Muffin Break 2015 Great Bake Sale Promotion Australian Terms & Conditions 1. Information on how to enter and the prizes form part of these conditions of entry. 2. The Promoter is Muffin Break Pty Ltd ACN 007 192 529 of Unit 215F1, Building 215, The Entertainment Quarter, 122 Lang Road, Moore Park, NSW, 2021 (PO Box 303, Double Bay, NSW, 1360). 3. The promotion will be administered by Capture Pty Ltd, 52 Victoria St Paddington NSW 2021. ABN 33070360931 4. Entry to the Muffin Break Great Bake Sale Promotion shall be deemed acceptance of these terms and conditions. 5. Entry is open to all Australian residents over the age of 13. If you are under the age of 18 you must obtain the prior permission of your parent or guardian to enter. 6. The promotion runs from 12.01AM AEST 19 October, 2015 to 02.00PM AEST 16 November, 2015 ( Promotional Period ). No entries outside the Promotional Period will be considered. Entry into Muffin Break Great Bake Sale Promotion 7. To enter, you must, during the Promotional Period: a) be a user of the Facebook platform; and b) visit the official Muffin Break Facebook page (www.facebook.com/muffinbreak); and Select your school though the Great Bake Sale application tab and then place your vote for the selected school. 8. The Promoter may disqualify any individual who the Promoter has reason to believe has breached any of these Conditions, or engaged in any unlawful or other improper misconduct which places the fair and proper conduct of the competition at risk. 9. No votes subsequent to the entrant s initial vote (established by chronological order) will be recognised as valid. Entrants will be identified by their Facebook ID and no votes placed beyond their initial vote will be counted towards their selected school s total. 10. The Promoter is not responsible for any technical malfunction of any communications network or any lost, late, delayed, ineligible, incomplete or corrupted entries, however this may happen.
Details of Prizes 11. This is a game of skill. Chance plays no part in determining the winners. 12. There are 9 prizes in total. 13. Six (6) Australian schools will receive an AUD$1000 ANZ Cash Card and 1000 Muffin Break muffins (to be selected by the Promoter in accordance with these conditions) (the Bake Sale prize ). 14. The total retail value of each Bake Sale prize is AUD$5,000.00. 15. One (1) school will receive the Grand Prize. 16. The Grand Prize consists of: a) one (1) ANZ Direct Cash Card pre-loaded with AUD$3,000.00; and b) 1,000 Muffin Break muffins (to be selected by the Promoter in accordance with these conditions) to sell to raise funds for their school. 17. The total retail value of the Grand Prize is AUD$7,000.00. 18. Total prize pool value is AUD for minor and major prizing is $37,000.00. in addition to this, there is AUD$3270.40 in secondary prizing, this totals $40,270. 19. In addition to the six (6) Bake Sale Prizes and the Grand Prize, there will also be a total of two (2) additional prizes to be awarded each fortnight during the Promotional Period. The fortnightly prize will be given to the school which has accrued the most votes during that fortnight (moved up the leader board the most) Prize below: 20. Prizes are awarded to the school faculty for educational purposes, not individual voters. 22. The Promoter suggests that the muffins awarded as part of the Bake Sale prize be sold at the recommended retail price of AUS$4. 23. Each Bake Sale prize and the Grand Prize will include 1000 muffins selected by the Promoter from their Weight Watchers, low fat or lower carb endorsed range. The available muffins are Choc Orange, Passionfruit & Pineapple, Peach Cinnamon, Raspberry Apple or Raspberry Choc. The Promoter retains full discretion as to what
muffins and what quantities of each flavour are included in any prize. If a winner would like to request particular quantities of the flavour of the muffins to be provided in their prize, they must notify the Promoter of this request. One revision is permissible. This revision will be final and at the discretion of the Promoter. Details of Determining Winners 24. Primary and high schools are eligible to receive any prize from the Great Bake Sale promotion. 25. The Great Bake Sale application will divide every school s total number of votes by their student population. 26. The resulting score (the Bake Sale score ) will determine which schools receive Bake Sale prizes and which school will receive the Grand Prize. 27. Schools with under 100 students will have their total student population rounded up to 100 and their Bake Sale score determined accordingly. 28. The recipients of the Bake Sale prize will be determined by the school with the highest Bake Sale score in their respective Australian State or Territory. 29. The school with the highest Bake Sale score of any participating school in all Australian States or Territories during the Promotional Period will receive the Grand Prize. The school that receives the Grand Prize will also be the state winner for the respective Australian State or Territory. The school will not receive the Bake Sale prize. The school will only receive the Grand Prize. 30. In the event of multiple schools in the same Australian State or Territory receiving the same Bake Sale score the Bake Sale prize will be divided in equal shares. 31. In the event of multiple schools in the same Australian State or Territory receiving the highest national Bake Sale score, the Grand Prize will be divided in equal shares. 32. The National & State Leader Boards within the Great Bake Sale Promotion tab that ranks schools by their estimated Bake Sale score are not exact measures of Bake Sale score and will not be used to determine winners of each Bake Sale prize and the Grand Prize. 33. All student populations are determined through publicly accessible data and no correspondence will be entered into by the Promoter on the subject of their mathematical or statistical validity. 34. The Promoter reserves the right to determine the Bake Sale score with the public data provided and determine winners accordingly. Details of Contacting Winners & Prize Delivery
35. Winners will be determined at 02.30PM AEST 16 November 2015 in the offices of Capture Pty Ltd, 52 Victoria St Paddington NSW 2021. 36. Winners will be notified at 03.00PM AEST 16 November 2015 by email or phone call where possible. 37. All winners will be notified by email or phone. 38. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute it for a prize of equal or greater value. 39. If any school declines the offer of any prize, or objects to any part of any prize, the Promoter reserves the right to award the prize to the school with the second highest total of votes in that respective Australian State or Territory. 40. The Promoter is not liable for any loss or damage or for personal injury suffered or sustained by the taking of the prize except for any liability which cannot be excluded by law. 41. If the Promoter is unable to contact the winner for the purposes of distributing the prize, that winner will forfeit the prize entirely and it shall be awarded to the next selected winner in the promotion. The Promoter will not be liable where a winner forfeits their prize. 42. In the event that any prize is not claimed by the winner within ten (10) working days of the close of 16 November 2015, an unclaimed prize draw will take place at 12.01pm on 1 December 2015 in Slingshot Digital Ventures, Level 11, 68 York Street, Sydney, NSW 2000, Australia. 43. Winners will be notified at 12.30PM 1 December 2015 by email. 44. Winners that do not redeem the muffin component of their prize by the close of 17 January 2016 will receive Muffin Break vouchers to the equivalent value. This exchange is final. 45. Any winner that cannot redeem the muffin component for their prize due to logistical complications regarding the distance of the nearest Muffin Break franchise may request to have that component of the prize exchanged for a AUD$1,000 ING Cash Card. This exchange will be made at the discretion of the Promoter. 46. If a prize is unavailable, for whatever reason, the Promoter reserves the right to substitute it for a prize of equal or greater value, subject to state regulation. 47. The Promoter is not liable for any loss or damage or for personal injury suffered or sustained by the taking of a prize except for any liability which cannot be excluded by law.
