2.1 Subject Property Description 2.0 Executive Summary The Site is located at 1380/1388 Cattleman Road, Sarasota, Florida, at the intersection of 5838 Bahia Vista Road. The Site is comprised of an unimproved L-shaped property, sloping east-southeast, that encompasses approximately 1.68 acres. The FDIC requested that Malcolm Pirnie conduct a Phase I Environmental Site Assessment (ESA) of the Site for the identification of environmental hazards and special resources. The site reconnaissance was conducted on June 29, 2010 by Ryan McKenna, project engineer with Malcolm Pirnie. The property is an undeveloped parcel. The Site is immediately bordered to the north and west by residential properties and to the south by a residential property and commercial development. The Site is bordered to the east by Cattlemen Road. Sarasota County Government offices are located across Cattlemen Road. A gopher tortoise hole was found on the site; however, this is not a federally endangered animal within Sarasota County. Wetlands were also observed int he southern portion of the Site. Stains were observed on one of the two transformers identified on Site, as shown in Appendix B. No labels were observed and the PCB content was not indicated. One large mound, approximately three feet high, was observed in the northern portion of the Site. The contents are unknown, however, clay, soil/fill and miscellaneous debris including concrete pieces and landscape debris were observed. Evidence of an abandoned well was observed at the Site. The Site contact could provide no history of the use or closure of the well. Further research showed that the well classified as a non-community water system; it was likely used for irrigation purposes based on the rows of citrus trees on the property. The well had been sampled for ethylene dibromide in 1989 and was below detection limit. Six database properties were identified within a mile of the Site. Verizon in Sarasota Springs has active ASTs and USTs within 500 feet of the Site. Quick Stop #19 has active USTs with an LUST with no clean up required. Scott Paint and King Lighting Supply are both RCRA-Non Generators with violations for handling ignitable materials. J M Stewart is a RCRA Small Quantity Generator with violations for handling ignitable materials. One Stop Food Mart has an on-going LUST cleanup. 2.2 Data Gaps A data gap, as defined by ASTM, is a lack of or inability to obtain information required by the standard and practices listed in ASTM despite good faith efforts by the Environmental Professional to gather information pertaining to the Site. The following significant data gaps were identified for the Site: A transformer with staining was identified on the Site. It is unknown if it contained PCBs. A mound of dirt and debris was discovered that may have been a dump site. Six properties were identified within 1 mile of the Site that may pose an environmental hazard. 2.3 Findings Malcolm Pirnie has performed an Environmental Site Assessment, in conformance with the Scope of Work developed in cooperation with the Client and the provisions of ASTM Practice E1527-05. Any exceptions to, or deletions from this practice are described elsewhere in this Report. Within the scope of the investigation, Malcolm Pirnie discovered evidence of the following Recognized Environmental Conditions in connection with the Site: 100980007 Page 2
A small wetland area is located adjacent to the southwest corner of the Site. A transformer with staining was identified on the Site. It is unknown if it contained PCBs. A mound of dirt was found at this site. It is unknown where this came from and whether or not it was a dump site. Six properties posing a moderate risk were identified in the environmental databases within one mile of the Site. Verizon in Sarasota Springs has active ASTs and USTs within 500 feet of the Site. Quick Stop #19 has active USTs with an LUST with no clean up required. Scott Paint and King Lighting Supply are both RCRA-Non Generators with violations for handling ignitable materials. One Stop Food Mart has an on-going LUST cleanup. 2.4 Recommendations Within the scope of the investigation, Malcolm Pirnie discovered evidence of Recognized Environmental Conditions in connection with the Site and recommends further evaluation of the following: Research should be conducted into whether the transformers on the Site contain PCBs prior to the sale of the property. The origin of the mound of dirt and debris found on the Site should be determined. Evidence of an abandoned well was observed at the Site. Further research showed that the well classified as a non-community water system and had been sampled for ethylene dibromide in 1989. Ethylene dibromide was below detection limit. Results should be verified prior to the sale of the Site. Further research should be conducted into the possible hazards posed by the six properties in the environmental databases that appear to pose at least a moderate risk to the Site. 100980007 Page 3
3.1 Purpose 3.0 Introduction The Federal Deposit Insurance Company (FDIC) requested that Malcolm Pirnie conduct a Phase I ESA of the Site for the identification of environmental hazards and special resources. The objective of the Phase I ESA was to identify Recognized Environmental Conditions (RECs) in connection with the Site, to the extent feasible pursuant to the processes prescribed in ASTM Practice E 1527-05 guidelines and special resources as outlined in the FDIC scope of work. The term Recognized Environmental Condition is defined by ASTM as the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, ground water, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. Conditions determined to be de minimis are not recognized environmental conditions. The purpose of an Environmental Site Assessment is to identify Recognized Environmental Conditions on a property, as the term is defined by the American Society of Testing Materials in ASTM E 1527-05. This report follows the requirements outlined in ASTM E 1527-05 and 40 CFR 312, The Innocent Landowners, Standard for Conducting All Appropriate Inquiries. This Report is one aspect of the Client's environmental due diligence assessment into the previous ownership and uses of the property consistent with good commercial or customary practices. The Report may not address all the requirements that may be required in the Client's due diligence assessment of risks associated with this property. Disclosures to Client by the property seller and the Client's own specialized knowledge and experience may also be factors in determining the extent of a due diligence effort. 3.2 Scope of Work Malcolm Pirnie, Inc. was retained by the FDIC to perform a Phase I Environmental Site Assessment (ESA) of the property located at 1380 Cattleman Rd (Site; Figure 1). The approximately 1.68-acre site is undeveloped. This assessment was conducted in general accordance with the FDIC Statement of Work for the Identification of Environmental Hazards and Special Resources and the ASTM Practice E 1527-05. The assessment conducted by Malcolm Pirnie included, but not limited to, the following services: A reconnaissance-level visit of the Site to look for evidence of the releases(s) of hazardous materials and petroleum products to assess the potential for on-site releases of hazardous materials and petroleum products. Drive-by observations of adjacent properties and the Site vicinity. Interviews with people familiar with the Site, as available. A review of regulatory and local agency files, as necessary. A review of historical documents, as available. Preparation of a report presenting our findings, including a summary of conclusions and recommendations. The Phase I ESA report will: Identify the presence or likely presence of an REC or Special Resource that may trigger an environmental liability on, restrict the use of, or affect the marketability of the Site. Identify an immediate risk to the public health or safety of the environment. Identify the need for additional investigation, studies to confirm and evaluate the location, extent, magnitude, and source of an REC and/or for follow-up actions. 100980007 Page 4
3.3 Significant Assumptions The purpose of this Phase I ESA is to provide appropriate inquiry into the previous ownership and use of the Site consistent with good commercial and customary practice in an effort to minimize liability. MPI also assumes that the information provided by the Client, regulatory database provider, and regulatory agencies is true and reliable. There is a possibility that even with proper application of these methodologies there may exist on the Site conditions that could not be identified within the scope of the assessment or which would not be identified within the scope of the assessment or which were not reasonably identifiable from the available information. Malcolm Pirnie believes that the information obtained from the record review and the interviews concerning the Site is reliable. However, Malcolm Pirnie can not and does not warrant or guarantee that the information provided by these sources is accurate or complete. The methodologies of this assessment are not intended to produce all inclusive or comprehensive results, but rather to provide the FDIC with information relating to the Site. 3.4 Limitations and Exceptions This Environmental Site Assessment Report (Report) has been prepared for the sole use of Malcolm Pirnie's Client, FDIC. The purpose of this Report is to provide information to the Client on the environmental conditions of the Site, which consists of approximately 1.68 acres of undeveloped land located at 1380 Cattleman Road, Sarasota, Florida. This Report may not address all the requirements that may be required in the Client's or other user's due diligence assessment of risks associated with this property, including but not limited to an evaluation of the relationship of the purchase price to the fair market value considering site contamination, if any. An Environmental Site Assessment can reduce but not wholly eliminate uncertainty regarding the potential for recognized environmental conditions in connection with the Site. The conclusions in this Report have been based, in part, on information obtained from third parties including historical aerial photographs, environmental agency records, and other public records regarding the Site obtained from various sources. Unless noted, Malcolm Pirnie has not independently evaluated or verified the accuracy or completeness of such third party information. Visual observations related to hazardous materials or waste on the Site only represent conditions at the time of the Site visit. Malcolm Pirnie makes no warranties that the on-site observations made during the Environmental Site Assessment are representative of historical or future conditions at the Site. Malcolm Pirnie performed its services and prepared this Report at the level customary for other prudent and competent professional engineers performing such services at the time and place where the services are provided. Malcolm Pirnie makes no other warranty, expressed or implied. 3.5 Deviations No deviations from the FDIC scope were performed as part of this Phase I ESA. 3.6 Special Terms and Conditions There are no special terms or conditions associated with this Phase I ESA. 3.7 Reliance The use of and reliance on this Report by any person or entity other than the Client is not authorized unless the user enters a secondary user agreement with Malcolm Pirnie. At the time this report was written there were no authorized users identified. It is the responsibility of the unauthorized user to assure itself that information contained herein is accurate and complete. 4.1 Location and Legal Description 4.0 Site Description The Site is located at 1380/1388 Cattleman Road, Sarasota, Florida. Access to the Site is via Cattleman Road and Bahia Vista Road. The Site is shown on Figure A-1, Site Location Map. Sarasota County, Florida identifies the Site as Parcel 0049-02-0003. The Site is comprised of an L-shaped undeveloped property encompassing approximately 1.68 acres. The Site is zoned as Office, Professional, Institutional (OPI). Site photographs are included in Appendix B. 4.2 Activity/Use Limitations No activity or use limitations were identified by the Client for this Site. 4.3 Site and Vicinity Description The following are descriptions of land and land uses immediately adjacent to the Site: North: The Site is bordered by residential properties. South: The Site is bordered by a residential property and commercial development (chiropractor, payroll services company). East: The Site is bordered by Cattlemen Road. Sarasota County Government offices are located across Cattlemen Road. West: The Site is bordered by two residential properties. 4.4 Current Use of Property The Site is a non-developed vacant lot. According to Sarasota County, the Site is zoned "Office, Professional, Institutional (OPI)". No significant hazardous or petroleum products were noted at the Site. 4.5 Description of Structures and Other Improvements The site consists of a 1.68-acre vacant lot. There were underground telephone cable utilities observed running along the eastern border of the Site. A storm drain is located at the south east corner of the Site. Also, an electrical pole was observed at the east of the site near two cement access drives. 4.6 Adjoining Property Information There was no evidence of potential releases from the adjoining properties. 100980007 Page 6
5.1 Specialized Knowledge 5.0 User Provided Information The Client has no specialized knowledge of the Site outside the research which was conducted and reported as part of this Phase I ESA. Site ownership and tenants as well as all individuals who were interviewed as part of this Phase I ESA investigation have not reported any specialized knowledge of this Site beyond what is summarized in this report. 5.2 Valuation Reduction for Environmental Issues This Phase I ESA was not conducted as part of a property transaction and as such, a selling price to value comparison is not available. 5.3 Owner, Property Manager, and Occupant Information No written or verbal communication with the Site owner revealed any information which suggested that there currently or historically exists the presence or likely presence of contamination associated with the Site's uses. 5.4 Reason For Performing Phase I The Phase I ESA was conducted to assess historical uses and current conditions of the Site and to identify existing or potential Special Resource(s) in connection with the Site. 100980007 Page 7
6.1 Environmental Database Records Search 6.0 Records Review Malcolm Pirnie contracted Environmental Data Resources, Inc. (EDR) to conduct a search of Federal and State databases containing known and suspected sites of environmental contamination. The number of listed sites identified within the approximate minimum search distance (AMSD) from the Federal and State environmental records database listings specified in ASTM Standard E 1527-05 are summarized in the following table. Detailed information for sites identified within the AMSDs is provided below, along with an opinion about the significance of the listing to the analysis of recognized environmental conditions in connection with the subject property. Copies of the EDR research data and a description of the databases are included in Appendix D of this report. There were 25 sites identified within 1 mile of the project Site. Potential to affect the project Site is low. 6.2 Additional Environmental Record Sources The historical records reviewed as part of this Phase I ESA are summarized in the following Sections. There are no additional environmental record sources available for this Site. 6.3 Physical Setting Sources This Section contains a description of the physical environmental setting based upon visual observations, appropriate USGS 7.5 Minute Topographic Maps, and information provided in reports generated by Environmental Data Resources, Inc. (EDR) of Milford, Connecticut (Appendix D). 6.3.1 Topography Based on the USGS 7.5 minute topographic map for Bee Ridge, Florida (Appendix A), the elevation of the Site is approximately 27 feet above mean sea level. The Site is located in an area of flat terrain with a general topographic gradient sloping east-southeast. 6.3.2 Surface Water Bodies A wetland area was observed adjacent to the southwest corner of the Site. Further evidence of surface water including streams, creeks, or ponds on the Site was not observed during the Site visit. Surface water bodies in the surrounding vicinity of the Site includes two ponds located approximately 0.5 miles east of the Site. Information pertaining to the Site's proximity to FEMA flood plains is discussed in Section 10.4. 6.3.3 Geology and Hydrology Groundwater flow within the water table aquifer is influenced by localized boundary conditions such as creeks, rivers, and drainage channels, as well as ground surface topography. Groundwater flow direction in the water table on the Site would be expected to follow surface topography and flow eastwards towards the wetlands in the south. AQUAFLOW data from wells within one mile of the site show that the groundwater in the area flows in a general southerly gradient. One public water supply well (PWS ID: FL6584849) was identified in the area surrounding the site in the database information obtained form EDR. No violations or enforcement actions were noted for the well in the EDR report. No wells were observed on the Site or in the surrounding area during the Site visit. According to the EDR Physical Setting Source Summary (Appendix D), surface soils are typically comprised of one soil type, Floridiana, which is a Class D soil with a very slow infiltration rate. It is considered clayey, have a high water table, or have a shallow impervious layer. 100980007 Page 14
6.4 Historical Use 6.4.1 Historical Summary Historical information identifying the past Site uses was obtained from a variety of sources as detailed in Appendix C of this report and included: aerial photographs, city directories, Sanborn Fire Insurance maps, and historical topographic maps. 6.4.2 Title Records The following chain of title information was obtained from the Sarasota County Assessor's Office. 6.4.9 Other Land Use Records Malcolm Pirnie reviewed the U.S. Geological Survey, 7.5 Minute Topographic Quadrangle for Bee Ridge, Florida to determine Site and regional topographic characteristics that may influence the Site's recognized environmental conditions. These characteristics are described, as appropriate, elsewhere in this Report. A portion of the topographic quadrangle is provided in Appendix A. 6.5 Environmental Liens and Activity/Use Limitations No environmental liens or activity/use restriction in connection with the Site were identified by EDR. 100980007 Page 17
7.1 Methodology and Limiting Conditions 7.0 Site Reconnaissance The site reconnaissance was conducted on June 29, 2010 by Ryan McKenna, Project Engineer with Malcolm Pirnie. Weather conditions at the time of the site visit were sunny and warm. The site reconnaissance consisted of observing the boundaries of the property and systematically traversing the site to provide an overlapping field of view, wherever possible. Photographs of pertinent site features identified during the site visit are included in Appendix B. 7.2 General Site Setting The Site consists of approximately 1.68 acres and is undeveloped. The ground surface at the Site slopes gently towards the south. Ground cover consists primarily of short grasses, and citrus, oak, and pine trees. A gopher tortoise hole was also observed. The Site is accessed from the east via an entrance from Cattlemen Road, as well as from the north via an entrance from Bahia Vista Street. 7.3 Site Visit Findings 7.3.1 Hazardous Substances No chemicals were observed on the property during the site visit. 7.3.2 Petroleum Products No petroleum products were observed during the site visit. 7.3.3 USTs No readily apparent evidence of underground storage tanks (USTs) was identified on the subject property during the site reconnaissance. 7.3.4 ASTs No readily apparent evidence of aboveground storage tanks (ASTs) was identified on the subject property during the site reconnaissance. 7.3.5 Other Suspect Containers No suspect containers were identified on the property during the site reconnaissance. 7.3.6 Equipment Likely to Contain PCBs Two pole-mounted transformers were observed along the western side of the property - one was located at the southwestern corner of the Site, and one was located at the northwestern corner of the Site. No labels were observed and the PCB content was not indicated. Stains were observed on the northwestern transformer, as shown in Appendix B. The transformer is owned by the electricity provider, Florida Power and Light (1-941-917-0708). A call was made to the company on July 12, 2010. A message was left for the Service Planning Department as requested by customer service; however, no response has yet been received. 100980007 Page 18
7.3.7 Interior Staining/Corrosion There are no buildings located on the Site. 7.3.8 Stormwater Drainage/Wastewater Discharge Sanitary sewer services are provided by Sarasota County. Malcolm Pirnie did not observe evidence of an on-site septic system, generation of process wastewater or discharge features (i.e., floor drains, catch basins, oil/water separators, etc.) during the site visit. Malcolm Pirnie did observe evidence of an on-site stormwater collection system near the southeast corner of the property. The Site is graded such that water generated during storm events flows to a small swale running along the southern border of the Site where it enters the existing storm drain. 7.3.9 Pits, Ponds, And Lagoons No pits, ponds, or lagoons, were observed on the Site during the site visit. 7.3.10 Solid Waste Dumping/Landfills One large mound, approximately three feet high, was observed in the northern portion of the Site. The contents are unknown, however, clay, soil/fill and miscellaneous debris including concrete pieces and landscape debris were observed. 7.3.11 Stained Soil/Stressed Vegetation Generally, the area appeared to be in good condition with no evidence of staining or distressed vegetation. 7.3.12 Wells Evidence of an abandoned well was observed at the Site. Further research showed that the well classified as a non-community water system; it was likely used for irrigation purposes based on the rows of citrus trees on the property. The well had been sampled for ethylene dibromide in 1989 and was below detection limit. 100980007 Page 19
8.0 Interviews As part of this Phase I ESA, Malcolm Pirnie contacted individuals thought to have knowledge about the Site, to request an interview about the Site's recognized environmental conditions. The following summarizes personnel contacted for interview information: Mr. Neel Sheeti Site Contact Emailed on June 25, 2010 and July 6, 2010. He provided maps and the Site's parcel number. He had no knowledge of environmental conditions at the Site. Sarasota County Fire Department 941-861-5000 A fire chief was not available to be interviewed at the time of the call. 9.0 Other Environmental Considerations 9.1 Asbestos-Containing Materials No suspect Asbestos-Containing Materials (ACM) were observed during the site visit. The Site is undeveloped land, as such, no buildings or structures are located on the Site. 9.2 Radon Malcolm Pirnie obtained radon information from EDR. Sarasota County, Florida is listed as a Zone 3 area in the Federal EPA Radon Database. Zone 3 is classified as having an indoor average of less than 2 pci/l. The number of sites that have been tested in the Federal Database was 150, and 4% had greater than 4 pci/l activity in the living area. In the State Database, 123 sites were tested; 3.3% had averages greater than or equal to 4 pci/l. The EPA-recommended action level for radon is 4pCi/L. Because the site is undeveloped, the potential for radon gas is low. 9.3 Lead-Based Paint An assessment related to applicable state or local laws, regulations, or ordinances related to lead-based paint was not performed because the Site consists of only undeveloped land. No buildings or structures are located on the Site. 9.4 Lead in Drinking Water Domestic water supplied by the City of Sarasota complies with US EPA standards for lead. Because this is an undeveloped property, lead pipes or lead solder on piping is not likely present. However, lead piping may be present in the well on the property. 100980007 Page 21
10.1 Endangered Species 10.0 Natural Resources The Site contains Natural Areas as defined by FDIC according to aerial photographs and site reconnaissance. Therefore, Malcolm Pirnie reviewed the EDR NEPACheck report for information on any federally listed species are known from Sarasota County, Florida or surrounding counties. The EDR NEPACheck report indicated that federally listed species are known from the county where the site is located. Malcolm Pirnie therefore contacted the Natural Heritage Program (NHP) to request information on the potential presence of federally-listed endangered, threatened or rare species within a one-mile radius of the Site perimeter. Malcolm Pirnie also requested information on any significant habitats or natural communities that may be near the Site. The NHP response is pending. During the site visit, a gopher tortoise hole was found on the site. This is not a federally endangered animal within Sarasota County. 10.2 Wetlands A review of the U.S. Department of the Interior, Fish & Wildlife Service's National Wetland Inventory (NWI) Map obtained from EDR NEPACheck revealed that mapped NWI wetlands occur within 300 feet of the Site boundary. Malcolm Pirnie also observed visual evidence of potential wetland areas adjacent to the southwest corner of the site. It should be noted that a detailed wetland investigation or wetland delineation is not within the scope of this Report. 10.3 Covered Property The Site is located in close proximity to the coast and is located within Sarasota County Florida, which is a county listed as containing unit(s) of the Coastal Barrier Resources System (FDIC Phase I ESA Statement of Work, Attachment G, February 2006). Therefore Malcolm Pirnie contacted the USFWS Field Station for Ecological Services to ascertain whether the Site is located within a Unit of the Coastal Barrier Resources System. A response is pending at the time of this report. 10.4 Undeveloped Floodplains/Wild and Scenic Rivers Because Natural Areas occur on the Site, the EDR NEPACheck report was reviewed for the presence of undeveloped floodplain information. The EDR NEPACheck report indicated that the Site is not located within a 100-year or 500-year flood plain and is not proximate to any river designated as Wild and Scenic or as a Wild and Scenic Study Rivers. 10.5 Areas of Scientific Significance The Site is not larger than 50 acres; therefore, Areas of Scientific Significance were not researched during completion of this Phase I ESA. 10.6 Wilderness Area The Site contains Natural Areas and therefore the EDR NEPACheck report was reviewed to assess whether the Site contains, is contiguous to, or adjacent to federally-owned lands, or lands legally designated for acquisition by a federal agency, that are designated or proposed for designation as a part of the National Wilderness Preservation System. According to the EDR NEPACheck report and based on site reconnaissance, no designated wilderness areas are known to exist in the vicinity of the Site. 100980007 Page 22
10.7 National Natural Landmarks Because the Site contains Natural Areas, Malcolm Pirnie reviewed the National Registry of Natural Landmarks published by the National Park Service, reviewed maps and aerial photographs, and conducted a site reconnaissance to access whether any National Natural Landmarks occur on the Site (http://www.nature.nps.gov/nnl/). Based on this research, Malcolm Pirnie determined that there are no National Natural Landmarks on or in the vicinity of the Site. 10.8 Undeveloped Sole Source Aquifers No sole-source aquifer exists in the vicinity of the Site according to EPA's List of Sole-source Aquifers. 10.9 Archaeological Resources/Historic Sites and Structures Natural Areas occur on the Site based on available maps, aerial photographs, and site reconnaissance. Therefore, Malcolm Pirnie consulted EDR NEPACheck report to assess whether any Archaeological Resources or Historic Sites and Structures that are either listed or eligible for listing in the National Register of Historic Places exist on the Site. The EDR NEPACheck report revealed that no electronic data is available for this site. The Florida State Historic Preservation Office (SHPO) was then contacted to request information pertaining to any Archaeological Resources or Historic Sites and Structures that are either listed or eligible for listing in the National Register of Historic Places that may exist on the or in the vicinity of the site. A response from the SHPO is pending as of the date of this report. 10.10 Recreational Areas A review of available maps and aerial photographs indicate that no recreational resources occur on or in the vicinity of the Site. Additionally, the Site is not proximate to any public outdoor recreational areas. 10.11 Undeveloped Coastal Zones/Coastal Barrier Units The Site is located in close proximity to the coast and is located within Sarasota County, Florida, which is a county listed as containing unit(s) of the Coastal Barrier Resources System. Therefore Malcolm Pirnie contacted the USFWS Field Station for Ecological Services to ascertain whether the Site is located within a Unit of the Coastal Barrier Resources System. Sarasota County is within the Coastal Barrier Resources System. A response from the USFWS is pending. 100980007 Page 23
