Subject: Contract for outsourcing of the services of an Agency to provide manpower viz. Cook/ Halwai/Helper/Assistant Cook/Bearers and Sweeper for Departmental Canteen of Department of Agriculture & Cooperation.. Sir/Madam,, I am directed to invite sealed tenders in Two BIDs(TECHNICAL AND FINANCIAL) from experienced and reputed Manpower Agencies for outsourcing of the services viz. Cook/Halwai/Assistant Cook/Bearers and sweeper for Departmental Canteen of Department of Agriculture & Cooperation located at Krishi Bhawan, New Delhi. As per details given below:- Halwai-cum-Cook (Skilled) - 2 Assistant Cook (Semi-skilled) - 1 Bearer (Semi-skilled) - 8 Sweeper (Unskilled) - 1 Total - 12 If any further clarification is required in this matter, US(Welfare) may be contacted on Ph.23384929 or personally in Room 14, Krishi Bhavan, New Delhi. 2. The initial period of contract is one year, extendable up to two years, on year to year basis, on satisfactory performance as may be mutually agreed to and also subject to the necessary approval of the competent authority. In the event of any increase in the minimum wages by the Govt. of NCT of Delhi, the agency shall be responsible to pay minimum wages and consequential benefits to the concerned persons without any legal binding on this Department during the period of contract. 3. The manpower will have to be supplied by the agency within 15 days of award of contract, as per the detailed Terms and Conditions which are given at Annexure-I. 4. Only those bidders who fulfill the following criteria need to submit their bids: (i) The firm should be registered with the Government authorities such as ESI, EPF, Service Tax, Labour and Income Tax authorities concerned and a copy of each of the registrations shall be attached with the bid. (ii) The firm should have PAN number and Sales Tax/Service Tax registration Proof in this regard may be attached with the bid.
-2- (iii) (iv) (V) (vi) The firm should not have been blacklisted by any Ministry/Department of the Government of the India. The tendering firms/bidders shall have to submit notarized affidavit on a stamp paper of appropriate value to this effect that they have not been blacklisted or their business dealings with the Government Ministries/Departments have not been banned. The firm should be willing to take up the contract on the terms and conditions at Annexure I. The firm should have been in existence for not less than five years. The organization must undertake to pay Minimum Rates of wages to the workers engaged as per the applicable orders of Govt. of NCT (They shall furnish a notarized affidavit to the effect that the workers going to be employed in the performance of the contract would be paid minimum wages as per applicable order of Govt. of NCT of Delhi and statutory requirements w.r.t. ESI, EPF, Factories Act, ID Act, Contract labour (Regulation and Abolition) Act, etc., would be compiled with reference to those workers. On enhancement of the minimum rates of wages by the Govt. of NCT of Delhi from time to time, the wages will be increased accordingly. 5. An earnest money of Rs.65,000/- (Rupees Sixty Five thousand only) in the form of demand draft drawn in favour of Hony. Secy., Departmental Canteen, Department of Agriculture & Cooperation, New Delhi valid upto 90 days may be submitted along with the technical bid, failing which the technical bid shall not be considered valid. 6. The tender should be submitted in two sealed covers as explained hereunder: (A) The first sealed cover should be super scribed Technical Bid for provide manpower viz. Cook/ Halwai/Assistant Cook/Bearers and sweeper for Departmental Canteen of Department of Agriculture & Cooperation and should contain: (i) The proforma at Annexure II (duly filled in); (ii) Agency s profile including previous experience of manpower supplied to Government Departments etc. (along with the copies of offers/orders); (iii) Acceptance of terms and conditions at Annexure I; (iv) (v) Demand Draft for Earnest Money Deposit; All other required documents mentioned in Annexure-II;
-3- (A) (B) (c) The absence of any of the above mentioned documents in technical bid would result in the rejection of the entire tender. The second sealed envelope super-scribed Financial Bid for provide manpower viz. Cook/Halwai/Assistant Cook/Bearers and sweeper for Departmental Canteen of Department of Agriculture & Cooperation should contain only rates which is to be quoted on monthly basis for normal duty of 8 hours per day per person for Five days a week (Annexure III). Over time rate should also be quoted for each category @ per hour. It may be ensured that the rates as quoted must not be less than the prevailing minimum wages rates prescribed by the Government of NCT of Delhi excluding PF/ESI/Service Tax etc. Both the sealed covers should be placed in the main sealed envelope super scribed Tender for supply of Outsourced staff. This should be addressed to the Under Secretary(Welfare), Ministry of Agriculture, Department of Agriculture & Cooperation, Krishi Bhawan, New Delhi 110001 and sent by post or hand delivered dropped in the Tender Box kept near the Reception Counter, Department of Agriculture & Cooperation, Gate No.1 latest by 03:00 P.M. of 14 th April, 2015. 7. The technical bids will be opened by the Tender Opening Committee on same date at 3:30 p.m. after the expiry of the last date of receipt of the tenders in the Ministry, in the presence of the participating bidders, who may like to be present. 8. The technical bids will be analysed by the Tender Opening Committee and the Financial bids of only those bidders whose technical bids are found to be in order will be opened. 9. The Department of Agriculture & Cooperation reserves the right to accept or reject in part or in full any, or all of the responses and to scrap this tender without assigning any reasons thereof. 10. TERMS and CONDITIONS ANNEXURE I (1) The persons to be supplied by the contractor will be selected by the selection committee through interview. (2) All services shall be performed by persons experienced and skilled in performing such services as per the eligibility criteria indicated below :- Halwai-cum-cook - (a) 10 th Class Pass with certificate or Diploma in (Skilled) Catering (b) Experience 2 years in a Government Department or Undertaking preferred. (c) A Trade Skill Test for Cooking shall be conducted to assess suitability of the candidate. Assistant Cook - (a) 10 th Pass with a certificate or Diploma in (Semi-Skilled) Catering (b) Experience 1 year (c) A Trade Skill Test for cooking including maintenance of Hygiene etc. shall be conducted to assess suitability of the candidate. Bearer (Semi-Skilled) - Matriculate or equivalent. Sweeper - Primary standard passed. (Un-Skilled) (3) The persons supplied by the Agency should not have any Police records/criminal cases against them. The agency should make adequate enquires about the character and antecedents of the persons whom they are recommending. The character and antecedents of each personnel of the service provider will be got verified by the service provider before their deployment after investigation by the local police, collecting proofs of identity like driving license, bank account details, previous work experience, proof of residence and recent photograph and a certificate to this effect submitted in the Ministry. The service provider will also ensure that the personnel deployed are medically fit and will keep in record a certificate of their medical fitness. The service provider shall withdraw such employees who are not found suitable by the office for any reasons immediately on receipt of such a request. (4) The service provider shall engage necessary persons as required by this ministry from time to time. The said persons engaged would be paid salary every month by the service provider. There is no master & servant relationship between the employees of the service provider and this Ministry and further that the said person of the service provider shall not claim any absorption in this Ministry. (5) The service provider s person shall not claim any benefit/compensation/absorption/ regularization of services from/in this Ministry under the provision of Industrial Disputes Act, 1947 or Contact Labour (Regulation 7 Abolition) Act, 1970. Undertaking from the persons in this effect shall be required to be submitted to the service provider in this Ministry.
-2- (6) The service provider s personnel shall not divulge or disclose to any person, any detail of office, operation process technical know-how, security arrangements, administrative/ organizational matters which they came across during performance of their official duties in the Department. (7) The service provider personnel s working should be polite, cordial, positive and efficient, while handling the assigned work. The service provider shall be responsible for any act of indiscipline on the part of persons deployed by him. (8) That the persons deputed shall not be below the age of 18 years and they shall not interfere with the duties of the employees of the Ministry. (9) The Ministry may require the services provider to dismiss or remove from the site of work, any person, or persons, employed by the service provider, who may be incompetent or for his/her/their misconduct and the service provider shall forthwith comply with such requirements. The service provider shall replace immediately any of its personnel, if they are unacceptable to the ministry because of security risk, incompetence, conflict of interest and breach of confidentiality or improper conduct upon receiving written notice from office. (10) The service provider has to provide Photo Identity Cards to the persons employed by him/her for carrying out the work. These cards are to be constantly displayed & their loss reported immediately. (11) The service provider shall ensure proper conduct of his person in office premises and enforce prohibition of consumption of alcoholic drinks, paan, smoking, loitering without work. (12) The transportation, food, medical and other statutory requirements in respect of each personnel of the service provider shall be the responsibilities of the service provider. (13) Working hours would be normally from 9:00 a.m. to 5:30 p.m. during working days including half an hour lunch break in between. However, in exigencies of work, they may be required to sit late and the personnel may be called on Sunday and other gazette holidays, if required. They may be paid extra wages as per the rates approved. (14) That the agency will be wholly and exclusively responsible for payment of wages to the persons engaged by it in compliance of all the statutory obligations under all related legislations as applicable to it from time to time including Minimum Wages Act, Employees Provident Fund, ESI Act etc. and the Ministry shall not incur any liability for any expenditure whatsoever on the persons employed by the agency on account of any obligation.
(15) The agency will be required to provide particular of EPF, ESIC, etc. of previous month, of its employees engaged in the Ministry while raising monthly bill. -3- (16) The service provider will submit the bill in respect of a particular month in the first week of the next month. The payment will be released by the third week of the following month after deduction of taxes deductible at source under the laws in force. (17) Payment to the service provider would be strictly in certification by the officer with whom he is attached that his services were satisfactory and attendance as per the bill preferred by the service provider. (18) No wage-remuneration will be paid to any staff for the days of absence from duty. (19) The service provider will provide the required personnel for a shorter period also, in case of any exigencies as per the requirement of this Ministry. (20) The service provider shall provide a substitute well in advance if there is any probability of the person leaving the job due to his/her own personal reason. The payment in respect of the overlapping period of the substitute shall be the responsibility of the service provider. (21) The service provider shall be contactable at all times and message sent by phones/email/fax/special Messenger from Ministry to the service provider shall be acknowledged immediately on receipt on the same day. The service Provider shall strictly adhere in the instructions issued by the Ministry in fulfillment of the contract from time to time. (22) The Ministry shall not be liable for any loss, damage, theft, burglary or robbery of any personal belongings, equipment or vehicles of the personnel of the service provider. (23) That the agency on its part and through its own resources shall ensure that the goods, materials and equipment etc. are not damaged in the process of carrying out the services undertaken by it and shall be responsible for acts of commission and omission on the part of its staff and its employees etc. If the Ministry suffers any loss or damage on account of negligence, default or theft on the part of the employees/agents of the agency then the agency shall be liable to reimburse in the ministry for the same. The agency shall keep Ministry fully indemnified against any such loss or damage. (24) The Ministry will maintain an attendance register in respect of the staff deployed by the agency on the basis of which wages/remuneration will be decided in respect of the staff at the approved rates.
-4- (25) The successful bidder shall furnish a performance security deposit equivalent to Rs.1,25,000/- (Rupees One lakh Twenty Five thousand only) in the form of an account payee demand draft drawn in favour of the Hony. Secy., Departmental Canteen, Department of Agriculture & Cooperation, New Delhi, or Fixed Deposit receipt from a Nationalized Bank or Bank Guarantee from a Nationalized bank in an acceptable form safeguarding the interest of this Department in all respects should be deposited. The performance security deposit will be forfeited in case the supply of manpower is delayed beyond the period stipulated by Ministry and for non-compliance of the terms of agreement by the service provider or frequent absence from duty/misconduct on the part of manpower supplied by the Agency. (26) The successful bidder will enter into an agreement with this Department for supply of suitable and experienced manpower as per requirement of this Ministry on these terms and conditions. The agreement will be valid for a period of one year commencing from the date of award of contract and shall continue to be in force in the same manner, unless terminated in writing. Except for any enhancement in the minimum rates of wages by the Govt. of NCT of Delhi, the Service charges/rates quoted by the agency shall be fixed for a period of one year including the period extended, if any, and no request for any change/modification shall be entertained. Any statutory increase in wages/da etc. is to be borne by the service provider. The contract/agreement is extendable upto two years, on yearly basis or shorter period as per the requirement subject to satisfactory performance of the agency and such amendments as mutually agreed to. (27) The service provider shall not assign, transfer, pledge or sub-contract the performance or services without the prior written consent of his office. (28) However, the agreement can be terminated by either party by giving one month s notice in advance. If the agency fails to give one month s notice in writing for termination of the Agreement then one month s wages etc. and any amount due to the agency from the Ministry shall be forfeited by the Ministry. (29) That on the expiry of the agreement as mentioned above, the agency will withdraw all its personnel and clear their accounts by paying them all their legal dues. In case of any dispute on account of the termination of employment or non-employment by the personnel of the agency, it shall be the entire responsibility of the agency in pay and settle the same. (30) In the event, if any dispute arises touching any of the clauses of the agreement the matter will be referred to the Secretary, Ministry of Agriculture whose decision shall be binding on both the parties. (31) Any legal dispute arising out of the above contract shall be settled in the jurisdiction of the High Court of Delhi.
