SUBJECT This specification, which is an integral part of the technical documentation (Quality Agreement, acceptance specification, drawings and purchase orders), has to be applied to the purchased components and materials used in all the divisions of IRCA SpA. 2. SCOPE This specification guaranties the compliance with legal requirements and regulations in force and customers requirements relating to hazardous substances used in products manufactured and sold by IRCA SpA. 3. MAIN EUROPEAN REFERENCES EU-Directive 2002/95/EC and 2011/65/EU on restriction of use of certain hazardous substances in electrical and electronic equipment (RoHS); EU-Regulation 1907/2006/EC concerning the Registration, Evaluation, Authorisation and Restriction of chemical substances (REACH); EU-Regulation 987/2008/EC regarding annexes of IV and V of EU-Regulation 1907/2006/EC; EU-Directive 76/769/EEC relating to restrictions on the marketing and use of certain dangerous substances and preparations, including all amendments; EU-Directive 67/548/EEC on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances and following the amendments; EU-Regulation 2037/2000/EC (Ozone Depleting Substances); EU-Regulation 1272/2008/EC on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation 1907/2006/EC. 5. APPLICATION MODALITIES

3 ZOPPAS INDUSTRIES: HAZARDOUS SUBSTANCES LIST Date: Page: 3/90 The supplier of materials and components has to guarantee and declare that the goods supplied to IRCA SpA are compliant with the requirements of paragraphs 6 and 7. To comply with what above carried, the Supplier shall, in his headed paper, fill in, undersign and send back the model of Enclosure 1 within 45 days from reception. In case of absence of response, IRCA SpA will provide with adressing a remainder to the Supplier: after further 15 days, without any response, IRCA SpA will consider that the products, components and/or materials supplied are compliant with the requirements, considering the Supplier responsible in case of non conformities. The Supplier, in case of absence of response and/or false responses and in the event of a detection of a difference compared with the requirements of points 6 and 7, shall take himself the responsibility and shall support: the costs of analysis carried out; the costs for the replacement of IRCA SpA finished product found not compliant; all the other direct and indirect costs due to the missing observation of the requirements. Periodically, IRCA SpA update the contents of the tables of clause 6 and 7, sending the Functional specification to the Supplier. NOTE 1: As far as SVHC (Substances of Very High Concern) are concerned, regulated by REACH 1907/2006/EC and its amendments, the Supplier is responsible for communicating the presence of these substances to IRCA SpA, without IRCA SpA do a periodical request. NOTE 2: If the Supplier does not return what required (model of enclosure 1 filled in, undersigned in his headpaper), IRCA SpA give a negative judgment for the development/implementation of new businesses, reserving to evaluate further measures till considering the alimination of the Supplier from the Vendor List. 5.1 Legend of tables CAS: (Chemical Abstracts Service), numeric identification that individuated a chimica substance EC: (European Commission number, or EC number) European Commission number, of eigth numbers, assigned to chimica substances.
