Our NAA Education Conference attendees are back, rejuvenated and ready to share what they have learned. So make sure you mark your calendars for our upcoming events so they can share what they have learned. Make plans now to be at the July Membership Drive kickoff/evening Social on July 17, 2014 at the Hilltop House starting at 5:30 p.m. This year we will be hosting a casino night with proceeds going to Cape Fear Valley Friends of Cancer Center. Please take a moment to review and make plans to attend our upcoming events. Our calendar of events is on page 4 of this newsletter. Make sure you are also paying close attention to the Legislative Issues that are affecting the Multi-Family Housing Industry. The NC General Assembly has been moving very fast this year! 10 Page 10 NEWS AND VIEWS: REPUBLICAN PARTY Rep. John Szoka: House budget gains wide support Tuesday, June 17, 2014 As the General Assembly moves toward a final budget, I was proud to vote for the House version that responsibly spends taxpayer dollars. When combined with recent tax reform, this budget plan keeps taxpayers' money circulating in the economy, rather than in government, without sacrificing basic needs. Protests and drama may grab headlines, but at the end of the day, it is responsible budgeting that means the survival of a family, a business or a state government. Since 2011, Republicans have been working to get the state's fiscal crisis under control: tackling waste, reducing taxes and enacting measures that have made North Carolina among the fastest growing economies in the nation. By focusing on our core economy first through tax reform and regulation reform, we now have the flexibility to make schools, state employees and critical infrastructure our next funding priority. It takes time to right a ship that has been off-course for decades, and I am proud to be a part of this House that has righted the ship and is putting us back on course. The House's budget unfreezes teachers' pay steps that were frozen in 2008 under the previous administration. The average teacher will get a raise of 5 percent without having to give up tenure. School administrators would receive an average 3.5 percent raise. In addition, Highway Patrol troopers will get up to a 6 percent pay increase, and all other state employees get a $1,000 pay raise. Even with these raises, the budget fully funds K-3 teacher assistants, Medicaid and State Health Plan benefits, and restores the master's pay supplement for teachers who get an advanced degree in their subject area. Teachers told us that testing in public schools is out of control and that it is far easier to intervene early than it is to catch a child up who has fallen behind. As a result, the requirements in the Read to Achieve law were clarified in the budget, reducing excessive testing and investing $9 million more into pre-k education. We also increased textbook funding to help more schools move toward a digital classroom by The budget provides additional money to the state Department of Health and Human Services to address a growing caseload in child protective services, foster care and mental health services. We've also made key investments in the biotech industry, small business support centers, rural economic development and highways. A budget focused on keeping taxes low, investing in economic development and adequately funding education will ensure a bright future for North Carolina. I am proud of this budget. It shows respect for hard working taxpayers by responsibly meeting the demands of our state without spending money we don't have, or sacrificing the basic needs of our most vulnerable citizens. 11 Page 11 NEWS AND VIEWS: DEMOCRATIC PARTY Hagan Visits Fayetteville VAMC Monday, June 23, Washington, D.C. - U.S. Senator Kay Hagan met with senior officials and staff at the Fayetteville VA Medical Center (VAMC) today to receive an update on corrective actions being taken to eliminate excessive wait times for veterans seeking medical care. Hagan's trip comes after Acting VA Secretary Sloan Gibson visited the Fayetteville VAMC at Hagan's urging, where he met with representatives from her office and other stakeholders. "Immediate and extraordinary action must be taken to address excessive wait times at the Fayetteville VAMC, which are among the highest in the nation. While there are steps being taken to implement some of the changes Acting Secretary Sloan announced during his visit, much remains to be done to restore the trust and faith of our veterans," said Senator Hagan. "After talking with Fayetteville VAMC staff and leadership, I believe there are some additional steps we can take immediately, including expediting the process for leasing additional space to accommodate veterans and examining more ways to ensure enough medical personnel are on hand to administer care. I look forward to speaking with Acting Secretary Gibson about both his visit and mine, and how we can work together to ensure the veterans who have served our country are getting the care they deserve." Earlier this month, Hagan also helped pass a bipartisan VA reform bill in the Senate that would provide the VA Secretary the authority to immediately remove senior executives for poor performance and allow veterans to seek care from outside providers if the VA could not meet their needs within the Department's current wait-time goals or if they reside more than 40 miles away from a VA facility. Hagan also joined a bipartisan group of 20 of her colleagues in sending a letter to U.S. Attorney General Eric Holder urging the Department of Justice to lead a criminal investigation, and the FBI has announced that they are investigating potential misconduct. Hagan comes from a strong military family. Her father-in-law was a two-star Marine General; her brother and father served in the Navy; her husband, Chip, is a Vietnam veteran who used the GI Bill to help pay for law school; and she has two nephews who have served in Iraq and Afghanistan. Hagan Joins Colleagues to Introduce DISCLOSE Act Tuesday, June 24, Washington, DC - Today, Senator Hagan joined her colleagues in introducing the Democracy is Strengthened by Casting Light on Spending in Elections (DISCLOSE) Act, legislation that would rein in anonymous campaign spending by special interests and wealthy corporations. "Right now, the voices of ordinary Americans and North Carolinians are being drowned out by a flood of secret money from shadowy special interests," said Senator Hagan. "The amount of anonymous campaign funds spent by special interest groups to influence our political elections is growing at an alarming rate. Americans deserve a campaign finance system that is transparent and just, and information on who is funding political advocacy should be readily available to the public so voters can make fully informed decisions when they head to the ballot box. The DISCLOSE Act would take a step in the right direction by ensuring accountability and transparency in our electoral system." The DISCLOSE Act seeks to end the surge of unlimited, anonymous campaign spending by special interest groups that followed the Supreme Court's decision in Citizens United v. FEC. The bill would require organizations that spend money to influence federal elections, including "Super PACs" and tax-exempt 501(c)(4) groups, to disclose donors who have given $10,000 or more during an election cycle. The bill includes provisions to protect membership organizations from having to disclose their member lists, and to prevent the disclosure of any donor who does not wish his or her contribution be used for political purposes. Senator Hagan has long advocated for greater transparency in the campaign finance system and is cosponsoring a Constitutional amendment permitting Congress to regulate contributions and expenditures on political campaigns.

12 Page 12 NAA NEWS 4 Things to Know about Requests from Deaf Applicants and Residents- Simple steps to ensure the rights of the deaf/hard of hearing and avoid a fair housing violation. The next time it appears a telemarketer is calling in your leasing office, think twice before hanging up. In January 2014, the National Fair Housing Alliance (NFHA) filed nine housing discrimination complaints with the U.S. Department of Housing and Urban Development (HUD) against major apartment community owners for discriminating against the deaf and hard of hearing. NFHA investigated 117 national or regional rental firms in 98 cities and 25 states. Of those tested, one out of four reportedly treated deaf callers differently from hearing callers in a manner that appeared to violate the Fair Housing Act (FHA). HUD has negotiated settlement agreements with at least one large apartment firm, relating to the investigation conducted by NFHA. Under the terms of the agreement, the company is required to pay $175,000 to NFHA, including $25,000 in attorneys fees. The company must provide fair housing training to its employees, adopt a written policy addressing equal access to housing for applicants with disabilities, including deaf and hard of hearing individuals and pay the National Association of the Deaf $15,000 for consulting services in the development of these policies. Here are four things onsite staff should know about fielding requests from deaf applicants and residents: 1. Listen closely to automated calls. A deaf prospective or current resident may be trying to reach you! Deaf persons use telecommunications relay services to place and receive telephone calls. Several forms of relay services are available for use by a deaf person. Visit the Federal Communications Commission for more information on relay services. To avoid fair housing violations, onsite staff should be trained to recognize the different technologies available. Several apartment firms were sued based on an investigation by the NFHA. The complaints allege that leasing office staff hung up on deaf callers. 2. How does a property owner or manager distinguish between a relay service call and other automated calls i.e. robocalls? During a relay service call, the housing provider will likely receive a message from an operator who is facilitating the conversation between the deaf person and the person he or she intends to reach. The operator may begin with the following statement: "This is relay operator 345 with a relay call. Do you know how a relay call works?" Remember the operator will NOT be selling anything. 3. May a deaf person request an interpreter as a reasonable accommodation? A property owner may be required to provide an interpreter (at no cost to the resident) for complex communications such as eviction proceedings. Under the FHA, it is unlawful for any person to refuse to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford a person with disabilities full enjoyment of the premises of a dwelling. 4. Can a property owner or manager deny a request from a deaf resident to install visible doorbells? No. The owner or manager cannot prohibit a deaf resident from installing special equipment at the resident s expense. See 42 U.S.C. 3604(f)(3) (A). A rental housing provider may require the resident to restore the property to its original condition at the end of the lease term, if it is reasonable to do so. Under the FHA, it is unlawful to refuse to permit, at the expense of a person with disabilities, reasonable modifications of existing premises, occupied or to be occupied by a person with disabilities, if the proposed modifications may be necessary to afford the person with disabilities full enjoyment of the premises of a dwelling. - See more at: Precautions To Take For Mold-Free Apartments Digested From Fighting Mold in Your Apartment Seaside Courier (05/12/14) Pentico, Alan Mold and mildew are virtually omnipresent, and the potential for finding them in apartment communities is endless. Wherever there is moisture, there is bound to be at least a little fungus growth. But it doesn't necessarily equate to harmful, toxic mold. Molds are actually very common in all buildings, most notably where people live, reports the Centers for Disease Control and Prevention. Those apartment communities that are situated in areas with coastal conditions have a higher likelihood that mold or mildew will make an appearance. There are simple, everyday precautions that owners, managers, and residents can take to maintain mold-free apartments. It is important to start with the basics: keep each unit as clean as possible. This entails encouraging residents to vacuum and mop regularly and consistently clean all kitchens, bathrooms, and living areas. Adequate ventilation is also important in preventing mold. All apartments should have working ventilation, including exhaust fans in the kitchen and bathrooms. Windows should also be in good working order. When steam or humidity from a shower or bath condenses on such cool surfaces as mirrors, ceilings, windows, and walls, mildew may form without proper ventilation and drying for the area. Additional measures that can be taken to keep apartments as moisture-free as possible include using dehumidifiers and moisture-removal products found at home improvement stores. Where there are small patches of mold or mildew, the fungus should be removed immediately by washing the area with soapy water or bleach diluted with water in an adequately ventilated area. Finally, property management should be notified immediately of any moisture, standing water, or water intrusion of any kind -- a sprinkler consistently soaking the side of the building or leaving pools of water where the ground meets the structure, for instance. Old, young, babies, it does not care whose lives it takes over. There is not one of us that can say that we have not known someone with this awful disease. That is why the board decided to pick this charity this year. What is even better is that the money we raise stays right here in our town, helping the ones that we know. So please join the CCAA at FESTIVAL PARK on Saturday, September 20 for the 9th Annual Ribbon Walk & Ride for Cancer to support local cancer patients right here in our community or even get your own team started. Proceeds will benefit Cape Fear Valley Health Foundation s Friends of the Cancer Center. The support you give will make a difference in the lives of hundreds of cancer patients and their families. 14 COMMUNITY OUTREACH Page 14 Cumberland County Guardian ad Litem Program Be the Voice for a Child in Court Become a Guardian ad Litem volunteer and improve a Cumberland County child's future. If you have arrived here, it is because you are at least curious about how you could help an abused or neglected child... and you can. Throughout North Carolina, we always need more volunteers to be a voice for the children who find themselves the subject of court cases. We provide training to make sure you are at ease in your role, and as a volunteer Guardian ad Litem you will be in court as a team member with a trained attorney advocate. Since 1983, the North Carolina Guardian ad Litem (GAL) program has served the best interests of thousands of children. Many were able to return home, some now live with other family members, still others have been adopted. What we try to ensure is that all of the children we represent remain safe, and that their homes are permanent. In the past fiscal year, 4,767 trained volunteers served 17,189 children. These children were in court because a petition had been filed stating they were abused or neglected. These numbers were a significant increase over the preceding year, and a record number of hearings were scheduled 38,043. We continue to need more volunteer Guardians ad Litem to meet the needs of these growing numbers of children. ~Remember, one person doing one act of kindness, can make a difference!~
