1 Orders of Commissioners Court Bexar County, Texas TUESDAY, MAY 6, 2014 Court met at 10:08 a.m. A Regular Meeting was held by the Honorable Commissioners Court, in and for said State and County, met at the Courthouse, of thereof, in Bexar County on Tuesday,. Present at roll call: Nelson W. Wolff, County Judge; Sergio "Chico" Rodriguez, County Commissioner Precinct No. 1; Tommy Adkisson, County Commissioner Precinct No. 4; David Smith, County Manager; Susan Yeatts, County Auditor; Gerard Rickhoff, County Clerk (Rep. by Leonor Salazar); Susan Reed, District Attorney (Rep. by Ed Schweninger); David Marquez, Executive Director of Economic Development; Daniel Garza, Purchasing Agent When the following proceedings were had to-wit: Velma Muniz, Mental Health Department, gave the invocation at today's meeting. County Judge Nelson W. Wolff led the Pledge of Allegiance. A letter of condolence is to be sent to the family of Justin Christopher Ware, expressing to them the sympathy of the court on the loss of their loved one. He is survived by his parents Trey and Nancy Ware; grandparents Richard C. Ware, Sr. and Theresa Hooper; nieces Zoe Hoffman and Annabelle Ware, and numerous relatives and good friends. A letter of condolence is to be sent to the family of Harry William Brooks, expressing to them the sympathy of the court on the loss of their loved one. He served in the Navy in World War II and the Korean War. He is survived by his son, John L. Brooks; son, Robert W. Brooks; daughter, Melissa E. Seitze; and 3 grandchildren. A letter of condolence is to be sent to the family of Elbert H. Esparza, expressing to them the sympathy of the court on the loss of their loved one. He is survived by his wife, Patricia S. Esparza; children, Elbert Esparza, Jr., Gina E. Esquivel, Eleazar Esparza, and Edwardo C. Esparza; as well as other family members. A letter of condolence is to be sent to the family of Felis R. Marquez, expressing to them the sympathy of the court on the loss of their loved one. She is survived by her daughters Jo Cox and Virginia Gina Marquez; sons Tony Marquez and Juan Marquez; 9 grandchildren, 12 great-grandchildren; she is also survived by many other relatives and friends. A letter of condolence is to be sent to the family of Betty Bayer, expressing to them the sympathy of the court on the loss of their loved one. She is survived by her husband of 57 years, Lawrence A. Bayer; daughters, Cheryl Bayer and Deborah Bayer; sons, Lawrence E. Bayer and Ronald Bayer, Robert Bayer; as well as other family members. A letter of condolence is to be sent to the family of Herman Mendez Cortez, expressing to them the sympathy of the court on the loss of their loved one. Herman was a lifetime educator and a WWII Navy veteran. He is survived by numerous loving nieces and nephews.

He is survived by his wife of 29 years Virginia Berlanga; mother Dolores Pelayo; children Robert Berlanga, Jr., Julie B. Garcia Robert Berlanga Item 3 (a-e) Commissioners Court The Court presented a Proclamation Court recognizing and proclaiming the month of May 2014 to be Older Americans Month: Safe Today Health Tomorrow. (Record) A Moment of Silence was observed in honor of Estella Tyson, who passed away, Sunday, March 9, The Court presented a Proclamation to the Bexar Audubon Society recognizing and proclaiming Saturday, May 10, 2014 as International Migratory Bird Day. (Record) The Court presented a Proclamation the San Antonio Conservation Society recognizing and proclaiming May 2014 as National Historic Preservation Month. (Record) The Court presented a Proclamation recognizing and proclaiming the month of May 2014 to be Elder Abuse Prevention Month in Bexar County. (Record) County Commissioner Paul Elizondo joined the meeting at this time. The Court presented a Proclamation to the Randolph Roadrunners Volkssport Club recognizing and proclaiming May 8 th as International World Walking Day. (Record) County Commissioner Kevin A. Wolff joined the meeting at this time. 2
3 Item 4a (i ii) Economic Development The Court hereby ordered and approved a motion directing staff to negotiate a Tax Abatement Agreement with FMC Technologies (FMC) and approving a Resolution nominating FMC Technologies, Inc., for an Enterprise Zone Project designation under the Texas Enterprise Zone Program. (Record) A motion was presented by County Commissioner Tommy Adkisson, duly seconded by County Commissioner Paul Elizondo, which motion was voted on as follows: Commissioners Rodriguez, Elizondo, Wolff, Adkisson, and Judge Wolff voting Aye. Item 6 Commissioners Court The Court hereby ordered and approved a motion approving the Consent Agenda (items 9-33) with the exception of agenda item 28 which will be heard separately. Item 9 District Attorney s Office The Court hereby ordered and approved a motion ratifying the submission of an application to the City of San Antonio by the Bexar County Family Justice Center Foundation for continuation funding of a Licensed Professional Counselor-Supervisor (LPC-S) for the Victims Empowerment Counseling Program, hired through the Bexar County Criminal District Attorney s Office, for the period of October 1, 2014 through September 30, 2015 in the amount of $74,654 for the LPC-S; there is no Bexar County cash-match required; and acceptance and approval of funding upon award. (Record) Item 10 3
4 District Attorney s Office The Court hereby ordered and approved a motion ratifying the submission of an application to the City of San Antonio by Bexar County Family Justice Center Foundation for continuation funding of a Community Resource Manager for the Dream Center Program, hired through the Bexar County Criminal District Attorney s Office, for the period of October 1, 2014 through September 30, 2015 in the amount of $56,547; there is no Bexar county cashmatch required; and acceptance and approval of funding upon award. (Record) Item 11 Juvenile Probation Department The Court hereby ordered and approved a motion approving a Contract for Services #14-C0048 between the Office of the Attorney General of the State of Texas and Bexar County in the amount of $1,105,282 over a 30-month period that continues the existing arrangement whereby Bexar County is paid for community supervision services provided by the Juvenile Probation Department on Title IV-D cases for the purpose of enforcement of child support and medical support orders. (Record-original contract to be filed later) Item 12 County Auditor s Office The Court hereby ordered and approved a motion authorizing the County Auditor to pay routine bills from Monday, May 5, 2014 through Friday, May 9, The list of bills paid will be presented to the Court on Tuesday, May 13, (Record) Item 13 County Auditor s Office The Court hereby ordered and approved a motion approving the disbursement of payroll, including overtime and auto allowances, to be paid Thursday, May 15, (Record) 4

(Record) Item 16 Office of County Manager The Court hereby ordered and approved a motion approving a Marketing, Management, and Operational Agreement between Bexar County and the San Antonio Sports Foundation for the 2014 Bexar County Games for an amount not to exceed $110,000. 6 Purchasing Department The Court hereby ordered and approved a motion rejecting proposals and awarding a delivery order to U.S. Bank, Inc., for the purchase of Commercial Fuel Card Services on a requirements contract basis, as requested by Bexar County ; and authorizing the Purchasing Agent to execute and file the appropriate award documents for record. (Record) Item 18 Purchasing Department The Court hereby ordered and approved a motion approving an extension and amendments to the 2011 Amended Delinquent Tax Collection Contract and Amended Software License, Hardware Purchase and Maintenance Agreement between Bexar County, the law firm of Linebarger Goggan Blair and Sampson, L.L.P., a Texas registered limited liability partnership, and Appraisal and Collection Technologies, LLC (ACT). (Record) Item 19 The Court hereby ordered and approved a motion approving the First Amendment to the Engineering Services Agreement between Bexar County and Freese & Nichols, Inc., reducing the contract in the amount of $113, for a revised total not-to-exceed contract amount of $508, in connection with the Flood Control Capital Project, Kirkner Road LWC, SA46, BC Precinct Number 4 (Record) Item 20 The Court hereby ordered and approved a motion approving a Field Alteration Request Number 3 between Bexar County and EZ Bel Construction, LLC, requesting to increase the contract amount by $18,663.34, in connection with Flood Control Capital Project, VFW Blvd. Drainage Segment 2, SA44; Purchase Order No Precinct Number 1 (Record) 6

(Record) No action taken. Item 36 Judicial Service s Department The Court hereby ordered and approved a motion creating the Public Defender Trial Division Pilot to include the 11
12 Appellate and Mental Health Divisions to report to the County Manager; Conducting an evaluation after one year providing the Criminal District, County Courts and Commissioners Court with an overall evaluation of the cost and efficiency of the program as well as measure quality and fairness of defendant representation; Approving a resolution for approval of Public Defender Texas Indigent Defense Commission Grant Submission; and reconstituting the Oversight Committee to operate as the Advisory Committee to the Public Defender s Office to make recommendations to the Chief Public Defender and County Manager for modifications of policies procedures and budget. The Advisory Committee shall consist of Dianne Garcia, County Court at Law Administrator; Melissa Barlow-Fischer, Criminal District Court Administrator; Laura Angelini, Juvenile Court Administrator; Gilbert Gonzales, Mental Health Director; John Bud Ritenour, San Antonio Bar Association Criminal Law & Procedure Committee and a representative from the San Antonio Criminal Defense Bar to be confirmed by Commissioners Court. (Record) A motion was presented by County Commissioner Paul Elizondo, duly seconded by County Commissioner Kevin A.
