2 .SKY Dmain Name Registratin Plicy This.SKY Dmain Name Registratin Plicy (.SKY Dmain Plicy) sets ut the terms and cnditins gverning the registratin and use f dmain names in the.sky Tp Level Dmain. The.SKY Dmain Plicy may be updated peridically, withut prir ntice. Updates may be required by ICANN, a TLD registry, and applicable laws, as well as t adjust t changing circumstances. The current versin can be fund at nic.sky/plicy, and cntinued registratin r use f a.sky dmain name after any update cnstitutes acceptance f the current versin. The nly remedy in case f any disagreement with the current terms f the.sky Dmain Plicy is t cancel yur dmain name registratin. The terms f the.sky Dmain Plicy described belw cnstitute the entire agreement cncerning the registratin f a.sky dmain name; n ther agreements r representatins supplement r alter the terms f the.sky Dmain Plicy, except as expressly incrprated herein. Any undefined capitalised term in the.sky Dmain Plicy shall have the meaning set ut in the ICANN Registry Agreement applicable t the.sky Tp Level Dmain, available at General/Definitins Abuse Pint f Cntact means the.sky Tp Level Dmain s abuse respnse team, which can be cntacted at [email protected]. ICANN means the Internet Crpratin fr Assigned Names and Numbers. Identical Match means that the dmain name cnsists f the cmplete and identical textual elements f a Trademark Clearinghuse-validated trade mark. In this regard, marks which wuld be identical t Trademark Clearinghuse-validated trade marks but fr the fllwing amendments qualify as Identical Matches: (a) spaces cntained within a mark that are either replaced by hyphens r mitted; (b) nly certain special characters cntained within a trade mark are spelled ut with apprpriate wrds describing it and & ); (c) punctuatin r special characters cntained within a mark that are unable t be used in a secnd-level dmain name may either be (i) mitted r (ii) replaced by a hyphen and still be cnsidered Identical matches; and (d) n plural r marks cntained (i.e., brandx in brandxprducts ). Registrar means an ICANN-accredited registrar thrugh which.sky dmain names are registered. Registry Services Prvider means the entity prviding back-end technical and peratinal services fr the.sky registry. Reserved Names mean dmain names which are unavailable fr third-party registratin at the time f their appearance n a list f Reserved Names. SIAG (r we r us ) means Sky Internatinal AG, a cmpany incrprated in Switzerland with address at Sky Internatinal AG, Stckerhf, Dreikönigstrasse 31a, CH-8002 Zürich, Switzerland (Cmpany Number CHE )..SKY means the.sky Tp Level Dmain..SKY Dmain Plicy this.sky Dmain Name Registratin Plicy which sets ut the terms and cnditins gverning the registratin and use f dmain names in the.sky Tp Level Dmain. 3 Tp Level Dmain means the final characters after the dt in a dmain name; in the case f nic.sky, this is sky. Trademark Claims means the prcess whereby ntice is given t a prspective dmain name registrant cncerning the scpe f the rights f a trade mark wner whse mark is an Identical Match t the requested dmain name, and whereby the prspective registrant warrants that: (i) they have received ntificatin that the mark(s) is included in the Trademark Clearinghuse; (ii) they have received and understd the ntice; and (iii) t the best f their knwledge, the registratin and use f the requested dmain name will nt infringe the rights that are the subject f the ntice. If the dmain name is registered subsequent t the ntice being issued and the registrant attesting t its nn-infringement, the Registrar r the Trademark Clearinghuse will ntify the mark hlder(s) f the registratin. Trademark Claims Perid means the first ninety (90) calendar days during which dmain names are made available t eligible registrants. Trademark Clearinghuse means the central strage repsitry f validated (authenticated) trade mark rights-related data and infrmatin fr disseminatin with respect t trade mark rights prtectin mechanisms and ther registry-related services mandated by ICANN and currently run by Delitte. Website means the.sky website lcated at Yu r yur means an individual r entity seeking t initiate registratin f a.sky dmain name, r if allwed, the dmain name registrant. Terms used in the singular r plural are merely fr cnvenience, and shall apply mutatis mutandis, as the cntext may require. All cmmunicatins and infrmatin under this.sky Dmain Plicy shall be in English. Registratin Eligibility Eligibility t register and use.sky dmain names, at any level, is limited t SIAG, its Affiliates, and Trademark Licensees. SIAG reserves the right, fr any reasn, t peridically verify.sky dmain name registratin eligibility. Any determinatin as t such eligibility shall be made by SIAG in its sle discretin, and is nt subject t any further appeal mechanism r recnsideratin prcess. SIAG reserves the right, in its sle discretin, t suspend, cancel, revke, r take ther actin it deems necessary with respect t a.sky dmain name registrant in the event it determines that their registratin vilates the registratin eligibility criteria. Questins abut a determinatin by SIAG as t.sky dmain name registratin eligibility shuld be directed t the [email protected]. Registratin Terms & Cnditins By submitting a request t register a.sky dmain name, r by asking us t maintain r renew a.sky dmain name registratin, yu agree t the fllwing terms and cnditins: yu have read and understd, and agree t be bund by the.sky Dmain Plicy yu warrant and represent that yu meet the.sky dmain name registratin eligibility criteria set ut belw Page 3 f 11

4 yu warrant and represent that yu are legally capable, and authrised t enter int an agreement fr a.sky dmain name registratin yu acknwledge and agree that all.sky dmain name registratins are, and shall irrevcably remain, the sle prperty f SIAG and that any attempted sublicensing, transfer, delegatin, r assignment t any third party withut SIAG s prir cnsent will be cnsidered vid ab initi registratin f a.sky dmain name merely prvides yu with a temprary, revcable, and nn-transferrable, nn-sublicensable license t register r use that dmain name, and yu agree that all.sky dmain name registratins are made fr the benefit f SIAG in furtherance f its gals and perating principles yu agree that SIAG s Whis data requirements require yu t prvide yur cmplete, accurate, and current cntact details in rder t undertake a.sky dmain name registratin; yu als agree that, pursuant t its cntractual bligatins t ICANN r fr any reasn determined apprpriate in its sle discretin, SIAG may publish these cntact details and/r prvide them t third parties in cnnectin with its administratin f the.sky registry yu agree t immediately (but at least within 48 hurs f any change) update yur cntact details and t certify their accuracy annually yu agree that any change r update t yur cntact details may be subject t prir apprval by SIAG SIAG reserves the right t peridically verify yur cntact details, and t cancel, suspend, r revke yur dmain name registratin fr any nn-cmpliance with the.sky Dmain Plicy including yur bligatin t prvide accurate and current cntact details yu understand that SIAG disclaims all liability fr any cmmunicatin failure due t yur prvisin f inaccurate cntact details yu agree t indemnify and hld SIAG harmless fr any cmmunicatin failure due t yur prvisin f inaccurate cntact details yu understand and agree that, except where agreed therwise (n a case by case basis), the publicly-available Whis infrmatin fr.sky dmain name registratins will reflect SIAG r ne f its Affiliates as the dmain name registrant yu will nt distribute malware r perate btnets, r engage in phishing, piracy, trade mark r cpyright infringement, fraudulent r deceptive practices, cunterfeiting r any ther activity cntrary t applicable law yu agree that fr certain aspects f the administratin f the.sky Tp Level Dmain, fr example a rapid takedwn prcess, SIAG may delegate certain functins t an agent such as its Registry Services Prvider yu agree t the applicability f ICANN-mandated Rights Prtectin Mechanisms, including the Unifrm Dmain Name Dispute Reslutin Plicy (UDRP); the UDRP and rules are lcated at: the Unifrm Rapid Suspensin system (URS); the URS and rules are lcated at: Page 4 f 11

5 As between the parties yu acknwledge and accept that all cpyrights, trade marks and ther intellectual prperty rights in the SKY element f any dmain name, and any SKY brand used n the Website (Items) belng t SIAG r its Affiliates. Yu are permitted t use the Items nly as expressly authrised by SIAG in writing. Yu will nt, and yu will nt assist any third party t use, cpy r distribute such Items. By applying t register a particular dmain name within.sky yu grant SIAG and its Affiliates and service prviders an irrevcable, perpetual, ryalty free, wrldwide license t use, cpy and reprduce any f yur intellectual prperty rights in that name bth within the Website and in any ther manner reasnably required in cnnectin with this.sky Dmain Plicy. Yu agree t indemnify SIAG and its Affiliates and their directrs and emplyees, and keep them indemnified, and hld them harmless against all lsses, claims, liabilities, damages, prceedings, csts and expenses (including legal fees), arising ut f any breach by yu f the.sky Dmain Plicy r yur use f the Items. SIAG expressly disclaims all warranties f any kind in relatin t the Items including but nt limited t the implied warranties f merchantability, fitness fr a particular purpse and nninfringement. Yu agree that yur use f the Items is at yur sle risk and t the maximum extent permitted by law SIAG shall nly be liable t yu in cnnectin with the Items up t the amunt paid (if anything) fr the initial registratin f the.sky dmain names. SIAG and its affiliates shall nt be liable fr any indirect, cnsequential r special lss r damage (hwsever arising) in cnnectin with the Items. Yu agree that SIAG reserves the right, in its sle discretin, t suspend, lck, cancel, revke, r therwise alter any.sky dmain name registratin: (i) t prtect the interests f SIAG; (ii) t cmply with any laws, curt r law enfrcement requests, r any dispute reslutin prcess including ICANN rights prtectin mechanisms; (iii) t avid any civil r criminal liability against SIAG r its Affiliates, subsidiaries, fficers, directrs, emplyees, agents, cnsultants, r cntractrs; (iv) pursuant t the.sky Dmain Plicy; r, (v) t remedy any errr in cnnectin with a.sky dmain name registratin; r (vi) as therwise deemed necessary by SIAG in its sle discretin. If any prvisin f this.sky Dmain Plicy is held t be unenfrceable, fr any reasn, then the unenfrceable prvisin shall be severed, and the remainder f the prvisins shall cntinue in full frce and effect. Dmain Name Registratin Rules In rder t submit a.sky dmain registratin r renewal request yu must cmplete and submit a written request using the Sky technlgy request system. Once the abve request has been submitted dmain name registratins in the.sky Tp Level Dmain fllw a fur-step prcess managed by SIAG r the Registrar r its agent: (i) Eligibility Cnfirmatin; (ii) Naming Cnventin Check; (iii) Acceptable Use Review; and (iv) Registratin..SKY dmain name registratins are available t eligible registrants fr annual terms f between ne (1) and ten (10) years. 6 In the event Internatinalized Dmain Name (IDN) registratins are made available in the.sky Tp Level Dmain, they will be subject t any.sky IDN registratin pairing rules (as and when they are develped). (i) Eligibility Cnfirmatin Only SIAG, its Affiliates, r Trademark Licensees wh agree t be bund by the terms f the.sky Dmain Plicy are eligible t register r use a.sky dmain name..sky dmain names may nt under any circumstances be registered r used by third parties ther than SIAG, its Affiliates, r Trademark Licensees. Prir t any.sky dmain name registratin r renewal, and at any time during the registratin life cycle, dmain name registratins will be verified by SIAG fr cmpliance with the.sky Dmain Plicy including as t eligibility. (ii) Naming Cnventin Check.SKY dmain names must meet the fllwing cnditins: a. must be available fr registratin b. must meet any technical prtcls required by SIAG c. must be at least 1 character and n mre than 63 characters lng d. must cntain nly letters (a-z), numbers (0-9) and hyphens r a cmbinatin f these e. must start and end with an alphanumeric character, nt a hyphen f. must nt be a Reserved Name g. dmain names at the secnd level, must nt cntain a hyphen at the 3rd and 4th psitins (tagged dmains), unless crrespnding t a valid Internatinalized Dmain Name in ASCII encding (fr example xn--ndk061n ). (iii) Acceptable Use Review By asking us t register r renew a.sky dmain name registratin, yu warrant and represent that yur.sky dmain name registratin des and will at all times cmply with the.sky Dmain Plicy. Registratin r renewal f a.sky dmain name is subject t SIAG s satisfactin that the Acceptable Use standards set ut belw are met prir t, and at all times during a.sky dmain name registratin. (iv) Registratin Prvided that the.sky eligibility cnfirmatin, naming cnventin check, and acceptable use review are satisfied, SIAG will prvide a secure instructin per its internal dmain management prcess t the Registrar t prceed with the registratin r renewal f yur.sky dmain name. At the cnclusin f the registratin perid fr yur.sky dmain name, unless yu have instructed the Registrar (with a cpy t us) therwise prir t the expiratin f yur.sky dmain name registratin, the Registrar will renew yur.sky dmain name registratin n the basis f an agreed standing renewal rder. Acceptable Use SIAG reserves the right t peridically review.sky dmain name registratins and uses fr cmpliance with the.sky Dmain Plicy. Withut limitatin, by registering a.sky dmain name, r by asking us t maintain r renew a.sky dmain name registratin: Page 6 f 11

7 yu represent and warrant that yu will nt distribute malware r perate btnets, r engage in phishing, piracy, trade mark r cpyright infringement, fraudulent r deceptive practices, cunterfeiting r any ther activity cntrary t applicable law yu acknwledge and agree that it is yur respnsibility t determine whether yur dmain name registratin des r may infringe r vilate the rights f a third party r applicable law yu warrant and represent that yur registratin r use f a.sky dmain name des nt and will nt: give rise t any mrally bjectinable r therwise scially questinable cnduct vilate any applicable laws r regulatins in any way harm the reputatin r gals and perating principles f SIAG Yu further agree that SIAG may, in its sle discretin, lck, suspend, cancel, revke, r therwise take (r require yu t take) remedial actin t cure any breach f the.sky Dmain Plicy if yur registratin r use f a.sky dmain name vilates the.sky Dmain Plicy r applicable law, r therwise vilates standards f cnduct deemed acceptable t SIAG. By registering a.sky dmain name, r by asking us t maintain r renew a.sky dmain name registratin, yu agree t use any technical prtcls required by SIAG in its sle discretin. Any failure t cmply with these acceptable use standards may be cnsidered a breach f the.sky Dmain Plicy and may, in SIAG s sle discretin, be grunds fr the suspensin, cancellatin, r revcatin f yur.sky dmain name registratin. Reserved Names The fllwing terms are reserved frm registratin by third parties: a. reserved terms prhibited by ICANN frm availability fr registratin including as prvided in the ICANN Registry Agreement applicable t the.sky Tp Level Dmain, and in particular: 1. the terms example, www, rdds, and whis at all levels, which at SIAG s discretin shall be withheld frm registratin r allcated t SIAG r ne f its Affiliates 2. the term nic, at all levels, as this term shall be allcated t SIAG r ne f its Affiliates fr use in cnnectin with the peratin f the.sky Tp Level Dmain b. any term reserved by SIAG frm time t time in its sle discretin Rapid Takedwn Prcess In furtherance f SIAG s effrts aimed at abuse preventin and mitigatin, r where it appears that a.sky dmain name is being used t threaten the stability r security f the.sky Tp Level Dmain r is a part f a real-time investigatin by law enfrcement, SIAG may, either n its wn initiative r at the request f a third party, initiate a rapid takedwn prcess. In the event a rapid takedwn prcess is initiated, after assessment by SIAG, the Registrar may be cntacted fr its cperatin in taking the subject dmain name dwn (by lcking r suspending the dmain name, r placing it n hld r deleting it), unless a cmpelling argument is prvided by the Registrar t SIAG n which basis the subject dmain name may remain in the zne. 8 event, if the Registrar has nt reacted within 12 hurs f SIAG s request, SIAG may place the subject dmain name n ServerHld r any ther status it deems necessary r apprpriate. If SIAG determines that the subject dmain name is being used t threaten the stability r security f the.sky Tp Level Dmain r is a part f a real-time investigatin by law enfrcement, SIAG reserves the right t immediately remve the subject dmain name frm the zne, in which case SIAG will infrm the Registrar f such actin being taken. Abuse Preventin and Mitigatin SIAG will nt tlerate abusive r malicius cnduct (including, but nt limited t: illegal r fraudulent actins, spam, phishing, pharming, distributin f malware, malicius fast flux hsting, btnets, distributin f illegal child sexual images, nline sale r distributin f illegal items) in the.sky Tp Level Dmain. In additin t any mnitring SIAG may undertake t prevent abusive r malicius cnduct, SIAG has established an Abuse Pint f Cntact fr handling cmplaints r cncerns related t any such cnduct, which shall als include investigatin f and a respnse t any reprts frm law enfrcement and gvernmental and quasi-gvernmental agencies f illegal cnduct in cnnectin with the use f the.sky Tp Level Dmain. In the event f any suspected abusive r malicius cnduct r vilatin f the.sky Dmain Plicy r any applicable laws, SIAG may suspend r lck yur dmain name registratin pending reslutin f any such suspected vilatin. SIAG may als initiate a rapid takedwn prcess t handle such cmplaints r suspected vilatins. While respecting privacy and cnfidentiality, SIAG may peridically cnduct technical analyses t assess whether dmain names in the.sky Tp Level Dmain are being used t perpetrate security threats, such as pharming, phishing, malware, r btnets. If SIAG identifies security risks that pse an actual risk f harm, it will ntify the Registrar and, if the registrar des nt take immediate actin, SIAG may suspend the dmain name until the matter is reslved. SIAG r its delegate may remve rphan glue recrds (see when prvided with written evidence that such recrds are present in cnnectin with malicius cnduct. Abuse Pint f Cntact Inquiries, whether frm law enfrcement r the general public, related t alleged abusive r malicius cnduct in the.sky Tp Level Dmain shuld be directed t the.sky Abuse Pint f Cntact. Cmplaints may als cncern Whis infrmatin accuracy, r cncerns that a dmain name registratin is being used t facilitate r prmte malware, peratin f btnets, phishing, piracy, trade mark r cpyright infringement, fraudulent r deceptive practices, cunterfeiting r therwise t engage in activity cntrary t applicable law. Data Prtectin & Privacy By applying t register a.sky dmain name, r by asking us t maintain r renew a dmain name registratin, yu agree that SIAG and its Affiliates may cllect and use f yur infrmatin in the way we describe in this sectin. We may use any infrmatin yu prvide as part f yur applicatin, and any ther infrmatin we hld abut yu including yur IP address, t register r renew the dmain name requested and perfrm assciated administrative activities, which include prviding yur infrmatin t ur service prviders and ICANN. 9 T mnitr the accuracy f Whis data T mnitr and imprve ur services and the Website We may share infrmatin with credit reference and fraud preventin agencies fr use in credit decisins, and fr fraud detectin and preventin purpses. If false r inaccurate infrmatin is prvided and fraud is identified, the details will be passed t fraud preventin and law enfrcement agencies T enable us t cmply with any legal r regulatry requirements; t prtect r enfrce ur rights r the rights f any third party; in the detectin and preventin f fraud and ther crimes; and fr the purpse f safeguarding natinal security We may disclse yur infrmatin t any successrs f ur business fr them t use fr the purpses set ut in this privacy ntice SIAG s Whis data requirements require yu t prvide yur cmplete, accurate, and current cntact details in rder t undertake a.sky dmain name registratin; pursuant t its cntractual bligatins t ICANN SIAG may publish these cntact details. ICANN may cnduct Whis verificatin and checks n a statistically significant basis t identify registratins with deliberately false, inaccurate r incmplete Whis data at least twice a year which may result in the Registrar cntacting yu t slicit accurate and cmplete Whis cntact infrmatin. We may transfer yur persnal infrmatin utside the Eurpean Ecnmic Area, but will d s with apprpriate measures and cntrls in place t prtect that infrmatin, in accrdance with applicable data prtectin laws and regulatins. Disputes This.SKY Dmain Plicy and the Website are gverned by English law. Disputes between yu and SIAG shall be dealt with by the English curts. All disputes between yu and a third party cncerning that third party s rights shall be handled accrding t the terms f the UDRP r URS (see Registratin Terms & Cnditins), curt, r ther apprpriate adjudicatry system. (i) UDRP By registering a.sky dmain name, yu agree t the applicability f the Unifrm Dmain Name Dispute Reslutin Plicy (UDRP); the UDRP plicy and rules are lcated at: The remedies available fr a successful cmplaint under the UDRP are cancellatin r transfer f the dmain name t the UDRP filing cmplainant. In the event f a UDRP decisin cncerning a.sky dmain name, rdering transfer f a dmain name t a UDRP cmplainant, any such transfer can nly ccur if the prevailing UDRP cmplainant meets all requirements f the.sky Dmain Plicy including as t eligibility. In the event a prevailing UDRP cmplainant des nt meet the cnditins f the.sky Dmain Plicy including as t eligibility, ntwithstanding any UDRP transfer rder, SIAG will cancel the subject dmain name registratin. At SIAG s sle discretin, such cancelled dmain name registratin may be placed n a reserved list, r may be made available fr registratin under the terms f the.sky Dmain Plicy. Page 9 f 11

10 (ii) URS By registering a.sky dmain name, yu agree t the applicability f the Unifrm Rapid Suspensin system (URS); the URS plicy and rules are lcated at: Trademark Claims During the Trademark Claims Perid, an attempt t register a dmain name that is an Identical Match t a Trademark Clearinghuse-validated mark will trigger a Trademark Claims Ntice (see Annex). Upn a registrant s cnfirmatin that they have received and understd a Trademark Claims Ntice, and that t the best f their knwledge the registratin and use f the requested dmain name will nt infringe the trade mark rights listed in the Trademark Claims Ntice, a request fr registratin will be managed by SIAG in accrdance with the.sky Dmain Plicy. If, during the Trademark Claims Perid, pursuant t the.sky Dmain Plicy, a request t register a.sky dmain name which is an Identical Match t a Trademark Clearinghuse-validated mark is eligible and subsequently registered, SIAG r the Registrar will ntify the relevant mark hlders(s) f the registratin. Fr purpses f.sky Trademark Claims during the Trademark Claims Perid SIAG will recgnise and hnur all wrd marks that have been r are: (i) natinally r reginally registered (ii) curt-validated r (iii) specifically prtected by a statute r treaty in effect at the time the mark is submitted t the Trademark Clearinghuse fr inclusin fr purpses f Trademark Claims n demnstratin f use is required Page 10 f 11
