1 Page 1 CIBC FirstCaribbean International Bank Shop & Win 2015 Promotion TERMS AND CONDITIONS - JAMAICA This information represents the Terms and Conditions of this Promotion as they will appear on the corporate website of CIBC FirstCaribbean International Bank at PROMOTION refers to this specific Shop & Win Promotion offered by CIBC FirstCaribbean International Bank ( the Bank ) wherein eligible cardholders earn chances to win cash and other prizes based on card usage. PROMOTION PERIOD: From 12:00 AM on December 6, 2015 to 11:59 PM on January 31, 2016 inclusive ( Promotion Period ) DEADLINE DATE: Eligible Card transactions must be processed by 11:59 PM on January 31, 2016 ( Deadline Date ). ELIGIBLE CARD PRODUCTS CIBC FirstCaribbean Visa Classic and Visa Gold credit cards; and Visa Debit Classic and Visa Debit Platinum cards only. CIBC FirstCaribbean MasterCard accounts, Platinum and Infinite credit cards and Visa credit card accounts designated as Business accounts are not eligible for this Promotion. MERCHANT A person in duly authorized possession of a Point-of-Sale terminal issued by CIBC FirstCaribbean (and clearly branded as such) accepting CIBC FirstCaribbean International Bank debit and credit cards. ELIGIBLE TERRITORY This Promotion is offered in Jamaica. PROMOTION MATERIAL Refers to all advertising materials for this Promotion as disseminated via print, electronic or social media; associated printed or electronic materials provided in the Bank s branches or sent directly to its customers and clients; and all related information appearing on the Bank s corporate websites, which the Bank in its sole discretion may change from time to time. HOW TO ENTER CARDS OFFER One (1) entry will be generated automatically for every US$50.00, or the local equivalent of US$50.00 (using the currency exchange rate as at the date of the transaction), spent in any purchase transaction made by a cardholder using an Eligible Card Product during the Promotion Period at any merchant in Jamaica who has not been issued with a CIBC FirstCaribbean Point-of- Sale terminal ( Eligible Purchase Transaction ). A cardholder will automatically receive five (5) entries for every US$50.00, or the local equivalent of US$50.00 (using the currency exchange rate as at the date of the transaction) spent in any purchase transaction made by a cardholder using an Eligible Card Product at all CIBC FirstCaribbean Merchants during the Promotion Period. The minimum purchase transaction value must be US$50 or the local equivalent of US$50.00 (using the currency exchange rate as at the date of the transaction). Additionally customers who apply for and receive an Eligible Card Product during the Promotion Period will be automatically awarded 5 bonus entries into the cards prize draw.

2 Page 2 TERMS AND CONDITIONS OF THE PROMOTION GENERAL 1. Participants will be required to confirm if they are a member of staff of the Bank; or is an individual who lives in a household with a member of staff of the Bank during the Promotion Period (excluding short-term visitors to the household during the Promotion Period); or are an immediate relative (e.g. spouse, parents and grandparents; children and grandchildren; brothers and sisters; mother-in-law and father-in-law; brothers-in-law and sisters-in-law; daughters-inlaw and sons-in-law; and adopted children) of a member of staff of the Bank. Any confirmation of relation aforementioned, whether by acknowledgement from the customer or as a result of internal investigation, automatically disqualifies a potential winner. 2. Participants will be asked to agree to be bound by the terms and conditions and any other requirements set out in the Promotion Material. 3. The Bank reserves the right in its absolute discretion to amend, suspend or terminate this Promotion at any time, with or without notice, subject to the approval of the Betting, Gaming and Lotteries Commission. 4. Prizes must be accepted as awarded. The Bank will not be liable for any changes to prizes occurring outside of its control. 5. Substitutions will not be available. 6. Images used in advertising are representational only and may differ from actual prizes awarded. Prizes are not transferable. 7. To the fullest extent permitted by law, each participant in the Promotion is deemed to have waived any right he/she has or may have against the Bank and its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers or participating Merchants that the Bank may engage for the purposes of the Promotion) in respect of any loss or damages howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Promotion even if CIBC FirstCaribbean has been advised of the possibility of such damages in advance. 8. The Bank does not accept any responsibility or liability relating to any defects, whether by manufacturer or otherwise, in any of the prizes offered. CARDS OFFER & ELIGIBILITY: 1. Persons holding one or more Eligible Card Products in the Eligible Territory. 2. All entrants must be at least eighteen (18) years of age prior to the commencement of the Promotion Period to be eligible for entry into the Promotion. 3. The use of an Eligible Card Product to make an Eligible Purchase Transaction automatically qualifies the cardholder to participate in this Promotion 4. CIBC FirstCaribbean credit card customers whose accounts are delinquent (those in arrears in excess of 30 days) at date of draw will not qualify as winners. 5. Credit Card cash advances, credits, annual membership fees, service charges or adjustments do not qualify as purchase transactions and are not eligible for entry into this Promotion.

Entries from unauthorized card use or made with lost or stolen or fraudulent CIBC FirstCaribbean Visa credit cards or Visa Debit cards are void and therefore not eligible for this Promotion. 7. Merchant discounts or special offers given by the Merchant at the same time as this Promotion are solely the responsibility of the Merchant. As such, the Merchant may assign specific terms and conditions to each offer which must be observed by all customers. 8. Each Merchant reserves the right to vary or discontinue any discounts or other promotions offered by it during the time of this Promotion with or without prior notice. 9. Acceptance of the Eligible Card Products is at the discretion of any Merchant. The Bank is not obligated to award entries into the Promotion for transactions not processed by a Merchant. 10. The Bank does not endorse and is not responsible or liable for any issue relating to any transaction made during this Promotion including, but not limited to, quality, delivery, warranties or the exchange policy of a Merchant, which remain the responsibility of the Merchant. 11. There is no joint venture, agency or partnership between any Merchant and the Bank with respect to the Promotion; the Bank will not be liable for any loss, theft or damages related to the performance of the Merchants, their products or services. NOTIFICATION OF WINNERS The Bank s Credit Card Product Manager, with the assistance of staff in participating countries, will assume responsibility for contacting the winners for the Cards draw. Three (3) attempts will be made to contact the winner by telephone over a three (3) day period following the date of the prize draw to arrange for presentation of the prize. In the event the Bank is not able to make contact with the winner, the Bank will attempt to contact individuals from our reserve list in the order in which they were drawn. Winners will be required to confirm if they are a member of staff of the Bank; or reside in a household with a member of staff of the Bank; or are an immediate relative (e.g. spouse, parents and grandparents; children and grandchildren; brothers and sisters; mother-in-law and father-inlaw; brothers-in-law and sisters-in-law; daughters-in-law and sons-in-law; and adopted relations) of a member of staff of the Bank. Any confirmation of relation aforementioned, whether by acknowledgement from the customer or as a result of internal investigation, automatically disqualifies a potential winner. The winners will be asked the skill-testing question at the time of notification. If they are unable to correctly answer the skill-testing question, they will forfeit the prize and the Bank will contact the individuals listed on the reserve list in the order in which they were drawn. Reserve winners will be required to correctly answer the skill-testing question in order to be awarded the stated prize. Winners hereby agree to take part in any publicity event(s) arranged by the Bank relating to this prize draw. If the winner declines to participate in any publicity event, (s)he will forfeit the prize. The Bank reserves the right to reallocate any prize to a reserve winner. CLAIMING OF PRIZES All winners selected are required to present valid Government-issued Photo Identification, such as a driver s licence, national ID card or passport, along with their CIBC FirstCaribbean Visa credit card or Visa Debit Card, at the nearest CIBC FirstCaribbean branch in their territory. All prizes must be claimed by the winners within seven (7) business days of notification that they have won. If a prize winner does not claim the prize within seven (7) business days of notification, the Bank will contact the individuals listed on the reserve list in the order in which they were drawn. If the first reserve winner does not claim the prize within seven (7) business days of notification, the

4 Page 4 second reserve winner will be contacted. If the second reserve winner does not claim the prize within seven (7) business days of notification, CIBC FirstCaribbean will retain the prize. GRAND PRIZES, DRAWS & DATES CARDS OFFER A grand prize will be awarded as per the following schedule. A total of two (2) grand prizes will be awarded: In January 2016 In February 2016 Prize Currency USD $5, (equivalent to JMD $600,000.00)* USD $5, (equivalent to JMD $600,000.00)* US Dollars * The Jamaica currency equivalent of the prize draw displayed above was calculated at the date of document creation. It is subject to change due to currency fluctuations. The Bank will award all cash prizes in US dollars. The local dollar currency conversion displayed above is for information purposes only and was calculated at $120:1. Each grand prize will be drawn from among all Eligible Purchase Transactions made during the preceding qualifying period as follows: - Grand Prize Draw #1: on January 8, 2016 for the period December 6, 2015 to January 6, 2016 inclusive - Grand Prize Draw #2: on February 15, 2016 for the period December 6, 2015 to January 31, 2016 (Deadline Date) inclusive INTERIM PRIZES, DRAWS & DATES: Interim prizes will be awarded during each of eight (8) weeks of the Promotion Period. It is subject to change due to currency fluctuations. The Bank will award all cash prizes in Jamaica Dollars converted from US currency at the Bank s exchange rate in effect on the date of award. The local dollar currency conversion displayed above is for information purposes only and was calculated at $120:1. Conditions applicable to each Sandals Resort prize (only): Winner receives a Luxury Included vacation at any Sandals Resort in Jamaica*** (on a space available basis). This offer includes all meals, snacks, drinks, entertainment, land and water sports activities, taxes and gratuities. It is subject to space availability, black out dates, is not redeemable for cash, is nontransferable, cannot be used in conjunction with another promotion, and must be used within twelve (12) months from the date of award. Extensions for use will not be granted. Incidentals, including but not limited to, personal telephone calls, spa services/treatments, gift shop purchases, laundry services and any applicable government taxes are not included and would be payable by the winner. Sandals/Beaches Resorts reserve the right to relocate any confirmed prizewinner or complimentary recipient, from their resort of choice, to an alternate resort within the chain, or to alternate dates, based on availability. Prizes may not be redeemed 5 days prior to and 5 days after public holidays. Winner must fax the prize award letter provided by the Bank along with three choices of resort and dates of travel to Sandals Resorts International, 5 Kent Avenue, Montego Bay, Saint James, (876) Winner must include both a daytime and evening phone number so the winner can be contacted directly. Prizes are subject to availability and may be replaced with an alternate prize at the sole discretion of the Bank, subject to, where applicable, the approval of the Betting, Gaming and Lotteries Commission. SELECTION OF WINNERS Prizewinners will be selected by random draw. All draws will be conducted at the Bank s Head Office in Barbados. The draws are conducted internally and the software used to conduct the draws is Microsoft SQL Server Management studio 2012 which queries a MS SQL version database called PrizeDraws. Credit Card prizes for cash will be drawn based on each month s transactions. All transactions meeting eligibility criteria will be entered for the respective grand prize draws. The first interim prize draw will be made on December 14, 2015 from among Eligible Purchase Transactions made during the period beginning from the official start of the Promotion until

6 Page 6 December 12, 2015 (inclusive). Subsequent interim Cards prize draws will be made on each succeeding Monday (or closest business day thereafter) from among all Eligible Purchase Transactions made during the period beginning from the official start of the Promotion until midnight on the Saturday preceding the respective draw. Two (2) additional names will be drawn randomly from all eligible entries for each prize draw. These names will be held in reserve in the event that the Bank is unable to contact any winner at the telephone number(s) provided by that customer as listed on the customer s account. All draws will be done in the presence of an audit representative chosen by the Bank in its sole discretion. The results of the drawings are final and binding on all participants.
