3 NC_Utland engelsk_ :07 Side 3 How to use the guide The first step to take to find the price of a given consignment is to find out where in Norway the load starts or ends. Go to the List of Places in Norway and find the appropriate zone. Note the number of the zone and go to the List of European Countries. Link the zone number to the appropriate place in the List of European Countries to find the correct freight zone. Note this zone and find it in the Tariff table. There you will obtain the correct price for the load, based on the freight calculated weight of the consignment. For example: How much will it cost to send 250 kg from Hannover in Germany, which has postal code number DE-30000, to Mjøndalen in Norway (postal code number NO-3050). Since Mjøndalen is in zone 4 in Norway, fit zone 4 to the appropriate postal code interval in the Germany section of the List of European Countries (25000 to 31999) and this will tell you that this journey is in freight zone 22. If stowing or groupage cannot be performed due to the shape or contents of the consignment, or special requirements stipulated by the consignor, the following calculation is made: Length x Breadth 2.4 (e.g.1 pallet 1.20 x , which is the breadth of the load). For loads requiring extra security in the form of a span set, chain or the like, which in turn need more floor space than the piece itself, the load metres will be calculated on the basis of the actual floor space required. The same also applies to goods that have a shape or size that prevent the maximum utilisation of the lorry that is otherwise carrying other standardised items, such as EUR pallets or ISO containers. 1 load metre = 1850 kg 1 load metre = 2000 kg in the Nordic countries 1 m3 = 333 kg Road transport 1 m3 = 1000 kg Overseas 1 m3 = 167 kg Air The freight is always calculated according to the method yielding the highest freight calculation weight. The consignor is responsible for the measurements and weight being correctly stated. The freight payer is informed of corrected deviations when invoicing takes place. Special goods: Pieces weighing more than 1000 kg, or having outer measurements exceeding 2.4 x 2.0 x 1.2 m: 25% freight surcharge Goods that must be kept frost-free as dry goods in winter: 25% freight surcharge. Waiting time when loading/unloading: No-load journey: A direct loading task is calculated as requiring max. 1 hour at NOK per hour A no-load journey (booked goods are not to be found) is charged at 80% of the agreed price. Consignments to private individuals, construction sites, hospitals, school and addressees lacking a manned daytime address are unloaded at the terminal, where a normal warehousing rental, a terminal fee, a warehousing charge and an advising fee, amounting to NOK , are charged. Unpacked goods: 25% freight surcharge Minimum NOK Pallet exchange: Pallet exchange is not available on our international transport service. 21

22 NC_Utland engelsk_ :07 Side 22 General terms and conditions General Goods are received for carriage in accordance with the tariffs, the terms for calculating freight and the transport regulations used by Nor-Cargo. Nor-Cargo s transport regulations are regulated by the General Conditions of the Nordic Association of Freight Forwarders (NSAB 2000), Act no. 68 of 20 December 1974 relating to agreements on the carriage of goods by road, the Norwegian Maritime Code and Nor- Cargo s Transport Guide. Approved information on each consignment for Europe is made available for Nor-Cargo in accordance with the agreement and transportation contract for the individual consignment. The transportation takes places in accordance with Nor-Cargo s transportation terms. The goods are loaded together with other consignments. They must be labelled and provided with information about their contents and properties. The packing must be of such quality that they can withstand being loaded together with other cargo, whether this is due to their own character, the contents or other aspects that require special forms of carriage. All prices and terms in the transport guide are in accordance with the general conditions known as of 1 June We reserve the right to make changes to the guide without prior notice due to changes in the general conditions that are not known at the present time. Labelling goods and filling in documents All pieces are to be clearly labelled and in accordance with the consignment note, packing slips or electronically transmitted information about the consignment. Only labels (packing slips) approved by Norsk Edipro are accepted. Incorrect labelling and/or errors in transmitted information about the consignment will be corrected by Nor-Cargo and this task will be charged to the carriage payer. All pieces sent as credit transfer consignments must be clearly labelled as such (see the filling in of documents). The consignor is responsible for removing or crossing out old labels. Weight and volume calculations The consignor is responsible for the weight and measurements of the individual consignment or piece being correctly stated. If more than one line is used when filling in Type of packaging (type of goods), the gross weight and measurements must be stated on each line. Incorrectly stated measurements and/or weights will be corrected and the cost will be charged to the carriage payer. The freight payer is informed of corrected deviations in the consignments due to errors in the stated weight or volume when invoicing takes place. The following rules apply for Forwarding Europe: Cubic metre 1 cubic metre is converted to 333 kg. Consignments weighing less than 1000 kg are rounded off upwards to the nearest 50 kg. The weight of all consignments in excess of 1000 kg is rounded off upwards to the nearest 100 kg. Fixed weights Cycles of all kinds: 60 kg each Passenger car tyres: the actual weight is raised by 50 percent Used car engines: the actual weight is raised by 100 percent (Used car engines must be placed in a leak-proof crate, oil must have been removed and the bottom plug must be screwed out.) Snowmobiles, motorised sledges, mopeds and motorcycles: the actual weight is raised by 300 percent. Freight calculation The freight is calculated separately for each consignment and is split between the individual stretches of the route. A consignment is to be understood as the goods stated on a consignment note or a consignment number for dispatch from a consignor to a consignee. A consignment may consist of one or more pieces. By special agreement, a third party may also be permitted to pay the freight and other charges. Unless another payee of the freight and other charges is clearly stated on the consignment note or electronically transmitted information, the consignor will always have to pay. The maximum calculated freight sum in a weight interval is the minimum calculated freight sum in the next weight interval. Exception from this rule is between the weight intervals of Kg and Kg. Shipment to the following Consignees/Receivers shall always be paid by the shipper: Freight costs must always be paid by the consignor in the case of the following consignees. Private individuals and firms having a recipient address that is unmanned between 8.00 am and 4.00 pm, works, construction sites, conferences, trade fairs and ships. Guaranteed transport times Guaranteed transport times apply only where these are agreed by the parties in writing. Reduced frequency must be expected in connection with festive days, Christmas, Easter and summer holidays. Guaranteed transport times do not apply for transport assignments to customers with delivery limitations between 8.00 am and 4.00 pm. Delivery hindrances If the consignee refuses to accept the goods, or a hindrance arises in connection with delivery, the carrier will ask the consignor for instructions on what to do. If these instructions are not received within 7 days of the request being made, the consignment will be automatically returned to the consignor at his cost and risk. Return and re-forwarding If the customer wishes to have the consignment returned or forwarded to another destination, a re-forwarding fee is calculated (see the Tariff). This is only done on receipt of an order in writing from the owner of the goods. EUR pallets Pallets are not exchanged when the transportation involves border crossing. Special regulations Dangerous goods Dangerous goods (corrosive, toxic, explosive and flammable substances and substances that are hazardous to health) are accepted for transport on special terms and under the assumption that IMDG and/or ADR regulations are being complied with. When it is agreed that the transport assignment will concern dange- 22

23 NC_Utland engelsk_ :07 Side 23 rous goods, both parties must fulfil their commitments with respect to regulations that are at any time valid for dangerous goods. At present, the valid regulations are the Provisions concerning the Transport of Dangerous Goods on Roads and Railways, dated 8 May When dangerous goods are to be conveyed, the consignor is responsible for ensuring that: a) only goods permitted to be transported are delivered b) the goods are packed, classified and labelled in accordance with the regulations c) the goods are labelled dangerous goods declaration d) the transport documents and transport accident card contain the information required by the Provisions and are completed in all the relevant languages. The consignor must compensate the carrier for any loss or damage resulting from these obligations not being met. Any extra cost, as well as costs for waiting and returning, that accrue when these obligations are not met, will be charged to the consignor. Should the carrier be held responsible by public authorities or a third person for matters that can be traced back to the consignor, the carrier may claim recourse from the consignor. The carrier is under obligation to refuse the goods if: a) it is obvious that the goods are not packed in accordance with the regulation b) the packing has visible damage that may have a bearing on safety during transport c) the goods are not properly labelled in accordance with valid rules d) essential documents for undertaking the transport are lacking If dangerous goods have been loaded, and the carrier has not been informed of this, the goods may be unloaded without liability to pay compensation. The carrier may destroy or render the goods harmless at the expense and risk of the consignor when there is reason to assume that the danger cannot be averted by less radical measures. Nor-Cargo has special safety advisers at all terminals to answer queries regarding normal methods of shipment, special transport and whether and when the consignment can be received. Consignments in danger classes 1 (explosives) and 7 (radioactive substances) cannot normally be accepted without special agreement with Nor-Cargo regarding the consignment. Dangerous goods are priced with a 25% surcharge on the ordinary freight rate. A freight surcharge of 100% is placed on goods in classes 1 and 7. Heated goods Frost-free transport can be provided between most destinations in winter. Contact the nearest Nor-Cargo terminal and request a plan for this. A 25% surcharge on the ordinary freight rate is charged for heated goods. Part loads Part loads are normally consignments in excess of 2000 kg for which a special price and form of carriage has been agreed and where the individual consignment has been termed a part load. The carriage of part loads is agreed in response to separate booking for a specific consignment. A separate tariff has been drawn up for part loads, which follows the same principles as that for general cargo. The minimum price in the individual zone can be found in the tariff for part loads. Part loads are normally picked up and delivered by the same vehicle and at ramp level. It is assumed that conditions at both the consignor and the consignee are appropriate for this. If additional loading or unloading equipment has to be sent for, or the customer requires the consignments unloaded at our terminal and delivered from there, this is done at the customer s own cost and risk. Special transport Goods exceeding the following weight and/or outer measurements are classified as special goods when a piece: weighs more than 1000 kg, or has one long side that measures more than 2.4 m, or has two sides that measure more than 2.0 m Pieces whose length, breadth and height exceed 650 cm x 240 cm x 240 cm, respectively, and/or cannot be handled with standard equipment, are priced and carried by prior arrangement. Up to 2 days longer transport time than for normal general cargo and part loads must be allowed for the shipment of special goods. A 25% surcharge on the ordinary freight rate is charged for special goods. Unpacked goods These are not accepted for shipment without prior agreement. A 25% surcharge on the ordinary freight rate is charged for unpacked goods. Removal goods These are only accepted for shipment by special agreement. Customers may hire whole containers for the shipment of removal goods by road or railway. Nor-Cargo undertakes no form of insurance for damage or shortages. This is because the company s third-party insurance does not cover removals and Nor-Cargo does not cover such damage or shortages in any other manner. The customer is personally responsible for obtaining any such insurance from an insurance company, or via Nor-Cargo. The customer must accept these conditions on a separate form before taking over the container. Freight costs and other charges must always be paid in advance. Consignments to private individuals or unattended daytime addresses, building sites, hospitals, schools or customers with delivery limitations between 8.00 am and 4.00 pm will normally be unloaded at the terminal. This also applies to consignments and pieces subject to a credit transfer. Warehousing and advising charges will be invoiced to the freight payer. It is presumed that the consignee fetches the goods in the course of two working days after he or she has received the advice from Nor- Cargo, or that delivery between 8.00 am and 4.00 pm has been agreed. If the consignment is kept at the terminal for more than two working days, a warehousing rental fee will be charged from day three inclusive. Customs clearance Consignments arriving from Europe will be cleared through customs by Nor-Cargo at the arrival terminal, unless an alternative is agreed upon. Currency and fuel surcharges Currency and fuel surcharges will be added to the calculated freight sum. These are variable and will be influenced by changes taking place on the international currency and fuel markets. Information about the levels of such surcharges can be found at Pickup and delivery Pickup and delivery are normally included in the freight charge. At places with an established pickup service, pickup is performed at specific times on certain days. Three alternatives are offered: 1. Pickup on fixed days at fixed times 2. Pre-booked pickup before am (varies locally) 3. Pickup booked after am for a pickup the same day (varies locally) Booking after am for pickup the same day normally entails a surcharge. The goods are picked up and delivered at street or ramp level. It is presumed that conditions are such that pickup and delivery can be undertaken with ordinary distribution vehicles. Delivery and pickup at special times, to or from firms with addresses in shopping centres, indoors in shops, restaurants, kiosks, etc. are carried out at pre-arranged times and places. In the case of a particularly complicated pickup or delivery, or if a crane or other special equipment is required, the service is performed at a pre-agreed price, time and place. Delivery and warehouse rental Consignments will normally be delivered to the consignee. If the goods are to be delivered to private individuals, the consignee will be notified in advance. If reservation has been made regarding the delivery of a 23

24 NC_Utland engelsk_ :07 Side 24 consignment, the consignee will always be notified in advance. A warehousing rental fee will be charged for consignments that have not been fetched or cannot be delivered by day 2 after the notification has been sent to the consignee. Consignments that need to be kept at the destination terminal for more than two days will be charged a warehousing rental fee from day three inclusive. Unsuccessful pickup or delivery If pickup or delivery has been pre-arranged and the consignor or consignee are absent, or the assignment is cancelled less than 3 hours before the agreed pickup or delivery time, a charge will be made to cover the expenses incurred. Terms and conditions of payment In principle, non-contract customers must pay freight costs in cash, i.e. before the goods are dispatched or delivered. Credit Following specific agreement, up to 10 days credit and an agreed credit limit are normally given. The credit and credit limit are annulled if there is any kind of default in payment. If payment takes place after the due date, 12 % p.a. is charged, along with a surcharge per invoice. Charges for offering credit The cost of offering credit, which includes the cost of postage and paper, monitoring, reminding, etc., is not included in the freight charge between the consignor and the consignee. A fixed amount is charged for each invoice that is made out. Invoices All transport orders for which credit has been granted must be paid by the due date. Any objections to the invoice must be taken up in writing with Nor-Cargo within 10 days of the receipt of the invoice. In the event of non-payment, invoices not yet due will be considered overdue and can be collected along with overdue claims. Nor-Cargo reserves the right to offset balances due to it against claims the customer has against Nor- Cargo. The customer may not offset or withhold monies that are overdue, even if a claim has been made regarding the freight, damage or a short delivery. ISPM 15 New requirements regarding pallets and wooden packaging Many countries have introduced phytosanitary demands on the importation of wooden pallets and other wooden packaging accompanying imported goods. The demands vary slightly from one country to another, but an international phytosanitary standard for packaging (ISPM 15) and a common labelling scheme, which several countries are in process of incorporating into their legislation, have now been established. The EU introduced the new standard from 1 March This means that from that date EU nations will not permit the import of wooden pallets and wooden packaging that do not meet the demands laid down in ISPM 15. The standard requires, for example, that all bark must have been removed from the wood. The wood must also have undergone heat treatment with a minimum temperature of 56 C for 30 minutes. (Fumigation with methyl bromide gas can also be used to kill any pests, but this form of treatment is being phased out and will be banned in Norway in the course of 2005.) Wooden pallets and wooden packaging that meet the demands will be marked with a special standard mark as proof that the wood has undergone such heat treatment. Norway will also introduce corresponding regulations in due course. In Norway, it is the Norwegian Food Safety Authority (formerly the Norwegian Agricultural Inspection Service) which administers and supervises the scheme. It states that the normal drying of timber that takes place at most Norwegian manufacturers of timber products is adequate treatment and meets the requirements of the standard. The Norwegian Food Safety Authority has approved a number of firms for treatment and marking of timber, and manufacturers of wooden pallets and packaging will have to purchase their timber from these firms. In the longer term, all wooden pallets and packaging that are manufactured will therefore meet the demands of the standard and have the required mark. The ISPM 15 standard will also eventually be adopted as part of the standard for EUR pallets. This problem can be avoided by ensuring that existing pallets undergo heat treatment (or fumigation) that meets the demands. However, this is expensive and it is probably not unlikely that manufacturers of plastic pallets will have a prosperous future. Moreover, there is obviously nothing to prevent existing, unmarked pallets being used within Norway. Since Norway is not introducing the standard from the same date as the EU, it can also be envisaged that Norway may be used as a "dumping nation" for unmarked, out-of-date pallets. Norwegian importers and transporters should therefore instruct their contacts abroad that only wooden pallets and packaging marked in compliance with the standard are to be used with consignments to Norway. There, you will find links to the new standard and a summary of the status for the introduction of ISPM 15 in various countries. There is also a list of firms which the Norwegian Food Safety Authority has approved for treating and marking wooden packaging. Claims and Liability All settlement for damage or missing goods is to be decided in accordance with the NSAB that is at any time valid, Act no. 68 of 20 December 1974 relating to agreements on the carriage of goods by road and the Norwegian Maritime Code. Nor-Cargo has prepared a special brochure that helps you should an accident occur. Visit our home page, or contact the nearest major terminal to have the material sent. If the goods are damaged, or parts or all of the consignment are missing when it is received or delivered, this must be noted on the consignment note when the goods are delivered or received and be authenticated by the driver or by Nor-Cargo and a responsible member of staff at the consignee. A demand for examination must be directed to the Nor-Cargo destination terminal. In the case of consignments lacking a consignment note, the same information must be noted on a special form and be registered in the driver s handheld computer. If the damage is not visible on the outside, the consignee must inform the relevant Nor-Cargo office of the damage in writing without undue delay and no later than seven days after the goods are received (3 days in the case of sea transport). If the goods are signed for on the consignment note or the display of the handheld computer without a comment being added, it will be taken for granted that they were in the state indicated on the consignment note unless the consignee can prove otherwise. The damaged goods and packing must be kept until they have been examined. Claim for compensation A specified claim accompanied by the consignment note or a copy of the electronic information regarding the consignment, as well as a copy of the purchasing invoice, must be sent to the Nor-Cargo destination or departure terminal immediately. Limitation of responsibility (international transport) Nor-Cargo s liability to pay compensation is limited in accordance with the NSAB that is at any time valid, Act no. 68 of 20 December 1974 relating to agreements on the carriage of goods by road and the Norwegian Maritime Code. Any compensation for loss due to delayed delivery is limited to the freight price paid to Nor-Cargo for the consignment in question (see Guaranteed transport time). 25 NC_Utland engelsk_ :07 Side 25 General information about transport in Europe Communication structure General cargo Nor-Cargo handles all kinds of general cargo consignments via pre-defined HUBs in central parts of Europe and Scandinavia. Direct services go between these HUBs and the larger towns in Norway. This enables us to achieve: high regularity, many departures (we have daily departures from Germany, Sweden and Denmark, for example) shorter transport times (we always have an alternative means of transport to all places) cost-effective transport Part loads Part loads and full loads are handled in accordance with demands placed on us by customers, authorities and other factors that influence how goods are transported. It is therefore essential to reach agreement beforehand with the local Nor-Cargo office regarding transport times, pickup and delivery times and other aspects concerning the shipment. This will help Nor-Cargo s partners to have satisfied customers. Customs clearance Irrespective of their value and nature, all consignments to be transported to or from Norway must be cleared at the Customs. If, for one reason or another, neither duty nor other charges are to be collected in respect of a consignment, this must be approved by the Customs. Customs clearance is normally carried out by a freight forwarder linked up electronically with the Customs (TVINN). If you need advice or information in connection with the import or export of goods, please contact the nearest Nor-Cargo office. See also the Customs home pages: Documents The owner or consignor of the goods must issue an approved commercial invoice to use as customs clearance documentation. Invoices issued in connection with the sale of goods should have a character and content that are accommodated to international standards and recommendations (cf. Norwegian Standard for Commercial Documents). The invoice must be filled in by the vendor and should contain the following information: Name and address of the vendor and/or supplier. Name and address of the purchaser and/or recipient. Place and date of issue. Ordering date, purchasing date, order number or similar reference. Number of pieces, weight, labels, type and tariff classification codes. Precise specification of the contents of the consignment, including information about the type of goods and the net amount of each kind of goods. The agreed price of each goods entity and the stated currency. All other conditions attached to payment, sale, takeover, delivery, discounts and the like. All invoices must also contain an invoice declaration in which the vendor or supplier must declare the origin of the consignment. The actual wording of the declaration is an international standard, and is as follows: - The exporter of the products covered by this document (authorization No... (1)) declares that, except where otherwise clearly indicated, these products are of... (2) preferential origin.... Place and date... Signature of the exporter, in addition, the name(s) of the signee(s) must be repeated in block capitals. 25

26 NC_Utland engelsk_ :07 Side 26 Terms of delivery - Incoterms 2000 Nor-Cargo regards Incoterms 2000 as the approved terms of delivery for a consignment. Basically, Incoterms 2000 concerns apportioning the risks, expenses and responsibilities between the purchaser and the vendor when goods are being transported, and should always be an element in the contract. The terms of delivery should always be stated in the commercial invoice and in all transport documents. FAS Free Alongside Ship Ship The vendor must deliver the goods placed alongside the ship in the port of shipment and cleared for export. FOB Free On Board Ship The vendor delivers the goods when they pass the ships railings in the port of shipment and cleared for export. CFR Cost and Freight Ship The risk passes from the vendor to the purchaser when the goods pass the ships railings in the port of shipment. The vendor must, however, pay all the expenses to the port of arrival stated. CIF Cost Insurance Ship The risk passes from the vendor to the purchaser when the goods Freight pass the ships railings in the port of shipment. The vendor must, however, pay all the expenses to the port of arrival stated, including transport insurance to cover the purchaser s risk of loss of, or damage to, the goods during transport. CPT Carriage Paid To Road vehicle, ship, plane The risk passes from the vendor to the purchaser when the goods and train are delivered to the first carrier, irrespective of the means of transport. The vendor must, however, pay all the expenses to the destination stated. CIP Carraige and Road vehicle, ship, plane The risk passes from the vendor to the purchaser when the goods Insurance Paid to and train are delivered to the first carrier, irrespective of the means of transport. The vendor must, however, pay all the expenses to the destination stated, including transport insurance to cover the purchaser s risk of loss of, or damage to, the goods during transport. DAF Delivered At Frontier Road vehicle, plane The purchaser must pay all the expenses when the goods have and train been made available to him or her on the means of transport that has arrived at the stated location and place on the frontier, unloaded, cleared for export, but not cleared for import. DES Delivered Ex Ship Ship The purchaser must pay all the expenses when the goods have been made available to him or her onboard the ship, without them having been cleared for import in the port of arrival stated. DEQ Delivered Ex-Quay Ship The purchaser must pay all the expenses when the goods have been made available to him or her on the quay in the port of arrival stated, without them having been cleared for import. DDU Delivered Road vehicle, ship, plane The vendor must deliver the goods to the purchaser without them Duty Unpaid and train having been cleared for import, and not unloaded from the means of transport that has arrived at the destination stated. DDP Delivered Road vehicle, ship, plane The vendor must deliver the goods to the purchaser without them having been cleared for import, and not unloaded from the means of transport that has arrived at the destination stated. The vendor stands all the costs except unloading at the destination stated. When Incoterms 2000 is used, the place where the risk and responsibility are transferred must also be stated. 27 NC_Utland engelsk_ :07 Side 27 MAUT German trunk toll system France is divided into two zones. In zone 1, MAUT is calculated on the basis of vehicles travelling via Holland and Belgium, and in zone 2 on those travelling via Strasbourg. The new German trunk toll system, MAUT, was introduced on 1 January This entails a dramatic taxing of heavy goods vehicles on German motorways and amounts to about NOK per km, depending on the type of vehicle. This means a 12-15% increase in costs for all goods traffic through Germany, compared with the former level of costs per km. In addition, there are administrative expenses connected with MAUT, as well as the cost of installing the equipment required, and other costs. All the toll rates are stated in NOK per 100 kg. Nor-Cargo AS will try to find alternative means of transport by rail and ship to avoid transit on German roads to some countries on the Continent. The most important exceptions are loss and damage caused by: the quality and state of the goods when the insurance was taken out protest actions, disturbances, strikes, sabotage and the like delays temperature fluctuations war and war-like conditions Transport accidents - C terms (C) Limited compared with A terms. Only specifically mentioned hazards are covered. The basic principle is that compensation for loss or damage is given when the actual means of transport has met with a (serious) accident. In addition, loss and damage are covered when caused by: fire, explosion and natural disasters Road toll at Svinesund As most people will be aware, the new bridge over Svinesund was officially opened on Friday 10 June In that connection, all traffic is being routed onto this bridge and will be able to draw advantage from the improved standard of the road network on both sides of the border between Norway and Sweden. To partfund this project, the authorities in Norway and Sweden decided to introduce a road toll to be paid when crossing the new Svinesund Bridge. Because this public fee entails a significant increase in costs, we must regrettably raise our prices for all goods carried over Svinesund. This surcharge will be invoiced as a separate line on our invoices, and is as follows: NOK 7.50,- per tonne Minimum NOK 7.50 per consignment Maximum NOK per consignment This mainly concerns consignments to and from Sweden, Finland, Denmark (via Sweden), Poland and the Baltic States. The collection of this toll begins on 1 July We beg your understanding that this toll charge, which is beyond our control, must be passed on to our customers.
