2 Document Management Record Retention & Archival Ethical Considerations for Lawyers Technology Issues Avoiding e-discovery Traps Document Destruction Learn the How, Why and Where Most of us know of the existence of HIPAA, Sarbanes- Oxley, and Gramm-Leach-Bliley and the Rules of Professional Conduct. What other state and federal laws and regulations also contain records retention requirements? What measures need to be instituted to be prepared should e-discovery issues arise? What actions could result in sanctions? If you were asked to advise clients or your company on records retention, would you know the numerous ways documents and communications can be disseminated, stored and eliminated? Do you or your clients know all the myriad of places that records are stored? Is there a document inventory? What are the issues raised by outsourcing? What are the Sedona Guidelines? With electronic records and communications being added to paper records, new devices appearing every day, and an increase in remote computing the task of capturing it all and organizing it can become a daunting task. What types of records must you be concerned with? Which electronic records are part of the client file and how does a law firm or legal department manage this new and potentially very large collection of data? How do you write a policy and procedures manual? How and when do you destroy client files, electronic communications and files? What are your ethical and malpractice considerations? Can documents be read by newer versions of software or do you need to retain older versions of software and hardware when updating? This conference will help you identify areas of concern in records management and retention and ways to advise on appropriate actions.
