1 General Terms and Conditions By submitting an application for a stall at the Fortitude Valley Markets or renewing a current stall, the stall holder acknowledges that they have read, understood and agree to comply with the Terms and Conditions and the Privacy Statement, which are available below and online at Privacy Statement The personal information collected by Iconic Productions will be used for the purposes of fulfilling your stall requests. Your personal information will not be disclosed to any third party without your consent, unless this is required or permitted by law. Terms and Conditions MARKET INFORMATION The Fortitude Valley Markets in the heart of Fortitude Valley Malls is a Saturday & Sunday Food, Produce, Vintage and Art markets within the Fortitude Valley Malls Precinct. The market has a fully diversified offering with a variety of mobile food stalls, licensed and themed eating areas, vintage markets, art installations, live entertainment and creative pop up concepts. The markets provide a platform for local art, entertainment and community groups to host and bring to life specific creative and themed concepts within the Valley Precinct. These will take the stage on a weekly/monthly basis and will help keep interest and drive promotion. Each week there will be a variety of concepts such as a live pop up band stage, live street art demonstrations, themed bar area, fashion, interactive food workshops, Brunswick Street suitcase sidewalk and pop up barber shops. OPERATION TIMES The Valley markets will trade: Every Saturday - 9am 4pm Sunday - 9am - 4pm The market will operate rain, hail and shine. Iconic Productions reserves the right to not conduct a market on any day/s, or close part of the Valley Markets for other events or activities in the Malls. Traders can access their site 2hrs prior to trading hours and must be ready to trade by the designated times listed above.traders can commence to dismantle their stalls 15mins after the closing times listed above. Staggered vehicle access will be allowed at the discretion of the Iconic Production staff. LOCATIONS Brunswick Street Mall, Fortitude Valley QLD Chinatown Mall, Fortitude Valley QLD CODE OF CONDUCT Stallholders must ensure the following standards are maintained or removal from markets may occur:
2 Do not interfere with public pedestrian access or access to and from stallholder sites and adjoining properties. Be considerate towards neighbouring stallholders and businesses adjoining the markets. Stallholders arguments will not be tolerated. Stallholders are to adhere to requests/directions from market supervisors and traffic controllers at all times. Do not behave in an abusive and aggressive manner towards public, market staff or stallholders. Conduct yourself in a professional manner at all times. OBTAINING A SITE Management has the right to refuse traders. Payment of the stall fees entitles a person to the use of the site for a day. The stall fee is subject to these terms and conditions, which may be varied from time to time. The site location is always subject to the discretion of the Market Manager, Market Coordinator or Iconic Productions and is subject to weekly availability. BOOKING ENQUIRIES& PAYMENTS If you are interested in applying for either a permanent or casual stall please complete our online application form which is available at call us on (9am 5pm, Monday to Friday). Iconic Productions offers both casual and permanent stalls. In order to receive your requirements accurately and to respond faster we would prefer online enquiries. Please be aware that we do not offer refunds for stall cancellations (after payment has been made) PERMANENT STALLHOLDERS Stalls are booked on a permanent basis one month at a time. Permanent fees are paid in advance by the 20th day of the current month for stall bookings for the following month. Stallholders will not be permitted to attend if payment is not received by the 20th. Payments must be made online via direct deposit. Please contact mail@fortitudevalleymarkets.com.auor bank details. Cash payments may be made at the discretion of the market operator. Once payment is received we will provide you with all the relevant information you need for trading. Upon arrival at the markets you will be met at the entrance to the markets and shown to your allocated site by one of our friendly staff. CASUAL STALLHOLDERS
3 A limited number of casual stall spaces are available each week at Fortitude Valley Markets. Casual stalls must be booked and payment must be received by 3pm on the Wednesday prior to the Saturday that you are attending the market. Payments can be made online via direct deposit. Please contact Cash payments may be made at the discretion of the market operator. After attendance is confirmed we will provide you with all the relevant information you need for trading. Upon arrival at the markets you will be met at the entrance to the markets and shown to your allocated site by one of our friendly staff. 4 Casuals - $85 + GST (Food & beverage stalls ) INC GST SUITCASE SIDEWALK $20 per site (allowance of 1 rack & 1 suitcase) CHARITY & COMMUNITY GROUPS Fortitude Valley Markets supports the local community and registered charities. If you qualify as a local community group or a registered charity, we offer discounted stall fees which are subject to availability. Information STALLS AND EQUIPMENT Stallholders are to provide all of their own equipment required for the trading day. Eg, Marquees, tables, chairs, gazebos, tents, etc. All stallholders must ensure that all trading day activity including advertising frames is undertaken within the boundaries of the allocated site. Stalls are to be neat, tidy, in good condition and well presented. Traders must be well presented clothing and footwear must be appropriate. Clear access must be maintained to public telephones, bins and street furniture. Any electrical devices connected to a power supply must have up to date testing and tagging. All tables within stallholder s site are to be in good condition and covered by a suitable tablecloth. No boxes are to be visible at the stallholder s site. Stallholders are not to use council bins for placement of stallholder s rubbish. The Market Operators will supply bins. Stallholder products should be of a high standard and quality and well presented at all the stall. Stallholders must not place any item against neighbouring building properties or so that they are blocking access pathways through the mall. PRODUCTS The Fortitude Valley Markets will focus on providing unique stallholders offering the following products: Handmade goods including, but not limited to, arts, craft, fashion, home wares, jewellery, soft furnishings. Vintage clothing and wares Fashion and lifestyle products Plants and flowers The Market Co-Ordinator and supervisor are responsible for determining the type of stock allowed to be sold at the markets. No stallholder may sell a product - That is an exact product (brand) as offered by retailers in the Mall Deemed unsuitable or inappropriate by the Market Coordinator or supervisor. Deemed, by the appropriate government authorities, to be in breach of any laws. Eg, counterfeit or copyright laws. PUBLIC LIABILITY
5 Public Liability Insurance is mandatory; It is preferred that all stallholders have their own public liability insurance. Iconic Productions can supply public liability Insurance for an additional $10 per day of trade. TEMPORARY FOOD STALL LICENSE If you are operating a Food Stall and are unsure about Brisbane City Council requirements for a Temporary Food Stall License please contact the Brisbane City Council on or visit the Council s website at further information. All Food Stalls must have a current Temporary Food Stall Licence to operate at the Fortitude Valley Markets. INFORMATION DESK The Information Desk is located at the entrance of the mall near Ann St. A first aid kit and the Lost & Found register are also located at the desk. TRAFFIC MANAGEMENT PRACTICES Entry times are specific for each stallholder and will be ed to stallholders and will be agreed upon before the market trading day. Once a site has been allocated, stallholders may access the Malls in vehicles at a walking pace of no faster than 5km/h in order to unload their products. Any infringement of this safety practice will incur an immediate ban on the stallholder s vehicular access. Stallholders must follow the Traffic Controllers directions at all times. The maximum unloading time is 20 minutes. Exit Time for Saturday & Sunday Day Markets will be between 4pm 5pm There will be no packing down during official market hours. All gazebos and equipment must be packed down before stallholder vehicles enter the market site. Please do not move your vehicle until customers have vacated. There are two major carparks in the Chinatown Mall as well as additional parking within the Fortitude Valley Precinct. Iconic Productions and Events are looking to secure a parking discount to all stallholders who attend the markets. Please contact us for further information.please be aware that Iconic Productions and Events are not liable for any parking fines stallholders may receive. FACILITIES Public toilets are located in Brunswick Street Mall and drinking water fountains can be found in both malls. SPECIAL REQUIREMENTS FOR FOOD AND BEVERAGE STALLS All Food Stalls need to have a canvas on the floor of their stall that covers the entire stall site, to prevent staining. This is a condition of attendance and trading. All coffee stalls need to remove any rubbish and left-over coffee grounds, before leaving the site. WASTE MANAGEMENT The removal of stallholder rubbish is each stallholder s responsibility. Brisbane City Council waste bins are not to be used by stallholders to place stallholder rubbish. Please DO NOT leave you re trading rubbish behind or a charge of $35 will be incurred by the stallholder responsible. GENERAL INFORMATION/FAQ FOR ENTERTAINERS
6 The Fortitude Valley Markets has and welcomes entertainers and buskers to perform at the market each Friday, Saturday and Sunday. All performers will be sent an prior to the market trading day confirming performance arrangements. All performers will be required to provide their own AMR and equipment. The stage for performances is located in the central area of the mall, please check-in at the information desk.
