Some of them will be unlucky enough to have their holiday dream turn into a nightmare. Accidents abroad often present legal and practical difficulties, particularly when the parties reside in different jurisdictions. Disputes and claims are inevitable. Rights of action, levels of compensation, evidential burdens, access to court and arbitral systems differ widely throughout the world. There is a huge lack of consistency in the overall approach to practice and procedure in the world and even within the EU. Through a case study, this session will try to illustrate how various regimes work to allow choices of forum for the plaintiffs, for the defendants and tactical consideration which will influence that choice. In a moderated session, a series of case studies will identify how those systems differ and the options available when advising those looking to bring a claim for personal injury following an accident abroad.
