Dated:21i PUBLIC NOTICE NO. 14/2011, Subject :- Customs - Procedure to be followed for granting of Factory Stuffing Permission (FSP) valid for ail Customs Stations to Exporters - reg. ******** Consequent to the issue of Board's Circular, No.952/13/2011-CX dt , Circular No.20/2010-Cus. dt Colmbatore Commissionerate's General Circular No.08/2011 dt , one time permission for stuffing of export goods in containers the Arotory of manufacture/warehouse will be issued by. Commissioner. of Customs, Coimbatore for the exporters who wish export through the Customs Formations of this Commissionerate. Further as this is a orie,time permission, valid for all 'the Customs Stations in the Country, exporters si,811, fufnish a list of custom stations from where they intend to export the goods. ACcordingly, the procedure for grant of factory stuffing permission is outlined as below :- In terms Board's Circular No.860/18/2007-tX At.: P7r. self sealing of export goods has been made mandatory for the manufacturer exporters who export such goods under free "trigging bilis. Therefore, factory stuffing permission (FSP) under Contra Excise. supervision will not be granted to manufacturer exporter ex ding goods under free shipping bills. Manufacturer exporter under Central Excise Registration/Unregistered units will be granted FSP only on receipt of feasibility/veriflcation report from the Central Excise Divisional Asst./Deputy Commissioner concerned regarding' the genuineness of the existence and functioning of the units and existence of facility for factory stuffing. In view of it the Central Excise Divisional AC/DC must send the verification report within 10 days of receipt of communication from this office. 4. Though the FSP granted to the exporter is one time permission in nature, their track record will be monitored and reviewed,periodically i.e., after a period of every six months. The FSP will be cancelled forthwith in cases where any abuse of the permission comes to the notice of the. Department....2/-

2 -2- All the exporters who seek FSP shall submit their request in the prescribed form as per Annexure-I to the Custpm Policy Sec., Hqrs., Coimbatore. The Customs Policy on receipt of the appqtation will forward the same to the divisional office for verification regarding the genuineness of the existence and functioning of the unit at the declared premises, feasibility of stuffing therein and whether any adverse practice noticed against them and record the same in the appropriate place in Annexure-I. Based on the verification report the FSP will be granted and circulated to all the Customs Formations indicated by the exporter in his application to export the goods. The exporters clearing the goods under the factory stuffing permission shall invariably produce at the time of goods registration a copy of the FSP along with checklist of the Shipping Bill generated by EDI, ARE-is and other documents to the Customs Station during export. The Central Excise Officer who supervises the factory stuffing should give the examination report as per Annexure II and further he shall mention his office contact number and affix his Name and Designation Seal in the examination report/are-1 and other documents. Similarly the contact number, Name, Designation of the Authorized Signatory of the exporter also will be legibly indicated below his signature, below his certificate in the case of self sealing in the ARE-1 that accompanies the export goods. As the containers sealed by the Central Excise Officers are not invariably opened for examination by the customs at the port of exportation, it shall be the responsibility of the Central Excise Officer who supervises the stuffing to examine the eligibility of the goods to the export incentives claimed by the exporter. To this end, the Central Excise Officer may call for the check list of the shipping bill filed by the CHA/Exporter at the port of exportation. The Annexure-II should carry a specific certification in this regard from the said.central Excise Officer. MOT charges as applicable will be payable by the exporters for all the premises whether registered with Central Excise or not if the services are provided by the Central Excise Officers beyond the normal working hours. 9. Further the existing factory stuffing permission granted to the exporter so far will be valid only upto 31/12/2011. Hence, such exporters who wish to avail of the one time FSP should apply afresh to Custom Policy (Hqrs.), Coimbatore along with the copies of permission already granted to them, immediately so that they can continue to avail of the facility. For such exporters the FSP will be granted immediately, pending verification report from the jurisdictional Central Excise Division. Encl:- As above. To SSIO COIMBA All.
