3 Seminar Speakers In Order of Appearance LAURIE K. WEATHERFORD graduated from University of Florida, B.S. in 1978 with honors. She graduated from Cumberland School of Law of Samford University, J.D., cum laude, in She has served as Chairman of the Orange County Bar Association Bankruptcy Committee. She formerly served as a Chapter 7 Trustee prior to her appointment as Standing Chapter 13 Trustee for the Orlando Division. STUART FERDERER graduated from the Thomas M. Cooley School of Law in Lansing, Michigan in He was a law clerk for the Legal Drafting Division of the Michigan Legislative Service Bureau. He has represented debtors and creditors in the Middle District of Florida since JAN LINGO is a paralegal working for the Chapter 13 Standing Trustee for the Middle District of Florida, Orlando Division. She graduated from Valencia Community College in She has been employed as a legal assistant since 1982, working while in college, and as a bankruptcy paralegal for more than 20 years. ROBERT THOMAS has served as a Chapter 7 panel trustee for the Middle District of Florida since He received an MBA from the University of Virginia in 1980, a JD from Loyola University New Orleans in 1978 and a BS degree from the University of Richmond in Mr. Thomas is a member of the Florida and Virginia Bar Associations. From 1980 through 1992, Mr. Thomas was an investment banker in New York and Dallas where he assisted clients in public and private equity and debt financings and merger and acquisition advisory. From 1993 through 1997 Mr. Thomas was the CEO of a privately owned printer and uniform manufacturer. Robert enjoys rowing out of the Rollins boathouse on Lake Maitland and visiting UNESCO heritage sites. ROBERT HOOFMAN practices in the areas of bankruptcy, commercial litigation, and creditor's rights, including replevin, foreclosure and also has experience in appellate practice. He is also a Florida Supreme Court Certified Circuit Civil Mediator. Mr. Hoofman is a past Chairman of the Bankruptcy Law Committee of the Orange County Bar Association and has served as a speaker and prepared seminar materials on bankruptcy and foreclosure topics, has coauthored various articles concerning creditor rights, and served as a law clerk to the judges of Florida's Fifth District Court of Appeals before entering private practice. Mr. Hoofman received his law degree from the University of Florida, with honors, in 1979, and his Bachelor of Arts degree from the University of Central Florida in He is admitted to practice in all Florida courts, the U.S. District Court for the Middle District of Florida, the U.S. District Court for the Northern District of Florida, and the U.S. District Court for the Southern District of Florida. He is a member of the Florida Bar, the Texas Bar, the Central Florida Bankruptcy Law Association, the American Bankruptcy Institute, and the Orange County Bar Association.

4 Seminar Speakers Continued CYNTHIA LEWIS is an attorney in Orlando, Florida whose practice centers around consumer bankruptcy. Ms. Lewis represents both individuals and businesses in Chapter 7 liquidations and individuals who want to protect some of their assets through Chapter 13 reorganizations. Ms. Lewis is also involved with the representation of creditors and Chapter 7 Trustees. A second career individual, Ms. Lewis, who is also a Certified Public Accountant, spent a good portion of her career directing the administration of various Orlando law firms. Most recently, she served nine years as the Orlando Office Administrator for a national law firm. Her varied experience with human resource issues, construction and equipment projects and budgetary concerns, as well as, life experience, gives her a deeper appreciation of the difficulties facing the individuals and businesses she represents. Ms. Lewis is a member of the Florida Bar, Orange County Bar Association, Central Florida Bankruptcy Law Association, American Bankruptcy Institute, American Bar Association and the Central Florida Association of Women Lawyers. She is certified to appear in the U.S. District Court for the Middle District of Florida. Ms. Lewis graduated from the Florida Agricultural & Mechanical University, College of Law located in Orlando, Florida and cum laude from Florida Southern College. R. SCOTT SHUKER practices primarily in the areas of bankruptcy and creditors rights and has represented corporate debtors, and secured and unsecured creditors, in bankruptcy cases of corporate and individual debtors. Prior to entering law school, Scott was a corporate banking officer for Southeast Bank, N.A. Mr. Shuker received his J.D. from the University of Florida College of Law in 1993 with High Honors. He received his B.S. degree in Finance from Pennsylvania State University in He is past President of the Central Florida Bankruptcy Law Association (1999) and a member of the Executive Council of the Business Law Section of the Florida Bar. JEFFREY DAVIS is a Gerald A. Sohn Research Scholar and Professor of Law, University of Florida Levin College of Law. He received his B.S. in1965 from the University of California, Los Angeles; J.D Loyola Law School, Los Angeles; LLM, 1973, University of Michigan. Professor Davis has specialized in Contract, Commercial, and Bankruptcy law for 33 years, publishing numerous articles on Consumer Credit, Bankruptcy, and Banking law. He taught at the University of South Dakota, Rutgers-Camden University, and New York University Law Schools before joining the University of Florida faculty in He is a member of the California, Florida, and American Bar Associations. He is a past chair of the Bankruptcy/UCC Committee of the Business Section of the Florida Bar, and regularly serves on the Legislation Committee of the Executive Council of the Business Section. From 1995 to 2001 he served as the Reporter for the Business Section s Special Committee on Post- Judgment Creditors Remedies. In recent years he has received the Florida Law School Professor of the Year Award, the Lifetime Achievement Award from the Business Section of the Florida Bar, and has written about Florida s new Judgment Lien Statute, the use of the In Pari Delicto defense in bankruptcy cases, and the amendments to the Florida Assignment-for-the-Benefit-of-Creditors law. DONALD F. WALTON is the United States Trustee for Region 21 (Georgia, Florida, Puerto Rico and the U.S. Virgin Islands) and concurrently is serving as the Acting Deputy Director of the Executive Office for United States Trustees. He received his undergraduate degree from the University of North Carolina at Chapel Hill at which time he received a commission in the United States Navy Reserve. He attended law school at the University of Georgia where he received his Juris Doctor degree, cum laude. Mr. Walton clerked for the Honorable James C. Hill, Judge, United States District Court for the Northern District of Georgia and the United States Circuit Court of Appeals for the Fifth Circuit. After completion of his judicial clerkship, Mr. Walton practiced law for 11 years in Atlanta until he was appointed as an Assistant United States Trustee in August, Prior to his current appointment, he served as Acting United States Trustee for Region 21 from 1992 to 1997, Acting United States Trustee for Region 3 (Pennsylvania, Delaware and New Jersey) from October 2001 to March 2003, Acting General Counsel of the United States Trustee Program from October 2003 to April 2005, and Acting Deputy Director of the Executive Office for United States Trustees from April 2005 to December In 1992, Mr. Walton was presented with the Attorney General's Award for Distinguished Service.

HERNDON has operated her own residential real estate appraisal firm, Real Property Analysts/Gulf Coast, since 1997 where she specializes in residential real estate valuation and consulting services. Joni earned the prestigious SRA professional designation from the Appraisal Institute in April, Joni is a qualified expert for the United States Bankruptcy Court, Middle District of Florida, Tampa Division. She is also a qualified expert witness in Pinellas, Pasco and Hernando County Circuit Courts. Governors Bush, Crist and Scott appointed Joni to the Florida Real Estate Appraisal Board (FREAB). She was elected to serve as Chair of the FREAB in 2008, 2009 and Currently, she is the Chair of Region X (Florida and Puerto Rico) of the Appraisal Institute and is a voting member on the Appraisal Institute s national Board of Directors. Ms. Herndon was a Guest Speaker at the 36th Annual Judge Alexander L. Paskay Seminar on Bankruptcy Law and Practice Evidence in Consumer Cases. She served as an appraisal panel member at the annual Florida Realtors Convention in 2007 and As a member of the Florida Appraisal Management Company (AMC) Regulation Task Force, she helped write the model legislation for the registration and regulation of AMC s which became law on July 1, She has provided pro bono residential real estate valuation and consulting services for Habitat for Humanity of Hillsborough County, Florida and Kids Charity of Tampa Bay, Inc. Joni has been active in community service by representing the appraisal industry as a guest columnist for the Tampa Bay Times, writing the Homeward Bound column on residential real estate valuation issues. Joni was raised in Tampa where she attended local public schools. She holds a Bachelor of Science Degree in Business Administration from the University of Florida. DENISE D. DELL-POWELL is a partner at Burr & Forman where she practices in the firm s bankruptcy, creditors rights, distressed property and inventory finance litigation. Denise has more than 18 years experience in bankruptcy and creditors rights, distressed property, dealer distribution and inventory finance litigation, including CMBS foreclosures, workouts and bankruptcy matters. In addition to a focus on banking and financial institutions, her career also includes extensive counsel to the hospitality, restaurant and citrus industries. During her career, Denise has received numerous awards including being named a Florida Super Lawyer ( ), being listed in The Best Lawyers in America for bankruptcy and creditor-debtor rights law ( ), and is AV rated by Martindale-Hubbell. In addition, she serves on the firm s Strategic Growth Committee. Denise holds current or has held past leadership positions in a variety of organizations including the Florida Bar, the Central Florida Bankruptcy Law Association and the Jacksonville Bankruptcy Bar Association. She is a member of the State Bar of Georgia, Orange County Bar Association, American Bar Association, American Bankruptcy Institute, the Central Florida Bankruptcy Law Association, and the International Women s Insolvency and Restructuring Confederation. She earned her law degree from Mercer University School of Law and received her Bachelor of Science from Florida State University. Denise has been a frequent lecturer, presenter and author on bankruptcy, restructuring and related issues. She has presented at conferences and seminars sponsored by the American Bar Association, The Florida Bar, The Bankruptcy / UCC Section of The Florida Bar, the Florida Bankers Association, the Jacksonville Bankruptcy Bar Association, the Central Florida Bankruptcy Law Association and Lorman Education Series. ELENA PARAS KETCHUM joined the law firm of Stichter, Riedel, Blain & Prosser, P. A. in 2001 and became a shareholder in She specializes in the representation of debtors and creditors in out-of-court workouts, bankruptcy cases, and state court proceedings. While maintaining an active Chapter 11 practice, she has headed up the firm s practice under Chapter 727 of the Florida Statutes dealing with General Assignments, also referred to as Assignments for the Benefit of Creditors or ABCs. Ms. Ketchum has also represented clients in documenting complicated commercial transactions such as workout and loan modification agreements and agreements related to asset sales. Prior to joining the firm, Ms. Ketchum was an Assistant State Attorney with the State Attorney s Office for the Thirteenth Judicial Circuit, Hillsborough County, assigned to the Felony division. She has continued to regularly appear in State Court in civil matters in defense of actions against borrowers and guarantors represented by Stichter, Riedel, Blain & Prosser. While in law school, Ms. Ketchum received book award in Comparative Tort Litigation and Rules of Procedure. She is a member of Phi Beta Kappa. She currently serves as Chair of the Tampa Bay Bankruptcy Bar Association.

6 Seminar Speakers Continued DONALD R. KIRK is a Shareholder and Bankruptcy & Financial Restructuring Practice Leader for the law firm of Fowler White Boggs. He has experience in bankruptcy and creditor's rights; commercial litigation; and contract disputes. His practice includes representation of businesses in all aspects of bankruptcy cases. His representative experience includes representing secured lender in restructure of $200 million of loans to significant commercial real estate developer, debtor in confirmed Ch. 11 case for 18 store fast food franchisee (Quick Service Foods ), Ch. 11 Trustee in Premier Mortgage Funding, Inc. Ch. 11 case ( ). Mr. Kirk has also represented the Unsecured Creditors Committee and, post-confirmation, the Liquidation Trustee in the Tropical Sportswear Inc., et. al. Ch. 11 cases (Lead Case No ). The case involved the $88.5 million sale of assets to Perry Ellis International, the Ad Hoc Committee of 11% Senior Secured Noteholders and certain of those Noteholders providing DIP financing in the Anchor Glass Container Corporation Ch. 11 proceeding (Case No ). The bondholders (approximately $350,000,000.00) became the owners of the reorganized company. He has represented the general partner in the Kaiser Aluminum Corp, et al Chapter 11 proceedings in the District of Delaware wherein we preserved a right of first refusal relating to the auction of a $331 million partnership interest and a national financing company and plan proponent in the Optical Technologies, et al Chapter 11 cases (Recomm) (Lead Case No ). The client financed thousands of equipment leases pre-petition and provided post-petition financing. He has continued to represent the financing entity post confirmation in liquidating their portfolio. He counsels businesses on ways to repair financial relationships with companies in distress, including recovering debt or restructuring deals to protect his clients' interests and maintain profitability. A partner in the Orlando office, Mr. Brumby uses more than 30 years of experience to lead the firm's Creditors' Rights Practice Group. While practicing commercial finance, bankruptcy, insolvency and creditors' rights litigation, Mr. Brumby has handled a wide range of cases in different industries. He often counsels secured and unsecured creditors, creditors committees, receivers and trustees in state and federal insolvency proceedings. He has served as a court appointed examiner in Chapter 11 cases. Mr. Brumby represents companies throughout Florida's large real estate market as well. He has represented commercial lenders, for example, in workouts and restructuring transactions, including commercial foreclosure issues and related limited liability suits. In past years, Mr. Brumby has also handled large First Amendment cases for local governments trying to regulate adult entertainment establishments. The first president of the Central Florida Bankruptcy Law Association, Mr. Brumby served on its Board of Directors from its inception through He is also a former Chairman of the Ninth Judicial Circuit Grievance Committee of The Florida Bar. Current memberships include The Florida Bar's Bankruptcy/UCC Committee and the American Bankruptcy Institute. He is a frequent speaker on creditors' rights and insolvency issues. ELIZABETH A. GREEN practices primarily in the areas of bankruptcy and creditors rights and has represented corporate debtors and secured creditors, unsecured creditors, committees, bondholders and trustees in bankruptcy cases of corporate and individual debtors. Ms. Green also has experience with out-of-court workouts, assignments for the benefit of creditors and in the representation of receivers. She has been recognized in Best Lawyers in America, Orlando Magazine s Top Lawyers, Florida Trend s Legal Elite and Florida Super Lawyers since She is rated AV Preeminent by Martindale-Hubbell. An active member of her community, Ms. Green has served as a Director of the Central Florida Bankruptcy Law Association since 2008 and is past president. 7 Seminar Speakers Continued FRANK P. TERZO is the Chair of GrayRobinson's Bankruptcy & Creditors' Rights practice group. His practice is devoted to a wide range of insolvency matters, including representation of corporate and consumer clients in complex workouts, bankruptcies, assignment for the benefit of creditors, and receiverships. He has also represented creditor's committees and Chapter 11 and 7 trustees. In addition, his practice encompasses both the prosecution and defense of all forms of complex bankruptcy litigation including preference, fraudulent transfers and complex contested matters. Prior to practicing law, Frank spent eighteen years in the healthcare industry, successfully starting up, managing and operating various public companies. He filed his first Chapter 11 just six weeks after his admission to the Florida Bar and successfully reorganized the largest minority plumbing contractor in Miami-Dade County. Because of his past experience in managing public companies and raising both debt and capital offerings, Frank has devoted much of his attention in the last several years to representation of both state and national lending institutions in all aspects of insolvency and workout matters. Most recently he has been involved in large complex Chapter 11 litigation matters pending in both the United States Bankruptcy Court in the Southern and Middle Districts of Florida and the United States District Court on behalf of secured and unsecured creditors. MICHAEL GOLDBERG is a shareholder at the law firm of Akerman Senterfitt, LLP. He practices bankruptcy and reorganization. Mr. Goldberg has been qualified as an expert witness on Ponzi schemes in several district court cases. He has testified as an expert witness on Ponzi schemes in several cases in the District Court for the Southern District of Florida. Michael has appeared on national news programs such as CNN, CNBC, Fox News, National Public Radio (NPR), and numerous local NBC, ABC, CBS, and Fox affiliates on Ponzi schemes and receiverships. He has also been quoted on Ponzi schemes and receiverships in national publications such asbloomberg's, Forbes, People Magazine, The Wall Street Journal, The New York Times, The Miami Herald, the Sun Sentinel, and numerous other publications. SONEET R. KAPILA is the founding partner of Kapila & Company. After several years experience with KPMG Peat Marwick and a regional accounting firm, he formed Kapila & Company, which has concentrated its efforts for many years in the areas of consulting and representing bankruptcy debtors, creditor bodies and trustees. Mr. Kapila s practice is concentrated in the area of creditors rights, bankruptcy, and financial transactions litigation. He represents both creditors and debtors in and out of bankruptcy court, and has considerable expertise representing secured creditors. He also regularly advises clients about the insolvency implications involved in business transactions. Mr. Kapila has served as Bankruptcy Trustee, Examiner, Corporate Monitor (S.E.C. appointment) and State Court Receiver in numerous matters in the Southern and Middle Districts of Florida. He has advised and represented debtors and creditors' committees in formulating, analyzing and negotiating plans of reorganization. Mr. Kapila is a recognized expert in fraudulent conveyance and insolvency issues. He has provided expert testimony and extensive litigation support services to law firms involving complex insolvency issues. Mr. Kapila is a sitting trustee on the panel of U.S. Bankruptcy Trustees in the Southern District of Florida. Mr. Kapila has conducted numerous forensic and fraud investigations, and has worked in conjunction with the S.E.C., the Federal Bureau of Investigation and the United States Attorney s Office. Mr. Kapila has served both as a consultant and expert witness for litigation matters in State and Federal Courts. He has worked on behalf of plaintiffs and defendants in commercial lawsuits regarding bankruptcy/creditor s rights issues, construction damages, securities fraud, patent infringement, lost profits and business valuations. Mr. Kapila has also provided a wide variety of tax services to clients throughout his career. Consulting with and offering tax planning strategies and ideas to bankruptcy trustees is also a significant part of Mr. Kapila s responsibilities. Mr. Kapila has spoken to various groups including the New York Law School, St. Thomas University Law School, National Conference of Bankruptcy Judges, Receiver s Forum, Association of Insolvency and Restructuring Advisors, Florida Institute of Certified Public Accountants, National Business Institute, and the American Bankruptcy Institute on topics related to insolvency, under-performing businesses and insolvency taxation.

8 Seminar Speakers Continued ROY S. KOBERT is a Partner in the Orlando office of Broad and Cassel. He is the Chairperson of the Firm's Bankruptcy and Creditors' Rights Practice Group and co-chairs the Firm s Special Assets Practice Group. Mr. Kobert is Board Certified in Business Bankruptcy Law by the American Board of Certification. He has represented secured creditors, commercial debtors and creditor committees throughout the country. Mr. Kobert currently represents the chairman of Enron s post confirmation committee, in his capacity as Receiver/Chapter 11 trustee for a $140 million sub-prime mortgage lenders in bankruptcy with 1800 investors. Mr. Kobert served as lead creditors counsel in a $250 million Ponzi fraud case, the largest in Florida history. He also successfully represented 1,200 investors in another Ponzi scheme involving investments of more than $40 million. Mr. Kobert prevented a major secured creditor/lender from a confirmation of Plans of Reorganization by mobilizing creditors from around the world in opposition, thus preventing a third-party channeling injunction. He achieved a decision in 1999 awarding an insurance company a $6.5 million recovery of real and personal property and securities in a fraudulent transfer action. Mr. Kobert represents over 400 subcontractors as counsel to the Official Trade Creditors Committee in the XL Homes, Inc., and Olympia Homes, Inc., a residential developer of tract homes. He has been involved in many national retail bankruptcy cases including: Service Merchandise, KMart, Heilig-Meyers, Frenkel Home Improvements, Winn-Dixie Supermarkets, Planet Hollywood, Heckinger s Builders Square, Waccamaw/Home Place, TWA, United Airlines, Alamo, National Rent-a-Car, Budget Rent-a-Car, ATA Airlines, US Airways, and Air Canada. Mr. Kobert represented the Trustee in the Cypress Restaurants case, which included the liquidation of 44 Denny s Restaurants in Florida, Georgia, Alabama, Tennessee, and South Carolina.
