BACKGROUND With a population of million, the country has a per capita GDP of $1,105 and poverty rate of 37.5 percent. Myanmar is among the poorest countries in the world ranking 148th out of 186 and territories in According to the Labour Force, Child Labour and School-to-work transition survey 2015, almost 45% (9.6 million) of workers aged 15 and older are self-employed 3 with the informal economy covering an estimated 75% of the workforce. 2 the aged of 35 working on their own account. Also, over half of the labour force work in agriculture, forestry and fishing, and 72% work in rural areas. Reliable OSH data in Myanmar is limited and fragmented. High rates of workplace injury occur among agricultural, forestry and fishery workers, craft workers, and elementary occupations. The development of OSH data is needed to serve as a baseline for the formulation of sound OSH policy and as a guide to OSH regulations. ILO in Myanmar is implementing the SafeYouth@Work project funded by United States Department of Labour (USDOL). The project aims to promote the safety and health of young workers on the job, with a particular focus on those aged 15-24, who are more vulnerable to occupational injuries and disease, and who as they join the workforce are essential contributors to a sustainable and prevention-focused OSH culture 4.Working with key stakeholders at national, regional and global levels in an integrated fashion, the project will work to build and sustain a culture of prevention in occupational safety and health. The project will implement a comprehensive intervention framework in Myanmar, including targeting particular sectors in which young workers are found. 2. RATIONALE The Promotional framework for Occupational Safety and Health Convention, 2006 (C 187) promotes continuous improvement of OSH to prevent occupational injuries, diseases and deaths. The convention highlights the importance for Member States to have a national policy on OSH; a national system for OSH, consisting of at least appropriate laws and regulations, national authorities, a compliance mechanism, and arrangements to promote labour management cooperation at the workplace level on OSH; and a national programme on OSH, taking into account the principles set out in instruments of International Labour Organization (ILO) 5. Among other things, the National Programme on OSH shall be formulated and reviewed on the basis of analysis of the national situation regarding occupational safety and health, including analysis of the national system for occupational safety and health. The promotional framework for OSH recommendation, 2006 (R197), which supplements C187, clarifies the mandate to develop a National Programme on OSH and provides the framework for developing a national OSH Profile, which serves as the basis of National Programme. The preparation of National OSH Profile is therefore an essential step in the process of building an effective National OSH Programme. The profile is an inventory of all the tools and resources available in a country to implement and manage OSH. It is a diagnostic which summarizes a country s existing OSH situation, including national data on occupational accidents and diseases, high risk industries and occupations, and a description of the national OSH system and its current capacity. A comprehensive national OSH profile therefore collects and organizes the information necessary to set national priority for OSH action, aimed at the progressive and continual improvement of workplace safety and health. Countries are expected to review and update the OSH Profile periodically, so that it can serve as a tool to monitor and demonstrate progress on OSH. It can also serve as a key management tool for continual improvement of national OSH system. 4 The incidence rate of non-fatal accidents at work per workers was more than 40.% higher among those aged years, compared to the total workforce or those aged years. 3 This profile will include basic data on all the parameters that may affect the sound management of OSH at both national and enterprise levels, including the available legislative framework; enforcement and implementation mechanisms and infrastructures; workforce distribution; human and financial resources devoted to OSH; OSH initiatives at enterprise level; protection levels; and other key aspects. It will thereby enhance stakeholders knowledge. This profile provides practical information to all persons concerned with information on ongoing activities at country level (e.g. activities related to implementation of international agreements, ongoing and planned technical assistance projects, etc.). The National OSH Profile can therefore serve as a tool to help identify important gaps in stakeholder knowledge and actions concerning OSH. The document should also provide an improved understanding of the potential problems and a critical analysis of the activities being undertaken within the country, providing better understanding of the resources, activities, and limitations of core stakeholders. The national OSH Profile also serves as a means of improved co-ordination and convergence of points of view, and of facilitating communication between all parties interested in OSH, given that it provides a common view of the most important issues to be taken into consideration in the national administration of OSH. The Profile can provide a basis for initiating a process by which a country will be able to identify gaps and opportunities for improvement in the existing legal, institutional, administrative, and technical infrastructure in relation to the OSH system. Furthermore, the OSH profile serve as a reference with which to monitor the progress or development that can be achieved. The Profile is a tool that allows identification of the baselines and indicators (the current performance references at the time of the elaboration of the National OSH Profile) through which performance, progress and impact following implementation of the National OSH Programme can be traced. It is therefore a critical tool for benchmarking national OSH performance and progress. The ILO SafeYouth@Work Project, together with FGLLID and concerned stakeholders, identified the need to develop a new National OSH Profile for Myanmar, particularly integrating the issues young workers are confronted with, and identifying strategies and programmes to address these. This exercise is particularly timely given the pending legislation on OSH which is expected to elevate the issue as a matter of public policy, as well as increase the demands on the FGLLID to secure improvements in national OSH performance. 3. Purpose of Assignment This ToR seeks to engage a National or International Consultant that will provide the necessary technical assistance to the development of the national OSH Profile. The consultant will specifically: Increase the knowledge and awareness of concerned stakeholders on the relevance and proper development of a national OSH profile with reference to relevant ILO Conventions, instruments and good practices. 6 Provide guidance as necessary to the concerned stakeholders including FGLLID Officials and key government agencies among others on the required process and resources to develop a comprehensive national OSH Profile. Identify relevant data collection tools and methodologies to elicit national OSH data and information that will be used to develop the national OSH Profile, with a view to 6 See, e.g., ILO training package on development of a national programme of occupational safety and health,
4 developing a comprehensive picture of OSH in Myanmar that identifies gaps that can be addressed by a National Action Plan on OSH, particularly regarding young workers and from a gender perspective. Facilitate the design and implementation of workshops, consultations, meetings, fora, focus group discussions and other necessary activities with concerned stakeholders to gather and validate OSH data and information to support the development of the national OSH profile. Produce the draft national OSH profile in collaboration with FGLLID and other concerned stakeholders for endorsement and approval of the Technical Working Group (TWG) under National Tripartite Dialogue Forum (NTDF) and/or the Project Advisory Committee (PAC). 4. METHODOLOGY The National or International consultant shall propose the most appropriate methodology for the development of National OSH Profile to ILO. The proposed methodology should be approved by ILO and FGLLID. A critical element of the methodology will be to deliver an inception workshop with stakeholders to develop a realistic work plan for completing the national OSH profile within the identified time frame. 5. SCOPE OF WORK The national or international consultant will- Conduct a desk review of relevant OSH laws, policies, programmes and available OSH data, systems and researches in Myanmar; review the previous published version of the National OSH profile and compare it with other related publications (e.g., national OSH profiles from other ASEAN nations). Draft a preliminary outline of the national OSH profile consistent with ILO model guidance on the content of a National OSH Profile and with particular reference to gender and youth issues. Design the tripartite plus workshop Facilitate the tripartite plus workshop to review and assess the current national OSH profile and to develop the complete work plan that identifies key activities with key stakeholders for development of National OSH Profile. Submit the tripartite plus workshop report to the ILO. Recommend the agreed structure and content of the new National OSH Profile. Collect relevant information, through primary and secondary data sources, to support the finalisation of the National OSH Profile. Draft the National OSH Profile in consultation with the PAC and/or TWG. Develop priority recommendations to be included in the National Programme and/or Action Plan on OSH. Design and facilitate the validation workshop with concerned stakeholders in order to present the draft National OSH Profile and the recommendations for priority actions in the national action plan. Finalize the OSH Profile by incorporating the recommendations from the validation workshop. 6. EXPECTED OUTPUTS The national or international consultant is expected to deliver the following outputs; A detailed work plan that identifies key activities covering start-up to culmination with defined dates, lead partners and resource requirements;
5 A design for a consultation workshop to review and assess the current national OSH profile and to develop the complete work plan that identifies key activities with key stakeholders for development of a new National OSH Profile. A comprehensive consultation workshop report. A draft National OSH profile including recommendations for Action Plan to be reviewed by SafeYouth@Work team and FGLLID. A design for validation workshop to be reviewed by SafeYouth@Work team and FGLLID. A comprehensive validation workshop report. Final version of the National OSH Profile including recommendations for actions to be included in a national action plan on OSH. Final report highlighting key activities which includes documentation of workshops, consultations, meetings, fora, FGD among others supported by attendance sheets. 7. TIMELINE This assignment will commence on 1 st March to 15 th July REQUIREMENTS The national or international consultant needed for this consultancy should possess the following qualifications: At least five years demonstrated experience in analysis and strategic planning. Demonstrated ability to design, organize and facilitate workshops, consultations, meetings, fora, Focus Group Discussion Experience in drafting / preparing reports and strategic plans, highly desirable. Experience working with government, workers and employers organizations is considered an asset. Demonstrated experience in Occupational Safety and Health. Familiarity with labour laws and occupational safety standards, labour standards is highly desirable. Experience working with ILO or other UN Agencies, donor agencies or international NGOs is considered an asset. 9. ADMINISTRATION, REPORTING AND COORDINATION The contract of this assignment will be issued by ILO Myanmar. The consultant will report directly to the National Project Coordinator (NPC) of the SafeYouth@Work Project in ILO Myanmar and receive technical guidance from the NPC, and the Chief Technical Adviser of the SafeYouth@Work project based in ILO Geneva. The contract payment shall cover consultant s fee, travel expenses and DSAs, if applicable. The travel expenses and DSA will be calculated based on the estimated duration and days for consultation and interview meetings (domestic). The consultancy is expected to propose and agree with the Project Team on the duration and days for consultations and interviews. All airfare is to be approved before purchase of tickets by ILO. No subsistence allowances are to be paid for travel time or overnight travel on airplanes, trains, vehicles or other means of transport. Terminal allowances/ local transport (e.g., taxi or public transport) costs are considered as included in the fee charged by the consultant. 10. APPLICATION
6 Interested national or international consultant are required to submit a proposal or application by 14 March The proposal should be included expected fees and work plan for key activities. 11. BUDGET The application has to be submitted with detailed breakdown of the expenses. Detail budget and fees (clearly describe the professional fees, and other cost such as DSA, meeting and travelling cost. DSA at prevailing UN rates and round trip economy class airfare) shall be made in cash in USD at the end of mission before the consultant's departure subject to production of original airfare receipt, boarding passes and original hotel's receipts.
