Hold a Publc Heang; and 2. Adopt a Resoluton Appovng the Fnal Engnee' s Repot and Odeng the Levy and Collecton of Assessments fo the Landscape and Lghtng Mantenance Dstct No Woodfeld Pak Mantenance Zone fo Fscal Yea 2016/ 17 SUMMARY: At the Apl 4, 2016 Cty Councl Meetng, Staff pesented the Pelmnay Engnee' s Repot and Intent to Levy fo the Landscape and Lghtng Mantenance Dstct No Woodfeld Pak Mantenance Zone (' Woodfeld Pak") o ( LLMD 93-1") to Councl fo appoval, and equested to set a publc heang date to ntate the fnal appoval pocess. The Cty Councl appoved the Pelmnay Engnee's Repot and Intent to Levy fo the LLMD 93-1, and set the publc heang date fo May 2, A notce of the publc heang was maled to each popety owne wthn the Dstct. The publc heang was publshed n the Manteca Bulletn on Apl 14t'' and Apl 21St. The assessment of LLMD 93-1 fo Fscal Yea 2016/ 17 shows that the evenues fo Woodfeld Pak do not meet the expendtues, esultng Consequently, a Geneal Fund subsdy n a shotfall of $ 25, 963. of $ 10, 847 coupled wth the use of the Dstct' s eseves wll be equed to mantan cuent sevce levels fo Woodfeld Pak. Staff estmates the begnnng Fscal Yea 2016/ 17 Dstcts eseves to be 15, 116. Woodfeld Pak s poposed to be' leved at a ate of $ pe Equvalent Dwellng Unt ( EDU). The assessment ate of $ pe EDU has been n effect snce Fscal Yea 1998/ 99 and s not poposed to ncease. Table 1 below dsplays the cuent and poposed assessment ates. Tonght, the Cty Councl s beng askecl to appove the Fnal Engnee' s Repot fo the Landscape and Lghtnng Mantenance Dstct No Woodfeld Pak Mantenance Zone and ode the levy and collecton of annual assessments fo Fscal Yea 2016/ 17. Cty Councl may ode amendments to the Engnee's Repot o confm t as submtted. If appoved, the assessment nfomaton wll be submtted to the County Audto- Contolle, and ncluded on the popety tax oll fo each beneftng pacel fo Fscal Yea 2016/ 17. The collected mones wll fund Woodfeld Pak opeaton and mantenance costs. BACKGROUND: Mantenance Dstcts ae fomed to fund sevces and mpovements that povde specal beneft to the popetes wthn the Dstct' s boundaes. Impovements may nclude landscapng, pak stes, steet lghtnng and stom danage. The Dstcts leves ae made pusuant to the Landscapng and Lghtng Act of 1972, Pat 2 of Dvson 15 of the Calfona Steets and Hghways Code ( the " Act"), applcable to the povsons of Poposton 218 ( Calfona Consttutonal Atcles XIII C and XIII D). Each pacel wthn a Dstct s assessed n accodance to assessment methodology adopted and appoved by the Cty Councl at the tme of Dstct fomaton. The assessments ae pad by the popety owne as a pat of each pacel' s secued popety tax bll. NBS Govenment Fnance Goup pefoms an annual assessment of the Dstcts, evaluatng costs of the mantenance, opeatons, and sevcng of the mpovements to be mantaned. The assessment pocess s geneally ntated n Mach. Upon the completon of the assessment, NBS submts a Pelmnay Engnee's Repot ( the Repot") to Cty staff whch ncludes a dstct ovevew, estmate of costs, method of appotonment, dstct dagams, and pacel lstng. Cty staff utlzes the Repot fndngs to poduce the Dstct' s annual budget. The Cty of Lathop has eght ( 8) Mantenance Assessment Dstcts ( MAD): fve ( 5) Landscapng and Lghtng Dstcts ( LLMD), ncludng Woodfeld Pak; thee ( 3) Beneft Assessment Dstcts ( BAD). Woodfeld Pak was ceated to fund the cost of the opeaton and mantenance of specfc pak mpovements wthn Tact Ths ncludes costs fo pesonnel to mantan buldngs and equpment and the cost fo contacted pak mantenance.

In Fscal Yea 2016/ 17 Woodfeld Pak wll eceve $ 54, 764 n evenue fo assessments. The total expendtues fo ths Dstct ae $ 80, 727, whch ceates a shotfall of $ 25, 963. The Dstct s antcpated to begn Fscal Yea 2016/ 17 wth a eseve fund balance of $ 15, 116, whch wll be used to patally offset the shotfall. Howeve, n ode to keep the same sevce levels n the Dstct, a Geneal Fund subsdy n the amount of $ 10, 847 wll be needed to fund the emanng shotfall. Ths means, Woodfeld Pak has a maxmum assessment ate that does not escalate to mo nceases n dstct expenses. The mbalance of Woodfeld Pak' s expendtues wll contnue due to the lack of the evenue nflaton facto. In ode to emedy ths mbalance, a Poposton 218 ballotng of Woodfeld Pak' s popety ownes would have to be ntated and successfully completed. By law, assessments may only ncease to the maxmum appoved amount set by popety ownes at the tme of dstct fomaton o annexaton. Any poposed ncease whch exceeds the appoved amount eques the appoval of the then cuent popety ownes va a Poposton 218 ballot pocess. Each of the Cty' s Dstcts has a maxmum assessment amount. The Cty Councl may authoze any level of assessment up to the maxmum amount. If t s detemned that the maxmum amount s not needed, Cty Councl may lowe the actual annual assessment wthout jeopadzng the ongong maxmum assessment. The Fnal Engnee Repot fo Woodfeld Pak s avalable fo evew at the Cty Clek' s offce and the Publc Woks Depatment. Copes wll be avalable at the Cty Councl meetng pe equest.

Based upon the Engnee's Repot and the testmony and othe evdence pesented at the Publc Heang, the Cty Councl heeby makes the followng detemnatons egadng poposed to be mposed: the assessments a. The popotonate specal beneft deved by each ndvdual pacel assessed has been detemned n elatonshp to the entty of the cost of the opeatons and mantenance expenses. b. The assessments do not exceed the easonable cost of the popotonal specal beneft confeed on each pacel. c. Only the specal benefts have been assessed. The assessments fo the Dstct contaned n the Engnee' s Repot fo Fscal Yea 2016/ 17 ae heeby confmed and leved upon the espectve lots o pacels wthn the Dstct n the amounts set foth n the Engnee' s Repot. ORDERING OF MAINTENANCE Secton 4. The County Audto shall ente onto the County Assessment oll opposte each lot o pacel of land the amount assessed theeupon, as shown n the Engnee's Repot. COLLECTION AND PAYMENT Secton 7. The assessments shall be collected at the same tme and n the same manne as County taxes ae collected, and all laws povdng fo the collecton and enfocement of County taxes shall apply to the collecton and enfocement of the assessments. FISCAL YEAR Secton 8. The assessments as above authozed and leved fo these poceedngs wll povde evenue and elate to the fscal yea commencng July 1, 2016 and endng June 30, 2017.
