1 Versie DOEL EN TOEPASSINGSGEBIED Deze instructie geldt voor het certificeren van - diervoeder met melkgrondstoffen, - petfood met dierlijke grondstoffen en - petfood met plantaardige grondstoffen - vet dat bestemd is als diervoedergrondstof (Tijdelijk niet mogelijk!) ten behoeve van de export naar China en beschrijft de voorwaarden die worden gesteld aan de invoer in China, de controles die ten behoeve van de certificering moeten worden uitgevoerd door de NVWA, en de gegevens die het bedrijfsleven ter controle aan de NVWA moet aandragen. Over de certificeringseisen ten behoeve van de export van petfood naar China zijn officiële bilaterale afspraken gemaakt. Deze afspraken zijn BINDEND. Van deze instructie kan derhalve niet worden afgeweken. 2 WETTELIJKE BASIS 2.1 EU-regelgeving Verordening (EG) nr. 183/2005 Verordening (EG) nr. 1069/2009 Verordening (EG) nr. 142/ Nationale wetgeving Gezondheids- en welzijnswet voor dieren, artikel Overige Bilaterale afspraken tussen China en Nederland. 3 DEFINITIES n.v.t. 4 WERKWIJZE 4.1 Diervoeder met melkgrondstoffen De export van diervoeder met melkgrondstoffen naar China is toegestaan. Certificaat zie bijlage 1 Het certificaat is beschikbaar via het systeem Client. Toelichting bij het certificaat Verklaring 1 Deze verklaring kan na controle worden afgegeven als het bedrijf beschikt over een erkenning/registratie voor export naar China van de relevante productsoorten, te vinden in het bedrijvenregistratiesysteem van de NVWA, registratie China kunstmelk, ofwel in de lijst erkende bedrijven (bijlage 3). Het laatste deel van deze verklaring kan worden afgegeven wanneer een recente free sale verklaring (niet ouder dan 1 jaar), waarbij de receptuur en ingrediënten van het betreffende product beoordeeld zijn door de NVWA, wordt getoond. Verklaring 2 Deze verklaring kan worden afgegeven op basis van een grondstoffenlijst, aan te leveren door belanghebbende. Verklaring 3 Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. De melk moet afkomstig zijn van geregistreerde bedrijven of legaal geïmporteerd zijn. 2 Versie Het eerste deel van deze verklaring kan worden afgegeven na controle van de dierziektesituatie. Informatie over de dierziektesituatie is te vinden op NVWA-intranet, afdeling NVWA Incident en Crisiscentrum (NVIC), of is direct opvraagbaar bij deze afdeling. Het tweede deel van deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. Verklaring 5 Deze verklaring kan worden afgegeven op basis van een controle van het productieproces. Verklaring 6 Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. Verklaring 7 Deze verklaring kan worden afgegeven op basis van een beleidsbeslissing van de Chief Veterinary Officer van het ministerie van Economische Zaken, dat voor het doel van dit certificaat voldaan wordt aan de Chinese wet- en regelgeving en de daarin genoemde limietwaarden, indien voldaan wordt aan de Europese- en Nederlandse wet- en regelgeving en de daarin genoemde limietwaarden. Verklaring 8 Deze verklaring kan worden afgegeven op basis van een beleidsbeslissing van de Chief Veterinary Officer van het ministerie van Economische Zaken, dat voor het doel van dit certificaat voldaan wordt aan de Chinese wet- en regelgeving, indien minimaal voldaan wordt aan de geldende Europese- en Nederlandse wet- en regelgeving inzake labelling. Verklaring 9 Deze verklaring kan na controle worden afgegeven. Het gaat hier om dierlijke consumptie. 4.2 Petfood van dierlijke grondstoffen De export van petfood met dierlijke grondstoffen naar China is toegestaan. Certificaat zie bijlage 2 Het certificaat is beschikbaar via het systeem Client. Toelichting bij het certificaat Verklaring 1 Deze verklaring kan worden afgegeven als het bedrijf beschikt over een erkenning/registratie op basis van EU- en nationale regelgeving. Het bedrijf moet bovendien erkend zijn door de Nederlandse autoriteit, wat betekent dat alleen Nederlandse bedrijven kunnen exporteren. China wil alleen petfood ontvangen afkomstig van door China erkende bedrijven. De door China erkende bedrijven staan vermeld in het bedrijvenregistratiesysteem van de NVWA. Aan de hand van dit systeem kan controle plaatsvinden of aan deze verklaring wordt voldaan. Verklaring 2 Deze verklaring kan worden afgegeven als het bedrijf beschikt over een erkenning/registratie op basis van EU- en nationale regelgeving en wanneer een recente free sale verklaring (niet ouder dan 1 jaar), waarbij de receptuur en ingrediënten beoordeeld zijn, wordt getoond. Verklaring 3 Deze verklaring kan worden afgegeven na controle van de ingrediëntenlijst. Er mogen geen herkauwersingrediënten inclusief melkproducten in het petfood aanwezig zijn. Verklaring 4 Deze verklaring kan worden afgegeven, wanneer een free sale verklaring kan worden overlegd waaruit blijkt dat geen prohibited substances zijn gebruikt. Verklaring 5 Verklaringen a t/m c kunnen op basis van EU- en nationale regelgeving worden afgegeven. Bij verklaring 5d moet gecontroleerd worden of de grondstoffen afkomstig zijn van erkende/geregistreerde bedrijven en de leverancier dient een grondstoffenlijst aan te leveren. 3 Versie Verklaring 6 De belanghebbende moet aantonen dat het petfood een hittebehandeling heeft ondergaan waarbij een kerntemperatuur van 90 graden C is bereikt of dat de grondstoffen afkomstig zijn van erkende/geregistreerde bedrijven. Verklaring 7 Deze verklaring kan worden afgegeven na controle van de analyseresultaten, aangeleverd door belanghebbende. Verklaring 8 Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. Verklaring 9 Deze verklaring kan worden afgegeven na controle van de verpakking. Verklaring 10 Deze verklaring kan na controle van het label worden afgegeven. Aangezien Chinees geen in Nederland gangbare taal is, dienen dezelfde gegevens tevens in het Engels vermeld te zijn. Betrokkene overlegt een document, ondertekend door een erkend vertaalbureau, waarop de Engelse en de Chinese tekst naast elkaar staan. Verklaring 11 Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. 4.3 Petfood van plantaardige grondstoffen De export van petfood van plantaardige grondstoffen naar China is toegestaan. Certificaat zie bijlage 3 Het certificaat is beschikbaar via het systeem Client. Toelichting bij het certificaat Verklaring 1 Deze verklaring kan worden afgegeven als het bedrijf beschikt over een erkenning/registratie op basis van EU- en nationale regelgeving. Het bedrijf moet erkend zijn door de Nederlandse autoriteit, wat betekent dat alleen Nederlandse bedrijven kunnen exporteren. China wil alleen petfood ontvangen dat afkomstig is van door China erkende bedrijven. De door China erkende bedrijven staan vermeld in het bedrijvenregistratiesysteem van de NVWA. Verklaring 3 Deze verklaring kan worden afgegeven wanneer een free sale verklaring kan worden overlegd waaruit blijkt dat geen prohibited substances zijn gebruikt. Verklaring 4 Deze verklaring kan worden afgegeven na controle van de grondstoffenlijst. Er mogen geen grondstoffen van dierlijke oorsprong aan het petfood zijn toegevoegd. Verklaring 5 Deze verklaring kan na controle van het productieproces worden afgegeven. Verklaring 6 Deze verklaring kan worden afgegeven na controle van de analyseresultaten, aangeleverd door belanghebbende. 4 Versie Verklaring 8 Deze verklaring kan worden afgegeven na controle van de verpakking. Verklaring 9 Deze verklaring kan na controle worden afgegeven. Aangezien Chinees geen in Nederland gangbare taal is, dienen dezelfde gegevens tevens in het Engels vermeld te zijn. Betrokkene overlegt een document, ondertekend door een erkend vertaalbureau, waarop de Engelse en de Chinese tekst naast elkaar staan. Verklaring 10 Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. 4.4 Vet dat bestemd is als voedergrondstof EXPORT VAN VET DAT BESTEMD ALS VOEDERGRONDSTOF IS TIJDELIJK NIET TOEGESTAAN. Certificaat zie bijlage 6 Toelichting bij het certificaat Verklaring 1 Deze verklaring kan worden afgegeven als het bedrijf beschikt over een erkenning/registratie op basis van EU- en nationale regelgeving. Het bedrijf moet erkend zijn door de Nederlandse autoriteit, wat betekent dat alleen Nederlandse bedrijven kunnen exporteren. China wil alleen vet dat bestemd is als voedergrondstof ontvangen dat afkomstig is van door China erkende bedrijven. De door China erkende bedrijven staan vermeld in bijlage 7 van deze instructie. Verklaring 2 Deze verklaring kan worden afgegeven na controle van de grondstoffenlijst. De voedergrondstoffen mogen geen ingrediënten bevatten die uit derde landen afkomstig zijn. Verklaring 3 Deze verklaring kan na controle van het productieproces worden afgegeven. Verklaring 4 Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. Verklaring 5 Deze verklaring kan worden afgegeven op basis van een beleidsbeslissing van de Chief Veterinary Officer van het ministerie van Economische Zaken, dat voor het doel van dit certificaat voldaan wordt aan de Chinese wet- en regelgeving en de daarin genoemde limietwaarden, indien voldaan wordt aan de Europese en Nederlandse wet- en regelgeving en de daarin genoemde limietwaarden. Verklaring 6 Deze verklaring kan na controle worden afgegeven. Verklaring 7 Deze verklaring kan worden afgegeven op basis van negatieve testuitslagen die door de belanghebbende moeten worden overgelegd ten behoeve van de exportcertificering. Verklaring 8 Deze verklaring kan worden afgegeven na controle van de analyseresultaten, aangeleverd door belanghebbende ten behoeve van de exportcertificering. Verklaring 9 Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving. Verklaring 10 Deze verklaring kan na controle worden afgegeven. 5 Versie BEVOEGDHEDEN EN VERANTWOORDELIJKHEDEN De NVWA-dierenarts is bevoegd en verantwoordelijk voor het afgeven van het certificaat. 6 TOELICHTING In juni 2015 is de instructie aangepast.
