Terms and Conditions Organiser 1. By participating in the Win Big Contest ( Contest ) jointly organised by AEON BIG (M) SDN. BHD. ( AEON BIG ) and Malaysian Electronic Clearing Corporation Sdn Bhd ( MyClear ) (collectively referred to as Organisers ), the customer who participates in the Contest ( Customers ) is agreeing to be, and shall be, bound by these terms and conditions and all amendments, additions, replacements and modifications hereto ( Terms and Conditions ) as may be made from time to time by the Organisers. 2. The Contest is open to holders of ATM cards issued by participating e Debit Financial Institutions in Malaysia (the Cardholders ). Only Cardholders who are 18 years of age and above on/before 29 August 2014 and have a valid identification document (example: identity card or passport) are eligible to participate in the Contest. 3. Only PIN based ATM e Debit card transactions are accepted for the Contest. Duration This Contest shall commence at all AEON BIG stores nationwide from 00:00 29 August 2014 until 23:59 4 December 2014 ( Contest Period ). Qualifying Criteria 1. There will be three stages for the Contest : a) Submission of entries; b) Selection of participants; and c) Free shopping game called Supermarket Sweep. Customers need to successfully go through each stage to be able to go through the next stage. In the event of non compliance with the Terms and Conditions, Customers will not proceed to the next stage. 2. Customers who are Cardholders ("Participants" and individually a "Participant") must charge their retail purchase transactions in minimum amount of Ringgit Malaysia Eighty (RM80.00) in a single receipt. The payment of such purchase must be paid via ATM Debit card. Eligible Entries must be submitted before the Contest Period ends. Eligible Entries received outside the Contest Period will not be entertained and considered. 3. In order to qualify as an eligible Participant, a Participant must have an ATM card account which is valid, non dormant and in good financial standing, and remain valid, non dormant and in good financial standing during the Contest Period and until redemption of the prizes. 4. Directors, officers and employees as well as their parents, spouse and children of the Organisers, as well as advertising agencies of the Organisers are not eligible for participation in the Contest.
Submission of Entries 1. Eligible Entry shall be determined in accordance with the following : a) Each retail purchase transaction which is made during the Contest Period, by the Participants in Ringgit Malaysia Eighty (RM80.00) or more in a single receipt shall be eligible as an entry ( Eligible Entry ). Participants are eligible to one (1) Contest form per receipt which can be collected from AEON BIG s information counter. There is no limit to number of Eligible Entry submitted by a Participant. b) The Contest form must be submitted at the AEON BIG store where the purchase was made. c) Contest forms that are incomplete, unclear, photocopied, without attachment of original receipt of valid purchase, without submission stamp by AEON BIG and/or not satisfactory in any way howsoever will be disqualified at the Organisers sole and absolute discretion. d) Any participants who violate the Terms and Conditions, tamper with the operation of the Contest, perpetrate fraud or abuse, or engage in any conduct that is detrimental or unfair to the Organisers, the Contest or any other Participant (in each cases determined in the Organiser s sole discretion) are subject to disqualification from participation in the Contest. The Organisers reserve the right to disqualify Participant(s) whose eligibility is in question or who is otherwise ineligible to participate in the Contest and to have any declared prize for such Participants forfeited forthwith. Selection of Participants 1. At the end of the Contest Period, the Organiser shall randomly select twelve (12) Participants (with correct answers) who ( Selected Participants ) will stand a chance to participate in a supermarket sweep game to be held by AEON BIG on a designated day. 2. AEON BIG shall notify the Selected Participants by telephone and e mail and will provide details to participate in the Supermarket Sweep as the Selected Contestant. A maximum of three (3) telephone calls will be made to each Selected Participant. Should all three (3) phone calls are not answered, the Selected Participant is deemed not contactable. 3. Only Selected Participants who accept telephone call invitations from AEON BIG will be able to participate in the Supermarket Sweep ( Selected Contestants ). 4. At the end of the Contest Period, the results of the Selected Contestants will be published at the Organisers websites.
Supermarket Sweep 1. The Selected Contestants shall notify AEON BIG of his/her agreement to participate in the Supermarket Sweep by replying to AEON BIG s e mail within ten (10) days from date of AEON BIG s e mail. 2. Eligibility of participation is transferable only with the consent of the Organisers, provided always that the Organisers shall have sole and absolute discretion to allow or disallow such transfer. If the Selected Contestants, due to unavoidable reason requests for such transfer, he/she shall via e mail, notify the Organisers not later than five (5) working days. 3. In the event the Organiser decides to allow for any such transfer, AEON BIG or MyClear may request an authorisation/consent letter from the Selected Contestants pertaining to such transfer. 4. In the event any of the Selected Contestants declines to participate in the Supermarket Sweep, then he/she will be disqualified and the Organisers shall be at liberty to select a substitute. Supermarket Sweep Day 1. The Supermarket Sweep day will be held at AEON BIG Subang Jaya store on a day to be announced ( Supermarket Sweep Day ) by AEON BIG to the Selected Contestants. 2. All cost incurred by the Selected Contestants (including but not limited to transportation, accommodation and meals) to attend and participate in the Supermarket Sweep is the sole responsibility of the Selected Contestants. 3. In the event of no show during the Supermarket Sweep Day, such Selected Contestants will automatically be disqualified and no compensation or arrangements will be made for such disqualified Selected Contestants. 4. A list of Supermarket Sweep rules has been set and will be announced and given to the Selected Contestants on the Supermarket Sweep Day ( Rules of Supermarket Sweep ). 5. All Selected Contestants will be expected to practice due diligence and care when handling the trolley during the Supermarket Sweep. The Organisers will not be responsible for any injury or accident caused during the Supermarket Sweep.
Prizes 1. The Organisers reserves the right to change and/or recall any prizes from any winner(s) at any time at the sole discretion of the Organisers. The Organisers also reserve the right to recall any prizes from any winner who it reasonably suspects has violated the Terms and Conditions of the Contest and/or Rules of Supermarket Sweep, in which event, the winner(s) are obliged to return the prize(s) to the Organisers. The Organisers also reserves the right to pursue legal action against any individual who it believes has fraudulently or failed to declare that he/she is not parents, spouse or children, of the Organisers and related to the administration of the Contest. 2. Prizes are not exchangeable with cash. The Organisers reserves the right to change the prizes advertised with prizes of a similar value without prior notification at its sole and absolute discretion. The Organisers, its agencies, affiliates, sponsors and representatives are not responsible for defective prizes or misuse of any prize, or claims, liability, loss or damage arising out of or in connection with this Contest. 3. Prizes must be claimed on the Supermarket Sweep Day (at the winner s own costs). Any unclaimed prizes for whatsoever reasons will be forfeited. 4. All questions and disputes regarding the Contest and the prizes will be determined at the sole discretion of the Organisers. The Organisers decisions on all matters relating to the Contest are final and binding on all the Participants, Selected Participants, Selected Contestants, as the case maybe. No correspondences, objection or appeal will be entertained. 5. Selection of winners will be made and announced at the end of the Supermarket Sweep, based on the fulfilment of the criteria by the Selected Contestants as stipulated in the Rules of Supermarket Sweep. The judges decision is final and no correspondences, queries, appeals or protests will be entertained. 6. Each Selected Contestant is eligible to win only one (1) prize for the entire Contest Period.
Liability and Responsibility 1. The Organisers collect process and use the personal data submitted by Participants for the purpose of the Contest. 2. By participating in the Contest and by submitting personal data with the Organisers, Participants have consented to the use of his/her personal information for the aforementioned purposes. 3. All entry instructions and any other specific requirements relating to the Contest or the prizes (if any) form part of these Terms and Conditions. By particpating in the Contest, the Customer will be deemed to have read and understood the Terms and Conditions and specific requirements therein (if any) inclusive of the Data Protection & Privacy Notice as detailed below, be bound by them and abide by the decision of the Organisers. 4. The Participants, Selected Participants and Selected Contestant shall assume full liability and responsibility in the event of any liability, mishap, injury, loss, damage, claim, costs or accident resulting from their participation in this Contest, redemption and/or usage of the prizes. 5. All costs, fees and/or related expenses that are incurred during the participation in this Contest, winning, redeeming, receiving or using the prizes are the sole responsibility of the winners/participants/selected Participants/Selected Contestant. Rights of the Organisers 1. All decisions made by the Organisers in relation to the Contest including but not limited to the selection of participants, winners and forfeiture of prizes shall be final, conclusive and binding. No correspondence or appeals will be entertained. 2. The Organisers reserves the right to amend and/or change the Terms and Conditions of the Contest herein at Organiser s sole and absolute discretion at any time without prior notice. The Participants may obtain updated versions of the Terms and Conditions, if any, by logging on to the Organisers websites. The exercise by the Organisers of any of its foregoing rights shall not entitle any Participant or winner to any prize or claim for compensation against the Organisers or any of its affiliates. 3. The Organisers shall not be liable to any Participant s financial loss arising out of the refusal, cancellation or withdrawal of the Contest. 4. The Organisers may assign all rights granted by a Participant hereunder to any party at the Organisers sole discretion. 5. AEON BIG reserves the right to publish or display photographs of the winners for advertising and publicity purposes without prior notice/consent.
6. The Organisers reserves the right to extend, cancel, terminate or suspend the Contest for any reason whatsoever, without prior notice. Extension, cancellation, termination or suspension of the Contest by the Organisers shall not entitle the Participant(s) to any claim or compensation against the Organisers for any loss or damage suffered or incurred as a direct and indirect result of the act of cancellation, termination or suspension. General 1. Questions and inquiries about Contest can be inquired at any of AEON BIG s information counters or by logging to www.myclear.org.my or www.aeonbig.com.my at any time during Contest Period. 2. The Terms and Conditions of this Contest shall be governed and construed in accordance with laws of Malaysia and the exclusive jurisdiction of courts of Malaysia. 3. Time shall be of the essence of this Contest. Data Protection & Privacy Notice Your personal data including your name, NRIC number and/or contact details which you have provided in your application to participate in the Win BiG Contest ( Contest ) including any publicly available information available on social networking websites will be recorded, stored or otherwise processed by AEON BiG for purposes relating to the administration of the Contest and for related advertising, publicity, marketing and communication relating to AEON BiG ( Purpose ). Please be informed that your personal data may be disclosed to AEON BiG's affiliates, service providers and relevant business partners (if any), including MyClear for the Purpose and as permitted by applicable data privacy laws. You may request for access to or correction of the personal data, submit inquiries or complaints, or limit the processing of the personal data at any time hereafter by submitting such request to AEON BiG via e mail at dataprivacy@aeonbig.com.my. Please note that it will be necessary for us to process your personal data for the Purpose, without which you will not be able to participate in this Contest. By providing your personal data and submitting your application including your signature, you expressly consent and agree to the terms above with respect to the processing of you personal data by AEON BiG.
