Call to Order Following the welcome, Pledge of Allegiance and introductions, President Michael I. Green called the meeting of the West Virginia Board of Education (WVBE) to order at 6:04 p.m. on September 8, 2015, in the auditorium at Fayetteville High School, 515 West Maple Avenue, Fayetteville, West Virginia. The following members were present: President Green, Vice President Lloyd G. Jackson II, Secretary Tina H. Combs (via telephone), Thomas W. Campbell, Beverly E. Kingery, L. Wade Linger Jr., Gayle C. Manchin, William M. White, and James S. Wilson, and ex officio Michael J. Martirano, State Superintendent of Schools. Members absent were ex officios Paul L. Approval of Agenda President Green called for a motion to approve the agenda. Dr. Wilson moved that the agenda be approved. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. III. Overview of August 27, 2015, Public Informational Meeting regarding the Proposal for the Reconfiguration Plans for Fayette County Schools Mr. Terry George (distributed information), Superintendent, Fayette County Schools, provided an overview of the August 27, 2015, public informational meeting regarding the proposal for the reconfiguration plans for Fayette County Schools. Delegations Ms. Kristin Anderson, Executive Director, WVDE Office of Communications and Partnerships, announced that delegations would be provided two minutes. Recess President Green called for the meeting to recess and announced that the meeting would reconvene in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia on September 9 at 10:00 a.m. Mr. Jackson moved, and Mrs. Manchin seconded, that the meeting be recessed. Upon the call for the question the motion was carried unanimously and the meeting was recessed at 8:14 p.m. VI. Reconvene President Green reconvened the meeting of September 8, 2015, at 10:19 a.m. on September 9, 2015, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. Consent Agenda President Green requested a motion to approve the Consent Agenda. Mrs. Manchin moved that the Consent Agenda be approved. Approved minutes of August 12 and 21, 2015 (Attachment A) Received WVDE personnel matters (Attachment B) Approved three first time waivers of WVBE Policy 2510 related to the delay of required professional development for Advanced Placement teachers (Attachment C) Approved Employment of Substitute Teachers in Areas of Critical Need policies for Boone, Logan, Raleigh, Wirt and Wyoming counties (Attachment D)
3 - 3 - Received notification, per W. Va. Code 18A-4-7a(l)(3), of transfer of person employed in a professional position after the twentieth day prior to the beginning of the instructional term from Mineral and Wayne County Schools (Attachment E) Approved the Barbour County Board of Education's request to amend its Ten Year CEFP to include the performance of a county-wide Energy Conservation Project at all Barbour County school facilities except Mount Vernon and Volga Century Elementary schools (Attachment F) Approved the Mineral County Board of Education's request to amend its Ten Year CEFP to include the addition of a portable classroom at Wiley Ford Primary School (Attachment G) Approved Fairmont State University's Teacher-in-Residence partnership with Doddridge County Schools (Attachment H) Approve Marshall University's agreement with Mingo County as an additional county to Marshall University's existing approved Teacher-in-Residence Program (Attachment I) Appointed Ms. Gail Adams and Ms. Shawna Safreed to three-year terms on the Educator Preparation Program Review Board (Attachment J) Appointed Ms. Katie Dantrassy, Ms. Christy Schwartz, Ms. Tonya Blackburn, and Dr. Samuel P. Sentelle be appointed to three-year terms on the West Virginia Commission for Professional Teaching Standards (Attachment K). VIII. Office of Education Performance Audits (OEPA) Director's Information Ms. Susan O'Brien, Director, Office of Education Performance Audits, provided a brief update regarding Year 2 on-site reviews, trainings, and a conference presentation. Ms. O'Brien introduced her staff (Allen Brock, Charlene Coburn, Michele Samples and Debbie Ashwell). Ms. Ashwell showcased and demonstrated the use of Galaxy notebooks for Year 2 on-site reviews. Moving to electronic documents will enable team members, team leaders and coordinators to efficiently collect information during the school reviews as well as house numerous datasets accessed before and during our external reviews. Data comes from the public side of ZoomWV and all files are 'unshared' at the completion of the audit for access control purposes. Efficient data collection during OEPA school on-site visits will support a reasonable turnaround time for report review and approval by the WVBE for local level continuous improvements efforts in the areas of student performance and well-being. IX. Amendment - Fayette County Schools Comprehensive Educational Facilities Plan (CEFP) President Green invited Superintendent George to provide an overview of last night's portion of the meeting and the process and plan for the amendment of the Fayette County CEFP. President Green thanked Superintendent George and those who attended last night's portion of
4 the meeting. Superintendent George answered questions posed by Board members regarding facilities Following discussion, Superintendent George recommended that the Board approve the amendment of the Fayette County CEFP to reflect: 1) the construction of a 9-12 high school to accommodate the closure of Fayetteville High School, Meadow Bridge High School, Midland Trail High School and Oak Hill High School and the consolidation/merger of Fayetteville High School (grades 9-12) students, Meadow Bridge High School (grades 9-12) students, Midland Trail High School (grades 9-12) students and Oak Hill High School (grades 9-12) students; 2) renovation/reconfiguration of the Fayetteville High School building to accommodate the closure of Fayetteville Elementary School, Gatewood Elementary School and Fayetteville High School and the consolidation/merger of Fayetteville Elementary School (grades PreK-6) students, Gatewood Elementary School (grades K-4) students and Fayetteville High School (grades 7-8) students; 3) renovation/reconfiguration of the Meadow Bridge Elementary School building and Meadow Bridge High School buildings to accommodate the closure of Meadow Bridge High School and the consolidation/merger of Meadow Bridge Elementary School (grades PreK-6) students and Meadow Bridge High School students (grades 7-8); 4) renovation/reconfiguration of the Midland Trail High School building to accommodate the closure of Ansted Elementary School, Divide Elementary School and Ansted Middle School and the consolidation/merger of Ansted Elementary School (grades PreK-5) students, Divide Elementary School (grades PreK-5) students and Ansted Middle School (grades 6-8) students; and 5) renovation/reconfiguration of the Oak Hill High School building to accommodate the closure of Collins Middle School and to serve as an Oak Hill area middle school (grades 5-8) replacing the current Collins Middle School (grades 5-8). Mrs. Manchin moved that amendment of the Fayette County CEFP be approved. Mr. Jackson seconded the motion. Following discussion, Mr. Campbell moved to amend the original motion by removing Meadow Bridge High School from the amendment of the Fayette County CEFP. Dr. White seconded the motion. Following additional discussion, Dr. Wilson moved that a decision in this matter be postponed for 14 calendar (September 23). Mr. Campbell seconded the motion. President Green requested, due to the lateness of the hour, that the disposition of this matter be delayed to follow a scheduled executive session with its attorney. X. WVBE Personnel Matters inclusive of Update in Jorea M. Marple v. West Virginia Board of Education, et al. President Green called for a motion to move into executive session as provided in W. Va. Code 6-9A-4(b)(2)(A) [personnel exception] and/or 6-9A-4 [matters involving attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)]. Mr. Jackson moved that the Board enter into executive session. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 12:13 p.m. President Green informed the assembly that the Board would remain in executive session through lunch with an expected return time of 1:10 p.m.
5 - 5 - XI Return from Executive Session President Green announced that the Board had returned from executive session with no action taken. The Board returned from executive session at 1:32 p.m. XII. Amendment - Fayette County Schools Comprehensive Educational Facilities Plan (CEFP) Continued President Green called the Board's attention to the motion currently on the floor regarding the amendment of the Fayette County CEFP and called for the question regarding Dr. Wilson's motion, seconded by Mr. Campbell, that a decision regarding this matter be postponed for 14 calendar days (September 23). President Green announced that the motion was defeated. President Green called for the question regarding Mr. Campbell's motion, seconded by Dr. White, to amend the original motion by removing Meadow Bridge High School from the amendment of the Fayette County CEFP. President Green announced that the motion was defeated with four members voting in favor of the motion and five members voting against the motion. President Green called for the question regarding Mrs. Manchin's motion, seconded by Mr. Jackson, that amendment of the Fayette County CEFP be approved. President Green announced that the motion was carried with six members voting in favor of the motion and three members voting against the motion. (Copy appended to Official Minutes, Attachment M.) XIII. WVBE Personnel Matters inclusive of Update in Jorea M. Marple v. West Virginia Board of Education, et al. Continued President Green called for a motion to approve the Board's personnel items found in the attachment. Mr. Jackson moved that the personnel items be approved. Mrs. Manchin the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment L.) XIV. Resolution on Behalf of Gilmer County Board of Education Approving a Lease Purchase Agreement with United Bank as a Qualified Zone Academy Bond (QZAB) in the Amount of $1,000,000 Ms. Heather Hutchens, General Counsel to the WVDE, presented a Resolution on behalf of Gilmer County Board of Education approving a lease purchase agreement with United Bank as a Qualified Zone Academy Bond (QZAB) in the amount of $1,000,000 for the Board's consideration. The proceeds from the bond will be used to equip Gilmer County Elementary School; United Bank will hold the title to the equipment. Mrs. Manchin moved that the Resolution on behalf of Gilmer County Board of Education approving a lease purchase agreement with United Bank as a Qualified Zone Academy Bond (QZAB) in the amount of $1,000,000 for the Board's consideration be approved. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment Mc.)
6 - 6 - XV. Policy 5100, Approval of Educator Preparation Programs Ms. Michele Blatt, Chief Officer, Division of School Effectiveness, presented Policy 5100 for the Board's consideration. Policy 5100 has been revised to continue the governor s challenge to increase the quality and rigor in teacher preparation in West Virginia. Changes include: added language to reflect new legislative changes in alternative certification; description of the validity period for operating/evaluating a pilot educator preparation program; added language to include new endorsements in Earth and Space Science & Integrated Mathematics; updates to reflect changes in Praxis exams; and clarification for several endorsement descriptions including requirement of master's degree for reading specialist. These changes will improve the preparation of educators to teach in West Virginia schools. In July, 2015 the suggested revisions were voted by the WVBE to be placed on public comment for a period of 30 days. At the conclusion of that period, seven comments were received. Of the received comments, no changes were made to the policy. Noted: Based on a comment submitted for Policy 5202, expressing the need for a content proficiency assessment to be required in WVBE policy, the following addition was made to this policy (5100, Appendix E): Requirement of Praxis Assessment #0631 Braille Proficiency for Visually Impaired Endorsement. The major function of Policy 5100 is to provide guidelines and procedures for new and continuing educator preparation programs of study leading to licensure in West Virginia. Policy 5100 supports the intended collaborative process to improve educator preparation programs and potential educators by incorporating program guidelines based on research and best practices. Support of continuous improvement and clear and consistent guidelines to West Virginia educator preparation programs will produce more effective educators in West Virginia schools, resulting in increased student learning in the classroom. Dr. Wilson moved that Policy 5100 be approved as amended. Mrs. Manchin seconded the motion and upon the call for the question the motion was carried unanimously. Policy 5202, Minimum Requirements for the Licensure of Professional/Paraprofessional Personnel & Advanced Salary Classifications Ms. Blatt presented Policy 5202 for the Board's consideration. Policy 5202 has been revised to clarify language to ensure the intent of the policy. On July 10, 2015 the suggested revisions were voted to be placed on public comment for a period of 30 days. During the 30 day comment period, 29 comments were received. Of these 29 comments, 23 were not accepted. The remaining 6 comments resulted in minor revisions to Appendix B and Appendix C. After consultation with the Policy 5202 Advisory Committee, Appendix B and Appendix C were modified. Mrs. Manchin moved that Policy 5202 be approved as amended. Ms. Kingery seconded the motion and upon the call for the question the motion was carried unanimously. (Copies appended to Official Minutes, Attachment O-1 and O-2.) XVII. Policy 5310, Performance Evaluation of School Personnel Mr. Jackson moved that Policy 5310 be laid over to September 10, Mrs. Manchin seconded the motion and upon the call for the question the motion was carried unanimously.
7 - 7 - XVIII. Policy 5901, Alternative Certification Programs for the Education of Teachers Ms. Blatt presented Policy 5901 for the Board's consideration. Policy 5901 establishes the requirements and guidelines for developing alternative certification programs for the education of teachers. The Policy creates alternative means for a qualified person to earn a professional teaching certificate by authorizing a school district to offer a rigorous program for teacher certification in partnership with a regionally accredited IHE, an entity affiliated with a regionally accredited IHE, the WVDE, or a RESA. It also calls for the repeal of Policy 5901, effective March 25, 1992, and the replacement of it with the revised version. The updated Policy 5901 will impact public education by filling the need for certified teachers in West Virginia classrooms. Parents will be impacted by the passage of the new Policy with the assurance that their children are being taught by qualified and certified teachers. On July 10, 2015, the suggested revisions were placed on public comment for a period of 30 days. At the conclusion of that period, 26 comments were received. One comment was accepted, resulting in a minor change to a definition. Policy 5901 provides a means for qualified persons, many from our state's diverse work force, to earn professional teacher licensure while teaching in a classroom in an area of critical need and shortage. Students will benefit in having a teacher who is qualified and certified to teach the subject matter being taught. Dr. White moved that Policy 5901 be approved as amended. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. (Copies appended to Official Minutes, Attachment P-1 and P-2.) XIX. Teaching, Empowering, Leading and Learning (TELL), Survey of Teaching and Learning Conditions Ms. Blatt and Dr. Monica Beane, Executive Director, WVDE Office of Educator Effectiveness and Licensure, presented information regarding Teaching, Empowering, Leading and Learning (TELL), a survey of teaching and learning conditions. Following discussion, it was requested that an item be placed on the October agenda for further discussion and consideration. (Copy appended to Official Minutes, Attachment U.) XX. Superintendent Reports Superintendent Martirano presented no reports. XXI. Capacity Building for Priority Schools and Intervention Counties Ms. Blatt provided a brief update regarding funding and support services provided to priority schools. Update intervention counties is found in Attachment Q-1 and update regarding Wayne County Schools is found in Attachment Q-2. (Copies appended to Official Minutes, Attachment Q-1 and Q-2.) XXII. Update - WVBE Actions for Improved Outcomes Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations, and Board members provided an update regarding actions taken by the Board to improve educational outcomes and support to county boards of education. WVBE Finance Committee -
8 The September 8, 2015, WVBE Finance Committee meeting was canceled. (Copies appended to Official Minutes, Attachment V.) XXIII. Chancellor Report Chancellor Hill and Chancellor Tucker were unable to attend the meeting. XXIV. WVBE Coordinator of Board Agencies Report/ WVBE Regional Education Service Agency (RESA) Liaison Report Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided an update regarding his work in conjunction with WVBE agencies inclusive of the West Virginia Schools for the Deaf and the Blind, Office of Education Performance Audits, WVDE Office of Institutional Education Programs, RESAs, and a brief report on the behalf of Mr. Jacob Green, Special Assistant to the Chief Officer, WVDE Office of Institutional Education Programs, regarding institutional education programs. Mr. Joe Oliverio, Executive Director, RESA 5, provided a report on behalf of the RESAs regarding services provided by RESAs that benefit all students all day every day. XXV. Recess President Green called for the meeting to recess and announced that the meeting would reconvene in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia on September 10 at 9:00 a.m. Mr. Jackson moved, seconded by Mrs. Manchin, that the meeting be recessed. Upon the call for the question the motion was carried unanimously and the meeting was recessed at 2:29 p.m. XXVI. Reconvene President Green again reconvened the meeting of September 8, 2015, at 9:20 a.m. on September 10, 2015, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. The following members were present: President Green, Vice President Lloyd G. Jackson II, Secretary Tina H. Combs (via telephone), Thomas W. Campbell (via telephone), Beverly E. Kingery, L. Wade Linger Jr., Gayle C. Manchin, William M. White, and James S. Wilson, and ex officio Michael J. Martirano, State Superintendent of Schools. Members absent were ex officios Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and Sarah Armstrong Tucker, Interim Chancellor, West Virginia Council for Community and Technical College Education. XXVII. Policy 5310, Performance Evaluation of School Personnel Continued Ms. Blatt requested that Policy 5310 be moved to the October Board meeting as evaluations need to be finalized prior to responding to comments received during the comment period and moving forward with policy revisions.
9 Dr. White moved that Policy 5310 be placed on the October 2015 agenda. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously XXVIII. American Federation of Teachers - West Virginia, AFL-CIO v. Monongalia County Board of Education, and Frank DeVono President Green introduced Mr. Frank Devono, Superintendent of Monongalia County Schools, Mr. Howard Seufer Jr., Esq., and Dr. Barbara Parsons, Vice President of the West Virginia School Board Association, who presented information regarding the Monongalia County Board of Education's appeal to the Supreme Court of Appeals of West Virginia and requested that the Board submit a friend of the court brief. Ms. Christine Campbell, President of the American Federation of Teachers - West Virginia, AFL-CIO, addressed the Board regarding the suit. Following discussion, Mr. Linger moved that Board delegate President Green the authority to discuss with counsel and take appropriate action as it relates to filing an amicus brief in this matter. Dr. Wilson seconded and upon the call for the question the motion was carried with eight members voting yes and one member, Mr. Campbell, voting no. Items for Future Consideration Ms. Peduto (distributed information) stated that the Board's goals and strategic actions will be taken up in October. President Green (distributed information), Ms. Kingery and Mr. Jackson provided information regarding a West Virginia Roundtable Panel presentation delivered at the 2015 West Virginia Chamber of Commerce Annual Meeting and Business Summit on September 2, Ms. Peduto, on the behalf of Mr. Campbell, requested that a meeting of the Board's Local and Regional Efficiencies Committee be convened and that the committee take up the West Virginia Commission of School District Governance and Administration's recommendations for action by the Board at the October meeting. Mr. Linger requested an item be placed on the October or November agenda regarding insurance for teachers. Dr. White provided an update regarding the Westside project; a meeting of the Educational Broadcasting Authority and requested that Scott Finn invited to present at a future meeting; and, announced that the WVDE's Re-imagining Instructional Time stakeholders group will meet September 11. Dr. Wilson spoke regarding press from yesterday's meeting. President Green announced that a press conference regarding Jamie's Law was taking place today at 11:00 a.m. in the Governor's Press Conference Room. Superintendent Martirano reminded the assembly that an Academic Spotlight town hall meeting was scheduled tonight in South Charleston; general discussion ensued regarding Academic Spotlight town hall meetings and follow-up as a result of comments received during the meetings. (Copy appended to Official Minutes, Attachment R and addenda.) XXX. Future Meetings The next regular meeting of the WVBE will be held October 14, 2015, in Charleston, West Virginia. The meeting will continue on October 15, 2015, if the agenda is not completed on October 14, 2015.
10 XXXI. Adjournment President Green called for a motion to adjourn. Dr. White moved that the meeting be adjourned.
