2 The Attorey Diversio ad Assistace Act (Busiess Ad Professios Code , ) was passed by the Califoria Legislature i 2001 to establish the Lawyer Assistace Program. The missio of the Lawyer Assistace Program is to support recoverig attoreys i their rehabilitatio ad competet practice of law, ehace public protectio, ad maitai the itegrity of the legal professio. 4 2 Message from the chair of the lap oversight committee Ehacig participatio while spedig less Left uatteded, the issues addressed by the Lawyer Assistace Program ( LAP ) ca quickly lead to a adverse impact o the iterests of the public as well as o persoal ad professioal lives. The LAP addresses this risk with a ew desig for the comig year ad several ew approaches. The ew desig deals with the protectio of all cocered while beig resposive to ecoomic realities. Evolutio of the LAP I accordace with the Board of Goverors, durig the past 12 moths the LAP prepared for substative chages to the desig of the program, its resources, ad the rules that gover the operatio of the program. My colleagues o the LAP Oversight Committee ad I are dedicated to broadeig the scope of services while maitaiig efficiecy i the existig program operatios. While streamliig the program to accout for a greatly reduced operatig budget ad with a view toward servig the eeds of public protectio ad the eeds of the Bar, members of the Oversight Committee collaborated with staff toward a revisio of the program s structure. Amog the chages to be implemeted as a result of this effort are the additio of a ew participat-drive support compoet, a ew stad-aloe assessmet compoet, additioal limits to the fiacial assistace pla, ad a corps of voluteer peer couselors to assist LAP participats. The historical moitorig compoet will cotiue to be available, but ow as a three year program. New Support LAP It is well established that assistace early i the process has a positive impact o prevetig future harm to the public. We ecourage attoreys to seek assistace prior to their problems havig a impact o their practice of law. We are very pleased that, effective i 2010, we will offer a opportuity called Support LAP for attoreys to have the support of the LAP ad the LAP groups i situatios where moitorig ad extesive staff resources are ot eeded. Orietatio ad Assessmet We are addig a ew compoet to the LAP with the itetio of helpig attoreys who may oly eed short term help, while at the same time itroducig them to the resources LAP has to offer. A assess- met will be completed by oe of our cliicias located throughout the state. Referrals to outside resources ad a opportuity to participate i the LAP groups will also be provided.

5 3 Impactig Careers The LAP has offered career couselig services for quite some time, ad we expaded those services i I respose to the tremedous impact of the recessio o attoreys, we offered two differet career-focused workshops i both the orther ad souther parts of the state. The respose was beyod capacity ad overwhelmigly positive. The Board of Goverors has supported the cotiuatio of these workshops ad further expaded this service i the comig year, icludig a free webcast for those attoreys uable to atted a workshop i perso. Ecoomic Times Respodig to tough ecoomic times ad budgetary costraits, the State Bar Board of Goverors directed the LAP to sigificatly reduce its budget i Havig already made cuts of early five percet i 2008, the LAP made a similar reductio i expeditures i The program expects to implemet further budgetary reductios ext year. Furthermore, the LAP aticipates operatig at the statutory fudig level i 2011; this will reflect a reductio of $800,000 i aual expeditures compared to 2007, our highest cost year. The program is successfully meetig its budgetary challeges ad I am cofidet that it will cotiue to do so. Reducig Fiacial Assistace By statutory requiremet, fiacial assistace is available for attoreys who would ot otherwise be able to eter the program. I alliace with the Board of Goverors, the LAP Oversight Committee cotiued its work of previous years to further limit the availability of fiacial assistace. Movig ito 2010, loas will be limited to participatio costs ad will cover a period of o more tha oe year. The small loas that had bee available to assist with treatmet costs have bee elimiated. Repaymet of loas by past recipiets has bee disappoitig. I collaboratio with the ogoig work of Alliace Oe, we are implemetig all appropriate collectio measures icludig credit bureau reportig ad the pursuit to judgmet. Lookig Forward The LAP is poised to focus resources towards the missio of supportig recoverig attoreys i their rehabilitatio ad competet practice of law, ehacig public protectio, ad maitaiig the itegrity of the legal professio. 6 44 The Year i Review 2009: Aother Busy Year Attoreys Served attoreys served 1200 This year early 1,000 attoreys received assistace from the LAP a 18 percet icrease 200 over the previous year There were 988 attoreys who received assistace from oe or more program services durig the year. 7 5 Short-term Couselig Services short-term services Four hudred forty-seve attoreys received short-term couselig for persoal or career cocers. 1 A applicat shall meet the followig criteria for acceptace ito the Program: 1. The applicat shall be a active or iactive member, or former member of the State Bar of Califoria; 2. The applicat shall be foud to have a substace-related disorder or a metal health disorder; 3. The applicat shall volutarily agree to participate i the Program; 4. The applicat shall agree i writig to comply with all the elemets of the participatio agreemet; ad 5. The applicat shall cooperate with the Program by providig access to medical iformatio, disclosure authorizatios ad releases of liability as may be ecessary for participatio i the Program. 2 Participats may be termiated from Program participatio whe ay of the followig coditios exist: 1. The participat has failed to comply with the participatio agreemet, icludig but ot limited to: a) Failure to comply with the prescribed moitorig or treatmet recommedatios, or b) Use of alcohol or other uauthorized drug; c) Ay cause for deial of participatio; ad d) Failure to meet the criteria for acceptace ito the Program. 8 6 the year i review Educatio ad Outreach Activities The Attorey Diversio ad Assistace Act directed the State Bar to develop cotiuig legal educatio courses ad materials related to the prevetio, detectio ad treatmet of substace abuse. The Lawyer Assistace Program offers a free oe hour self-study MCLE package that is available to all Califoria attoreys via dowload from a freestadig educatioal website, This has bee a popular resource for attoreys who appreciate the coveiece of affordable, approved self-study material o this topic. I additio, the program offers free MCLE presetatios coverig substace abuse, depressio, stress ad the services of the LAP to local, statewide ad specialty bar associatios as well as to law firms. Evaluatios ad feedback cotiue to be very positive, icludig may commets like the best presetatio of the day. Satisfactio with LAP presetatios is also reflected i a large umber of repeat requests from the same associatios ad firms for LAP speakers. 10 8 lawyer assistace program areas of focus New Services Available i 2010 Rules Overview The Oversight Committee of the Lawyer Assistace Program proposed revised Lawyer Assistace Program Rules to the State Bar Board of Goverors i November of The Board adopted the revised LAP Rules i Jauary of 2010 followig a period of public commet. The revised rules are completely cosistet with the spirit ad programmatic purpose of Seate Bill 479 (Burto), Chapter 129, Statutes of 2001, the statute which created the Lawyer Assistace Program (Busiess ad Professios Code 6230 et seq.). The revised rules cosolidated the two sets of previous rules regulatig the operatios of the LAP, the Rules ad Regulatios Goverig the Lawyer Assistace Program ad the Rules Goverig the Fiacial Assistace Pla of the State Bar of Califoria Lawyer Assistace Program, ad elimiated duplicative provisios. Provisios relatig to criteria for acceptace ad deial of acceptace, termiatio from, ad completio of the LAP, which formerly were to be foud oly i a appedix to the LAP aual report, were icorporated ito the ew rules themselves. I additio to simplifyig ad cosolidatig the program s rules, the programmatic chages reflected i the ew rules were desiged to allow the program to serve a expaded pool of participats without icreasig existig staffig levels. The ew rules related to the Fiacial Assistace Pla were desiged to further slow the growth of the outstadig loa obligatio owed to the State Bar ad to ehace repaymet of the fuds loaed to participats (see page 11). Program redesig efforts i 2009 will result i ew services for Begiig i Jauary of 2010, LAP services will ow iclude: Orietatio & Assessmet (O&A) A distict Orietatio ad Assessmet ( O&A ) service will ow be available to all attoreys, former attoreys ad cadidates for admissio to the Bar prior to their electio to participate i either the Support LAP or the Moitored LAP. The O&A is available without a commitmet to log-term participatio. Creatig the O&A as a stad-aloe service is expected to ecourage more attoreys to seek assistace at the earliest possible time ad prior to persoal or professioal cosequeces. Support LAP The most sigificat chage is the creatio of a less structured, participat-drive LAP called the Support LAP. Aimig to attract attoreys at the earliest possible time, the creatio of the Support LAP will ow eable the program to provide services to a expaded pool of participats without icreasig existig staffig levels. The Support LAP was desiged for attoreys who do ot require moitorig or verificatio of participatio. I additio to the support of professioal group facilitators ad other group participats, the LAP will develop a etwork of voluteers who will provide ogoig support to these participats i their recovery efforts. Moitored LAP A Moitored LAP will exist for attoreys who wat to satisfy a specific moitorig or verificatio requiremet imposed by the Office of Chief Trial Cousel, State Bar Court, Committee of Bar Examiers or other etity. The Moitored LAP will also be available to self-referred attoreys who wish to participate ad who wat additioal structure. The Moitored LAP substatially duplicates the existig LAP. A big turaroud Greg is a very high profile lawyer who had bee charged with umerous misdemeaors for violatios of Califoria state campaig fiace law ad was o the verge of State Bar discipliary proceedigs whe his lawyer recommeded that he eter the LAP. Now a member of the Bar i good stadig, Greg will graduate from the LAP i sprig While i the LAP he led a team of lawyers from 20 firms that received a favorable verdict i a multi-billio dollar case. My greatest professioal achievemets have come durig the time I was i the LAP process, ad I would ot have bee able to do that but for the couselig ad isights that I got through the LAP, he says. Greg adds that he is livig proof that the LAP is oe of the greatest services the Califoria State Bar ca give to its members ad to the public.

11 lawyer assistace program areas of focus 9 Strog Demad For Ehaced Career Developmet Services Califoria s deep ecoomic recessio of has led to icreased uemploymet ad related career challeges faced by may State Bar members. I recogitio of these challeges, the LAP offered two low-cost career developmet workshops durig the fall of 2009 to complemet the two free sessios of persoal career couselig that has bee offered by the LAP for may years. Learig Strategies to Take Your Career to the Next Level was a workshop held i Los Ageles oe ight per week for six weeks begiig o September 16, The program was desiged to help participats idetify career goals, develop a pla for obtaiig the career they wat, develop ew skills to elimiate barriers i the way of their success, ad coect with a supportive commuity of other legal professioals with similar aspiratios ad career challeges. Learig Strategies was preseted i a small group format with a maximum attedace of 12 attoreys. The program was taught ad facilitated by a team of LAP career couselors i cojuctio with a LAP group facilitator. 300 Thigs You Ca Do With a Law Degree was a half-day semiar coducted o October 1, 2009 i Sa Fracisco by Hidi Greeberg, the director of a orgaizatio called Lawyers i Trasitio. Her semiar taught participats how to coduct a career assessmet to decide whether a job or career chage is ecessary, how to effectuate job chage strategies ad avoid pitfalls, how to assess the beefits ad detrimets of various job choices both withi ad outside the field of law, ad illustrated how to discover alterative career optios usig a legal degree as a basis for that career. Accommodatig the emotioal side JoAe Robbis became a disciplie defese attorey followig service as a State Bar Court Hearig Judge ad a State Bar prosecutor. She poits to establishmet of the Lawyer Assistace Program as a moumetal improvemet i the State Bar disciplie system because it could accommodate attoreys with emotioal ad psychological problems, which I believe is as big or a bigger issue with miscoduct by attoreys tha substace abuse. Ackowledgig that o program is 100 percet effective, she says that if the Court, the attoreys ad the other support people are able to get a impaired attorey ito the LAP, the it ca work woders, because most of the time it will save lives, careers ad people s futures. Some have lost their jobs or have see their practices dimiish to almost othig or ca t fid that first job ad just eed a etree. Ad still others foud time away from the law oly made them more eager to get back to it George Mai wated to etwork ad lear about legal opportuities i the midst of a tumblig ecoomy that hurt his immigratio practice. Karre Moore-Jorda wated to get out of probate law ad shift to somethig that frees her from court-imposed schedules ad pay. Birgitte Gillilad wated to test her desire to retur to law after beig a stay-at-home mom despite assertios by family ad frieds that she was crazy to wat to go back. Ad Peter Shelto wated to kow what he eeded to do to get back to his passio after takig time out to maage a family real estate busiess. From coversatios I ve had with literally thousads ad thousads of lawyers over the past 23 years, says Greeberg, 64, I ca break them ito roughly two groups those who thik their practice of law should be abadoed, the sooer the better, ad those who feel that usig their legal skills is desirable but wish they could lesse aspects of the practice that they dislike, or fid ew meaig, or rekidle lost excitemet i their work. As a result, they were able to recommed a comprehesive course of treatmet, which icluded a itesive outpatiet eatig disorder program, idividual therapy, ad a atidepressat regime that was maaged by a psychiatrist. Today, I am happier tha I have ever bee i my etire life ad doig what I love, practicig law. (cotiued from page 9) A recet article i the Califoria Bar Joural (see sidebar, page 9) described the semiar ad quoted the LAP s Richard Carlto o a major reaso for lawyer stress: You re expected to be right all the time ad you re expected ot to make mistakes. 300 Thigs was atteded by 95 attoreys. More tha 200 iquiries were received from attoreys expressig iterest i these programs, may of whom were ot able to participate this year due to geographic obstacles or schedulig coflicts. Additioal sessios of both programs are plaed for the sprig of As a pro boo service to the membership, the Practicig Law Istitute has offered to host the ext sessio of 300 Thigs i their Sa Fracisco facility while simultaeously makig the program available to ay attorey aywhere via a live web cast all for o charge. The Board of Goverors has ecouraged the LAP to expad these career developmet services durig the comig year. The short-term couselig compoet of the LAP also provides two free sessios of oe-o-oe couselig with a local therapist who specializes i workig with legal professioals aroud ay persoal issue or cocer impactig work productivity stress, burout, depressio, coflicts with colleagues or family-members, etc. Demad for both forms of short-term couselig services persoal ad career were strog durig 2009, with 12 percet more attoreys requestig these forms of assistace tha did so durig the prior year. A recet Califoria Bar Joural article idetified Kathy Freistadt, who recetly stopped practicig trasactioal, evirometal compliace, patet ad regulatio law to begi a ew career as a ladscape desiger.

13 lawyer assistace program areas of focus 11 Sigificat Chages to the LAP Fiacial Assistace Pla As a result of chages to the rules ad a comprehesive review by the Oversight Committee, the total umber of LAP participats who are borrowig moey from the Pla i support of LAP-related expeses as well as the total amout of moey loaed by the Pla declied dramatically durig the course of The Attorey Diversio ad Assistace Act, the statute that created the Lawyer Assistace Pla, directed that the State Bar establish a fiacial assistace program to esure that o member is deied acceptace ito the program solely due to the lack of ability to pay. Accordigly, a LAP Fiacial Assistace Pla was established allowig LAP participats who are uable to afford certai o-state Bar costs associated with participatig i the program (such as group facilitator fees) to borrow those fuds from the Pla. These loas become due ad payable whe a attorey stops participatig i the program. Participats who successfully complete the program are allowed to repay the Pla over a 60-moth period, amortized at a rate of seve percet iterest per aum. For attoreys who stop participatig i the Pla prior to successful completio, the etire amout of the loa balace becomes due ad payable immediately. Those loas begi to accrue iterest at a rate of seve percet per aum from the date of cessatio of participatio. Slowig the Growth of Outstadig Debt To slow the growth of outstadig debt obligatios to the Pla, the LAP Oversight Committee has proposed chages to the Fiacial Assistace Pla rules twice, the first time i the fall of 2007 ad most recetly i the fall of 2009 (with the chages to take effect i Jauary 2010). The ew rules restrict the legth of time assistace is provided to each participat to less tha 12 moths. The rules ow also limit the type of expeses for which the loa moies may be used so that i most cases evaluatio ad treatmet expeses are o loger eligible. Furthermore, durig 2009 the Oversight Committee completed a thorough review of all participats i the Pla to esure that those cotiuig to receive assistace were truly i eed. Dramatic reductio At the begiig of 2009 there were 96 participats actively receivig loas from the Fiacial Assistace Pla. By the ed of 2009 the umber of participats actively receivig loas from the Fiacial Assistace Pla was 35, a reductio of 63 percet. This reductio led to a 30 percet drop i the amout of moey loaed i Begiig i 2010 the State Bar Board of Goverors has cut by 50 percet the amout of ew moey available to be loaed by the Pla. Debt Recovery By the ed of 2009, $739,570 had become due ad payable ad was deliquet. I additio, while graduates of the program have five years to repay their loas, $122,294 worth of loas to graduates was outstadig. Oly $68,446 worth of outstadig loas had bee repaid umber of participats i the fiacial assistace pla The high rate of deliquet debts owed to the Pla prompted the State Bar i 2008 to hire Alliace Oe to process repaymets to the Pla ad to attempt to collect deliquet debts. As a result, the State Bar was able to icrease the amout collected i 2009 by 48 percet over the previous year. There was also a 21 percet icrease i the umber of former participats who made paymets to the Bar i 2009 versus lawyer assistace program: 2009 Aual Report
