Minimum Wage Review 2012 Fair Work Australia has announced a 2.9% increase to award rates of pay. When does this wage schedule apply? On the first full pay period commencing on or after 1 July 2012 Who does this wage schedule apply to? This shedule applies if the employer is the hospitality industry anywhere in Australia, except for nonconstitutional corporations in Western Australia. Classifications Please check the classifications defined in schedule D of the award to ensure all employees are classisfied correctly. If an employee has now been graded as a different level (e.g. was level 5, now level 6) different wage rates may apply. Contact the Accommodation Association for further information. 2 No transitional arrangements Effective: First full pay period from 1 July 2012 * The Hospitality Industry (General) Award 2010 (HIA) commenced 1 January * Schedule A of HIA specifies a transitional period (phase in). Phasing in is to cushion the effect of changes to pay as a result of the new modern award. * This schedule does not factor in the transitional rules and may be applied providing there is no detriment to the employee, compared to transitional (phasing) payments. * Increases that flow to employees under a Modern Award can be absorbed into existing over award payments * Casual employees have no entitlement to overtime penalties in the modern Hospitality award. 8 Summary Hospitality Industry (General) Award 2010 This is a summary of terms and conditions which are found in the Hospitality Industry (General) Award 2010 which applied from 1 January Ordinary Hours (Cl 29) Part time (Cl 12) Casual (Cl 13) Allowances (Cl 21) Average of 38 hours per week (38 hours per week may be averaged over a 4 week period, provided the employee has at least 8 days off in the 4 wk period). Min. 6 hours, Max.11.5 hours per day; no more than 3 consecutive 10 hr shifts or more than eight 10 hour shifts per four week period. Max. 10 consecutive days without a rostered day off Employer and employee must agree to the days and hours of work including start and finish times at the time of engagement. Hours may be varied by mutual agreement in writing. Minimum 3 hours per day. Minimum of 2 hours per engagement, no maximum (no overtime) Regular casuals under certain conditions may request conversion to full time or part time employment after 12 months. Refer to Information on Summary Page Overtime (Cl 33) Mon to Fri 150% for the first two hours and double time thereafter (not for Cas. Employees) Sat/Sun 200% RDO 200%, minimum 4 hours Minimum Break Meal Breaks (Cl 31) 10 hours, or 8 hours on change of roster A half hour unpaid break where an employee is employed for 5 hours or more. If a meal break is rostered & not given 150% is pd until the meal break is given or when shift ends. If a meal break is not rostered and the employee has a meal break at 6 hours, or finishes their shift at 6 hours there is no penalty (ie do not roster a meal break). Rest Pauses Annualised Salary (Cl 27) No longer applies An employee may be paid 25% more above the otherwise applicable award rate, and be excluded from Cl 32 (penalty rates) and Cl 33 (overtime) of the award. The employee must receive at least equivalent salary to what would have otherwise been earnt if penalty rates and overtime rates had applied. Allowances in Cl 21 continue to apply. Salaried employees are entitled to time off in lieu or a day added to their annual leave in lieu of work on a public holiday. Must have at least 8 days off per four week period.
