Persons with a duty Eliminate risks to health and safety, so far as is reasonably practicable. If it is not reasonably practicable to eliminate risks, to minimise those risks so far as is reasonably practicable. Act: s17 and Reg: s35
Primary duty of care (PCBU and workers) A person conducting a business or undertaking has the primary duty to workers and others Workers have a duty to take reasonable care WHS Act s19 & s28
Primary duty of care PCBU Persons conducting business or undertaking (PCBU) must ensure: Safe work environment Safe plant & structures Safe systems of work Safe use, handling and storage of plant Adequate facilities Information, training, instruction and supervision Monitor worker health and workplace conditions WHS Act s 19
Reasonably practicable? Deciding what is reasonably practicable to protect people: the likelihood of the hazard or risk occurring the degree of harm knowledge about the hazard or risk, the availability and suitability of ways to eliminate risk, and after assessing the extent of the risk, the cost associated.
Function of guard A physical or other barrier that: prevents contact with moving parts screens harmful emissions minimises noise prevents ejection of parts.

Guarding properties Guarding must: be of solid construction and securely mounted prevent by-passing or disabling of the guard not create a risk in itself be properly maintained control any risk from potential broken or ejected parts and work pieces allow for servicing, maintenance and repair. If guarding is removed the plant cannot be restarted unless the guarding is replaced
