ISSUE Motion made by John Banken, seconded by Barry Burton authorizing the Orange County RESOLUTION Commissioners Court to issue a Resolution appointing Stephen Brint Carlton, Orange County Judge as director of the Gulf Coast Community Protection and Recovery District, Inc. and appointing Victor Pierson, President of Moody National Bank in Galveston, Texas, as an at-large director of Gulf Coast Community Protection and Recovery District, Inc. 2. ISSUE Motion made by John Banken, seconded by Barry Burton authorizing the Orange County RESOLUTIONS Commissioners Court to issue the first part of sixteen (16) resolutions that were recommended by the County Judge and Commissioners Association of Texas. The five (5) 2014 State Legislative Resolutions issued today were (1) Opposition to Unfunded Mandates, (2) Opposition to Appraisal Caps and Revenue Caps, (3) Opposition to Diversion of Dedicated Funds, (4) Emergency Services Program and (5) Indigent Health Care. 3. REVENUE Motion made by Jody Crump, seconded by John Banken to file in the minutes of the Court RECEIVED revenue received from the GLO by direct deposit in the amount of $262,996.13. This is payment for request #4 on the Ike 2.2 recover project. 4. BILLS PAID Motion made by David Dubose, seconded by John Banken authorizing payment of bills approved by the County Auditor as per attested listings and also specifically as follows: a. $21,652.83 to U.T.M.B. from the General Fund (001.111.54235) for contract payment due February 15, 2015. b. $465,806.42 to Texas Association of Counties Health & Employees Benefits Pool from the General Fund (001.101.51270) for Group Medical, Dental, Life & Retiree Insurance for February 2015. INTERVIEW Motion made by Jody Crump, seconded by Stephen Brint Carlton to move forward to APPLICANTS interview the remaining five (5) applicants for the Personnel Director position. 7. APPOINT Motion made by John Banken, seconded by Jody Crump to appoint three (3) members to BOARD the Adjustment and Appeals Board. The three (3) members will be Henry Ainsworth, MEMBERS Norman Blackman, and Steven Gault. Two (2) more members will still need to be appointed. 8. PURCHASE Motion made by Jody Crump, seconded by John Banken approving the purchase of a hand RADIO held radio and police vehicle radio and approving the $230 programming fee to come out of contingency. These items were budgeted items excluding the programming fee. 9. WAIVING Motion made by David Dubose not to waive the Penalty, Interest, and Attorney s Fees OF FEES associated with Biehslich Newsum, Inc., dba GT Auto, (Tax Account #008094-002170) following the legal opinion of the tax attorney Steven Bird and legal counsel for the County. Motion died for lack of a second. NO ACTION Motion made by Stephen Brint Carlton, seconded by John Banken that the Court take no action on waving the Penalty, Interest, and Attorney s Fees associated with Biehslich Newsum, Inc., dba GT Auto, (Tax Account #008094-002170) on the basis that this Court does not have legal authority to take action one way or another. ACCEPT Motion made by Jody Crump, seconded by John Banken to accept and record in the minutes REPORT of the Court the audited Annual Financial and Compliance Report for Spindletop Center. 11. RENEW Motion made by David Dubose, seconded by Barry Burton to approve and accept the renewal CONTRACT contract, Interlocal Cooperation Act Contract and UTMB Business Associate Agreement between Orange County and The University of Texas Medical Branch in Galveston, Texas for specialized care and other medical treatment, if needed, for the participants of the Orange County Indigent Health Care Program. The term of the contract shall be from September 1, 2014 through August 31, 2015. Upon approval, Judge Stephen Brint Carlton will sign each copy of the contract and agreement and return the originals to Social Services. Page 4 of 6

COMMENTS John Banken announced that Orangefield Water Supply Corporation is now taking applications from citizens of the Victory Gardens subdivision to put them on water and sewer. He encourages the citizens to sign up now at the greatly reduced rate and for more information they could contact Mr. Joe Martin at 409-735-9422. This would help with the cleanup of the pollution in Cow Bayou. Stephen Brint Carlton stated that he appreciates the help of Orangefield Water Supply Corporation on this and encourages the citizens to participate. He also stated that he was away at a Judicial Conference in Lubbock but is glad to be back home. Sonny Stevenson asked if the Appeal Board, when appointed, would be able to help Mr. Biehslich and if the Appeal Board would have the authorization to act on any situation similar to Mr. Biehslich s. He also welcomed County Judge Stephen Brint Carlton and Commissioner Barry Burton to the Court and thought they would do a fine job. Joel Ardoin announced that a public hearing regarding the Cow Bayou issue would be held on February 19, 2015 at 6:00 P.M. at Sabine River Authority located on North Highway 87. David Smith asked a question regarding agenda item #9. He asked should a taxpayer refuse to pay penalties, then would the Court have authority to pursue that person and make them pay the penalties.
