1 Accor Advantage Plus 'Refer and Win' Competition Terms and Conditions Information on how to enter the Promotion forms part of these terms and conditions. Entries not made in accordance with these terms and conditions will be disqualified. Section 1: Promotion 1. Promotion: Refer a member to the Accor Advantage Plus program by completing and submitting the Accor Advantage Plus Refer and Win online referral form located at or or calling in Australia or in New Zealand between 1 March 2011 and 29 February 2012 and if that person joins Accor Advantage Plus, the referring member will go into the applicable draw, as outlined in Clause 7, to win the prize. There will be 3 draws during the promotion period, and the prizes are: a. Prize Draw 1 - Return economy flights from the winner s nearest capital city to Cairns, Australia for two (2) people plus five (5) nights accommodation in a resort room, including breakfast daily at Novotel Cairns Oasis Resort and a reef day trip on board Ocean Free. b. Prize Draw 2 - Return economy flights from the winner s nearest capital city to Sydney, Australia for two (2) people and five (5) nights accommodation in an ocean view balcony room, including buffet breakfast daily at Novotel Wollongong Northbeach. c. Prize Draw 3 - Return economy flights from the winner s nearest capital city to Sunshine Coast, Australia for two (2) people and five (5) nights accommodation in a superior queen bed lagoon view room, including buffet breakfast daily at Novotel Twin Waters Resort. 2. Promoter: AAPC Limited (ABN ) of Level 30, Angel Place, 123 Pitt Street, Sydney, NSW, Promotion Period: The Promotion will commence at am on 1 March 2011 and will close pm on 29 February All times recorded throughout these terms and conditions are in Australian Eastern Standard Time. Section 2: Eligibility 4. Eligibility: To be eligible to enter the Promotion, the entrant must: a. be above 18 years of age; and b. be an Australian or New Zealand resident; and c. be a current member of Accor Advantage Plus d. complete and submit the Accor Advantage Plus Refer and Win online referral form located at or or by calling in Australia or in New Zealand and providing contact information (including full name, address and phone number) for a prospective member that leads to that person becoming a member of Accor Advantage Plus during the period of the promotion as a result of this referral. 5. Non-Eligibility: Entrants are not eligible to enter the Promotion or win any Prize if they are a director or manager, an employee or immediate family member of an employee of the Promoter, or an employee of their agencies associated with the Promotion.

2 6. Further, any personal information or contact details incorrectly provided for this referral process shall deem the entry as an invalid entry. Section 3: Entry to the Promotion 7. When an eligible entrant completes and submits the Accor Advantage Plus Refer and Win online referral form located at or or by calling in Australia or in New Zealand with a member referral, within the Promotion Period as noted in Clause 3, the entrant will automatically receive one (1) entry into the applicable draw during the Promotion Period if the person referred joins Accor Advantage Plus during that period Accor Advantage Plus members will receive one entry per successful referral during the promotion period. All eligible entries received from 12.00am on 1 March 2011 to 11.59pm on 30 June 2011 will be entered into Draw 1. All eligible entries received from 12.00am on 1 July 2011 to 11.59pm on 31 October 2011 will be entered into Draw 2. All eligible entries received from 12.00am on 1 November 2011 to 11.59pm on 29 February 2012 will be entered into Draw 3. Section 4: Draw 8. Draw: A representative of the Promoter will conduct a computerised random draw at MDSA, 15 Grosvenor Street, Neutral Bay NSW 2089 from all eligible entries on the following dates: a. Draw am on 5 July 2011 b. Draw am on 3 November 2011 c. Draw am on 5 March 2012 The Prize Winners will be selected at random from a computer-generated listing of entries for each prize that comply with Section 2 and 3 of these terms and conditions over the Promotion Period. 9. Prize Winner: The Prizes described below in Section 5 will be awarded to the first valid entry drawn as described in Clause 8. Section 5: Prize 10. Prize Components: There are three (3) Prizes to be awarded in this Promotion consisting of the following: a. Prize Draw 1 - Return economy flights from the winner s nearest capital city to Cairns, Australia for two (2) people plus five (5) nights accommodation in a resort room, including breakfast daily at Novotel Cairns Oasis Resort and a reef day trip on board Ocean Free (valued at up to AU$2,300.00). b. Prize Draw 2 - Return economy flights from the winner s nearest capital city to Sydney, Australia for two (2) people and five (5) nights accommodation in a

3 ocean view balcony room, including buffet breakfast daily at Novotel Wollongong Northbeach (valued at up to AU$3,200.00). c. Prize Draw 3 - Return economy flights from the winner s nearest capital city to Sunshine Coast, Australia for two (2) people and five (5) nights accommodation in a superior queen bed lagoon view room, including buffet breakfast daily at Novotel Twin Waters (valued at up to AU$2,400.00). 11. Prize Value: The total value of the Prizes to be won during the Promotion is valued at up to AU$7, inclusive of GST. 12. Prize Conditions: The Prizes are subject to the following conditions: a. No exchange of Prize: The Prize can be transferred to a person 18 years or over at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take any component of the Prize and he/she does not wish to transfer the Prize, then the Prize will be forfeited. If a winner resides in the prize destination, they will forfeit the airfare portion of the prize and no compensation will be paid in lieu. b. Ancillary Costs: All transport, meals, beverages, spending money, insurances, service charges, taxes (except for airport and surcharges included in the airfares), transfers and ancillary costs, including cost of travel to and from the property are not included in the Prize unless specified and are the responsibility of the Prize Winner. c. Taxes: If the Prize or receipt of it incurs a tax liability, the Prize Winner is liable for payment of such tax (except for airport and surcharges included in the airfares) d. Prize Availability: All components of the Prize, including flights and accommodation, are subject to availability and may not be available during school holidays, holiday weekends or special events. In the event that any component of the Prize is unavailable for any reason, subject to State legislation, the Promoter reserves the right to substitute that Prize component with another prize of equal value and the Prize Winner will be notified accordingly. e. Date Prize to be Taken: The Prize Winner must travel and utilise: a. Prize 1 by 30 December 2011 b. Prize 2 by 30 April 2012 c. Prize 3 by 31 August 2012 Section 6: Prize Winner 13. Contact: The Promoter will contact the Prize Winner in writing by mail or and telephone by the following date for each prize: a. 7 July 2011 for Prize 1 b. 7 November 2011 for Prize 2 c. 7 March 2012 for Prize 3 to confirm his/her eligibility under these terms and conditions and to confirm whether the Prize Winner wishes to claim his/her Prize. The name of the Prize Winner will also be published in the Public Notices section of The Australian newspaper on the following dates for each prize: a. 15 July 2011 for Prize 1 b. 18 November 2011 for Prize 2 c. 16 March 2012 for Prize 3

Claim of Prize: If the Prize Winner wishes to claim the Prize, the Prize Winner must confirm this fact and his/her eligibility to win under these terms and conditions by am and no more than three months after the prize winner notification date in The Australian newspaper. If the Prize Winner fails to do either or both of these things by the deadline, the Prize Winner will be deemed to have forfeited the Prize. 15. Redraw: Subject to applicable law, in the event that a Prize remains unclaimed, the Promoters will conduct a redraw, following the same procedure and format as set out under the Section 4 above. The redraw will take place at 12.00pm on 22 June Redraw Winner: The name of the Prize Winner from any redraw will be notified in writing and published in The Australian newspaper on 29 June In the event that this redrawn Prize Winner is not eligible, the Promoters will conduct a redraw until the Prize is awarded (subject to any further regulatory directions). 17. Winner Publicity: In accepting the Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter. The Prize Winner further acknowledges that the Promoter reserves the right to publicise their name, address and photographs without any payment being made to them in respect of this Promotion. Section 7: General Conditions 18. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication. 19. Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winner, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 20. Force Majeure: Subject to State legislation the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter. 21. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.

5 22. Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to entrants. This may include, but is not limited to, the names, addresses, telephone numbers and credit card details of the entrants, provided by the entrant on the online enquiry form, registration form or when paying for services provided by the participating Hotel. The entrant's personal information is collected so the Promoter is able to conduct the Prize Draw and to contact and award the Prize to the Prize Winner, to publish the results of the Promotion and to publicise the Promotion. 23. Consent to use of Personal Information for Marketing Purposes: Furthermore, by entering this Promotion, unless otherwise advised by the entrant, each entrant consents to the retention and use of the information collected pursuant to Clause 22 by the Promoter, which trades as Accor Asia Pacific and the Accor Group.
