level 31, 680 George Street, Sydney, ABN (the Promoter). 1.3 Subject to clauses 1.4 and 1.5, entry is open to Australian residents over the age of 18 who hold an Australian dollars Luxbet account in their name (an Eligible Participant). 1.4 Residents of SA, VIC, NSW and WA are ineligible to participate in the Promotion unless they opened their Luxbet account before receiving Notification of the Promotion or before the Promotion is advertised (whichever is earlier). 1.5 QLD residents are ineligible to participate in certain promotions, please check any Notification of the Promotion for details. 1.6 By entering and/or participating in the Promotion, each Eligible Participant agrees to abide by these Terms and Conditions. 1.7 Directors, officers and employees of the Promoter and its related companies are not eligible to participate in the Promotion. 1.8 This Promotion is not to be used in conjunction with any other offer that has or may in the future be offered by the Promoter. For example, a Bonus obtained in this Promotion cannot be used to participate in any other another Promotion offered by the Promoter. 1.9 This Promotion is only available to the customer to whom Notification has been directed to, and may not be on-forwarded to, and the offer may not be taken up by, any other person. 2. Term of Promotion The Promotion commences at the time specified in the Notification of the Promotion and continues until cancelled by the Promoter (Promotion Period). 3. How to Enter 3.1 Any Eligible Participant that during the Promotion Period: 1

2 receives Notification of the Promotion; and adheres to these Terms and Conditions and any Terms and Conditions contained in the Notification, including by satisfying the requirements to obtain a Bonus, will qualify to receive a Bonus (each a Winner). 4. The Bonus 4.1 The Bonus 4.2 Costs Each Winner will receive a Bonus as outlined in the Notification. All other costs associated with the Bonus, including but not limited to any applicable taxes, insurance, and other ancillary costs are the responsibility of the Winner. 4.3 Bonus Specific Conditions Unless otherwise advised in any Notification of the Promotion: each Eligible Participant who is a Winner qualifies to win a maximum of one (1) Bonus only per Promotion, unless otherwise advised. a Bonus and any winnings accrued using a Bonus will not be awarded and/or will be cancelled in any one or more of the following circumstances: (iii) (iv) (v) (vi) (vii) multiple Luxbet betting accounts or bonus bet accounts accessed from the same location, computer, device or IP address; multiple Luxbet betting accounts or bonus bet accounts sharing the same name; Luxbet betting accounts or bonus bet accounts belonging to the same family and/or household; Luxbet betting accounts or bonus bet accounts sharing a common contact detail or identifier (e.g. household address, address, telephone number, credit/debit card number); multiple Luxbet betting accounts or bonus bet accounts belonging to the same person; breach of any of these Terms and Conditions; reasonable suspicion by the Promoter of collusion between Eligible Participants in placing of bets. 2

3 (c) (d) the Bonus can only be used in accordance with clause 4.4. If the Bonus returns a winning dividend, your winnings (excluding the Bonus stake) will be credited to your Luxbet betting account (Bonus Winnings). You will have no entitlement to any Bonus stake. the full amount of: the Bonus must be turned over in accordance with clause 4.4; and the Bonus Winnings must be turned over (that is, wagered in a single bet or multiple bets) at odds of $1.50 or greater per $1 bet; (the Bonus Minimum Turnover Threshold) within the period specified in the promotion, or, if no such period is specified, within 30 days of the Winner receiving the Bonus (Bonus Period), prior to the Promoter allowing a Winner to withdraw the Bonus Winnings or part thereof from their Luxbet betting account. (e) (f) (g) (h) the full amount of any deposit made to obtain a Bonus (if applicable) (Bonus Deposit) must be turned over (that is, wagered in a single bet or multiple bets) at odds of $1.50 or greater per $1 bet before a Winner can withdraw the Bonus Deposit or part thereof from their Luxbet betting account (Deposit Minimum Turnover Threshold). Bets placed on different outcomes in the same event do not count towards the Bonus Minimum Turnover Threshold in clause 4.3(d) or the Deposit Minimum Turnover Threshold. If the Bonus Minimum Turnover Threshold has not been met within the Bonus Period, the Bonus (if it has not already been used), and any Bonus Winnings (if the Bonus has been used) will be cancelled from the Winner s Luxbet betting account or bonus bet account, and the Winner will no longer be able to bet using the Bonus or any Bonus Winnings. The Bonus must be taken as offered and cannot be varied or redeemed for cash. The Bonus value is GST inclusive and is in Australian dollars. The Bonus cannot be transferred. 4.4 Use of Bonus and Bonus Winnings Each Bonus allocated to a Winner will be combined with other Bonuses currently within a Winner s bonus bet account to create a total bonus bet balance (Bonus Bet Balance). 3

4 (c) Bonus Bet Balance can only be used by placing a bonus bet of $10 or more (up to the value of the Bonus Bet Balance at the time) on any market eligible for a bonus bet. If your Bonus Bet Balance is less than $10, you cannot use the Bonus Bet Balance until it is increased to $10 or more. Bonus Bet Balance cannot be used under clause 4.4 to place : (iii) a multi bet or exotic bet; a bet on a market not eligible for a bonus bet (e.g. a promotional market); or separate bets on all contingencies in a two or three contingency market. If this occurs, Luxbet may, in the case of and, void the bonus bet, or, in the case of (iii), void the last bonus bet placed on the market, but allow the other bonus bets to stand. The value of a void bonus bet will be returned to your Bonus Bet Balance as if that bonus bet was never submitted. (d) For the purposes of clause 4.3(d), Luxbet will deem a bonus bet placed under clause 4.4: to have been turn over of all or part (as applicable) of the Bonus which expires next; and if the bonus bet placed was greater than the value of the Bonus in 4.4(d), in relation to the remaining amount of the bonus bet placed not allocated under 4.4(d), to have been turn over of all or part (as applicable) of the Bonus which expires next after that Bonus, and so on until the full amount of the bonus bet placed has been allocated to a particular Bonus. (e) For example: (iii) 4 if a customer has two Bonus bets, one $60 Bonus expiring within 15 days and one $40 Bonus expiring within 30 days, they will have a total Bonus Bet Balance of $100; if the customer places a $20 bet with their Bonus Bet Balance, they will be deemed to have used $20 of their $60 Bonus (being the Bonus which expires next); if the customer then places a $60 bet with their Bonus Bet Balance, they will be deemed to have used the remaining $40 of their $60 Bonus (being the Bonus which expires next) and then $20 of their $40 Bonus;

5 (iv) after these two Bonus bets, they will then have a $20 Bonus Bet Balance remaining, all with the expiry date of the $40 Bonus. (f) For the purposes of clause 4.3(d), when a customer places a bet with their standard account balance that satisfies the turnover requirements in clause 4.3(d) and 4.3(f), and the customer has Bonus Winnings that need to be turned over, Luxbet will deem the bet to be use of the appropriate amount of Bonus Winnings which expire next, in the same manner as applies to bonus bets under clause 4.4(d) until the full amount of the bet has been allocated to particular Bonus Winnings. 4.5 Recreational Gamblers only This Promotion is intended for recreational gambler s only. The Promoter reserves the right to refuse to award the Bonus to, or remove a Bonus and any winnings accrued using a Bonus from, any Eligible Participant if the Promoter has a reasonable belief that the Eligible Participant is a professional gambler. The Promoter will advise the Eligible Participant in writing of its decision. The Eligible Participant will have 14 days to request that the Promoter conduct a review of its decision. Requests must be made in writing and directed to the Promoter at its address set out in clause 1.2 of these Terms and Conditions. Requests must address why he/she is a recreational gambler and not a professional gambler. The review will be conducted by someone other than the person who made the original decision. Subject to any regulator direction to the contrary, the decision of the review will be deemed final. In accordance with the above, and in addition to clause 4.3 of these Terms and Conditions, only one (1) Bonus is payable per name, household address, address, IP address, telephone number or payment method detail (E.g. credit card/debit card number). 5. Promoters right to cancel or refuse the Bonus/Bonus winnings 5.1 The Promoter reserves the right, at its sole discretion, to refuse to award a Bonus to, or cancel a Bonus and any winnings accrued using a Bonus from, any Eligible Participant s Luxbet bonus bet account or their Luxbet betting account where: 5

6 the Promoter has formed the reasonable belief or suspicion that any one or more of the circumstances in clause 4.3 apply to an Eligible Participant or the account of an Eligible Participant; or the Eligible Participant has breached any of these Terms and Conditions. 6. Delivery of Bonus Unless otherwise advised, the Bonus will be paid by way of a special account top-up into the Winner s Luxbet account (in the case of an account top up) or bonus bet account (in the case of a bonus bet) within one (1) business day of the Winner satisfying the conditions in clause Tax issues Any taxes which may be payable as a consequence of the Winner receiving the Bonus are the sole responsibility of the Winner. The Promoter encourages the Winner to seek independent financial and tax advice about any tax implications that may arise from the Bonus winnings. 8. Exclusion of Liability 8.1 Whilst the Promoter will use all reasonable endeavours to arrange the delivery of the Bonus in accordance with clause 6 of these Terms and Conditions, by entering this Promotion, Eligible Participants acknowledge that circumstances beyond the control of the Promoter may prevent the delivery of the Bonus by that date, and the Promoter will not accept any liability for any loss because of such a delay. In such circumstances where the Promoter forms a reasonable belief that any delay or loss of the Bonus has not been caused or contributed by an Eligible Participants negligence, fraud or misconduct, the Promoter may (if circumstances permit) re-deliver the Bonus to the Eligible Participant. 8.2 To the extent permitted by law, the Promoter is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by the Promoter or their servants or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to an Eligible Participant. 8.3 Nothing in these Terms and Conditions affect, nor is intended to affect, any rights that an Eligible Participant might have that are not able to be excluded under applicable Australian consumer protection laws. 6

Use of Personal Information / Marketing 9.1 The Promoter complies with the National Privacy Principles contained in the Privacy Act 1988 (Cth). 9.2 Any entries become the property of the Promoter. Any information Eligible Participants provide will be used by the Promoter for the purpose of conducting this Promotion. 9.3 The Promoter may disclose Eligible Participants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with Eligible Participants. 9.4 By entering the Promotion, Eligible Participants consent to their personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion, and business partners for any promotional activities, including Eligible Participants personal participation in reasonable promotional activities as requested by the Promoter, and any marketing and publicity purposes without any further reference, payment or other compensation to the Eligible Participant. 9.5 Eligible Participants consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion and business partners to send Eligible Participants future electronic messages including but not limited to, SMS, MMS, and regarding any promotional, marketing and publicity activities. 9.6 All Eligible Participants consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable Promotion activities as requested by the Promoter. 9.7 For more information, refer to the Promoter s Privacy Policy located on the Promoter s website, General Conditions 10.1 The Promoter, its employees, officers, agents, and its parent companies and subsidiaries are not responsible for and shall not be liable for: any condition caused by events beyond the control of the Promoter that may cause the Promotion to be disrupted, delayed, corrupted or cancelled; any injuries, losses (including, without limitation, loss of profits), or damages of any kind caused by the Bonus or resulting from acceptance, possession, use, or misuse of the Bonus, or from 7

8 participation in the Promotion or downloading material from or (c) any printing or typographical errors in any materials associated with the Promotion The Promoter reserves the right to: (c) (d) (e) cancel or suspend the Promotion, should the security, fairness, integrity, or proper operation of the Promotion be compromised in any way by way of any computer virus or bugs in the IT system used for this Promotion; unauthorized human intervention; or other causes beyond the reasonable control of the Promoter; disqualify any Eligible Participant who engages in offensive, illegal or objectionable conduct in respect of this Promotion; disqualify any Eligible Participant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions; cancel, terminate, modify or suspend the Promotion in accordance with any written directions given by any relevant government or regulatory authority to do so; or request an Eligible Participant provide proof of age, identity or proof of residency at the nominated Bonus delivery address In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the Promotion or part of the Promotion and recommence it from the start on the same conditions subject to Australian law By entering this Promotion, Eligible Participants acknowledge that it is a condition of accepting the Bonus that they may be required to sign a legal release in a form determined by the Promoter and agreed to by the Eligible Participant, acting reasonably To the extent that a situation or issue arises for which these Terms and Conditions make no provision or in relation to which the relevant Terms and Conditions are unclear, the Promoter will make a decision regarding such situation. The Eligible Participant will have the right to request a review of the Promoter s decision. Requests must be made in writing and directed to the Promoter at its address set out in clause 1.2 of these Terms and Conditions. The review will be conducted by someone other than the person who made the original decision. Subject 8

9 to any regulator direction to the contrary, the decision of the review will be final In the event that an Eligible Participant is identified as a minor, self excluded patron, problem gambler, involuntarily excluded patron or any other person who is in breach of these Terms and Conditions (the Refused Winner), the Promoter reserves the right to refuse to provide the Bonus, cancel the Bonus or any winnings obtained using the Bonus, and the Promoter will notify any relevant regulator accordingly where required by law to do so. If any Bonus associated with a deposit has been used by the Refused Winner but the corresponding deposit has not, the Promoter may, in addition to any other right it may have, deduct an amount equal to the value of the Bonus used from the Eligible Participant s Luxbet betting account. 9
