1 MINUTES Ferndale City Council Meeting Held Monday, October 16, 2006 City Hall Annex Council Chambers 6 p.m. PRESENT BY ROLL CALL: Councilmember Steve Oliver Councilmember Mel Hansen Councilmember Mike Reilly Councilmember Jim Elliott Councilmember Ken Downey Councilmember Gary Jensen Councilmember Keith Olson STAFF: City Administrator Greg Young Treasurer Mark Peterson Deputy City Clerk Sylvia Stiles Public Works Director Bob Cecile Police Chief Michael Knapp Mayor Jerry Landcastle Presiding CALL TO ORDER EXECUTIVE SESSION Mayor Landcastle called the meeting to order at 6 p.m. and adjourned to executive session to consider the proposed contract with the International Association of Machinists and Aerospace Workers Management Unit. Administrator Young updated the council on negotiations with the Police Guild. Discussion was held on a potential real estate purchase. CALL TO ORDER Mayor Landcastle called the meeting to order at 7:00 p.m. CONSENT AGENDA The following consent agenda was moved for approval by Councilmember Oliver and seconded by Councilmember Hansen: Approval of the Council meeting minutes of October 2, 2006 Payroll of 09/29/06: $ rd Quarter L & I Payroll of 10/02/06: $171, Auto Deposit Payroll amount $90,359.81; Auto Deposit Federal Tax Deposit: $32,195.98; Checks # #50039 Amount $48, Claims of 10/16/06: $205, Manual Check Run: # Totaling $22, Regular Check Run: # Totaling $182, Motion passed unanimously. PUBLIC COMMENT Ferndale City Council Meeting Minutes of October 16,

2 There was none LABOR CONTRACT WITH THE INTERNATIONAL ASSOCIATION OF MACHINISTS AND AEROSPACE WORKERS MANAGEMENT UNIT. It was moved by Councilmember Jensen and seconded by councilmember Elliott to approve the contract with the IAM Technical Management Unit as it has been negotiated. Motion passed unanimously. LIBRARY NEEDS ASSESSMENT SCOPE OF SERVICES Administrator Young presented the sample agreement for needs assessment for the library. Part 1 was a biography and background information on Cate McNeely, Deputy Chief Librarian, Richmond Public Library, Richmond, B. C. She is an experienced library consultant working in both the United States and Canada. Her contract is not to exceed $30,000. Mr. Young also handed out the sample architectural agreement. This contract is for $10,000. Joan Airoldi, Director of Whatcom County Library Systems was present to answer questions. Ms. Airoldi explained to the council that Ms. McNeely was well qualified, would accept the amount of the contract and was available. The architect selected is David King of Bellingham. The other firms with experience in working with libraries were requiring a larger consulting fee than had been authorized. Councilmember Olson had some concerns whether Ms. McNeely had the correct paperwork to work in the United States. Ms. Airoldi informed the Council that the steering committee has met with representation from the City Council. Councilmember Downey asked what type of information would be received from the architect. Ms. Airoldi felt Mr. King would present three different scenarios: a remodeled existing building, remodeling of the current facility or a newly constructed facility. It was moved by Councilmember Reilly and seconded by Councilmember Jensen to approve of the contract with Stewart and King Architects, Inc for Ferndale Library needs assessment. Motion passed unanimously. It was moved by Councilmember Jensen and seconded by Councilmember Oliver to approve of the contract with Cate McNeely for $30,000 pending her presentation of legal documentation to work in the United States. Motion passed unanimously. CONOCO PHILLIPS SPORTS COMPLEX USE POLICY Under the terms of the proposed Conoco Phillips Sports Complex Use Policy, organizations wishing to schedule use of the Sports Complex must file a Reservation Request no later than October 30 annually. The City will have until November 15 annually to approve and notify organizations of City actions on requests. Ferndale City Council Meeting Minutes of October 16,

3 Councilmember Jensen stated that the City wished to have the first right of refusal. Councilmember Oliver emphasized there is a portion of the policy that allows City sponsored events to take precedence. Mayor Landcastle informed the Council that the Highland Games has expressed interest in using the City Parks and Conoco Phillips Sports Complex beginning in June of Council discussed what situations would cause refusal and the appeal process thereof. It was moved by Councilmember Hanson and seconded by Councilmember Jensen to approve the new scheduling policy for Conoco Phillips Sports Complex as amended. Motion passed unanimously. It was moved by Councilmember Jensen and seconded by Councilmember Hansen to amend the motion to apply the same policy to all special events applications in the City. Motion passed unanimously. OFF-LEASH DOG PARK DESIGNATION Administrator Young explained to the Council that in committee it was determined that set hours were unenforceable the hours should be set at regular park hours, dawn till dusk. Committee also felt it important that there be concise signage regarding cleaning up after the animals. It was moved by Councilmember Reilly and seconded by Councilmember Downey that Vander Yacht Park be designated as an off-leash dog park from dawn to dusk for a test period of one year. Councilmember Jensen felt it was important that dog owners take responsibility to pick up after their pet and that the dog still be in voice control. This needs to be done by signage. Public Works Director, Bob Cecile, asked for an effective date two weeks from now so proper signs can be made and posted. Tony Birdsall submitted a petition of an additional 121 signatures in favor making Vander Yacht Park an off-leash dog park. Motion passed unanimously. AUTHORIZATION TO PURCHASE EQUIPMENT Director Cecile submitted a vehicle specification sheet for a 1996 International Dump Truck being surplussed by Pierce County with an asking price of approximately $35,000 plus tax. The truck is mechanically sound. It is currently at the City Shop where it has Ferndale City Council Meeting Minutes of October 16,

4 been check out and is in very good condition. It has a 10 plow and sander. Director Cecile estimated the City would get eight to ten years of use from this vehicle. It was moved by Councilmember Hanson and seconded by Councilmember Reilly to authorize public works purchase the vehicle as presented. Motion passed unanimously. CROSS-CONNECTION CONTROL ORDINANCE DISCUSSION Director Cecile discussed the necessity for a Cross Connection Control Program for consideration and adoption by Council. The program is being designed to comply with State Department of Health requirements, and will provide a higher degree of safety to the City s drinking water supply. The program has been written and will be presented to committee. It is believed that this can be implemented without any change in staffing in The City currently has two staff persons certified to inspect cross connections. ORDINANCE # THIRD QUARTER FINANCIAL REVIEW AND BUDGET AMENDMENT City Treasurer Peterson distributed the third quarter financial reports and highlighted various aspects of the revenue report and how actual revenue compared to the amount budgeted. Treasurer Peterson indicated areas of the expense report where there have been budget overruns. The major reasons for the overage are as follows: Current Expense Funds biggest change was the Council s decision to sign on to the County s interim jail contract. The Street Fund had payments for aerial photography and street lights in new developments. Park mitigation showed a transfer to the CP Complex irrigation project, which is over-budget mainly due to the rising cost of materials. The Equipment Repair and Replacement Fund showed overruns due to the authorized police car purchases being approximately $5,000 more for each car than projected. Also, the spike in gasoline prices over the past year accounted for around $10,000 more than budgeted. Councilmember Oliver pointed out that here needed to be additional $39,000 added to the revenue in the Traffic Mitigation Fund. It was moved by Councilmember Hanson and seconded by Councilmember Reilly to approve the Ordinance amending the 2006 budget including $39,000 additional revenue in the Traffic Mitigation Fund. Motion passed unanimously. Mayor Landcastle asked the Council to authorize additional expenditure of $2500 in the Centennial Fund for the purchase of banners and hardware. Councilmember Jensen asked if the Christmas brackets could be used for the banners and what would happen to them. Mayor Landcastle stated they could not be used but would be accommodated. 5 Councilmember Reilly had concerns regarding the additional expenditure and felt the Council needs to come up with a figure with a dollar amount they intend to spend on the Centennial. It was moved by Councilmember Reilly and seconded by councilmember Hanson to transfer $2500 from the current fund to the Centennial Fund for the purchase of banners and hardware. Motion passed unanimously. ORDINANCE # 1407 FALSE ALARMS Chief Knapp explained that the current code addresses false alarms and this ordinance would amend the code. The intention of the proposed revisions is to cut down on the number of false alarms. In 2005 there were nearly 230 false alarms in the City, many of which could have been prevented. The City is proposing a $50 fine for false alarms in excess of one false alarm in a six-month period. This ordinance would also eliminate liability to the City by removing the inspection of alarm systems by the police chief. Council discussed the timing of the penalty and concurred it would be a rolling six months. Councilmember Jensen felt the City needed to emphasize to the School District the need to train their staff to avoid false alarms. It was moved by Councilmember Reilly and seconded by Councilmember Downey to approve False Alarm Ordinance #1407. Motion passed unanimously BUDGET WORKSHOP: ALL FUNDS OPERATING BUDGET Treasurer Peterson submitted a document of the 2007 Budget. He pointed out the major expenditures and told the Council they would be receiving a booklet at the next council meeting with more detail. This presentation was a summary of anticipated revenue and expenses for Councilmember Reilly asked and Treasurer Peterson confirmed the City was spending more than it was taking in. The Council and Treasurer Peterson discussed the overall expenditures and revenue and what would need to be considered to balance the budget in Administrator Young pointed out the Must, Should and Could lists made as a result of the most recent budget work shop. He wanted the Council to consider these as the Council works on the 2007 budget. MAYOR REPORTS/COMMENTS Mayor Landcastle asked the Council to read over an information sheet sent by the Association of Washington Cities regarding the cost estimated to implement if passed in November. Mayor Landcastle also handed out a document prepared by Mr. Millspaw, the Senior Planner, with updated financial information on the transportation plan.
